The following article refers to the notion of military administration. The cognitive procedure was focused around the definition of “military administration”, and research was focused on recognizing the elementary facts that are related to this notion. The aim of the article is to present and organize the most important methodological approaches that refer to the notion of “military administration”. To achieve this goal, the method of document examination was employed, which made it possible to accumulate, sort, describe and scientifically interpret the issues of military administration. By pinpointing and justifying the problem, a stance was taken in the face of the views of other authors, who considered all the aspects of “military administration”. From a scientific point of view, the topic described below and the attempt at defining the notion of “military administra-tion” can lead to conclusions which have not been a topic of discussion for many years

The purpose of this article is to present the basic determinants as regards the use of the Territorial Defence Force (TDF) in the national defence system. The article focuses on issues related to security and defence as well as their impact on national security, and indicates the need to establish territorial forces in order to increase military potential in any country. What is more, it describes basic tasks which TDF can perform during individual stages of armed operations. Particular attention is paid to the fulfilment of the tasks by TDF as regards purely army-related activities, both military and non-military. It is indicated that TDF is a military formation that fills the gap as regards the security of a given area or territory, and that it can supplement the operational forces, thus constituting a vital element of the national defence system.

One of the biggest challenges faced in building the capacity of armed forces to operate in cyberspace is to attract, improve and retain expert staff. Cyberspace is, after all, the only operational domain that has been entirely created by people, so people have to be able to use it and also to constantly create it anew. According to the estimates cited e.g. by ENISA in 2019, there was a shortage of over 4 million cybersecurity specialists on a global scale, and approx. 65% of organisations declared staff shortages in the area of tasks related to cybersecurity. A real race for specialists in this domain is observed among both international corporations and domestic companies from plenty of industries, critical infrastructure operators and, finally, intelligence services. In this inter-sectoral, global competition, the public sector (which includes the military) is often in a difficult situation because of the limited possibilities of using financial incentives. Considering the needs and constraints, a resources-building strategy should be adopted that uses all the advantages found within the range of influence of the military sector. The article discusses them using various approaches, based on actions successfully implemented by the Polish Ministry of National Defence under the programme of capacity building in the armed forces to operate in cyberspace. The first aspect the image, motivation and challenges. Service in the cyber armed forces component provides the opportunity to reach areas unattainable anywhere else, including constant interaction with a well-prepared and highly motivated enemy. The second point for consideration is education and continuous improvement. The possibilities to recruit experts who already have a good position in the commercial market are limited. Therefore, development of the military education system is the best way to ensure a steady inflow of staff. In Poland, it was decided both to use military academies for this purpose and a real educational ecosystem is being created and constantly developed, also including a military IT secondary school and a dedicated non-commissioned officer school. Civilian secondary schools run (in co-operation with the Ministry of National Defence, MON) profiled vocational training classes, students of civilian universities undergo military training in cybersecurity, and the performance improvement will be managed by the Expert Cybersecurity Training Centre. The third aspect is the Territorial Defence Force, which gives the opportunity in the Cyberspace Operations Team to combine military service and to continue previous professional work on an extremely competitive market.

The proceedings before the Constitutional Tribunal in this case were initiated by a group of Deputies who questioned the constitutionality of some provisions of the Act of 21 June 2013 amending the Act on the Office of the Minister of National Defence and other acts. The Sejm did not share the arguments of the applicant. The abolishment of the posts of the commanders of the Army, Air Force, Navy and Special Forces (and their corresponding commands) accompanied by the creation of the posts of General Commander of the Branches of the Armed Forces and Operational Commander of the Branches of the Armed Forces is within the regulatory discretion of the legislature. The constitutional position of Chief of General Staff has not weakened, and the changes resulting from the Amending Act do not go beyond the framework set by the relevant constitutional provision. Entrusting to the President of the Republic of the competence to appoint – at the request of the Prime Minister – a person “designated for an appointment as Commander‑in‑Chief of the Armed Forces” has a strong constitutional grounds and ensures efficient procedure for filling the position of Commander‑in‑Chief for a period of war. In addition, the procedure in which the amendment was made did not infringe the principle of proper legislation.

Artykuł przedstawia zawiłości norm prawnych regulujących daną kwestię z dziedziny obronności państwa, a także wskazuje na negatywne przyczyny postrzegania prawa obronnego. Autor podkreśla dynamikę zmian prawa obronnego, które ewoluuje wraz ze zmianami życia społecznego. Wskazuje przy tym na rangę problemu dla poprawności funkcjonowania państwa nie tylko w aspekcie prawnym, ale i społecznym.
National defence has a special feature that regulates vital (main) national interests and therefore requires a detailed and transparent law. The body of law creates legal standards that define the relationships between the elements of the defence system of the state. These standards govern the relationship of the system with the environment. All of these relations were defined as the defence law. This paper presents the complexities of the legal rules governing the issue of the defence of a state and indicates the reasons for the negative perception of the defence law. The author emphasizes the dynamics of the law , which evolves with the changes of society. He is referring to the importance of the problem for the correct functioning of the state not only from a legal but also from a social point of view.

Defense preparations of territory are one of the key element of state’s defence preparations. They consist of deployment and maintenance of military installations, institutions and organizations serving to protect, defend, deter and counter various threats to national security. It is vital for taking advantage of defending homeland territory. Countries which made defence preparations of their territories have built up prosperous future. On the opposite countries that failed with this task often suffered defeats. Polish experiences are proof to this thesis.

Nowadays, ensuring cybersecurity is an important objective of public authority. It must take into account the protection of cybersecurity, both in the current and future perspectives. The state security policy must also take into account its dimension in cyberspace, especially today, where many services are provided through communication and information systems. A special place in the cybersecurity system is given to cyberspace security in the military dimension. In this regard, both the military administration and civil law entities, both acting for defence, will be competent. Effective military operations are directly linked to new digital technologies. As a result, for the sake of state security (both internal and external), it becomes necessary not only to respond to cyberattacks, but also to counteract them.

The fear of new ”hybrid warfare” in the south-eastern flank of NATO, provoked by the Russian Federation following the Ukrainian model, alongside whit the circumstances offered by the existent frozen conflict in the neighbourhood of Romania, with the evident process of Russian remilitarization in the Black Sea area, opened a serious debate in Romania about the need of recreating, training and endowing a National Reserve Force asked to manage the so-called concept of Territorial Defence. The role of TD is to support and to enhance the actions of the active defence forces through specific activities and to ensure a timely and efficient operation in order to prevent and reduce the consequences of an unexpected aggression over the country. The National Reserve Force will be composed of the existent reserve and of a volunteer reserve, according to new and drafted laws. Their missions will cover a broad scale of traditional and new risks and threats, particularly those linked to the hybrid and nonkinetic war. Fixing the National Reserve Forces issue will not only enhance the security of the country, but also will contribute to strengthening the southeastern flank of NATO.

Powoduje to, że mają one kluczowe znaczenie dla sprawnej i efektywnej obrony terytorium kraju.
This article covers the characteristics of the rights and obligations of railway companies in light of the fact that they have the legal status of entities of special economic and defence significance. This legal status is connected to the performance of a number of public, classified obligations which limit the freedom of their economic activity. It also means that, in times of danger to the sovereignty of the country and in times of war, railway companies are actively involved in the national security system and are thus of crucial importance for the efficient and effective defence of the national territory.

Poland’s accession to the North Atlantic Treaty Organization in 1999 was one of the most critical events in the Third Republic history. The integration process with NATO’s political and military structures is long-term and requires the constant commitment of all state structures and institutions. Participation in the joint creation of the North Atlantic Treaty Organization Member States’ defense force means, under Article 3 of the Treaty, the states’ maintenance and development of individual and joint capacity to counter armed attack. Thereby Poland is also obliged to conduct defense preparations in the national dimension. It requires providing formal, legal, and organizational conditions for the country’s functioning in the event of increasing the national defense readiness. Such conditions are necessary to perform tasks as part of national defense carried out on its territory and the territory of other states – the Members of the Alliance. The content presented in this article attempts to present legal, institutional, and instrumental aspects of defense preparations in Poland in the context of allied obligations. They concern the need for all NATO Member States to maintain and develop individual and joint capabilities to counter an armed attack. Given the nature of the problem, it should be remembered that Poland’s integration with NATO takes place both in the defense sphere and in economic, social, legal, and political matters.
Uzyskanie przez Polskę w 1999 roku członkostwa w Organizacji Traktatu Północnoatlantyckiego było jednym z najważniejszych wydarzeń w historii III Rzeczypospolitej. Proces integracji ze strukturami polityczno-militarnymi NATO jest długotrwały i wymaga stałego zaangażowania wszystkich struktur oraz instytucji państwa. Udział w kolektywnym tworzeniu siły obronnej państw – członków Organizacji Traktatu Północnoatlantyckiego oznacza, zgodnie z art. 3 Traktatu, utrzymywanie i rozwijanie przez państwa członkowskie indywidualnej i zbiorowej zdolności do odparcia zbrojnej napaści. Zobowiązuje to między innymi Polskę do prowadzenia przygotowań obronnych w wymiarze narodowym. Wymaga to przygotowania warunków formalno-prawnych i organizacyjnych do funkcjonowania kraju w sytuacji podwyższania gotowości obronnej państwa, niezbędnych do wykonywania zadań w ramach obrony narodowej realizowanej na jego terytorium, a także na obszarze innych państw – będących członkami Sojuszu. Zaprezentowane w niniejszym artykule treści stanowią próbę przedstawienia aspektów prawnych, instytucjonalnych i instrumentalnych problematyki przygotowań obronnych w Polsce, w kontekście zobowiązań sojuszniczych. Dotyczą one konieczności utrzymywania i rozwijania przez wszystkie państwa członkowskie NATO indywidualnej i zbiorowej zdolności do odparcia zbrojnej napaści. Uwzględniając charakter problemu, należy pamiętać, że integracja Polski w NATO odbywa się zarówno w sferze obronności, jak i w kwestiach ekonomicznych, społecznych, prawnych i politycznych.

W artykule przedstawiono zarys koncepcji Wojsk Obrony Terytorialnej jako piątego komponentu Sił Zbrojnych RP oraz ich miejsce w systemie bezpieczeństwa państwa. Zgodnie z koncepcją Ministerstwa Obrony Narodowej, Wojska Obrony Terytorialnej mają prowadzić ochronę i obronę miejscową w stałych rejonach odpowiedzialności we współdziałaniu z wojskami operacyjnymi oraz z miejscowymi organami władzy, służbami i organizacjami pozarządowymi (także paramilitarnymi), a także całym lokalnym społeczeństwem. Autor poddaje analizie strukturę, zadania oraz wyposażenie tego rodzaju sił zbrojnych. W pracy przytoczono także opinie ekspertów zajmujących się tematyką z obszaru bezpieczeństwa narodowego.
The article presents the concept of the Territorial Defense Force (TDF) as the fifth component of the Armed Forces of the Republic of Poland. Author elaborates the place of that formation in the national security system. According to the concept of the Ministry of National Defense, the Territorial Defense Forces are going to provide protection and defend areas of permanent responsibility in the close co-operation with the operational army units and local authorities. Very important role for the TDF is tight liaison with non-governmental organizations (incl. paramilitary) and with the entire local community. The author analyzes the structure, tasks and equipment of the new formation. The article also contains the opinions of experts, who are concerned with security and national defense issues.

Military classes in Poland can be defined as classes of lower secondary and upper secondary schools, which carry out broadly defined education for safety and participate with the Ministry referred to by their name. Also, the programmes of these classes are enriched with issues related to the defence of the country, the history of the Polish army and the evolution of patriotic attitudes among children and young people. Military classes in Poland are very popular among both teachers and students. The purpose of this article is to examine military classes in Poland, with particular focus on experience in this field, as well as an indication of capabilities, and, thus, the developmental prospects of these classes. The analysis was carried out starting with a presentation of the origins of functioning military classes, after which the current possibilities of building programmes of these classes were presented. In the next part of the work the author has carried out a preliminary diagnosis of the functioning of military classes. Subsequently, the proposal of a programme of military classes, which was developed at the National Defence Academy in Warsaw in 2014, is revealed. The whole article ends with a summary and conclusions.

Jednym ze składników potencjału obronnego państwa jest potencjał gospodarczo-obronny, którego źródłem są ogniwa gospodarczo-obronne w obrębie nie-militarnego podsystemu wykonawczego systemu obronnego państwa. Zakres działalności tego typu ogniw obejmuje również transport, w tym transport intermodalny, który szczególnie warto rozwijać z uwagi na szerokie spektrum zalet i korzyści dla jego interesariuszy. Zapewniając użyteczność czasu i miejsca, transport intermodalny tworzy pewnego rodzaju fundament do prawidłowego funkcjonowania i rozwoju wszystkich ogniw, których naczelnym zadaniem jest tworzenie potencjału gospodarczo-obronnego. Poniekąd, transport intermodalny pozwala uruchomić, wyzyskać ten potencjał.
National potential of defence consists of many components. One of them is national's economic potential of defence which is created by many units placed within the non-military executive subsystem of the national defence system. The scope of activity of these units also includes intermodal transport, which is particularly worth developing due to the wide range of advantages and benefits for its stakeholders. Ensuring the usability of time and place, intermodal transport creates a kind of foundation for the proper functioning and development of all units, whose main task is to create national's economic potential of defence. In a sense, intermodal transport allows to run, exploit this potential.

Artykuł stanowi pokłosie badań prowadzonych przez autora po dokonanym strategicznym przeglądzie bezpieczeństwa narodowego i ukazaniu się Białej Księgi Bezpieczeństwa Narodowego RP. W artykule udokumentowana została dekompozycja systemu obronnego państwa w ramach budowanego systemu bezpieczeństwa narodowego RP. Obecnie stanowi on jeden z podsystemów operacyjnych systemu bezpieczeństwa narodowego, a w skład jego struktury obecnie wchodzą: działania dyplomatyczne; działania w sferze militarnej; działania służb specjalnych (wywiadu i kontrwywiadu) oraz przemysłowy potencjał obronny. Wymienione elementy podsystemu obronnego zostały scharakteryzowane w zakresie celów, pełnionych misji i realizowanych zadań. Podsystem obronny państwa powinien być tak zorganizowany, aby zapewnić nieprzerwane funkcjonowanie organów władzy publicznej zarówno w czasie normalnego funkcjonowania państwa, w tym kryzysu, jak i stanów nadzwyczajnych (stanie wojennym, wyjątkowym, klęski żywiołowej). Zakłada się, że tak skonstruowana struktura systemu obronnego państwa powinna zapewnić utrzymanie zdolności do prowadzenia w pełnym zakresie skutecznych działań obronnych dla przeciwstawienia się wszelkim zagrożeniom (w tym agresji militarnej) dla żywotnych interesów narodowych. Jednakże faktyczna sprawność i wydolność systemu obronnego państwa może być zweryfikowana tylko przez konkretną sytuację kryzysową.
The article is the aftermath of the author’s research made after the completion of the strategic review of national security and the publication of the White Book on the National Security of Poland. This article documents the decomposition of the state defence system in the framework of the national security system of RP being built. Currently, it is one of the operational subsystems of the national security system, while its present structure and composition are: diplomatic actions; activities in the military sphere; operations of special services (intelligence and counterintelligence) and industrial defence potential. These elements of the defence subsystem are characterised in terms of objectives, performed missions and tasks. The state defence subsystem should be organised to ensure the uninterrupted functioning of public authorities both during normal operation of the state, including crisises, as well as states of emergency (state of war, state of emergency, natural disaster). It is assumed that the defence system structure, constructed in such a way, should protect the ability to conduct the full range of effective defence to counter any threat (including military aggression) to vital national interests. However, the actual performance and efficiency of the state defence system can be verified only by a particular crisis.

Opis:
The subject of the opinion is the admissibility of consideration by a committee of motions to carry out a control in connection with the lack of general principles of carrying it out set out in the Standing Orders of the Sejm. Motions to carry out the control submitted to the National Defence Committee stay within the scope of the subject matter of activities of the committee. The author claims that one of the motions rises some concerns of a legal nature. The subject of the request was defined in a problem way, whereas committee’s control relates to enforcement and executing statutes and Sejm resolutions, what leads to a conclusion that the scope of the control should be related to a given act or resolution.
