In Poland, since 1989, there have been ongoing processes of decentralization and socialization of state education. One of the fundamental conditions for the democratization of education is the possibility of creating, at various levels of public self-government, advisory, consultative and control authorities in the form of educational councils. Since the 1990s, the legislation has included and described the competences and tasks of educational councils at the level of voivodships, poviats and communes. Unfortunately, the last three decades in educational policy have proved that Polish society cannot create an education policy and build the civil society.

In the minutes of the meetings of the Public Education Council, referred to as the ‘supreme school authority in the Kingdom of Poland’ of the interuprising period, a lot of space between 1845 and 1850 was devoted to the matters of male secondary school students of the Warsaw Academic District. Among many decisions taken in this regard were also the issues of disciplinary penalties students received at that time. The punished can be divided into two groups. The first group consisted of 42 students, including those who, for patriotic reasons, escaped from schools and went abroad, probably to take part in the 1846 Kraków Uprising and the Spring of Nations afterwards. They were all expelled without the right to resume education. The second group consisted of 33 students who violated school discipline or committed criminal offences. Most often, they were punished with expulsion as well as flogging, a practice allowed by the law of the time. The information contained in the article complements the knowledge about secondary school students in academic circulation.

In the commentary, the author analyses the judgment of the Voivodeship Administrative Court in Kielce, which stated that “the school principal cannot be obliged to inform about the basis of the decision made by (...) the student council in the form of access to public information”. While agreeing with this court decision, the author elaborates on the question whether the student council is part of the school as a public authority; whether, on this basis, its activities are subject to the public information; and whether the school council may be represented outside by the principal of the school where this student council exists. Therefore, by carrying out the dogmatic (linguistic and logical) analysis of the current norms, literature, and the ruling itself, the author comes to the conclusion that the student council is a body separate from the principal of a public school, and therefore the principal cannot represent it outside. That is why, in the author’s opinion, the information about the activities of the student council is not a public information. The author in his gloss extended the topics the Court has signalized in its judgment, hoping to contribute to the scientific knowledge of the issues that have been so far rarely analyzed.
