A person, as a human being, has his or her own natural rights. These include, among other things, the right to life, to express one's views and the right to privacy. These rights are fundamental and indisputable. Among them is one of the most important liberties – the right to religious freedom. While one of the most important principles, its simplicity and naturalness raise at the same time many doubts. This study aims to provide a general presentation of the principles of the right to freedom of religion: the origin and history of the formation of this right and the road to its sanction. This article also discusses the chief contemporary documents which guarantee this freedom and the rulings of the European Courts of Human Rights in cases concerning infringement of religious rights.

In the paper the author discusses the issues related to the persecution of Jehovah’s Witnesses by the authorities of the Republic of Armenia and the Armenian Apostolic Church, which enjoys the status of the national church. In Armenia Jehovah’s Witnesses are commonly perceived as a „particularly negative sect”. Due to their refusal to perform military service (which is important in the situation of the still not resolved conflict over Nagorno-Karabakh) they are treated as traitors to their own nation. The registration application of Jehovah’s Witnesses was rejected by the authorities fifteen times and despite the & nal success with the registration they still face numerous obstacles which makes it hard to exercise their faith openly. The author’s intention is to raise awareness to the fact that Armenians still demonstrate a negative attitude to all religious minorities, as the re{ ection of the generally prevailing „fear of strangers”. The actions of local TV channels broadcasting current affairs programs in which minorities are shown as enemies to the country and the national unity, can also be blames. Social attitudes explicitly indicate that for Armenians religious diversity constitutes a threat to the ethnic unity. Papers devoted to the freedom of religion published before 2015 show that Jehovah’s Witnesses were the ones particularly persecuted. The blame for such a situation lies to a large extent with the clergy of the Armenian Apostolic Church who encourage locals to defend the national church. The issue of religious minorities is also used in the political struggle. According to some leading Armenian politicians Jehovah’s Witnesses run the policy which is most destructive for Armenia. The blame for the spread of sects in Armenia is put on Western European countries and the United States of America which are believed to & nance sects with the intention to destroy all Orthodox Christian churches that preserve national identity. It is widely believed that America supports sects as it is interested in destabilization of geopolitical situation in the regions close to Russia. The author also tries to find an answer to the question why, despite such unfavorable conditions, Jehovah’s Witnesses in Armenia keep gaining more followers at an increasing rate.

When examining the constitutionality of the contested Article 62 para. 1 and Article 63 para. 1 of the Preventing Drug Addiction Act, the author assumed that those provisions do not directly interfere with the freedom of religious practice. Therefore, such provisions to the extent that they relate to cannabis other than fiber hemp, are not incompatible with Article 53 para. 1 and para. 2 of the Constitution. It was also considered that the contested provisions do not apply to the medical use of narcotic drugs and can not be assessed in the context of Article 68 of the Constitution. Moreover, it was noted that the objectives of the prohibitions set forth in the challenged provisions can be considered justified by the guarantee of healthcare derived from the Constitution, indicating the usefulness of the contested regulation because of the general requirements of prevention and the duty of adequate protection of constitutional values. It is also claimed that restriction of access to medicinal products cannot be regarded as inconsistent with the prohibition of degrading treatment, which means that the above mentioned provisions are in conformity with Article 40 of the Constitution.

The subject of this article is the issue of religious fredom of prisoner in the light of limitations of religious practices. The article presents legal and sociological status of religious assistance in contemporary Polish prisons. The aim of the paper is to analyze the prisoner’s situation based on selected case law. Religious practices seem to be important part of long process of resocialization of the prisoners, but still prison staff is not prepared to ensure the perform religious practices in right manner. It needs to be stressed that religious practices are subject to limitations in prisons. The article focus on typical problems arising from lack of detailed internal prison policy regulations.

The article investigates changes in the religious sphere of Ukraine since the beginning of the military conflict in Donetsk and Luhansk regions. The use of religious rhetoric to justify the annexation of the Crimea and to invade part of the Ukrainian territory has caused a serious shift in the religious self-identification of a considerable number of Ukrainians. These changes are manifested at several levels. On the personal level there was the reorientation of the most faithful to the pro-Ukrainian religious organizations or to the rejection of religion in general. At the institutional level there was an ambivalent effect. On the one hand, it triggered a series of parish conversions that caused new religious conflicts. On the other hand, it intensified the search for ways to consolidate Ukrainian churches. All these changes put on the agenda of Ukraine several challenges related to the defence of religious rights and freedom and defence of national security. The article is based on various sources produced by churches and their leaders, latest sociological data, and reports of human rights organizations and religious studies institutions.

In the present article an attempt is made to analyze the place of religious symbols in the public space. The reason for undertaking the deliberations was the ruling by the European Court of Human Rights of November 2009. The article tries to confront the religious expression with the principle of the state’s world view neutrality. Also the questions of upbringing children in accordance with their parents’ and legal guardians’ convictions have been discussed.

Prayer constituted a core element of character and patriotic formation at the outset of the American public education system in the colonial period. Over the years, however, the status of this religious practice has undergone a significant transformation, including a complete ban on school prayer. The article discusses the factors that have had a decisive impact on the status of school prayer, including increasing religious diversity of the American population as well as tensions between dominant and minority religions and non-religion. Both old controversies over state-sponsored and school-run prayer as well as more recent ones surrounding graduation prayer and prayer before sports games will be discussed in more detail on the basis of landmark Supreme Court and lower court cases as well as government regulations, including presidential guidelines and other administrative documents.

The subject of the foregoing considerations is the rights of a child staying beyond a family to churchgoing which expresses the right to benefiting from the religious freedom. The guarantees are included in international documents as in the Polish law. They mainly come from the child's membership of a particular church or a religious group with regulated law position. The fact of staying beyond home comes from various circumstances, like illness, recreation or law breaking. However, independently from the reasons of staying beyond home, the range of the guarantees is similar.

Pielgrzymowanie Jana Pawła II było świadectwem wiary i ukazaniem wolności zwłaszcza religijnej oraz wartości kultury narodów, które nawiedzał. Podstawowym tematem pielgrzymek były prawa człowieka. Podczas pielgrzymki do Kazachstanu we wrześniu 2001 roku papież wyraził swoją solidarność z narodem kazachskim i jego bogatą kulturą. Przyjechał do tego kraju jako apostoł Chrystusa i z duszpasterską troską mówił o istotnych sprawach dotyczących Kościoła i społeczeństwa w Kazachstanie. Wielokrotnie podkreślał fundamentalne znaczenie kultury i potrzebę poszanowania ludzkiej godności oraz wolności sumienia i wyznania. Ukazał wielką siłę, która płynie z wiary i podkreślał, że nie można ulec terrorowi, złu i nienawiści. Wezwał do troski o kulturę i jedności wspólnoty narodów zamieszkujących Kazachstan. Zwrócił się także do młodych, by nie zapomnieli o znaczeniu wiary w życiu człowieka. Przywołując postać sługi Bożego ks. Władysława Bukowińskiego, Jan Paweł II ukazał wielką wartość jego świadectwa wierności Bogu, Kościołowi. Poprzez swoje słowo i spotkania papież podniósł naród kazachski na duchu, umocnił go w wierze i wlał w jego serca nadzieję na rozwój materialny i kulturalny. Zapewnił o swojej jedności z nim i nieustannej za niego modlitwie.
The pilgrimages of pope John Paul II were witness of faith and manifestation of freedom, especially the religious freedom, including the values of the culture of nations which he visited. The main focus of his pilgrimages was placed on the human rights. During his pilgrimage to Kazakhstan in September 2001 pope John Paul II expressed his solidarity with the Kazakh nation and its rich culture. He came to this country as an apostle of Jesus Christ and with pastoral care he preached about the key issues of the Church as well as of the Kazakh society. Many times he reiterated the fundamental significance of the culture and the need to respect the human dignity as well as the freedom of conscience and religion. He pointed out the great strength that comes from faith and emphasized that you cannot acquiesce in the face of hate, terror and evil. He called to care about the culture as well as the unity and the community of all nations living in Kazakhstan. He also asked the youth not to forget about the importance of faith in human life. Recalling the servant of God, Fr. Władysław Bukowiński, pope John Paul II showed the great value of his witness of fidelity to God as well as to Church. Through his preaching and various gatherings pope John Paul II lifted the spirits of the Kazakh nation as well as strengthened their faith. He also poured into people’s heart hope for material and cultural development of the country. He reassured them about his community with the whole nation and his unceasing prayer for them.

Autorzy recenzowanego czasopisma podejmują refleksję na temat wolności religijnej jako szczególnego aspektu wolności z perspektyw badawczych poszczególnych nauk humanistycznych i społecznych. To zróżnicowanie form i treści, a także metod i naukowego doświadczenia poszczególnych autorów widoczne jest w pierwszym numerze recenzowanego czasopisma. Pomimo tych różnic w naukowej wnikliwości prezentowanych badaczy redaktorzy czasopisma postanowili je opublikować, wychodząc z założenia, że chociaż autorów różnią zainteresowania i podejście metodologiczne, to jednak łączy ich przede wszystkim tak potrzebne różnorodne spojrzenie na problem wolności religijnej. To szerokie pole badawcze, tak warsztatowe, jak i kulturowe (oraz geograficzne) ma tutaj fundamentalne znaczenie, gdyż wymusza wcześniej czy później interdyscyplinarny charakter badań, holistyczny ich charakter i w pewnej mierze metodologiczny kosmopolityzm. Tytuły pierwszego tomu wskazują na aktualność zawartych w nim badań, stanowiąc dość reprezentatywny przegląd aktualnych zainteresowań polskich badaczy.
The authors of the reviewed journal reflect on religious freedom as a specific aspect of freedom from the research perspectives of the various humanities disciplines and social sciences. The first issue of the reviewed journal demonstrates this diversity in form and content, as well as in the methods and scientific experience of the individual authors. Despite these differences in the scientific insight of the presented researchers, the editors of the journal decided to publish them on the assumption that, while the authors’ interests and methodological approaches differ, they are united above all by a much-needed diverse perspective on the problem of religious freedom. This vast scope of investigation, both workshop and cultural (as well as geographical) is critical here, since it imposes the multidisciplinary nature of the research, its holistic character and, to some measure, methodological cosmopolitanism, sooner or later. The titles of articles in the first volume suggest the relevance of the research included inside it, offering a fairly representative overview of the current interests of Polish scholars.

Celem artykułu było z jednej strony podkreślenie kulturowych przemian w zakresie religijności, których wyrazem jest Deklaracja o wolności religijnej Soboru Watykańskiego II, zaś z drugiej wskazanie na wychowanie do wolności religijnej, które winno wiązać się z wychowaniem do szczęścia oraz ze sztuką życia. Wychowanie do szczęścia oraz umiejętność sztuki życia opierają się na wolności wyboru, a także godności osoby ludzkiej.
The aim of the article is to emphasize the cultural changes in religiousness, addressed by the Declaration on Religious Freedom of the Second Vatican Council, and to indicate education for religious freedom, which should involve education for happiness and the art of living. Education for happiness and human life skills rely on the freedom of choice and the dignity of the human being.

Przedstawiane w artykule badania mają swoje podłoże w naukowym podejściu do rozumienia i praktykowania pojęcia „wolności religijnej”, także w aspekcie problemów doświadczanych przez Nigeryjczyków w kontekście stałego zagrożenia ze strony fundamentalistów islamskich z sekty Boko Haram. Dyskusja zawiera wiele powiązanych i skomplikowanych wątków, w tym historycznych zaniedbań w kwestii wolności religijnej, pozycji Kościoła katolickiego, jego nauczania i aspektu wspólnotowego, ograniczeń zasięgu jego wpływów oraz porównania pomiędzy wolnością religijną a wolnością w ramach Kościoła. Autor omówią następujące kwestie: pojęcie wolności religijnej, wolność wyznania jako prawo człowieka, wkład Kościoła w rozwój doktryny wolności religii w Kościele, istota wolności religijnej w społeczeństwie współczesnym. Nie porusza jedynie kwestii teoretycznych. Przedstawiane tu problemy mają swój aspekt realny, dotyczą faktów dnia codziennego, a przez to umożliwiają także refleksję na temat funkcjonowania prawa. W tym zakresie należy koniecznie podkreślić następujące stwierdzenia: 1. Prawo ma na celu wspomaganie społeczeństwa w realizacji jego celów. Ma wspomagać realizację zadań niosących wspólne dobro całemu społeczeństwu; 2. Prawo ma gwarantować stabilność społeczną, tzn. porządek prawny, rzetelne procedury i przewidywalne skutki; 3. Prawo ma chronić obywateli oraz zapewniać im instrumenty postępowania prawnego, dochodzenia roszczeń oraz rozwiązywania konfliktów; 4. Prawo powinno budować świadomość członków wspólnoty co do przekazywanych w nim wartości i standardów. Jaka zatem jest prawdziwa rola wolności religijnej dla spokoju i ładu społecznego?
The research presented is rooted in the academic approach to comprehend and lay into practice the theoretical key term “religious freedom”, that is a personal challenge experienced in Nigeria, For example, the continuous threat of the Islamic fundamentalist sect Boko Haram. The discussion here involves a very complicated and complex term including the neglect of the historical approach to the religious freedom, the position of the Catholic Church, its content and collective dimensions, its limits and finally the comparison between the religious and the ecclesiastic freedom. In this condensed version I would like to analyze: “What is Religious Freedom?”; “Religious Freedom as a Human Right”; “The Contribution of the Church to the Development of the Doctrine of Religious Freedom in the Church”; and finally “The Significance of Religious Freedom to Today's Society”. Once more, it's not a theoretical approach only, the discussion is about something real, happening hic et nunc, it's a visible example with the functions of law, among which imperative ones ought to be mentioned: 1. Law is to aid a society in the achievement of its goals. It is to facilitate that attainment of the purpose or common good of the society; 2. Law is to afford stability to the society, that is, to provide good order, reliable procedures, and predictable outcomes; 3. Law is to protect personal rights and provide avenues of recourse, redress of grievances, and means for the resolution of conflicts; 4.Finally, law is to assist in the education of the community by reminding everyone of its values and standards. So, what is actually the role of the religious freedom for the social peace?
