Opis:
The article raises the subject of the functioning of workers' representatives of municipal companies in supervising bodies of these companies i.e. supervisory boards. Pursuant to the analysis of the regulations of the code of trading companies and regulations which normalise the functioning of local government and municipal economy of the units of local government, the article presents an institution of the board of supervisors, the creation of these authorities, their competence and methods of realising supervisory tasks, emphasising the peculiarities which distinguish supervisory boards of communal companies in comparison with supervisory boards of companies without the participation of local government units. It also discusses practical consequences of the existing legal status in the field of participation of municipal companies' employees in their supervisory boards on the basis of the study carried out in one-man companies of a local government unit. The author's conclusions about the participation of municipal company workers in supervisory boards indicate a necessity to explicitly and homogeneously regulate this issue with regard to all the communal companies.
Artykuł porusza temat funkcjonowania przedstawicieli pracowników spółek komunalnych w nadzorowaniu organów tych spółek, tj. rad nadzorczych. Zgodnie z analizą przepisów kodeksu spółek handlowych i wykonawczych, które normalizują funkcjonowanie samorządu terytorialnego oraz gospodarki komunalnej jednostek samorządu terytorialnego, w artykule przedstawiono instytucję rady nadzorczej, tworzenie tych organów, ich kompetencje i metody realizacji zadań nadzorczych, podkreślając specyfikę, która odróżnia rady nadzorcze spółek komunalnych w porównaniu z radą nadzorczą spółek, bez udziału jednostek samorządu terytorialnego. Na podstawie badań przeprowadzonych w jednoosobowych spółkach jednostek samorządu terytorialnego, omówione zostały również praktyczne konsekwencje obecnego stanu prawnego w zakresie uczestnictwa pracowników komunalnych spółek w ich radach nadzorczych. Autorskie wnioski dotyczące udziału pracowników komunalnych spółek w radach nadzorczych wskazują na konieczność wyraźnego i jednolitego uregulowania tej kwestii w odniesieniu do wszystkich gminnych spółek.

Currently in Poland there are two models for an public urban transport companies. The first is based on the mechanisms of budgetary economy, while the second is based on market principles. In the budgetary model, the efficiency is calculated and verified in accordance with the balance between costs and incomes. The market model and its efficiency is based in terms of increasing capital. To evaluate the financial efficiency of the public urban transport companies, standard indicators are not good enough as they are typical for other kinds of enterprises. The principles of a financial efficiency, is in responsibility of companies own economic and financial system. However, it will be different, depending on the adopted organizational and legal form of a chosen kind of public entity.

W artykule zaprezentowano uszkodzenia wybranych układów bezpieczeństwa pojazdów komunikacji miejskiej. Skupiono się na uszkodzeniach w układzie kierowniczym. Dane pozyskano z Miejskiego Przedsiębiorstwa Komunikacyjnego w Lublinie. Badaną grupę pojazdów stanowiły autobusy komunikacji miejskiej takie jak: Solaris Urbino 12, Mercedes Benz, Autosan San-City 9LE oraz Autosan Sancity 12LF. Celem prowadzonych badań było określenie jak często ulega awarii analizowany układ.
The article presents some damage of safety systems on public transport vehicles. The article focused on the steering system damages. The data were obtained from the Municipal Transport Company in Lublin. The test vehicle group were public buses such as: Solaris Urbino 12, Mercedes Benz, Autosan Sancity 9LE and Autosan Sancity 12LF. The aim of this study was to determine how often are failures of the analyzed system.

Opis:
Standards linked with the environmental protection and vehicles are increasingly restrictive. EURO VI standard and regulations define the acceptable limits for exhaust emissions of new vehicles sold. Because of that, Selective Catalyst Reduction systems are used in a new vehicles with the heavy-duty type engines. This paper presents a study of the SCR system in public transport vehicles of the Municipal Transport Company (MPK) in Lublin, Poland. The tests were performed to study the power consumption of the SCR (the urea applicator into the catalyst) and calculate the results per unit of fuel. The amount of fuel for the Solaris Trollino 12 trolleybus was estimated and the energy demand found was of the order of 343 kWh/year. This gives low diesel fuel consumption, i.e. only 34.3 litres per year. The study also shows a graph of the daily demand of energy by the SCR system in public transport vehicles.

Spółki komunalne prowadzą działalność mającą na celu zaspokajanie potrzeb mieszkańców i lokalnych przedsiębiorców m.in. w zakresie wody i ścieków, odpadów komunalnych, komunikacji, budownictwa komunalnego, energii cieplnej. Oznacza to, że wpływają w istotny sposób na jakość życia i prowadzenia działalności gospodarczej. Natomiast ocena kondycji spółek i działalności zarządów dokonywana jest w dużym stopniu na podstawie kryteriów ekonomicznych, odpowiednich dla podmiotów działających na konkurencyjnym rynku, nie realizujących zadań z zakresu użyteczności publicznej. Rozbieżność pomiędzy celami społecznymi spółek komunalnych a oceną ich działalności za pomocą kryteriów ekonomicznych wpływa w istotny sposób na jakość zarządzania i efektywność tych podmiotów. Celem artykułu jest identyfikacja dylematów organów właścicielskich i zarządów spółek komunalnych oraz wskazanie sposobu postępowania, który może ograniczyć negatywne skutki wynikające z tych rozbieżności.
Municipal companies execute the activities aimed to satisfy the needs of residents and local businesses, f.ex. in terms of water usage and sewages, household waste, transport, municipal construction and thermal energy. It confirms that they significantly affect the quality of life and business. Whereas the assessment of the condition of companies and activities of the management board is made largely basing on the economic criteria, relevant for entities functioning in the competitive market, not realizing the public tasks. The discrepancy between the social objectives of municipal companies and the assessment of their activities by using economic criteria, significantly affect the quality of the management and efficiency of these entities. This article aims to identify the ownerships and management of municipal companies dilemmas and suggests the procedures that can reduce the negative effects resulting of these differences.

The main objective of this article is to determine the effectiveness of enterprises providing municipal services and a model approach for processes related to the provision of local public transport services in Poland. In particular, the identification included methods of organisation and implementation of public utility tasks as well as organisational and legal forms and forms of ownership in the case of local collective transport. An attempt has been made to determine the effectiveness of enterprises providing urban transport services in cities in Poland, assessing their operational, financial, technical and social effectiveness. The research design and methods used in this article are based on the assessment of the effectiveness of enterprises using taxonomic methods of grouping e ntities according to selected characteristics and efficiency measures. The use of the k-means method with the number of clusters determined on the basis of the hierarchical Ward method, in which the contribution of variables to the differentiation of clusters was determined on the basis of a one-way analysis of ANOVA variance, to obtain groups of companies with similar efficiency indicators. The findings, based on the conducted research, present the relationship between the economic efficiency of public transport companies and their organisational and legal form as well as the type of ownership. Recommendations from empirical studies indicate that public enterprises operating in the field of municipal services provide public utility services with a higher level of economic efficiency than other distinctive groups of carriers. The added value is that the research methods presented in this work can be successfully applied to other sectors of the economy and other countries in order to verify the effectiveness of individual organizational, legal and ownership forms of enterprises.

Omówiono m. in. podstawowe regulacje dotyczące wymogów, które muszą spełnić kandydaci na członków rad nadzorczych oraz wynagradzania osób już powołanych.Artykuł zwraca uwagę również na kontrowersje powstałe w związku z nowelizacją ustawy o zasadach zarządzania mieniem państwowym, m. in. dotyczące zasady „jedna osoba na jedną radę”.
The article presents an analysis of basic legal acts in the field of companies with the participation of local authorities, focusing mainly on the subject of supervisory boards established in them. In addition to the basic elements, such as the number of members, the duration of their term, obligatory of appointment, the human factor in them is particularly emphasized. It presents, among others, basic regulations concerning the requirements that candidates for members of supervisory boards have to complete and the remuneration of persons already appointed.The article also presents the controversies arising in connection with the amendment to the Act on the management of state property, including the principle of "one person per one supervisory board".

Objectives: This paper aims to address a problem that includes the managing of the municipal economy by local government units (LGUs). The research issue raised regarded, in particular, the rules and organisational-legal norms for managing a municipal economy. Its expression is the posed hypothesis according to which what matters significantly for LGUs in the choice of form for conducting a municipal economy is both the character of the task as well as whether this form is recognised as a subject of the public finances sector, and, what follows, whether its indebtedness is subject to statutory restrictions and influences the financial situation of LGUs. Research Design & Methods: To verify a hypothesis formulated in such a way, firstly theoretical and legal aspects of managing a municipal economy by LGUs have been put forward. Next a comparative analysis for forms of managing a municipal economy by LGUs was conducted, i.e. a local self-government budgetary establishment and a municipal company, and the most significant characteristics of the discussed forms, as well as their effects being a result of their choice by LGUs, were indicated. Comparative and descriptive analysis has been used in this paper; it included analysis of financial data regarding the management of a municipal economy by LGUs, but in strict correlation with institutional and legal conditions for the realisation of public tasks and their conditioning. Findings: As a result of the research conducted, it has been concluded that changes taking place in the scope of forms of managing a municipal economy point towards more and more common tasks realised by LGUs both in the field of public utility as well as outside of the public utility zone in the form of commercial law companies. Contribution: Basic kinds of risks associated with the realisation of tasks by the budgetary establishment and municipal company have also been defined. Moreover, research results show that possibilities for such a wide operation result first and foremost from imprecise legal regulations, which are at the same time the only source of risk associated with the operation of such companies.

Objectives: Services provided in the general economic interest constitute a fairly significant research field with regard to public management, involving different local governing tasks, including municipal waste management. Full management of municipal waste services is carried out by individual municipalities (from July 2013 onwards), therefore the purpose of the article is pinpointing the municipal waste management providers (Municipally Owned Companies) in Polish provincial cities, including those using the in-house model. Research Design & Methods: The process of identifying the entities engaged in waste management as municipally owned companies (referred hereafter as “MOCs”) is preceded by a theoretical analysis of the peculiarities of municipal waste and municipal waste management, both of which are regarded as crucial and having imminent economic and social consequences. During that theoretical analysis the authors applied the European Union hierarchy on waste management in establishing the following waste management criteria: achieving of a specified rate of recovery and recycling; standardisation of the magnitude and structure of waste flows directed to incineration plants and landfill; and comprehensiveness of the waste management system. Findings: It has been established that MOCs (including those operating via in-house orders) are the principal type of entities which provide municipal waste management services in the cities included in the analysis. Implications / Recommendations: The article shows a clear need for further research on the efficiency of MOCs regarding the provision and performance of public utility services and tasks. Contribution / Value Added: The conducted research provides evidence supporting the statement that municipal waste management is performed mostly by MOCs, which are entrusted with public utility tasks through tender procedures or, more frequently, via in-house orders. Such entities co-operate with the private sector, with private sector firms often owning specialised installations.

Warunki pracy kierowców mają bezpośredni wpływ na bezpieczeństwo realizowanych zadań. Szczególnie zauważalne jest to na terenach zurbanizowanych na których występuje zwiększone natężenie ruchu oraz pewne ograniczenia wynikające ze stanu infrastruktury. Wśród czynników wywołujących zmiany zachowań kierowców są czynniki antropotechniczne wynikające z działań ludzi usytuowanych w pojeździe oraz jego otoczeniu, zewnętrzne wynikające z oddziaływania warunków atmosferycznych jak również stanu infrastruktury i robocze wynikające z funkcjonowania środka transportu. W pracy podjęto próbę identyfikacji i oceny wpływu czynników zewnętrznych i antropotechnicznych na bezpieczeństwo realizowanego procesu transportowego.
The working conditions of drivers have a direct impact on the safety of the tasks being performed. It is particularly noticeable in urban areas with increased traffic and certain limitations resulting from the condition of the infrastructure. Among the factors causing changes in drivers' behavior are the anthropotechnical factors resulting from the actions of people in the vehicle and its surroundings, external ones resulting from the impact of weather conditions as well as the condition of the infrastructure and work resulting from the operation of the means of transport. Opis:
The text discusses the installation of gas lighting in the urban space of Lviv, together with the construction and later modernisations of the city’s gasworks. The history of gas industry in Lviv is characterised by social and economic phenomena similar to those of other Austro-Hungarian and German cities (conflicts between the investor, municipal government, and gas consumers, communalisation of the gasworks). What distinguishes the gas supply system of Lviv from those of other cities was the use of non-standard resources to gas production (wood, and then petroleum oils), and a relatively late rise in production (after 1898), resulting from the increased availability of gas to both the city, and private users.
Tekst omawia proces instalowania w przestrzeni miejskiej Lwowa oświetlenia gazowego oraz budowę i późniejsze modernizacje gazowni. Historię przemysłu gazowniczego we Lwowie charakteryzują podobne zjawiska społeczne i gospodarcze jak w przypadku innych miast austro-węgierskich i niemieckich (konflikty inwestora z miejskim samorządem i odbiorcami gazu, komunalizacja gazowni). Lwowskie gazownictwo na tle innych miast wyróżnia użycie nietypowych surowców do produkcji gazu (drewna, a później olejów naftowych) oraz stosunkowo późno występujący wzrost produkcji (po 1898 r.), będący skutkiem większej dostępności gazu zarówno dla miasta, jak i prywatnych odbiorców. The text discusses the installation of gas lighting in the urban space of Lviv, together with the construction and later modernisations of the city’s gasworks. The provisions of the new salary cap act entered into force on 9 September 2016 (Ustawa z dnia 9 czerwca 2016). The new provisions apply to State Treasury Companies and some municipal companies. One of the basic assumptions of the act is the obligatory enforcement of management objectives in companies by the owners. The variable part of management salaries will depend on the degree of completion of individual objectives. In the first part, the article presents the results of studies of the texts of owner regulations concerning the method of formulating and the type of management objectives in municipal companies. The second part includes the author’s considerations concerning possible economic and social effects of the implementation of management objectives in companies. In the conclusions, the author attempts to answer a question whether objectives formulated in this manner can actually improve the quality of management of municipal companies?
