Opis:
This paper examines the measures and means used to fight against corruption in public procurement in Albania. Because public procurement is one of the key areas where the public sector and the private sector interact financially and this interaction is based on public money, it is a prime candidate for corrupt activity, cronyism and favoritism as well as outright bribery. The question marks that this paper raises are: what are the means used in the war against corruption in the public procurement field in Albania? Did they had any real impact or they just reshaped the ways of doing corruption? The main finding of this paper is that introduction of e-procurement system was one of the most appropriate means to fight corruption in Albania, because this system fixed one of the biggest problems of the Albanian Public Procurement system; lack of transparency. The electronic system is transparent, since it provides the increasing of information passing through it, and the most important, it enhances the responsibility in relations between the contracting authorities and economic operators, enabling a more effective and efficient use of the tax payers’ money.

The paper is about sustainable public procurement as a new global trend in the development of a sustainable economy. The main question raised is the following: how could sustainable public procurement be implemented in Russia? We aim to answer the question by presenting the findings of survey, covering public procurement practices of 51 contracting authorities and documentation analysis of 400 public tenders, and investigating Russian legislation. The conducted survey aims to identify the aspects of sustainable public procurement already used by public authorities in procuring practices in Russia. The analysis of Russian legislation allows to define in which sections of procurement documentation different aspects of sustainability could be included. This paper provides a unique survey of sustainable procurement practices across the Russian public sector. Research also shows the prerequisites of implementation of sustainable public procurement in Russia.

Theoretical background: There is an ongoing global acceleration of automation and digitalisation in financial processes, which points to significant changes in public spending policies. After an analysis of several scientific studies, fundamental approaches have been elaborated to understand public consumption and the system of state purchases. The basic hypothesis for this research was to study the possible impact of the electronic procurement market ProZorro on state purchases in Ukraine. Possible directions are: increasing competitiveness, optimising state expenditures and saving the budget funds of public services based on innovative digital technology.Purpose of the article: The main goal is to investigate the impact of the electronic public procurement system ProZorro on corruption and bureaucracy in the public sector of Ukraine. The study object is an analysis of the volume and structure of the public procurement market, the number of procedures and participants in a bidding process, and the savings amounts in ProZorro’s public purchases during the study period in Ukraine.Research methods: The following methods were used during the research of the Ukrainian electronic procurement system: dialectical method; analysis and synthesis method – for a comparison of certain types of public procurement; subthreshold and suprathreshold statistical methods – for analysing the dynamics of indicators of the domestic system of public procurement during the period under research for a comparison of the indicators of public consumption of certain ministries and departments, different regions and territorial entities; structural and logical analysis – for generalising the theoretical and methodological principles of building a public consumption system in Ukraine. The main source of data was the data and analytical base of the ProZorro electronic public procurement system.Main findings: Effects of the innovative digital paradigm on the transparency and efficiency of public procurement are determined. Considerable attention is paid to the implementation of the electronic public procurement system ProZorro in Ukraine. The expediency is substantiated for its implementation in the national practice of budget expenditures, and the principles and procedures of implementation are analysed. The practice and dynamics of the public procurement market in Ukraine are summarised. The conclusions of the advantages of electronic system are provided, including transparency and impartiality, stimulation of competition and non-discrimination of bidding participants, reduction of corruption and the effect of reducing the savings of budget funds. Potential risks, threats and disadvantages of the ProZorro system in Ukraine are highlighted. Among them are: a high proportion of non-competitive procedures; possible latent conflict regarding the participants’ interests; unreasonable time spent on individual procedures; the justification of the procurement procedure to one participant due to a dubious “urgent need”; unreasonable application of the procurement procedure to one participant due to the falsification of conditions or the division of the procurement subject; the existence of discriminatory requirements in the documentation of competitive bidding; and a lack of efficiency in the complaints handling mechanism.

The author discusses the Polish system of public procurement. She describes the institutions collecting data concerning public procurement, means of sharing this data with the citizens and legislation regulating this issue. The author considers whether the entry into force of an entirely new Act on Public Procurement, which came into force on 1st January 2021, will affect the manner of reporting on the functioning of the procurement system based primarily on the annual report about the conducted contract award procedures prepared by the contracting authority. Particular attention is paid to the collection of data on taking into account social aspects in public procurement.

Państwa członkowskie powinny wykorzystać szanse, jakie wiążą się z wdrożeniem kompleksowych e-zamówień, w ten sposób można usprawnić proces udzielania zamówień publicznych, a przez to przyczynić się do modernizacji administracji publicznej. W celu maksymalizacji korzyści konieczne jest przyjęcie strategicznego i całościowego podejścia, przewidującego określenie odpowiednich ram polityki i ram ustawodawczych oraz zapewnienie zarządzania procesem zmian i jego koordynacji. Koncepcja kompleksowych e-zamówień nie polega na wdrożeniu projektu informatycznego, który powieliłby jedynie przebieg procesów wykorzystujących dokumenty papierowe. Stanowi ona szanse na zasadnicze przeformułowanie sposobu organizacji administracji publicznej. Kompleksowe e-zamówienia stanowią zatem kluczowy środek służący realizacji priorytetów i mogą przyczynić się do osiągnięcia celów strategii Europa 2020 w zakresie zrównoważonego wzrostu gospodarczego.
The opportunities caused by the e-procurement implementation should be taken by EU member states. Therefore, the process of public procurement can be improved as well as public administration. In order to maximize benefits, the strategic and holistic approach is required. The appropriate policy framework and legislative framework should be ensured in order to manage the whole process effectively. The concept of comprehensive e-procurement does not involve the implementation of an IT project that would only duplicate processes using paper documents. It provides the opportunity to fundamentally reformulate the way public administration is organized. The comprehensive e-procurement is therefore a key measure to implement the priorities and can contribute to achieving the goals of the Europe 2020 strategy in the field of sustainable economic growth.

As a result of the adoption by the European Parliament, in 2014, of the package of new directives coordinating the procedure of public procurement granting, it was possible to consider improvements of the binding legal regulations, both with regard to their adjustment to the new directives, and with regard to the use of the experience gathered to date. Months passed since the adoption of the new directives, but no clear information was provided on the future of the public procurement law: whether comprehensive works would be taken to reconstruct the procurement system, or whether the government would focus on adding new provisions to the existing legal regulation that was not clear anyhow already. From time to time, the public opinion was informed about the works on the implementation of the new directives package. Today we know, though, that it will consist in another amendment to the public procurement law, deprived of the thorough consideration of the functioning of the procurement system.

The state's purchasing policy is one of the new institutions of the Public Procurement Law. Influenced by the changes in the package of directives coordinating public procurement procedures in 2014, our national legislator has taken steps to use public procurement for purposes other than strictly purchasing. Therefore, the authors' considerations strive to define the concept of "purchasing policy of the state", outlining the role and scope thereof in the functioning of the modern state. Furthermore, the authors try to point out problems related to its implementation by the public authorities, stating finally that purchasing policy will only be effectively implemented if all participants of the public procurement market are aware of the policy objectives.

The purpose of this article is to identify the factors influencing the probability of winning in public procurement procedures and to assess the strength of their impact from the perspective of both: the bidder and procurer. The research was conducted with the use of series of quantitative methods: binary logistic regression, discriminant analysis and cluster analysis. It was based on a sample consisting of public tenders, in which the examined company performed the role of a bidder. Thus, the research process was aimed at both identifying the factors of success and estimating the probability of achieving it, where it was possible to obtain probabilities. The main idea of this research is to answer questions about the utility of various methods of quantitative analysis in the case of analyzing determinants of success. Results of the research are presented in the following sequence of sections: characteristics of the examined material, the process of modelling the probability of winning, evaluation of the quality of the results obtained.

This opinion provides an assessment of amendments to the Act – Public Procurement Law, prepared by the Polish Academy of Sciences. According to the author, the proposed exclusion from the scope of the Act of contracts (with a value below the EU thresholds) awarded by scientific institutions, i.e. those of purely subjective nature, may be incompatible with EU law and Poland’s Constitution. Additionally, the author addresses other issues proposed in the bill, claiming inter alia that the legislature should determine the method of establishing the limits of a single contract, which would allow to introduce regulations relating to the division of the contract into parts.
