This article presents an analysis of the legal acts, which regulate road investment preparation procedures. The aim of this study was to identify the problems emerging upon the application of the current legal provisions, as well as to assess the effects of recent legislative amendments in this regard. The paper presents basic legal acts relating to the preparation of Road Development Projects and a general description of the procedures for obtaining the most important permissions. The assessment of the effects of latest legislative amendments has been conducted based on a comparison analysis of the current regulations with the previous ones. An example provided here was that of the construction of a grade separated motorway junction located in a traffic route over a motorway, i.e. a project prepared before 2006, and executed in 2008–2010.
W artykule przedstawiono analizę aktów prawych, które regulują proces przygotowania inwestycji drogowych. Celem pracy była identyfikacja problemów wynikających ze stosowania aktualnie obowiązujących przepisów, a także ocena efektów ostatnich nowelizacji prawa w tym zakresie. W pracy przedstawiono podstawowe akty prawne związane z przygotowaniem inwestycji drogowych oraz ogólny opis procedur uzyskiwania najważniejszych decyzji. Ocena efektów ostatnich nowelizacji prawa została dokonana na podstawie porównania obecnych uregulowań z obowiązującymi wcześniej. Posłużono się przykładem budowy węzła typu WA usytuowanego w ciągu autostrady, to jest przedsięwzięcia przygotowanego przed końcem roku 2005, a zrealizowanego w latach 2008–2010.

Nie gwarantuje jednak, że powstały dokument zapewni powstanie wysokiej jakości architektury. Sposobem na rozwiązanie tego problemu jest stworzenie metodyki aplikacyjnej programu funkcjonalno - użytkowego. Przyczyni się to do rzeczywistego wpływania na poprawę środowiska naszego życia a nie, tylko na poprawne wypełnienie wymogu prawnego.
Functional program is usually made in the case of public procurement. The law defines the structure of this type of document. It does not guarantee, however, that the resulting document will provide emergence of high-quality architecture. Way to solve this problem is to create a methodology for the functional program. This will contribute to a real influence on improving the environment of our lives and not only on the correct completion of a legal requirement.

The more and more popular opinion that provision of public services must not be ineffective while objectives and the related expenses should be rational and justified, results in continuous evolution of public administration – starting up with goal orientation, through introduction of various types of measures and indicators, to end up with systems of effectiveness measurement and optimisation. The private sector turned up to be the natural source of patterns and practical solutions, as being forever oriented towards profit maximisation and cost-effectiveness. The resulting trend of modern public management represents the effort aimed at implementation of business management methods in the public sector. The idea has been implemented at many levels which, however – with considerable simplification – has come to management according to the Deming cycle. In other words, each project should be carried out according to the sequence: plan → do → examine → apply. Consequently, management by objectives, strategic planning, benchmarking, managerial control, performance budget, audit and evaluation emerged in administration. It is the last concept which will be discussed in this publication because the managers of the public sector (frequently coming from business environment) increase the pressure on results of their own and their co-workers’ activities. As a consequence of this approach, it becomes necessary to measure results of civil servants’ work as well as of programmes and projects executed by them. This trend has become more intensive since the moment the Polish state started to absorb and administer resources from the European Union as the programme guidelines and books of procedures of individual managing institutions have enforced evaluation of effectiveness of the EU money utilisation. This stimulus has generated considerations on broader application of evaluation procedures, also in the areas which are not directly related to EU funds administration. The present publication will comprise observations of the authors, based on practical experience, concerning the pragmatic aspects of implementation of evaluation processes in various areas of activity of the territorial self-government units. The authors will approach both the objectives the evaluators are usually faced with and the areas in which the evaluation is or might be applied. Setting the required effects of evaluation against the capacity of the public sector, and considering the legal framework of the territorial self-government units, the authors will indicate the ways evaluation may be conducted as well as – which is even more essential – the complications resulting from the methods adopted. First of all, the procedural aspect of acquisition of the evaluation service will be analysed, with special consideration to procedures, conditions and criteria required by the public procurement law and the related bylaws. Methods of reaching the evaluation effects by the territorial self-government units, alternative to the tendering procedures, will be also considered. On the basis of the above considerations, the authors will develop two groups of conclusions. Statutory ones, connected with the methods of acquisition of this service which are best adjusted to the objectives set, and general ones, covering the proposals of broader application of evaluation in the public sector management process.

W artykule omówiono znaczenie podmiotów sektora MSP na rynku budowlanym. Podjęto próbę określenia rynku zamówień publicznych na roboty budowlane adekwatnego do możliwości MSP oraz wszechstronnie scharakteryzowano czynniki sprzyjające ekspansji i bariery ograniczające ekspansję podmiotów sektora MSP na analizowanym rynku.
The paper discusses the importance of the SME sector entities on the construction market. The author attempted to determine the public procurement market for building works adequately for the possibility of SMEs. The factors favoring the expansion are comprehensively characterized as well as the barriers, which limit the expansion of the SME sector entities on the analyzed market.

Green Public Procurement is an undisputable potential, although still used to a limited extent in Poland. Creating demand is a domain of the public sector, since it is the largest beneficient of goods and services in the economy. The aim of this article is to show the importance of green public procurement, especially for the participants of this market - the Contractors. In particular, law regulations, related with public procurement, have been analyzed. According to assumptions of green procurement, the strategy of reducing negative impact on the environment should take into account all elements of the production chain, and therefore all suppliers. Standards selected properly for this purpose should cover the entire product lifecycle starting from its design, through manufacturing to disposal, and should address all environmental aspects that are affected by the company's business. The research also made an attempt to assess the engagement of contractors in the eco-procedures and the status of their knowledge on green public procurement.

Klauzule społeczne stanowią wyjątek od ogólnych zasad zamówień publicznych - umożliwiają stosowanie dodatkowych kryteriów wyboru wykonawcy z uwagi na istotne cele społeczne. Te cele to przede wszystkim zwiększanie i podtrzymywanie zatrudnienia osób, które mają trudności ze znalezieniem pracy, a także tworzenie środowiska pracy sprzyjającego pracownikom. Artykuł wyjaśnia, jakie są podstawy stosowania klauzul społecznych, na czym one polegają, opisuje polskie rozwiązania w tym zakresie oraz dotychczasowe doświadczenia we wdrażaniu tych rozwiązań. Identyfikuje także bariery w upowszechnianiu stosowania klauzul społecznych w Polsce. Ponadto wskazuje, jakim celom może służyć stosowanie klauzul społecznych i jak je można wykorzystać jako instrument rozwoju przedsiębiorczości społecznej. Określa wreszcie kluczowe warunki, które są niezbędne do tego, aby był to instrument skuteczny. (abstrakt oryginalny)
The social provisions are an exception from comprehensive procedures in public tenders - they enable the use of extra criteria in selection of contractor, considering crucial social objectives. Those objectives include first of all increase and maintain the level of employment of people who meet difficulties in finding job as well as creating employees-friendly work environment. The article explains the fundaments of the use of social provisions, how they work, describes Polish practice in their use and hitherto experience in the introduction. It also indentifies the barriers dissemination of social provisions and how they can be used as an instrument of social entrepreneurship development. Finally it specifies key conditions necessary to make those instruments effective. (original abstract)

Klauzule społeczne w zamówieniach publicznych to instrument, dzięki któremu zamawiający może w prowadzonym przez siebie postępowaniu o udzielenie zamówienia publicznego uwzględnić dodatkowe cele społeczne, obejmujące przede wszystkim zatrudnienie i warunki pracy pracowników zaangażowanych w wykonanie zamówienia. W pierwszej części artykułu przedstawiono defi nicję klauzul społecznych w zamówieniach publicznych. Druga i trzecia część zostały poświęcone unijnym i polskim przepisom prawnym w zakresie klauzul społecznych w zamówieniach publicznych, a także zamówieniom zastrzeżonym. Następnie wskazano na sposób, w jaki klauzule społeczne powinny być formułowane w postępowaniu o udzielenie zamówienia publicznego. Ponadto w artykule, w jego ostatniej części, podjęto próbę oceny wpływu klauzul społecznych na podmioty ekonomii społecznej, podkreślając przede wszystkim fakt, że odpowiednio sformułowane w dokumentacji przetargowej klauzule społeczne są szansą dla przedsiębiorstw zatrudniających osoby mające problemy z integracją społeczną i zawodową. Wskazano także bariery dotyczące stosowania klauzul społecznych - zarówno od strony zamawiających, jak i podmiotów ekonomii społecznej. (abstrakt oryginalny)
The social clauses in public procurement are the instrument through which the contracting authority may include in the public award procedures additional social goals focusing on the employment and working conditions of employees engaged in the performance of public contracts. In the first part of article has been presented the definition of social clauses in public procurement. Second and third parts have been devoted to the presentation of the EU and Polish legal framework for social clauses in public procurement and additionally also the reserved public procurement. Then in the article has been pointed the way in which social clauses should be formulated in the public procurement award procedures. Furthermore, the article in its fi nal part, attempts to assess the impact of social clauses for the social economy entities by showing fi rst of all that the social clauses properly formed in the tender documents are a chance for enterprises employing people who have problems with social and professional integration. Addition the barriers to the use of social clauses from both the side of contracting authorities as well as social economy entities have been also identified. (original abstract)

The purpose of this article is to identify the factors influencing the probability of winning in public procurement procedures and to assess the strength of their impact from the perspective of both: the bidder and procurer. The research was conducted with the use of series of quantitative methods: binary logistic regression, discriminant analysis and cluster analysis. It was based on a sample consisting of public tenders, in which the examined company performed the role of a bidder. Thus, the research process was aimed at both identifying the factors of success and estimating the probability of achieving it, where it was possible to obtain probabilities. The main idea of this research is to answer questions about the utility of various methods of quantitative analysis in the case of analyzing determinants of success. Results of the research are presented in the following sequence of sections: characteristics of the examined material, the process of modelling the probability of winning, evaluation of the quality of the results obtained.

The draft Directive harmonizes on the EU level, rules of public procurement by contracting entities operating in the field of water, energy, transport and postal services. The paper presents the implementation of Integrated Product Policy in Poland in the light of the European activities. It analyses the EU laws within this scope. Najszerzej traktuje upowszechnienie i promowanie ecolabelingu, na podstawie badań empirycznych przeprowadzonych w Niemczech i Polsce.

During the last couple of years, there has been a tendency to include more and more political goals into public procurements, such as environmental and societal considerations. This can result in higher prices paid by the public sector compared with similar procurements in the private sector. The decision makers at local level are elected and should represent the interest of their communities and voters, which includes promoting regional/local companies and economic development. This task can sometimes get into conflict with public procurement law or the political goals of a central government.

W referacie - artykule przedstawiono doświadczenia władz Miasta Poznania przy realizacji parkingów w systemie partnerstwa publiczno-prywatnego. Przedstawiono przebieg postępowań przetargowych dla kilku parkingów w Poznaniu. Omówiono dwa scenariusze postępowania oraz wyniki badań rynkowych. Zidentyfikowano główne przyczyny niepowodzeń w realizacji postępowań przetargowych. Ponadto zarysowano plany budowy parkingów typu parkuj i jedź oraz parkuj i idź w Poznaniu.
The experience of the Municipality of the city of Poznan with car park construction in Public - Private Partnership system has been presented in the paper. The course of procurement procedures for a number of car parks in Poznan has been shown. Two scenarios of proceedings and results of market survey have been discussed. Moreover, the plans for car parks type of “Park & Ride” and “Park & Walk” in Poznan have been outlined.
