    In recent years there has been concern connected with the practice of collecting classic forensic traces in crime scenes. apart from this there are some problems concerning their accessibility. The main factor which affects the possibility of disclosing evidence negatively is the decreasing quality of forensic activities. Moreover, poorly trained police officers do not usually know how to use tactically the information content of forensic evidence. During the preparatory proceedings problems connected with small value of detection of classic evidence appear. also the significance of aFis and genom databases decreases and obtaining reference material is becoming difficult. in such situations law enforcement authorities do not have to be helpless because, while committing a crime, memory traces of this events are formed in the mind of a perpetrator. they can be revealed objectively by polygraph examination aimed at excluding and confirming a person’s connection with the event. in many cases, however, there is no alternative for polygraph, which was presented in this article.

    Opis:
    Standards of polygraph examination exclude testing sleep-deprived people. Lack of sleep (and examinee exhaustion) is a factor that can contribute to false polygraph examination results (including false positives). Based on behavioral assessments (careful observation of examinee behaviour during a pre-test interview and subsequent stages of polygraph examination), the critical role of examiners is to recognise incidences of lack of sleep and, consequently, to postpone the moment of testing. Professional literature treats the lack of sleep as a temporal inability to be subjected to the test (Widacki, 2018, 434). However, such a decision is nowadays usually powered with experts’ intuition (their experience) rather than the results of empirical research. There is therefore a need for conducting studies like the one presented below. In practice, a sleep-deprived person could take a polygraph examination for two main reasons. First, examinees may deliberately deprive themselves of sleep to interfere with the results of tests. Secondly, such a deprivation may be connected with external circumstances of a particular examination. In a case involving a jewelry store robbery in Katowice, police officers wanted an expert to examine the building’s security staff. They wanted to have outcomes of screening tests on the day of the theft. The expert refused to perform the test because the security guards were tired after the night shift. In any event, a polygrapher should not yield to pressure and test sleep-deprived persons. The main goal of the research reported in the present article is to explore the influence of sleep deprivation of tested subjects on the accuracy of polygraph test results.

    Artykuł 199a kodeksu postępowania karnego określa przesłanki wykorzystania badania wariograficznego na oskarżonym sensu largo. W referacie skupiono się na przedstawieniu możliwości wykorzystania badania wariograficznego, któremu podlega oskarżony, w celu określenia jego strony podmiotowej wobec popełnionego przez niego przedmiotowo pojmowanego zachowania się opisanego w przepisie określąjacym znamiona tego czynu. Określono warunki przystąpienia do wymienionego wyżej badania oraz jego ewentualne efekty w odniesieniu do strony podmiotowej badanego.
    Article 199a of polish Code of Criminal Procedure describes premises of utilization of polygraph examination of defendant sensu largo. This article focuses on presenting possibilities of utilization polygraph examination on defendant in order to qualify his subjective aspect towards committed action described in regulation which defines characteristics of the crime it consists. Terms of acceding to previously mentioned examination and its eventual effects in reference to subjective aspect of examined shall be defined.

    Opis:
    The authors of this article consider the advantages of using a visual version of CIT during polygraph examinations. The presentation of the rarely used CIT encourages to discussion about the possibility of implementation such tests in serious criminal cases. Their application takes a form similar to the police lineup. However, the main difference is that the suspect reviews photographs of possible crime victim. In the described case we are dealing with a so-called “reverse police lineup”. As the result, the visual CIT proved that the examinee knew the victim of the crime, despite the fact that he had previously denied this. Thanks to the examinee’s arousal recorded on the key question, it was also possible to obtain the desired psychological effect in the form of the perpetrator’s confession and the indication of other evidence proving his guilt.

    Celem artykułu jest wskazanie i ocena wydarzeń kształtujących na przestrzeni całego półwiecza pozycje badań poligraficznych w polskim procesie karnym. Pomimo upływu tak wielu lat wciąż jest to jeden z najbardziej spornych obszarów w procedurze, często pełen emocjonalnego nastawienia dyskutantów. Badania te stanowią również podręcznikowy przykład nagromadzenia wszystkich problemów, na które napotykają nowe metody kryminalistyczne na swojej drodze na sale sądowe. Wskazano, iż jedną z przyczyn może być ich błędne postrzeganie przez wielu procesualistów jako metody służącej wykrywaniu kłamstwa. Nie bez znaczenia jest też zdaniem autora stanowisko zajmowane przez Sąd Najwyższy. Jego linia orzecznicza jest raczej przychylna badaniom poligraficznym, jednak dostrzegalna jest w niej też nieporadność i skłonność do minimalizowania znaczenia opinii z tych badań. Wynika to w głównej mierze z trudności w przekształcaniu wniosków płynących z badań na fakty procesowe. Wydaje się, że właściwym rozwiązaniem, które otworzyłoby wreszcie szerzej podwoje procesu karnego przed badaniami poligraficznymi byłoby traktowanie ich jako sposobu weryfikacji wersji śledczej zakładanej wobec badanego. Przemawiają za tym też zapisy znowelizowanego w 2003 r. k.p.k.
    The aim of the paper is to point to the events which have been shaping the position of Polygraph examination in Polish penal proceedings over the last 50 years as well as to evaluate them. Despite many year history, Polygraph remains one of the most controversial items in the proceedings, often evoking quite emotional attitudes of the disputants. The examinations constitute a “by-the-book” example of accumulating problems specific to novel forensic methods on their way to the courtroom. It has been indicated that one of the reasons lies in misperception of these as methods for lie detecting. The position of the Supreme Court is also quite meaningful here. Its jurisdiction remains rather in favour of Polygraph examination, however it is also characterized by certain awkwardness and inclination towards diminishing the meaning of Polygraph-based opinion. This is primarily due to the difficulties in translating the conclusions from findings into lawsuit facts. It seems that a pertinent solution to open up the gate for Polygraph examinations would be to treat these as the way to verify investigative version taken towards the subject.

    Opracowanie dotyczy problematyki użyteczności badań poligraficznych i możliwości ich zastosowania w postępowaniach podatkowych. Profesjonalne badania poligraficzne mogą stanowić cenną pomoc w wyjaśnianiu stanu faktycznego sprawy podatkowej. Niepokojące jest jednak to, że w rzeczywistości niedoceniany przez organy podatkowe jest ich potencjał dowodowy. W artykule podjęto próbę ustalenia mocy dowodowej badań poligraficznych na gruncie postępowania podatkowego oraz ukazania przydatności przeprowadzenia tego rodzaju dowodu w celu prawidłowego ustalenia przez organ podatkowy stanu faktycznego konkretnej sprawy.
    The article describes the issues of usefulness of polygraph research and the possibility of their application in tax proceedings. Professional polygraph research can be a valuable help in clarifying the facts of a tax case. However, tax authorities often underestimate their potential as evidence. The article attempts to establish the probative value of polygraph research in tax proceedings and to show the usefulness of this type of evidence in order to properly clarify a specific case by the tax authorities.

    Previously, Krapohl (2020) evaluated the Bigger-Is-Better Rule (BIBR) on the polygraph electrodermal channel to assess whether there was a best minimum ratio between response sizes for assigning a score. Performance peaked at a minimum ratio between 10% and 20%. The ratios had been calculated by comparing the electrodermal responses for each relevant question against those of the immediately preceding comparison question. The analysis did not consider whether the same optimal ratio would be found if the relevant question electrodermal responses are compared to those of the stronger of two adjacent comparison questions. To investigate we analyzed responses from an independent sample of 255 laboratory cases. The data from those cases found the highest correlation between scores and ground truth occurred when the minimum difference between two electrodermal responses was 30%.

    Opis:
    The element of subjectivity in polygraph examination shall mean a margin of discretion, appearing in evaluation of expert’s interpretation, which is not subordinated to any other objective criteria. The existence of this margin of discretion confirms a divergence of evaluations carried out by different experts assessing the same reactions. In assessing the same records of reactions, experts differed in their evaluation but the divergence of correct evaluations of the same reactions was ranging from 3% to 31%. The convergence of expert’s evaluations can be measured according to the reliability coefficient (e.g. Spearman-Brown), the correlation coefficient (e.g. Kappa, Fleiss’ Kappa). The convergence of different expert’s evaluations which is shown in literature (calculated according to Kappa coefficient) is relatively high (0.77). In the experiment which was conducted by authors, experts was evaluating records of reactions using a qualitative method (global) and a quantitative method (numerical). The consistency coefficient (reliability) calculated by the alfa-Krippendorff coefficient was significantly higher applying the quantitative methods (numerical) – 0.43 to 0.82, whereas in the qualitative evaluation it was only 0.43. In view of the above, authors’ hypothesis is confirmed by the fact that there is the smaller scale of subjectivity in evaluations of numerical polygraphic records than in the qualitative method (global).
    Przez element subiektywizmu w badaniach poligraficznych rozumiemy występujący przy ocenie dokonywanej przez eksperta margines swobody interpretacji, niepodlegający żadnym obiektywnym kryteriom. O istnieniu tego marginesu przekonuje rozbieżność ocen dokonywanych przez różnych ekspertów. Oceniając te same zapisy reakcji, eksperci różnili się w ich ocenie, przy czym rozbieżność poprawnych ocen tych samych reakcji wynosiła od 3 do 31%. Zgodność ocen ekspertów może być mierzona współczynnikiem rzetelności (np. Spearmana-Browna), współczynnikiem korelacji (np. Kappa, Kappa Fleissa). Wykazywana w literaturze zgodność ocen różnych ekspertów (liczona współczynnikiem Kappa) jest relatywnie wysoka (0,77). W wykonanym przez autorów eksperymencie, eksperci oceniali zapisy reakcji metodą jakościową („globalną”) oraz metodami ilościowymi (numerycznymi). Współczynnik zgodności (rzetelności) liczony współczynnikiem alfa-Krippendorff a był zdecydowanie wyższy przy zastosowaniu metod ilościowych (numerycznych) – 0,43 do 0,82 niż przy ocenie jakościowej – jedynie 0,43. Potwierdza to hipotezę autorów, że numeryczne oceny zapisów poligraficznych są obciążone mniejszym marginesem subiektywizmu niż metoda jakościowa („globalna”).

    The purpose of the study was to learn the opinions of polygraph examiners concerning the role and applicability of scientific research in detection of deception conducted in Universities or other scientific centres. The questionnare was distributed among participants of the 56th Annual Seminar of the American Polygraph Association (Orlando Fl. 2022). The 55 copies of the questionnare were hande out, 48 completed sheets were returned. As it could been expected, polygraph examiners are generally not interested in of detection of deception other than the ones they currently using in their practice. The new methods of detection of deception, as for example exploiting the neurophysiological level (EEG, fMRI) or methods remotely observable and registrable indicators other than those that have as yet been used in polygraph examination generally was not interested for him.
