The issue of legal protection of life from Article 38 of the 1997 Constitution is one of the most important dilemmas of modern Polish law. This issue was already regulated in the March Constitution. The purpose of the article is to present the normative content of the legal protection of life on the basis of both constitutions. The research objective is to determine the importance of the two constitutions in providing legal protection of life in the context of the tasks of the ordinary legislature and the importance of judicial decisions. The text confronts the assumptions of the system legislator with lower–level regulations. Particular attention has been paid to the issue of assessing the compatibility of these solutions with the constitution’s design. Consideration was given to the influence of international organizations on the content and implementation of the protection of life in the Polish legal order. The study includes an analysis of the literature on the subject. The dogmatic and historical-legal method was used. The deliberations take into account the weaknesses and strengths of entrusting the judiciary with the constitutional task of defining the normative content of the protection of life. Contemporary public disputes in this matter should prompt greater efforts in clarifying constitutional solutions. It is worth bearing in mind the experience of the 1921 Constitution.

In the author’s view the possibility of submitting documents and applications by air carriers to the President of the Civil Aviation Authority in a language other than Polish raises serious due to its lack of conformity with Article 27 of the Constitution. Other provisions of the proposed amendment do not raise doubts about their constitutionality. In accordance with the proposal all administrative cases filed and pending before appropriate bodies (mostly the President of the Civil Aviation Authority) are subject to the new provisions which will be inserted in Aviation Law Act.

The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning constitutionality of the procedure for the creation of common and military courts (Ref. No. K 27/12). A group of Deputies and the National Council of the Judiciary, initiating the proceedings, challenged the transfer to create and dissolve common and military courts to – respectively – the Minister of Justice and Minister of National Defence. In the Sejm’s view, the procedure for creation common courts does not infringe constitutional standards, but the provision authorising the creation of military courts does not comply with the Constitution due to the lack of necessary guidelines.

Before I proceed to further detailed and developed arguments, I would like to present the main research problem involving the following question: how did the Border Protection Forces evolve in the years 1945–1965 from the perspective of the legal system and the constitutional law in particular. The constitution referred to above is not the basic law “as such”, in common parlance, but it is the constitution present in the course of the evolution of the legal status of the Frontier Protection Forces. This article is mainly focused on this constitution, although, apart from that, it contains the spectrum of legal and constitutional schemes adopted in different periods of the functioning of the Border Guard Forces in their constitutions. It is therefore immanent to present the process of the functioning of the Border Guard Forces – the origin and evolution of legal norms in the light of the constitution and the whole system of law, as well as the changes taking place in the system of law in the time-space between 1945 and 1965. Taking into account the defined objectives, it turned out to be necessary to present the work from a historical perspective. The chronology of facts is important for the discussed subject matter, as it helps to systematize the deliberations. The structure of the work has been adapted to the above principles of this publication. It begins with a legal-historical part introducing the subject of the tradition of constitutionalism in Poland. It presents the reasons for the creation and the process of subordination of border formations to various institutional solutions, and systematizes the legal and organizational transformation of the Border Protection Forces created in 1945 as a separate type of troops by the Ministry of Public Security and the Ministry of Internal Affairs as part of the People's Army of Poland. The Border Protection Forces repeatedly revised its structural-bureaucratic subordination from the Ministry of National Defence through the Ministry of Public Security to the Ministry of the Interior and vice versa. The general research method became a legal-historical method to reconstruct the past state of affairs, the evolution of the legal status of the Border Protection Forces.

The opinion provides an analysis of advisability and constitutionality of a bill initiated by citizens. The author claims that, pursuant to Article 176 (2) of the Constitution, the organizational structure and jurisdiction of particular types of courts must be specified by statute. However, a statute is not required for the creation of courts. But, in his view, the powers of legislative branch of government to establish and to dissolve the courts and to determine their seats and the boundaries of judicial districts are not at all limited. The author is afraid that after the adoption of the proposal the Act – System of Common Courts Law will cease to meet the requirement of comprehensive regulation of this particular sphere, as its essential elements are regulated in a separate statute. Moreover, the adoption of the bill could result in inconsistency of the provisions concerning creation and dissolution of courts in relation to administrative and military courts which regulations would still be applied. The author also points out numerous defects of the bill of a legislative technical nature.

The article makes a presentation of the relation between legal acts belonging to the so-called foreign orders and the national law at the level of regulation contained in the Constitution of the Republic of Poland and the problem of application of the EU law by the Polish administrative authorities. The ratified international agreements and acts of the EU law are sources of administrative law and must be applied by the public authority of Member States. The article deals with two issues: the relationship between the international law and national law in the light of the Polish Constitution and application of the EU law by public administration in Poland. These issues can be dealt with separately but have a number of tangent points. The author does not aspire to present a comprehensive discussion of these issues, but intends to point out some aspects. It has been argued that the standard of application of international law by public administrations (which is also the accession treaties) and the EU law depends on how the constitution regulates the issue of international law relation to the domestic law. In Polish jurisdiction (the Constitutional Court and the Polish Supreme Administrative Court) the practice of respecting the principle of primacy of the EU law as well as the principle of a community of interpretation of this law has been established.

Unimpeded functioning of the natural environment is the basis for the operation and effective development of society. However, the fundamental role that nature plays in the existence of society has not protected it from overexploitation. Human activity focused mainly on the progressive economic development has gradually led to a significant environmental degradation. Therefore the problem of environmental protection has rightly become the main topic of public discourse worldwide. In response, governments and international organizations have taken a series of coordinated actions to prevent further destruction. Law is one of the most effective instruments in environmental protection. The Polish Constitution provides that environmental protection is a duty of public authorities, which they are obligated to fulfil. The EU law also protects the environment by means of many legislative acts. Over the years, the European Union, as the economic and political union of states, has developed one of the most restrictive mechanisms of environmental protection. The EU legislation has always emphasized that sustainable development and green economy are the supreme values for the Union. The EU law is part of the Polish legal system, and thus also imposes the obligation on Polish public authorities to care for the environment.

In establishing the thematic scope of this work, I assumed that its subject would be the process of the formation of border services in interwar Poland. This means a deliberate and complete disregard for the essentially distinct administrative role played by the border guard. The presentation of the Border Guard from an administrative perspective changes the situation so profoundly that a thorough discussion of its implications would certainly double the volume of the publication. A superficial treatment of the administrative issue would lead to misunderstandings. Furthermore, a superficial omission of the administrative issue was deemed necessary because the formations were mainly military in nature. Before going into details and elaborations, I would like to present my main research objective, which is the following question: what was the evolution of the legal status of Polish border formations in the inter-war period? In view of this objective, it is necessary to present the work from a historical perspective. The chronology of the facts is important for the subject matter, as it serves to systematise the considerations. The structure of the work and the research method were adjusted to the above-mentioned assumptions of the publication, which shows the reasons for the creation and the process of transformation of the border formations in relation to various types of institutional solutions, up to the moment of the creation of the Border Protection Corps and the Border Guard Corps, operating under these names until 1939. The potential conclusions resulting from this chapter concern: the presentation of the institutional construction of the border formations in the years 1918–1939 and the demonstration that in the interwar period they were the main organs of the Second Polish Republic, which guaranteed the inviolability of state territory and the security of the citizens on the subordinate territory.

The article presents considerations and multifaceted analyses of the conditions and motives of judicial decisions taken after the judgment of the TSUE 19 November 2019, in the context of how Poland’s judiciary system functions. It begins by explaining how to perceive and understand the essence of legal corruption in terms of the use of law, power and professional position. The possibilities of the intentional use of judicial power for specific needs and purposes is discussed in this context. The next part of the paper is devoted to a critical analysis of selectively interpreted right to a tribunal enshrined in art. 45 of the Polish Constitution in connection with other values enshrined therein. The right of every citizen to a fair and public hearing of their case, without undue delay by a competent, independent, impartial and independent court, is presented in terms of the constitutional perspective, the principle of equal treatment and non-discrimination. The problem outlined here is considered from the point of view of protection against the arbitrariness of authorities and the possibility of appealing against personnel decisions enabling employment to be taken up in selected positions in state institutions. Attention is paid to the privileged legal position of judges over other citizens. The issues described and the arguments presented in this article are entirely overlooked in the literature, as well as in public debate. What follows is an explanation of how TSUE rulings are interpreted differently by various public authorities. Reference is also made to the dictum of the Supreme Court judgment of 5 December 2019, which was issued in its Labour Law and Social Security Chamber. That process initiated specific actions and activities taken by individual groups of Supreme Court judges. Finally, the resolution of the combined three chambers of the Supreme Court on 23 January 2020, the judgment of the Constitutional Tribunal of 20 April 2020, and divergent decisions regarding the implementation of the TSUE’s position of 8 April 2020 are discussed.

The paper investigates legal funding of the right to petition in Poland. It starts from a comparative background and it introduces the institution in a wider context, as a transparent and accessible for citizens legal solution, that has become an essential instrument of contemporary direct democracy and civic society. The author discusses regulations of the 2014 Acts on Petitions with reference to the Constitution of Poland and organisation of the Sejm and the Senate proceedings. Moreover, the study has placed the right to petition in a fieldwork of Polish system of human rights protection and Polish legal system in general. Finally, the paper presents results of opinion polls on direct democracy and civic engagement in Poland to discuss them with reference to previously presented construction of the right to petition as a legal institution. The author concludes with a relevant question on its further development in times of deep polarisation of Polish politics and during the Constitutional Crisis in the county.

There is a common comparison between the constitutions of the authoritarian regimes of Poland (1935) and Estonia (1937). The ideological model of the 1937 Estonian Constitution, especially in the section on loyalty to the state, was the 1935 Polish Constitution; for this reason, this section was also called the ‘Polish Section’. Compared to the first, 1920 Estonian Constitution, the 1937 Constitution was much more restrictive of basic rights, in particular through its general orientation and attitude. It was precisely in this that the so-called “loyalty to the state” section (§ 8) played a special role, affecting the whole chapter by its very nature, because it could, in its wording – and according to the example of Poland – constitute a general border clause on fundamental rights and freedoms. This article analyses specifically the ‘loyalty to the state’ section but first a short overview about historical background will be given. Secondly, the drafting of the section 8 of the Estonian Constitutions in the committees’ will be described and analysed, and thirdly, the discussions in the National Assembly will be summarized.

The Article discusses the issue of granting human dignity the status of the highest value in the Polish Constitution. What is more, it explains the grounds of the regulation of art. 30 of the Constitution of the Republic of Poland. Additionally, it presents dignity as a foundation of the legal order. Therefore, de facto, every legal norm that functions in our legal system should comply with this regulation. The article calls attention to a danger of potential abuses pointing out some of the practices that can violate the human dignity in the future.

Specyfika tej regulacji, oprócz tego, że art. 18 Konstytucji RP ujęto już w pierwszym rozdziale Konstytucji, wiąże się z łącznym unormowaniem najważniejszych instytucji prawa rodzinnego oraz objęciem ich gwarancją ochrony i opieki Rzeczypospolitej Polskiej. Podkreślenie znaczenia małżeństwa stanowiącego – w rozumieniu konstytucyjnym – związek kobiety i mężczyzny, rodziny, macierzyństwa i rodzicielstwa ma się wiązać z zapewnianiem odpowiednich warunków budowania więzi i kształtowania relacji międzyosobowych. Dotyczy to zarówno małżonków, jak i poszczególnych członków rodziny, a wiec przede wszystkim rodziców i dzieci. Ten ogólniejszy kontekst analizowanego przepisu zaprezentowano, nawiązując do licznych wypowiedzi Trybunału Konstytucyjnego, który w swoich orzeczeniach wielokrotnie akcentował znaczenie art.18 Konstytucji RP jako ważnego elementu aksjologii konstytucyjnej.
This study is an analysis of Art. 18 of the Polish Constitution from a more general perspective, that is to say with regard to all the normative elements of this provision. Apart from the fact that Art. 18 is in the very first chapter of the Constitution, what determines its specificity is that it regulates the most important institutions of family law jointly and places them under the protection and care of the Republic of Poland. Te emphasis Art. 18 puts on the importance of marriage in the constitutional sense as the union of a man and a woman, the family, motherhood and parenthood, is to be associated with the provision of the right conditions for building and shaping interpersonal relationships. This applies both to spouses and individual family members, primarily parents and children. This more general context of Art. 18 is presented with reference to many of the statements made by the Constitutional Tribunal, whose rulings have repeatedly stressed the importance of Art. 18 as a key element of Poland’s constitutional axiology.
