Opis:
Aim of research. The main aim of research is to present the common understanding of apoliticality as a concept and to contrast it with the scientific approach. This will make it possible to re-discuss the politics of the service, not only in the context of the Police. Methodology. The rule of apoliticism was investigated by using a method of analysis of primary and secondary sources. Research results. Common understanding of the rule of apoliticality, especially in the context of disability groups, can be assessed as insufficient. In the paper, the police's apolitical nature has been shown through the prism of five frames: historical, formal, legal, political, sociological and ethical.
Cel badań. Celem badań przeprowadzonych w ramach tematu jest zaprezentowanie powszechnego rozumienia pojęcia apolityczności oraz skonfrontowanie go z podejściem naukowym. Umożliwi to podjęcie na nowo dyskusji o polityczności służb, nie tylko w kontekście Policji. Metodologia. Zasada apolityczności została zbadana metodą analizy źródeł pierwotnych oraz wtórnych. Wyniki badań. Potoczne rozumienie zasady apolityczności, zwłaszcza w kontekście grup dyspozycyjnych, można ocenić jako niewystarczające. W artykule apolityczność Policji została ukazana poprzez pryzmat pięciu ujęć: historycznego, formalnoprawnego, politologicznego, socjologicznego oraz etycznego.

The article describes the fate of 5 people from Ostroleka, who, due to circumstances connected to 1st World War and Russian Revolution, were submitted to aggressive propaganda and eventually started to believe in Bolshevik’s point of view, after they stayed in Soviet Belarusia. At the end of the thirties during extermination of Polish people in USSR, they were considered as national enemies, then they were murdered in Belarusian Minsk during Operation Poland NKWD during 1937– 38.
Artykuł ukazuje los pięciu ostrołęczan, którzy na skutek zdarzeń losowych związanych z I wojną światową i rewolucją październikową ulegli agresywnej propagandzie, uwierzywszy w hasła głoszone przez bolszewików, zostali na Białorusi Sowieckiej. Pod koniec lat trzydziestych w czasie eksterminacji ludności narodowości polskiej w ZSRR zostali uznani za wrogów narodu a następnie zamordowani w Mińsku Białoruskim podczas Operacji Polskiej NKWD w latach 1937–1938.

The article discusses the issue of mutual relations between representatives of the Police and the Polish Army over the last 100 years. The intention of the issues raised is the need to build positive ties between soldiers and officers, who, as the history cards show, have repeatedly set an example of mutual sacrifice for the good of their Homeland. Although the discussed period of time also contains difficult historical threads, especially in the period between the functioning of the second and third Republic of Poland, thanks to the available sources and literature on the subject we learn about numerous examples of building the common good of citizens. Thanks to specific legal regulations throughout the century, we see more and more precise fields of cooperation between services, as exemplified by the activities of Police and Military Police officers during national and international events taking place in the country as well as beyond its borders. A special dimension of the presented relations is the more and more expressive contemporary cooperation not only on the military line, but also among the local community, as well as in the mutual sports rivalry of uniformed services.

The changes introduced in the system of internal security in Poland after 1990, especially the activities of the Polish Police, are aimed at perceiving the servant role of the whole formation in relation to the society. Progressive professionalisation is connected not only with continuous improvement and exchange of equipment resources, but above all with high expectations towards the officers themselves. In this sense, in order to carry out the statutory tasks well, the policeman should obviously have the latest technological achievements, but it is equally important that he or she has a high sense of morality. In difficult situations, he or she must have no doubts as to how he or she should behave, what is good and what is wrong - what is bad. Ethically deepened professionalism means not only taking care of the quality of their work and its effects, but also taking care of good interpersonal relations, effective protection against unnecessary tensions, observance of the rules of appropriate behaviour and the accompanying diligence and efficiency of their actions. Openness of the Police to society, including building public trust based on ethical principles and absolute respect for human rights, supported by social research, is a testimony to the growing professionalism. The indicated trend in the development of the Polish Police is a new challenge. It is characterized by a return to the ethos of the State Police, but as it should be believed, it will not always meet with full recognition and understanding of the police community. This justifies undertaking research on the relationship between the rules of professional ethics of the police officer and their impact on the safety in service. This article contains a scientific exploration of the issues raised, supported by empirical research on a group of 326 Polish Police officers.

"Wiertelnicy" - those were City officers appointed by the City Council to oversee the construction industry in the old Krakow. Preserved in the state Archives are the City books of records that contain minutes and rapports regarding the activities of the "Wiertelnics" - often referred to as the "construction police" or as it probably would be more adequate the old-time city engineers. The "wiertelnics" conducted site reviews. The preserved documentation of their activities such as divisions and subdivisions of real property; preformed estimates of value of real property; damage assessment (particularly, as it was pertaining to border or division walls, and prescription of construction works that were necessary to ensure building and construction safety constitutes an very important source of historic documentation in regard to city engineering as it allows to follow not only the history of the physical constructions of buildings and dwellings themselves, but also the technology and technical solutions i.e. plumbing or other necessary adaptations needed by particular workshops or craftsmen's sites. It can be observed that some solutions that were used by the owners of the buildings were frequently cost driven and consequently of a very provisory nature. Later on, much greater investments were necessary to avoid imminent "construction catastrophes". The information contained in the City public records of the "Wiertelnic's Deeds" give also some insights that are not directly related to the construction requirements or activities themselves, but were the predominant factors that determined the physical shape of the building or a site.

Leaving the UE by the UK has brought a number of consequences for bilateral Polish-British police and justice cooperation. The subject of the article was to present legal regulations, which provide the basis for international cooperation for British law enforcement agencies. The author analyzed and then evaluated the effectiveness of instruments of mutual cooperation. The articles focuses also on the assessment of Brexit consequences and its possible impact on the Polish-British police cooperation. It is worth emphasising that cross-border law enforcement cooperation - which includes police, customs, secret services and other law enforcement agencies, mainly concerns the most serious threats such as terrorism, organised crime, human traffi cking, money laundering, drug traffi cking or cybercrime. The article shows that the most unfavourable changes result from dropping the Schengen acquis by the United Kingdom - is disconnection from the second generation Schengen Information System. The article includes also information about The Agreement on Trade and Economic Cooperation between the European Union and the European Atomic Energy Community and the United Kingdom of Great Britain and Northern Ireland, which has retained a number of important mechanisms for effective police cooperation between EU Member States and the United Kingdom. But although, as mentioned in the article, the Trade and Cooperation Agreement between the European Union and the United Kingdom provides upgrades of the tools of police and judicial cooperation, it is a matter of practise to verify these as sufficient.

Niniejszy artykuł został w całości poświęcony problematyce związanej ze statusem policjanta pełniącego służbę na stanowisku radcy prawnego. Co do zasady funkcjonariusze Policji nie są uprawnieni do wykonywania tego zawodu, chyba że pełnią służbę na stanowisku służbowym radcy prawnego. Status policjanta radcy prawnego regulowany jest zarówno ustawą o radcach prawnych, jak i ustawą o Policji. Normy zawarte w obu aktach prawnych wzajemnie się uzupełniają. Skoncentrowano zatem uwagę na omówieniu kwestii odnoszących się do praw i obowiązków szczególnej grupy policjantów pełniących służbę na stanowisku służbowym radcy prawnego. Wykazano, że pełnienie przez policjanta służby na tym stanowisku nie modyfikuje kształtu stosunku służbowego ani też nie zwalnia go z obowiązków ustanowionych w pragmatyce służbowej dla wszystkich funkcjonariuszy.
This paper addresses issues related to the legal status of a police officer serving as a legal adviser. As a rule, under Polish law police officers are not authorised to practise in this profession unless their duties in the police force involve giving legal advice as a legal adviser. The legal status of a police officer who performs the services of a legal adviser is regulated by two acts of legislation, Ustawa o radcach prawnych (the Legal Adviser Act), and Ustawa o policji (the Police Act). The provisions in these two acts are complementary. Hence, in this paper I have focused on issues relating to the rights and obligations of this particular group of police officers, whose duties in the Polish police force entail the performance of a legal adviser’s services. I show that the legal aspect of a police officer’s employment relationship does not change if he is performing a legal adviser’s job in the course of his duties in the police force; neither doesit exempt him from carrying out the duties binding on all policemen.

Although the genesis of women police dates back to 1925, not much information on the activities of this formation has been preserved until today. It is known that it was established on the initiative of the Polish Committee for the Fight Against Trafficking in Women and Children and its main goal was to fight prostitution, to prevent women from being taken out of the country and exploited for work as prostitutes, and later also to take care of children. The formation was supervised by lt. Stanisława Filipina Paleolog. Her duties included controlling female police officers in terms of their task performance, as well as taking care of new candidates. In the article, on the basis of archival documents, the author analyses control reports and protocols drawn up during that period, on the basis of which it is possible to reconstruct, at least partially, the history of Polish female police officers in the late 1930s.

Artykuł został poświęcony codzienności w stanie wojennym w Trójmieście. Jego celem jest próba ukazania dnia powszedniego w okresie nietypowym dla całych dziejów PRL.
In the morning of 13 December 1981 Poles were informed of the martial law declared on Poland by Gen. Wojciech Jaruzelski. The move was accompanied by mass arrests of Solidarity leaders and political dissidents; and militia and army troops in tanks and armoured military vehicles appeared on the streets of every major city. The restrictions imposed on the country included, among others, curfew between 10 pm and 6 am; telephone lines were disconnected, and mail was subject to censorship. Streets were patrolled by soldiers, classes in schools and at universities were suspended, travel between towns required permission, and many other restrictions on civil liberties were imposed. Only two national-wide papers were issued, which in the Tri-City region were merged into one „tri-daily” published by the party comrades selected by the Voivodeship Committee of the party. All public administration, state services, mines, power plants and most of the key companies were placed under military management. All this, combined with an economic and political crisis of the state, had a dramatic impact on the everyday life of people, who rebelled against martial law by organising strikes and street demonstrations. The article describes the everyday struggle of people in the harsh reality during the first months after the introduction of martial law in Poland on the example of Gdańsk, Gdynia and Sopot, which together make up the “Tri-City” (Trójmiasto) conurbation.

The article concerns the implementation of the cross-border pursuit based entirely on the provisions of Art. 41 of the Executive Convention and submitted declarations that are possible to be carried out efficiently. In order to increase its effectiveness and efficiency, it is necessary to sign appropriate bilateral agreements as soon as possible between the governments of the Republic of Poland and the Federal Republic of Germany, which will unify the legal provisions and specify this form of policing, which will ultimately affect the effectiveness and professionalism of cross-border pursuit and the safety of the officers carrying out these activities.
Artykuł dotyczy realizacji pościgu transgranicznego opierającego się w całości na zapisach art. 41 Konwencji Wykonawczej oraz złożonych deklaracjach, które są możliwe do sprawnego przeprowadzenia. W celu zwiększenia jej efektywności, sprawności niezbędnym jest jak najszybsze podpisanie stosownych umów dwustronnych pomiędzy rządami Rzeczpospolitej Polskiej i Republiki Federalnej Niemiec, które ujednolicą przepisy prawne i uszczegółowią tę formę działań policyjnych, co ostatecznie wpłynie na skuteczność i profesjonalizm prowadzenia pościgu transgranicznego oraz bezpieczeństwo prowadzących te działania funkcjonariuszy.

Opis:
The aim of the article is to analyze determinants, standards and principles of co-operation between the Polish Financial Supervision Authority and selected stakeholders of the state security system. This is especially important in the context of the dynamic development of the financial market, challenges resulting from the computerization of this market in the era of pandemics and the geopolitical situation related to the war in Ukraine. Authors accepted the hypothesis that the effectiveness of cooperation of entities responsible for state security depends, on the one hand, on the proper legal basis, and on the other hand, on soft factors such as mutual trust, community of goals and competence of employees of public institutions and officers. The article is a review with a theoretical and empirical component. The doctrine and legal acts were analyzed, and also empirical material collected during the research process was analyzed. For the purposes of the considerations, the dogmatic-legal method and the analysis of source materials of the Polish Financial Supervision Authority were used.
Celem artykułu jest zanalizowanie uwarunkowań, standardów i zasad współpracy Komisji Nadzoru Finansowego z wybranymi podmiotami systemu bezpieczeństwa państwa. Jest to szczególnie istotne w kontekście dynamicznego rozwoju rynku finansowego, wyzwań płynących z informatyzacji tego rynku w dobie pandemii oraz sytuacji geopolitycznej związanej z wojną w Ukrainie. Autorzy przyjęli hipotezę, że skuteczność współpracy podmiotów odpowiedzialnych za bezpieczeństwo państwa zależy z jednej strony od właściwych podstaw prawnych, a z drugiej od czynników miękkich, takich jak wzajemne zaufanie, wspólnota celów oraz kompetencje pracowników i funkcjonariuszy instytucji publicznych. Artykuł ma charakter przeglądowy z komponentem teoretyczno-empirycznym. Dokonano w nim analizy dorobku doktryny i aktów prawnych oraz przeanalizowano zgromadzony materiał empiryczny. Na potrzeby prowadzonych rozważań wykorzystano metodę dogmatyczno-prawną oraz analizę materiałów źródłowych Urzędu Komisji Nadzoru Finansowego oraz Komisji Nadzoru Finansowego.

Opis:
Celem artykułu jest zanalizowanie uwarunkowań, standardów i zasad współpracy Komisji Nadzoru Finansowego z wybranymi podmiotami systemu bezpieczeństwa państwa. Jest to szczególnie istotne w kontekście dynamicznego rozwoju rynku finansowego, wyzwań płynących z informatyzacji tego rynku w dobie pandemii oraz sytuacji geopolitycznej związanej z wojną w Ukrainie. Autorzy przyjęli hipotezę, że skuteczność współpracy podmiotów odpowiedzialnych za bezpieczeństwo państwa zależy z jednej strony od właściwych podstaw prawnych, a z drugiej od czynników miękkich, takich jak wzajemne zaufanie,wspólnota celów oraz kompetencje pracowników i funkcjonariuszy instytucji publicznych. Artykuł ma charakter przeglądowy z komponentem teoretyczno-empirycznym. Dokonano w nim analizy dorobku doktryny i aktów prawnych oraz przeanalizowano zgromadzony materiał empiryczny. Na potrzeby prowadzonych rozważań wykorzystano metodę dogmatyczno-prawną oraz analizę materiałów źródłowych Urzędu Komisji Nadzoru Finansowego oraz Komisji Nadzoru Finansowego.
The aim of the article is to analyze determinants, standards and principles of co-operation between the Polish Financial Supervision Authority and selected stakeholders of the state security system. This is especially important in the context of the dynamic development of the financial market, challenges resulting from the computerization of this market in the era of pandemics and the geopolitical situation related to the war in Ukraine. Authors accepted the hypothesis that the effectiveness of cooperation of entities responsible for state security depends, on the one hand, on the proper legal basis, and on the other hand, on soft factors such as mutual trust, community of goals and competence of employees of public institutions and officers. The article is a review with a theoretical and empirical component. The doctrine and legal acts were analyzed, and also empirical material collected during the research process was analyzed. For the purposes of the considerations, the dogmatic-legal method and the analysis of source materials of the Polish Financial Supervision Authority were used.

On 1st July 2015 Art. 321 of the recently amended code of Polish criminal procedure (kodeks postępowania karnego, k.p.k.) enlarged the scope of powers of the Polish Military Police (Żandarmeria Wojskowa, ŻW) in criminal proceedings. In this respect ŻW now has the powers defined in the Military Police Act (ŻWU), while the respective powers of military prosecutors and courts have remained unchanged. Since 1st July 2015 ŻW has held the appropriate powers both with respect to soldiers regardless of the circumstances in which they committed an offence, and with respect to civilians violating the law in a military zone. The powers of the Polish Military Police have not been changed in cases of minor and tax offences, and correspond to the jurisdictive powers exercised by military courts. In this article the author analyses the scope of the changes in the powers held by the Polish Military Police regarding procedure in criminal cases, and on the basis of a comparison of the changes with ŻW’s structure and duties assesses the effects of the amendment, concluding that their impact goes well beyond the military community.

W II Rzeczypospolitej problem kłusownictwa był bardzo poważnym wyzwaniem i nigdy nie został znacznie ograniczony. W latach 1918–1939 z tym przestępstwem bezskutecznie walczyli policja, straż leśna oraz myśliwi. Kłusownicy byli niebezpiecznymi i nieprzewidywalnymi ludźmi, często zabijali myśliwych, leśników, a także nie wahali się strzelać do policjantów. W międzywojennej Polsce działalność kłusowników poważnie zagrażała istnieniu populacji nawet pospolitych zwierząt.
Poaching in the Second Polish Republic was a serious problem that was never quite resolved. In 1918–1939, it was actively fought against by the police, forest guards and hunters. Poachers were dangerous and unpredictable people; they often killed hunters and foresters, they did not hesitate to fire at policemen. In interwar Poland poaching was a real threat to species, even to common animals.
