Research objective: Justification of stakeholder engagement as a possible pillar of efficient regulatory governance The research problem and methods: To visualize the significance of stakeholder engagement to regulation, the OECD data on stakeholder engagement are interpreted. Then, the case studies of the stakeholder engagement within regulatory impact assessment procedures in the European Union, Korea and the United Kingdom are highlighted. The methodology is based on the comparative analysis of the OECD secondary data and case study comparative analysis. The process of argumentation: Starting from a view of regulatory policy as the realization of policy goals with regulation, law, and other instruments through which a higher standard of living of the population can be achieved. Concluding with the reasoning that stakeholder engagement is a crucial component of a check-and-balance mechanism in regulatory governance. Research results: The stakeholder-engagement-driven three-layer division covers: Policy-driven layer (strategy) determined by the contemporary challenges stemmed from emancipation of association consciousness and movements and ICT revolution; Administration-driven layer (operationalization) determined by effectiveness and efficiency as well as public service imperatives; Governance-driven layer serving as the exponent of varieties of conflicting and complementing ideas and interest of social groups, check and balance in the process of monitoring, legitimization and accountability of regulators while wide-spreading the essential public services. Conclusions, innovations, and recommendations: Stakeholder engagement as a crucial part of regulatory impact assessment has been the pivotal element of the systemic adjustments reaching out to the behavioral adaptations, and to the institutionalization of evidence-based policy making.

The scope of the considerations in the article is the analysis and evaluation of legal solutions proposed by the Ministry of Climate and Environment for the implementation of the regulatory sandbox in the energy sector into the Polish legal system. As part of the analysis, conclusions from the work on the proposal to implement the institution of regulatory sandboxes under the Energy Law Act were used as part of the implementation of the project for the development of distributed energy in energy clusters – KlastER.

Purpose: The paper describes the functioning of the RIA system in New Zealand using the analogy of RIA and the evaluation of public interventions. Presented solutions can provide inspiration for the Polish government in the process of improving the quality and extent of the use of RIA. Methodology: The analysis is based on a review of government documents and literature, as well as individual interviews and correspondence with representatives of the government of NZ. Conclusions: The RIA system in NZ is not error-free and its shortcomings include inter alia the lack of solutions with respect to ex-post analysis and insufficiently rigorous methodological approach. At the same time, a number of solutions can be regarded as good practice, e.g.: regular external quality reviews of RIS, obligation to supplement each RIS with ‘quality assessment’ and a ‘disclosure statement’ outlining their credibility and utility. Practical implications: The presented strengths of the RIA system in NZ may serve as an inspiration for modifying the RIA system in Poland. Originality: The RIA system is presented through the prism of the model of evaluation use, which is a related tool of collecting information about non-regulatory interventions.

In this research work, the author focuses on the analysis of the problem of specificity the regulatory protectionism in contemporary foreign trade policy. It has been emphasized that the talks between EU and USA will make reducing regulatory barriers. New agreements to remove trade barriers aim at reducing dead-weight costs and at increasing net social gains from international trade. The article examined the impact of investor-state dispute resolution mechanisms in reducing the power of national governments to regulate and elimination of market inequality. The article offers examples of successful regulatory cooperation efforts in the hope that it will shed light on possible approaches to addressing regulatory divergences. Ideally, the best way to address problems arising from regulatory divergence would be on a multilateral basis. The main aim of the article is the presentation of the specificity of the regulatory protectionism in contemporary foreign trade policy.

Ribonuclease Dicer plays a pivotal role in RNA interference pathways by processing long double-stranded RNAs and single-stranded hairpin RNA precursors into small interfering RNAs (siRNAs) and microRNAs (miRNAs), respectively. While details of Dicer regulation by a variety of proteins are being elucidated, less is known about non-protein factors, e.g. RNA molecules, that may influence this enzyme's activity. Therefore, we decided to investigate the question of whether the RNA molecules can function not only as Dicer substrates but also as its regulators. Our previous in vitro studies indicated that the activity of human Dicer can be influenced by short RNA molecules that either bind to Dicer or interact with its substrates, or both. Those studies were carried out with commercial Dicer preparations. Nevertheless, such preparations are usually not homogeneous enough to carry out more detailed RNA-binding studies. Therefore, we have established our own system for the production of human Dicer in insect cells. In this manuscript, we characterize the RNA-binding and RNA-cleavage properties of the obtained preparation. We demonstrate that Dicer can efficiently bind single-stranded RNAs that are longer than ~20-nucleotides. Consequently, we revisit possible scenarios of Dicer regulation by single-stranded RNA species ranging from ~10- to ~60-nucleotides, in the context of their binding to this enzyme. Finally, we show that siRNA/miRNA-sized RNAs may affect miRNA production either by binding to Dicer or by participating in regulatory feedback-loops. Altogether, our studies suggest a broad regulatory role of short RNAs in Dicer functioning.

These opportunities seem to significantly benefit the most sophisticated market agents, for whom this costly opportunity makes economic sense as they typically engage in gigantic transactions. However, the answer to the question of whether such a diversified system of regulations is socially desirable seems to be negative.

Zaproponowana przez E. Tory Higginsa teoria ukierunkowali regulacyjnych, rozróżnia dwie odrębne strategie (systemy) samoregulacji: (1) promocyjne i (2) prewencyjne ukierunkowanie regulacyjne. Pierwsza związana jest z koncentracją na ideałach, osiągnięciach, aspiracjach i wzroście, natomiast druga - z koncentracją na powinnościach, zobowiązaniach, odpowiedzialności, ochranianiu i bezpieczeństwie. Artykuł prezentuje najważniejsze tezy teorii oraz wyniki wybranych badań dotyczących znaczenia ukierunkowali regulacyjnych dla procesów poznawczych i decyzyjnych, różnych aspektów realizacji celów, a także dla emocji, formułowania ocen i wartościowania obiektów. Ostatnia część ma charakter dyskusyjny i koncentruje się na ocenie teorii Higginsa, jej związków z innymi modelami samoregulacji oraz miejsca w szerszym kontekście zmiennych osobowościowych i temperamentalnych.
The regulatory focus theory proposed by E. Tory Higgins differentiates between two distinct strategies for self regulation: (1) promotion and (2) prevention regulatory focus. The former is concerned with ideals, advancement, aspirations, accomplishments, and growth, while the latter – with oughts, obligations, responsibility, protection, and safety. The paper presents the main theses of the theory and results of selected studies concerning the role of regulatory focus in cognitive processes and decision making, different aspects of goal achievement, and also in experiencing emotions, assessment making and value judgments. The last part of the paper discusses strong and weak points of the theory as well as its associations with other cognitive models of self-regulation. It is also proposed to put the regulatory foci in a broader context of personality and temperament variables.

The article discusses problems of enforceability of regulatory decisions issued by the Polish regulatory authority – the President of the Office of Electronic Communications (UKE) in the context of the protection of the rights of electronic undertakings. The author refers to the standards for implementing decisions and provisional protection developed in the law of the Council of Europe and Community legislation, including Framework Directive 2002/21/EC. He also analyses Polish legal regulations which introduce European solutions, including regulations implementing Community framework for electronic communications, into the national legal order. Special attention is devoted to the competence of Polish administrative courts and the Court of Competition and Consumer Protection in suspending the enforcement of contested regulatory decisions. The author also points to significant gaps in existing national regulations and postulates the introduction of necessary legislative changes to better protect the rights of telecommunications undertakings.

W artykule podjęto próbę określenia relacji zachodzących między zjawiskiem deregulacji sektora telekomunikacyjnego a poziomem kultury regulacyjnej (infrastruktury regulacyjnej). Wprowadzono w nim opis infrastruktury regulacyjnej, zaprezentowano sposoby jej przedstawienia oraz podejście analityczne do ujęcia istniejących zależności między deregulacją a infrastrukturą regulacyjną w sektorze. Przeprowadzono również analizę mającą na celu weryfikację hipotezy o możliwym, pozytywnym wpływie dojrzałości regulacyjnej w sektorze telekomunikacyjnym na skalę deregulacji sektorowej. Dla uniknięcia dwuznaczności czy nieścisłości, zdefiniowano pojęcia wykorzystywane w rozważaniach teoretycznych. Metodyka pracy obejmuje zestawienia publikowane w latach 2000–2014 przez OECD, dotyczące wszystkich krajów, dla których istnieją spójne, porównywalne dane statystyczne co do zmiennych ekonomicznych w zakresie deregulacji i kondycji ekonomicznej. Celem artykułu jest uzyskanie, na podstawie analizy danych liczbowych, odpowiedzi na pytanie badawcze: czy dojrzałość reżimu regulacyjnego w sektorze telekomunikacyjnym przekłada się na skalę deregulacji sektora?
There is an endeavor undertaken in the paper to outline the relations between deregulation phenomenon and the level of regulatory infrastructure maturity. The content of the article introduces the description of regulatory infrastructure, the methods if its presentation as well as the analytical approach to the relations between deregulation and regulatory infrastructure in telecommunications sector. The empirical analysis was directed to verify the hypothesis on the possible, positive impacts of the maturity of regulatory infrastructure on the scale of deregulation in telecommunications. The notions of the scale of deregulation and the condition of sectoral regulator were defined. The methodology of the analysis encompasses the period of 2000-2014 and the data reported within OECD databases which are complete and comparable for a particular countries. The aim of the article is the presentation of the effects of the analysis based on the research question: Does the maturity of regulatory infrastructure translate into the scale of deregulation in telecommunications sector?

Recently, the rapid development of innovative technologies based on cloud computing has been observed. Many countries are not keeping up with the relevant legislation, while cloud computing adoption requires transparent and high-quality regulations. This paper is focused on European Union member states. It checks whether the quality of regulation has an impact on cloud computing usage in EU countries. As regulations, quality data from the World Bank’s Worldwide Governance Regulatory Quality 2021 indicator was used. Data on cloud computing usage from Eurostat questionnaires on ICT from 2021 were used. Between these variables, there is a moderate to strong linear correlation and causality. The univariate linear regression model was proposed to explain the impact of regulatory quality on cloud computing usage in a quantitative way. The regulatory quality indicator increased by one resulted in the increase in cloud computing usage by 21.56% by companies ceteris paribus. The model presented explains 40% of the variance for cloud computing usage by regulatory quality indicator. These conclusions can be valuable from the management perspective for governments that aim to increase the innovativeness and competitiveness of economies, for enterprises that consider the implementation of cloud computing services, and for non-governmental organizations that can have an impact on legislation to contribute to economic development.

In this research work, the author focuses on the analysis of the activity towards the Transatlantic Trade and Investment Partnership (TTIP) between the European Union and United States. It has been emphasized that the talks will reduce regulatory barriers. New agreements to remove trade barriers aim at reducing dead-weight costs and at increasing net social gains from international trade. The article examines the impact of free trade agreements like TTIP and, in particular, investor-state dispute resolution mechanisms in reducing the power of national governments to regulate and eliminate market inequality. The article offers examples of successful regulatory cooperation efforts in the hope that it will shed light on possible approaches to addressing regulatory divergences. Ideally, the best way to address problems arising from regulatory divergence would be on a multilateral basis, while taking into account the relations of the EU and the US with other countries. The main aim of the article is the presentation of the challenges for TTIP negotiations. The particular objective of the research task is the regulatory trade barriers in US-EU foreign trade policy, the nature and the promoters of TTIP, the interrelationship between regulatory standards and international cooperation in TTIP. The general theoretical approach will be of broad interest to economists interested in international questions, especially transatlantic cooperation, as well as to political scientists. The main methods applied in this research were the institutional method, comparative method, documentation method and statistical methods. Additionally, the methods of deductive and inductive forecasting were applied.

The author assesses that it is a legitimate intention to introduce into the legal system regulations providing for the possibility of an effective reaction of selfgovernment bodies to extreme cases of unjustified differentiation of the legal situation and, consequently, the financial one of individual owners of properties on which the adjacency fee is imposed. However, there are serious doubts as to the purposefulness of proceeding the bill, what results from a parallel legislative process, regarding a governmental bill which also covers the issue of the application of reliefs in connection with the imposition of an adjacency fee. The author points out that the legal means planned by the authors of the amendment are inappropriate with regard to the purpose of the statute, because they are connected to norms applied only in relation to civil law receivables, in a situation where the adjacency fee is strictly of a public law nature.
