Rawls’s theory of justice is based on Kant’s ethics and the theory of social contract. Rawls tries to obey two rules: of universalizations and universality and of the maximization for the least privileged. His theory can be used to judge the ethical position of business firms. It follows from my studies that a just organization of a firm is rare in times of transformation. This may be another reason for mass emigration and it must be taken into account in future debates of the economic development.

Artykuł prezentuje doktrynę równego obywatelstwa autorstwa Johna Rawlsa. Doktryna ta jest istotna zarówno jako kluczowa dla zrozumienia filozofii tegoż myśliciela, jak również jako paradygmatyczna dla ideału równości w liberalnej demokracji w ogóle. Podstawowym pytaniem stawianym w tekście jest pytanie o to, czy da się ów ideał równości połączyć z innymi, takimi jak choćby wolność, w ramach spójnej wewnętrznie koncepcji demokratycznej. The so-called debate between Jürgen Habermas and John Rawls concentrated mainly on the latter’s political liberalism. It dealt with the many aspects of Rawls’s philosophical project. In this article, I focus only on one of them, namely the epistemic or cognitivistic nature of principles of justice. The first part provides an overview of the debate, while the second part aims to show that Habermas has not misinterpreted Rawls’s position. I argue that Habermas rightly considers Rawls’s conception of justice as a moral one. In the last part, I discuss two key questions raised by Habermas. The first concerns the relation between justification and acceptance of the principles of justice. The second concerns the relation between two validity terms: truth and reasonableness.

This paper’s aim is to provide a new interpretation of Martha C. Nussbaum’s and Richard Rorty’s views on the ethical role of literature. I pursue this aim in a threefold manner. First of all, I shortly discuss and provide a critique of previous comparisons by other authors. Afterwards, based on the presented critique of other comparisons, I present concise summaries of their respective views. Finally, I propose a double context for interpreting and assessing their views together. The main claim of the paper is the following: despite several differences in their philosophical underpinnings, Nussbaum’s and Rorty’s views on literature can be interpreted together using the context of John Rawls and Jacques Rancière. This interpretation consists of showing how uncovering a shared Rawlsian characteristic of Nussbaum’s and Rorty’s views paves a way for explaining how literature actually does ethical work, using some concepts of Rancière. Such a contextual reading allows for both a more thorough understanding of their respective projects and assessing their shared shortcomings.

Opis:
Power is undoubtedly a politically intriguing phenomenon. However, mainly its socio-practical character makes power especially important from the educational point of view. Our thinking around the concept of power can be focused on its two types: 1. Asymmetrical conception of power containing elements of resistance and conflict, 2. Concepts of power as a collective potential. The institution of school using appropriate didactic strategies in an active way can support or block one of the two proposed concepts of power. By advocating for the concept of power as a collective potential, in this article the author proposes to consider a deliberative thinking procedure as an element of education influencing the understanding of the functioning of democracy. The main purpose of the article is to justify the thesis that applying the procedural model of justification in educational practice (see John Rawls) makes a significant contribution to students’ acquisition of thinking skills that support deliberative attitudes.

Celem artykułu jest ukazanie tego, jak wielkie znaczenie idea sprawiedliwości odgrywa w życiu społecznym i politycznym. W pierwszej jego części zostaje zarysowana historia sprawiedliwości począwszy od tradycji greckiej („Państwo” Platona), poprzez chrześcijaństwo (w ujęciu encykliki „Bóg jest miłością” Benedykta XVI) aż do współczesnej teorii sprawiedliwości J. Rawlsa, której zasady (m.in. wyrównywania szans, redystrybucji dochodów) stały się swoistym modelem dla wielu współcześnie funkcjonujących państw. W części drugiej spróbujemy spojrzeć na polską transformację ustrojową po 1989 roku przez pryzmat twierdzenia Rawlsa, że wszelkie instytucje i mechanizmy regulujące życie politycznej wspólnoty, niezależnie od tego jak były nowatorskie i doskonałe, muszą zostać w dłuższym dystansie zakwestionowane, jeżeli nie spełniają elementarnego wymogu sprawiedliwości. Postawimy tezę, że program „Prawa i Sprawiedliwości” w 2015 roku odpowiadał trafnie na niespełnioną potrzebę sprawiedliwości w polskim społeczeństwie, co było źródłem sukcesu wyborczego i poparcia społecznego dla rządu w kolejnych trzech latach. W zakończeniu wskażemy jednak także na niebezpieczeństwa, które związane są z nadmiernym rozrostem rządowych programów społecznych. Przypomnimy za F. von Hayekiem, że dążenie do równości ekonomicznej stanowi śmiertelne zagrożenie dla wolności.
The aim of the paper is to show a role of an idea of justice in social and political life. In the first part the Author describes the history of justice beginning with the Greek tradition (Platon’s State), through Christianity (as described in encyclical “God is love” by Benedykt XVI) till the modern theory of justice by J. Rawls, the rules of which (e.g. equality of chances, income redistribution) constitute a model for many modern states. In the second part an attempt to interpret the Polish political transformation after 1989 year is done, considering the Rawls’ claim that all institutions and mechanisms regulating a life of political community, independently of their modernity and excellence, must be put to the question in a long term if they do not fulfill the basic condition of justice. The Author proposes a thesis that the program of “Prawo i Sprawiedliwość” political party in 2015 year met the unfulfilled need for justice in Polish society and it was a source of the electoral success and social support for the government in the following three years. Nevertheless, some dangers connected with an excessive growth of the governmental social programs are indicated in the final part. It is reminded, on the basis of Hayek statement, that striving for economic equity creates a fatal threat for freedom.

The main aim of this paper is to propose the inclusion of the expertise of a prudent agent within the procedure of reflective equilibrium by adding a disposition for identifying reasonable beliefs. This can be seen as the starting point of the method, and would safeguard against the criticism of conservatism and subjectivism. In order to do this, I will begin by analyzing the core characteristics of the method and its main weaknesses. I will then investigate the characteristics of prudence as a disposition for identifying an adequate means for achieving a good end. With this in mind, I will apply prudence to the procedure which is carried out by an agent who deliberates well and can identify reasonable moral beliefs. These beliefs must be justified according to their consistency with ethical principles and with the factual beliefs of relevant scientific theories. Finally, I will argue that this deliberative process is consistent with ethical pluralism and democracy, and can be interpreted as a kind of moral knowledge.

In this article the author discusses two topics that are important for understanding the nature of practical justification. The first topic concerns the explanation of the nature of practical justification as an agreement to conditions (principles) of political action between citizens in a democratic society. The second topic concerns the explanation of the idea of reflective equilibrium.
W artykule autor podejmuje dwie istotne kwestie dla zrozumienia natury uzasadnienia praktycznego. Pierwsza z nich to wyjaśnienie natury uzasadnienia praktycznego jako porozumienia między obywatelami społeczeństwa demokratycznego co do warunków (zasad) działania politycznego. Druga z nich dotyczy wyjaśnienia tego, czym jest refleksyjna równowaga.

Background: This paper offers an interpretation of John Rawls’s philosophy as applied to jurisprudence. Research purpose: The purpose is to interpret the ideal of the original position as a device of non-positivist jurisprudence, which help us to better understand the theoretical bond between justice and law, as well as make a case for non-positivism. Methods: Analytical jurisprudence, conceptual analysis, reflective equilibrium Conclusions: The paper argues that Rawlsian original position can be applied in constructing a non-positivist conception of law, and that within the Rawlsian scheme moral considerations are indispensable when determining legal validity.
Przedmiot badań: Artykuł stanowi filozoficzno-prawną interpretację filozofii Johna Rawlsa. Cel badawczy: Zadaniem realizowanym w artykule jest reinterpretacja idei sytuacji pierwotnej jako narzędzia nie-pozytywistycznej jurysprudencji, co pomaga w lepszym zrozumieniu i uargumentowaniu związku sprawiedliwości i prawa. Metoda badawcza: analiza pojęć, analityczna jurysprudencja, refleksyjna równowaga. Wyniki: Teza o stosowalności Rawlsowskiej idei sytuacji pierwotnej do skonstruowania nie-pozytywistycznego pojęcia prawa, teza o niezbędności moralnej interpretacji prawa przy ustalaniu treści normy prawnej.

The debate between Habermas and Rawls that took place in 1990s concerned how philosophy can justify the principles of justice under the conditions of pluralism of different and irreconcilable moral, philosophical, and religious doctrines. The context of the debate was mainly Rawls’ Political Liberalism and Habermas’ Between Facts and Norms as well. This paper argues that a wider geo-cultural perspective is pertinent in order to better comprehend the different justification strategies in Habermas and Rawls, concerning the principle of justice. This goes for their different geo-cultural experiences and presuppositions – in short, Rawls living in a self-confident North America in the post-war period versus Habermas’ German experience of civilization breakdown. However, it might also be relevant for the assessment of these two strategies in our time, faced with new kinds of geo-political differences and conflicts.
