    A Deputy may not obtain information from the National Labour Inspectorate under Article 19 of the Act on the Exercise of the Mandate of a Deputy or Senator.     The labour inspector’s statement constitutes a non-statutory form of enforcing labour rights. In this context, we can see a variety of problems related both to the impact of the legal measure itself, appealing against it, as well as to the role it plays in ensuring compliance with employment rights. The jurisprudence and literature to date indicates explicitly that the employer’s failure to comply with the content of the labour inspector’s speech does not give rise to any negative legal consequences. Nevertheless, employers who do not agree with the solutions recommended by the authority through the labour inspector’s speech perceive this specific measure as a special type of decision. The decision itself, in turn, seems to be a natural manifestation of the state, the authority indicating to the subject of law the individual directions of its behaviour. However, this is, in fact, a different act. The article doubts the implementation of the model of labour supervision and control assumed by the legislator in the light of the measure outlined in the labour inspector’s speech. As a result, allowing this measure to be left to the inspector’s discretionary use may lead to the reinforcement of the feeling of a lack of efficiency on the part of the state bodies in the field of protection of workers’ rights, especially that the cases of its use are an open catalogue, which includes issues such as working time or the employment of young people. In order to better understand these trends, two examples are discussed where the National Labour Inspectorate had an impact on situations of a gross violation of labour law standards. A de lege ferenda direction has also been indicated, which means the creation of the institution of “re-inspection” of the employer. The existence of a non-authoritative “recommendation”, which is a statement by the labour inspector, is in fact a manifestation of the implementation of Article 17, paragraph 2 of the ILO Convention No. 81, which would not be incompatible with the consequence in the form of addressing a statement.

    Zadania Państwowej Inspekcji Pracy powinny być zgodne z funkcjami, które wypełnia. Jednym z konstytucyjnych zadań państwa jest sprawowanie nadzoru nad warunkami pracy. Ważną rolę w tym zakresie pełni PIP. Także konwencja MOP nr 81 określa główne uprawnienia inspekcji. Poszerzenie zadań nie może prowadzić do ograniczenia jej kluczowych funkcji. Niestety, od lat utrzymuje się trend polegający na zlecaniu inspekcji nowych zadań, co może negatywnie wpływać na wykonywanie przez nią zadań w zakresie ochrony pracy.
    The Polish state institution Państwowa Inspekcja Pracy (the National Labour Inspectorate) conducts supervisory operations which should be consistent with the purposes for which it has been founded. One of the state’s constitutional tasks is to supervise working conditions. The Inspectorate plays an important role in this area. A definition of the Inspectorate’s main powers to inspect workplaces is provided in the ILO’s Convention 81. New tasks added to the Inspectorate’s duties should not impede the performance of the main purposes for which it was founded. Unfortunately, for years we have been observing a tendency to encumber the Inspectorate with more and more new duties, which may have a detrimental effect on the work it is doing for the inspection of working conditions in Poland.

    State audit institutions constitute a very important part of the contemporary model of state. Auditors (people employed by state audit institutions), being professionals, should fulfill many duties which are customarily assigned to them by the society. In their daily work auditors should observe statutes and codes of ethics. The ethics of auditors of the Supreme Audit Office (Najwyższa Izba Kontroli) is held in high regard among rules of conduct for auditors. It serves a model for ethics in other state audit institutions, such as the National Labour Inspectorate (Państwowa Inspekcja Pracy) or Regional Chambers of Audit (regionalne izby obrachunkowe). Ethics of auditors is a special kind of ethics expected from public administration employees.

    This article presents the scope of the Polish Labour Inspector’s supervisory powers and the principles governing his supervision of safety and hygiene regulations in the workplace, which is particularly important in view of the growing scope of tasks entrusted to the National Labour Inspectorate. I present the results of a survey in which businessmen were asked about their relations with, and expectations of the National Labour Inspectorate. I also write on the important role the Inspectorate plays as an information and advisory service for the effective enforcement of the rule of law in labour relations.
