Opis:
The article deals with the analysis of mechanisms of public participation in the regional policy and determination of means of dialogue between the regions and community. In the first part of the article, the author defines the essence of the concept of political participation. The author also outlines the concepts of citizen participation and public relations. The next part of the text is devoted to the normative and legal regulation of institute of political participation in the development and implementation of regional policy. It defines the principles of cooperation between the executive power and institutions of civil society and reveals the main forms of citizen participation in the formulation and implementation of public policy. The researcher summarizes the reasons of inefficiency of regional self-government in Ukraine. The author thus asserts that implementation of the policy of partnership, transparency and accountability will help improve the system of self-government, increase the level of local democracy and consolidate the local community. Therefore, the main conclusion of the article is that the effectiveness of forms of political participation is an objective necessity for the development of the state in general, and for strengthening at the regional level.

Opis:
The possibilities of influence of the Ukrainian and Polish citizens on a decisions and activity of legislators are analysed in this article. The basic legal forms of participation of citizens in law-creation are examined; the policy of law-creation are defined; the possible ways of improvement the dialog between citizens and legislators are determined. The athour analyses the Ukrainian and Polish legal acts, in which rights of citizens on an address, legislative initiative, access to public information, participation in consultations, in activity of public councils, lobbying are described. The different forms of citizens participation in social and political life are described the Ukrainian and Polish legislation, however there is a question about the effectiveness of such participation. Neither deputies nor representatives of government in Ukraine and in Poland are obliged to take into account opinion and suggestion of NGO in their final decisions or laws. They must collect information, work over it and then accept a responsible decision. The objective consideration of public opinion depends on those persons. Now it’s necessary to disseminate information among the citizens about the existent legal forms of their participation in creation of legislation. The dialog between the authority and society is necessary for development of the state. The basis of policy of law-creation must be a benefit for the most people.

Opis:
The issues of civic participation in configurations of movements, associations, organizations and associations as a potential catalyst of democratic transformation of democratic processes in modern Ukraine are examined in the article. Civic participation is understood as the methods and means of communication in the form of exchanges outlined by institutional and value ordering system. It is studied that an important incentive for a citizen’s participation in social and political life is trust/distrust, which acts as a catalyst, a specific type of communication links that makes development of socio-political sphere more dynamic. Distrust is the special type of communication links, which creates political control and demand of accountability from institutions of political power. It was investigated that civic participation through displays of communication capacity, has an ability to implement the national practice of the three-phase model of socio-political transformation, liberalization, democratization, democratic consolidation. Unfortunately, in modern terms this process is reduced to the functions of «mass suggestion ritual», which aims to «convince citizens in their involvement» in the political process.

Ponieważ życie publiczne rozgrywa się wokół kwestii nieodzownych dla prawidłowej egzystencji zbiorowości staje się szczególnym polem odpowiedzialności. Odpowiedzialność w życiu publicznym polega na możliwie najbardziej efektywnym wykorzystaniu rezerwuaru dostępnych środków, celem korygowania społecznego świata systemów cząstkowych, zwłaszcza tych bezpośrednio poddanych społecznemu skrutynium: polityki i kultury.
Public life involves a variety of actions ordinary people undertake within the interstitial domain, located between the private realm of households and the institutional area of the state. Although public life was commonly cultivated in the ancient times as a way to attain stages of refined emancipation, its contemporary forms stem from the modern bourgeois culture. Owing to the fact, that public life plays out around issues that are of crucial significance for the proper existence of individuals and groups, it becomes a field of particular moral responsibility. Responsible actions in the public realm demand a stable disposition of adopting all available means for improving the social subsystems, particularly those which directly fall under civic scrutiny: politics and culture

Opis:
The zoning fee constitutes a public levy paid to the commune by the owners or perpetual users of properties. The purpose of the zoning fee is to compensate for the costs incurred by the local government units due to the adoption or change of the local spatial development plans. The subject fee may be collected pursuant to the provisions of local law if the market value of the property increased due to the implementation of a new or amended local spatial development plan. It should be observed that the zoning fee is an element of settlements between the commune and entities, whose property value changed with the adoption of the new local spatial development plan or change of the previous plan. The provisions do not clearly describe the legal nature of the zoning fee. Nonetheless, the public and legal status of the aforesaid fee was confirmed by judicial decisions. Since the commune is not the taxpayer, the fee constitutes its own income. It is due to the fact that the zoning fee does not follow from the Act and does not have an unpaid character. The obligation to pay the zoning fee is the result of a specific spatial policy of the commune. Even though they were the subject of many judicial decisions, the provisions of the Act on 27 March 2003 on Spatial Planning and Development referring to zoning fees still raise a lot of interpretation doubts as to their amount, date of payment or the very grounds for their existence. The objective of the article is to show the public and legal character of the aforesaid benefit. The author is trying to prove that such an institution is by all means necessary, but its structure requires certain amendments, which could be made using the test method in the form of an analysis of legal acts and selected judicial decisions.

Partycypacja obywatelska oznacza aktywne uczestnictwo obywateli w rządzeniu. Potrzeba jej rozwoju wynika przede wszystkim z konieczności wzbogacenia i uzupełnienia tradycyjnych mechanizmów demokracji przedstawicielskiej. Partycypacja obywatelska obejmuje cztery kategorie zaangażowania w życiu publicznym: aktywność publiczną, angażowanie obywateli, partycypację wyborczą i partycypację obowiązkową. Artykuł poświęcony został problematyce angażowania obywateli, czyli tym działaniom, które są inicjowane i kontrolowane przez władze publiczne. Założono, że partycypacja obywatelska ma najsilniejsze umocowanie w środowisku lokalnym i powinna być jednym ze stałych elementów polityki samorządu. Wśród czynników warunkujących aktywność publiczną szczególną uwagę zwrócono na zinstytucjonalizowane reguły praktykowania partycypacji. Mają one niejednokrotnie fakultatywny charakter, a więc ich użycie i funkcjonowanie jest uzależnione od władz samorządowych i wprowadzenia zasad zarzadzania lokalnego. Teoretyczne założenia dotyczące narzędzi i modeli partycypacji publicznej stały się podstawą badań przeprowadzonych w jednostkach samorządu terytorialnego. Na podstawie uzyskanych wyników stwierdzono, że niespełna 2% samorządów pozostaje na poziomie informowania, kolejne 5% plasuje się na szczeblu pozyskiwania opinii, a blisko 3/4 gmin osiąga poziom konsultowania. Tylko w 8,5% gmin wystąpiły natomiast formy współdecydowania. W artykule przedstawiono dwa założenia badawcze: 1) poziom partycypacji jest uzależniony od typu gmin; 2) wyższym poziomom partycypacji obywatelskiej towarzyszy rozwój partycypacji społecznej oraz rozwój przedsiębiorczości. Wyniki analiz potwierdziły te założenia.
Civic participation means citizens’ active participation in governance. The need of its development results from the necessity of enrichment and complement traditional mechanisms of representative democracy. Civic participation comprises four categories of engagement in public life: public action, public involvement, electoral participation and obligatory participation. The paper concentrates on public’ involvement, meaning these actions which are initiated and controlled by public authorities. It is assumed that civic participation has the strongest rooting in local environment and should be one of the local government’s constant elements. Institutionalized rules of participation practice are among factors conditioning public activity. They are often optional, therefore their usage and functioning depend on local authorities and by introduction of the principles of local governance. Theoretical assumptions on tools and models of public participation became the basis of the research conducted among local government units. The results show that less than 2% of government units remain on the level of information, further 5% rank on the level of information acquisition and almost 3/4 of the communities reaches the level of consultations. Co-decision appeared in only 8.5% of the communities. The article presents two research assumptions 1) the level of participation depends on the type of the community, and 2) the higher civic participation level the greater development of social participation and entrepreneurship. The results of analysis confirmed these assumptions.

W procesie scalania miasta integralną rolę stanowi dostrzeżenie rangi przestrzeni wspólnych jako miejsc koncentracji aktywności międzyludzkich. Potrzeba miejsc spotkań jest wynikiem natury człowieka i warunkuje jego percepcję przestrzeni. Środowisko miejskie jest głównie postrzegane przez mieszkańców przez pryzmat formy i charakteru przestrzeni wspólnych. To właśnie przestrzenie wspólne stanowią wizytówkę osiedli, dzielnic, miast tworząc poczucie przywiązania – łączności z danym miejscem. Jakość wnętrz urbanistycznych wpływa na budowanie więzi społecznych a przez to na atrakcyjność środowiska miejskiego. Nieodpowiednie dostosowanie przestrzeni publicznych dezintegruje strukturę miejską, w efekcie utrudnia, a wręcz uniemożliwia identyfikację z danym miejscem. Konfrontacja rzeczywistości z potrzebą zmian niejednokrotnie aktywizuje lokalne społeczności do działań, które przy współpracy z architektem zmieniają przestrzeń (jak w sztokholmskiej dzielnicy Tensta-Piazza Taxingeplan). Działania spajające strukturę miejską przybierają różnorodne formy, jednak najczęściej prowadzą do wytworzenia przestrzeni o charakterze dospołecznym, skłaniającej mieszkańców do integracji.
An integral part of the process of uniting the city is to notice importance of common places as fields of concentration of interpersonal acting. The need for gathering places is the result of human nature and determines space perception. The urban habitat is perceived by citizens mainly through the form and nature of the common areas. First of all common spaces showcase the settlements, neighborhoods, cities and create a sense of bond - attachment with the place. The quality of urban interiors affects the formation of social ties and thereby the attractiveness of the urban environment. Improper adjustment of public spaces disintegrates urban structure. In effect makes it difficult or even impossible to identify with the place. The confrontation of the reality with the need for change often stimulates local community to action, which change space in collaboration with the architect (as in the Stockholm district Tensta - Piazza Taxingeplan). Actions bonding urban structure can take various forms but most commonly lead to formation a space oriented to users, encouraging residents to integration.

Information society is characterized by self-organization and distributed information processing abilities. At the same time there is an increase in demand for participation in local decision processes. To meet these new expectations the authors present new, alternative framework for management of cities, in which local authorities are moderators, consultants and managers, whereas all stakeholders participate in decision making within purposely created networks and groups. In the article authors also indicate selected city infrastructure elements, which ownership and management could be transferred into “city cloud”.

Historyczny układ urbanistyczny miasta Suwałki objęty pełną ochroną konserwatorską, został uznany za teren zdegradowany infrastrukturalno–przestrzennie, społecznie, gospodarczo i środowiskowo. Gmina Miasto Suwałki opracowała dwa programy rewitalizacji dla tego obszaru w 2005 i 2017 roku i pozyskała środki na realizację zawartych w nich projektów. Celem tekstu jest omówienie projektów zawartych w programach, przewidzianych do realizacji w przestrzeni publicznej. Ukazanie złożoności, a jednocześnie różnorodności dochodzenia do ich realizacji, na przykładzie przebudowy Placu Marii Konopnickiej oraz zagospodarowania w formie bulwarów terenów nad rzeką Czarna Hańcza.
The historical urban layout of the city of Suwałki, under full conservation protection, has been recognized as a degraded infrastructural, spatial, social, economic and environmental area. The Municipality of Suwałki developed two revitalization programs for this area in 2005 and 2017 and obtained funds for the implementation of the projects. This text discusses projects included in the programs, intended for implementation in public space. Showing the complexity and, at the same time, the variety in approaches for their implementation, based on the example of Maria Konopnicka Square's reconstruction and development of the form of boulevards on the Czarna Hańcza River.

Celem pracy jest zobrazowanie szeregu możliwości tworzenia lub ożywienia przestrzeni miejskich w celu budowania tożsamości i wizerunku miasta, ale także w celu scalenia fragmentów i wykorzystania potencjału miejskich nieużytków. Istotny jest również aspekt potencjału samych użytkowników przestrzeni – jako inicjatorów, organizatorów i uczestników procesu tworzenia przestrzeni publicznej. W niniejszej pracy, autorka koncentruje uwagę na znaczeniu alternatywnych sposobów adaptacji miejsca oraz tworzenia relacji przestrzennych i społecznych. Cele działań projektowych powinny bowiem wynikać z potrzeb i preferencji różnych grup mieszkańców i wykorzystywać realne zasoby przestrzenne. W artykule poruszono kwestie aktywizowania przestrzeni i mieszkańców poprzez działania architektoniczne, działania kulturalne i akcje partycypacyjne. Celem było ukazanie siły oddziaływania i korzyści płynących z oddolnych inicjatyw społecznych, tymczasowych interwencji przestrzennych oraz działań proekologicznych, jako skutecznych metod odnowy krajobrazu miejskiego w krótkim czasie i po niskich kosztach.
The purpose of the work is to illustrate a number of ways of creating or revitalizing urban spaces to build the identity and image of the city, but also to integrate the fragments and utilize the potential of urban wasteland. The aspect of space users themselves is also signifi cant – as they are the initiators, organizers and participants in the process of reating public space. In this paper, the author focuses on the importance of alternative ways of adapting space and creating spatial and social relationships. The design goal should be based on the needs and preferences of different groups of people and use real spatial resources. The author discusses issues of activating space and residents through architectural forms, cultural activities and participatory actions. The aim was to show the impact and benefi ts of bottom-up social initiatives, temporary spatial interventions, as well as pro-ecological activities, as effective methods of restoration of urban landscape in a short time and at low cost.

The article is devoted to the practice of using participatory tools in the law-making process in Poland. The subject of the study was the public hearing introduced into the Polish legal order in 2005. It mainly used the institutional-legal and comparative methods. Embedded in the framework of the theoretical concepts of participatory, deliberative, and pluralist democracy, the presented analyses focus on the legitimizing dimension of the public hearing procedure. The analysis of the normative construction and practice of using this institution allows for formulating general conclusions that indicate its legitimizing potential, including its potential to influence institutional arrangements. At the same time, however, this practice revealed a specific “sensitivity” of public hearing procedure to the political and social context, carrying the risk of transforming it into a kind of facade institution for the representative rule (with a somewhat illusory participatory character.
Artykuł jest poświęcony praktyce stosowania narzędzi partycypacyjnych w procesie stanowienia prawa w Polsce. Przedmiotem badania uczyniono wysłuchanie publiczne, wprowadzone do polskiego porządku prawnego w 2005 r. Wykorzystano w nim przede wszystkim metodę instytucjonalno-prawną oraz porównawczą. Analizy zostały osadzone w ramach teoretycznych koncepcji demokracji partycypacyjnej, deliberatywnej i pluralistycznej, koncentrując się na wymiarze legitymizacyjnym procedury wysłuchania publicznego. Analiza normatywna oraz praktyka stosowania tej instytucji pozwala na sformułowanie uogólniających wniosków, które wskazują na jej potencjał legitymizacyjny, w tym na możliwości wpływania na układy instytucjonalne. Zarazem ujawniły one swoistą „wrażliwość” procedury wysłuchania publicznego na kontekst polityczny i społeczny, niosącą ryzyko przekształcenia jej w rodzaj instytucjonalnej fasady dla przedstawicielskiej reguły (o iluzorycznie partycypacyjnym charakterze).

Opis:
The subject of this article is the use of public consultations in the process of planning a participatory museum. The authors start by mentioning current discussions about participation in culture and debates among museum curators, culture experts, and sociologists concerning a new type of museum. In this context, they present Nina Simon’s idea of a participatory museum, which is a theoretic frame of reference for the long-term activities of the Józef Piłsudski Museum in Sulejówek, an institution desiring to establish a modern participatory museum in a certain social context. At the end, the results of the public consultations are presented. The data shows that one condition for the creation of a participatory museum is an effective, institutionalized, interactive system of communication. Three areas connected with the local community in which the museum could develop participatory projects were also indicated: the joint creation of memorial sites, community integration, and exhibition and educational activities.

W obliczu złożoności gospodarki przestrzennej a także samego procesu planowania przestrzennego, konieczne jest poszukiwanie rozwiązań pozwalających na usprawnienie i zwiększenie przejrzystości procesów planistycznych. Określając potencjał narzędzi internetowych opartych na systemach geoinformacyjnych, autorzy artykułu przedstawili możliwości zastosowania geoankiety jako narzędzia wspierającego partycypację społeczną w planowaniu przestrzennym – zarówno w jej ustawowych, jak i pozaustawowych formach. W niniejszym artykule zaprezentowano sześć zastosowań geoankiety w Poznaniu i gminach podmiejskich, realizowanych w latach 2015-2016. Zwrócono uwagę na silne i słabe strony wdrażania narzędzi e-partycypacji w jednostkach samorządu terytorialnego oraz na możliwości i ograniczenia w tym zakresie z punktu widzenia praktyki planistycznej.
In the face of the complexity of urban planning, it is necessary to search for solutions improving and increasing transparency of planning processes. Defining the potential of online tools based on Geographic Information Systems (GIS), the authors of the paper presented the geo-questionnaire as a tool supporting public participation in urban planning – both in the statutory and non-statutory forms. In the paper six geo-questionnaire implementations carried out in the years 2015-2016 in Poznań and its metropolitan area have been analyzed, highlighting the strengths and weaknesses of the implementation of e-participation tools and the opportunities and limitations in the point of view of planning practices.

Opis:
Participation of local community in the public decision making is an undisputed precondition of sustainable development of every territorial unit. In Poland this is slowly gaining acceptance though there are still only few examples of good practice in the field of social participation on a local level. To stimulate the cooperation between the local authorities and the citizens we need to improve the tools of participation in decision making. This paper presents the results of public consultations held in Wroclaw and Zielona Góra in 2007 conducted by means of Intenet surveys, the findings of which were used to define the principles of the future development of respective cities. The examples of Wroclaw and Zielona Góra show the growing possibilities of using the Internet opinion polls in the public decision making on a local level.
Udział społeczności lokalnych w podejmowaniu decyzji publicznych jest oczywistym warunkiem trwałego rozwoju społecznego, gospodarczego i przestrzennego każdej jednostki samorządu terytorialnego. Świadomość tego faktu w Polsce stale wzrasta, choć wciąż niewiele jest przykładów dobrych rozwiązań w dziedzinie partycypacji społecznej na szczeblu lokalnym. Chcąc stymulować współpracę władz samorządowych z mieszkańcami należy doskonalić istniejące narzędzia i poszukiwać nowych form uczestnictwa obywateli w procesach decyzyjnych. Artykuł prezentuje przebieg i rezultaty konsultacji społecznych prowadzonych we Wrocławiu i w Zielonej Górze w 2007 roku z użyciem ankiet internetowych. Wyniki ankiet zostały wykorzystane przy wyznaczaniu kierunków dalszego rozwoju każdego z miast. Na przykładzie tych miast autor wskazuje na wzrastające możliwości zastosowania ankiety internetowej w podejmowaniu decyzji publicznych na szczeblu samorządowym.

Artykuł prezentuje wybrane problemy związane z interpretacją przepisów dotyczących partycypacji publicznej w ochronie środowiska. Zwrócono uwagę również na wątpliwości dotyczące odpowiedniego stosowania przepisów prawnych w postępowaniu wymagającym udziału społeczeństwa.
The article presents some selected problems related to the interpretation of legal regulations concerning public participation in environmental protection. Particular attention was given to the more important terms related to the titular issue. It is important to highlighted, that doubts concerning the accordingly application of legal provisions in proceedings requiring public participation were also considered.
