Jusqu'au XVIème siècle la législation dans l'Empire éthiopien était principalement fondée sur les règles du droit canonique, les commandements bibliques, et des éléments du droit coutumier. Il a fallu attendre l'apparition du premier écrit code juridique pour voir l’intégration du droit romain et byzantin dans la législation éthiopienne. La codification du droit en Ethiopie, qui a eu lieu dans les années 1924-1933 et 1950-1960, a exigé des codificateurs l’application des législations des pays du monde occidental. Pour la création du code criminel et du code civil, on a utilisé les codes des pays dont la législation s’appuyait sur le droit romano-germanique, aussi bien que ceux des pays dont la législation reposait sur le droit anglo-saxon. Le texte ci-dessous tente de repondre à la question: à quelle famille juridique appartient la législation éthiopienne contemporaine?

The integration of legal systems in European is one of the most important issues. This process has started by the fact that there are significant differences between the civil law and common law system and between the legal families in it. A law (at domestic or international level) should not be viewed against the backdrop of the historical, political, cultural, social and economic context in which they function. In order to shed further light for our readers, we analyze by emphasizing the significant differences between the civil law and common law system on one side and the legal families that are part of the same legal system, either “Civil” or “Common,” on the other side. The Europeanization of law refers to the communization of the law by EU institutions and to a process that aims at creating a common Europe legal system. In the end, either in medium or long term, the Europeanization is contributing to the so-called non-mandatory or soft harmonization of private law. It is in the best interest of the EU to seek adequate judicial instruments to accommodate the massive numbers of laws deriving from different Civil Law and the Common law systems.

The philosophical basis of a legal system is the determinant factor of the content and focus of the legislation and judicial decision emanating from the legal system operating within the society. The focus of every legal system should be the pursuit of a society where men’s ambition is actualise within the purview of accepted norms and values guiding the people within the society. The aim of this paper is to examine the concept of morality and law, the intricate relationship between the two concepts and the moral contents in the Nigeria legal system. The methodology adopted is basically doctrinal with the primary source from various legislation and case laws. The secondary source includes articles in journal, internet sources, bible, etc. The paper concludes that there is no distinction between morality and the law but that the two concepts should be seen as complementary to each other in terms of regulating human behaviours. It is also our conclusion that a critical examination of Nigeria legal system through her legislations and judicial decisions is predicated on the basis that law and morality are two sides of the same coin.

This paper focuses on a highly specialized field of law, namely nuclear law. This is characterized, on the one hand, by strong national competences and the primary position of national law, but also, on the other hand, by the international dimension, which has a major impact on national law. For a European Union Member State, the picture is even more wide-ranging, as European Union law, in this case the Euratom Treaty, adds another important layer to the legal-regulatory framework in the nuclear energy sector. The point of departure for this paper is therefore that of an EU Member State, which in nuclear energy issues functions in a legal field consisting of three interdependent main elements – national law, European Union law and international law. Thus, the article seeks to answer the question of which of these three legal systems is the primary one for an EU Member State in the area of nuclear safety, and also to shed light on their interrelationships. he theoretical framework for this analysis aimed at systematization is Hans Kelsen’s classical theory of legal systems. The argument presented here is that for an EU Member State the primary legal system from a legal-hierarchical point of view is the legal system composed of EU law. This is the case mainly because the EU has competence in the area of nuclear safety, albeit shared with the EU Member States. Although the EU/Euratom has not yet significantly expanded regulation in this field, this will most likely change as EU energy policy and legislation develops further in the future. This evolution will most likely have both legislative and enforcement impacts, despite the fact that the substantive content of legislation on all three levels is quite similar. In spite of this, the three legal systems co-exist in constant interaction and without major collisions. Kelsen’s perspective can prove beneficial for understanding the boundaries of the three interdependent legal systems and the shift of the basic norm towards EU law over the past two decades.

The civil law system entered the codification path during the 19th century, enabling the creation of uniformity, such as drafting a civil code and building a new (national) identity. The structure of the code suggests that it provides a comprehensive, internally coherent set of rules for private law. The adopted civil codes secure lawyers a systematic and coherent foundation for the legal system and legal reasoning. Codification allowed laws to be in an easily identified document easily. Traditionally, the civil law system has been subject to several codification and consolidation processes during different periods in time, influenced from political, social or economic reforms. In Albania after the proclamation of the Monarchy, work began on the preparation of various codes, with the crucial one being the Civil Code. The first Albanian Civil Code entered in force on the 1st of April 1929. This process was the first step for the Albanian Legislator to compare the secularity of the European legal framework to that of the Ottoman Empire. In 1991, the end of the communist era in Albania was marked by bringing the transformation of the economy into a market-oriented system and the creation of a legal system that protected the right of private property. The Albanian system as a continental system has developed a system based on systematic approach to laws, a procedure known as dogmatic approach. It has created an internal system of laws based on generally codified norms and principles. The purpose of this paper is to explain the impact of political, social or economic reforms in the codification process and the nature of legal sources in Albania.

The subject of this article is an analysis of Szymon Rundstein’s theory of a legal norm. In the first part of his study, the author discusses primary trends in the theory of law in inter-war Poland. Indicating that normative concepts had few supporters, the author simultaneously notes that they attracted law practitioners dealing with legal theory. The second part is an attempt at reconstructing Szymon Rundstein’s views on legal theory. Having proposed his methodology, the author analyzes Szymon Rundstein’s statements regarding both a legal norm, a central category in his considerations, and a normative system. In conclusion, it has been pointed out that although Szymon Rundstein takes a very rigorous approach to the normative assumption about the “purity” of the theory of law, he appears to be fascinated with phenomenology and frequently alludes to psychological theories. Specifically, many references alluding to Leon Petrażycki’s tradition can be traced in his writings. Thus, Szymon Rundstein’s theory of a legal norm modifies the normative assumptions of Hans Kelsen and is an original concept that was developed under the influence of many theoretical-legal views. It undoubtedly has a lot to offer and requires „re-reading”.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. On March 18 2014, the Republic of Crimea became a federal subject of the Russian Federation and the Ukrainian legal system was changed to the Russian system. The transition period was set to end on January 1 2015. This transition period was characterized by the fact that the law was created on a day-to-day basis, and as the residents of Crimea were unfamiliar with Russian law they found themselves in a legal vacuum. Laws were adopted in an urgent manner to ensure that the unification was as smooth as possible. In practice it became apparent that the allocated time was not sufficient, and the transition period was extended in some areas. The Article presents a review of the accession procedure and the legal regulations established in the Republic of Crimea during the transition period, and identifies some issues which have arisen.

Both the notion of material monument and the scope of its protection constitutes the youngest theoretical jurisprudential construction. In the Polish legal system, the official issues related to the substantive and incorporeal national heritage, as well as the sphere of the cultural activity are particularly regulated according to the substantive administrative law, the Department of Culture and National Heritage; nevertheless the monuments are of very great importance on the protection of national heritage. On the basis of the law for the Protection and Preservation of Monuments from 23rd July 2003 the notion of monument was not defined in the wide sense invoking the concept of the monument division, which is based upon the primary classification into the material and immaterial monuments. Although the immaterial monument was omitted in the general notion of the monument defined by law, it is visibly shown in the theory of the preservation of historical sites; moreover, it is under protection according to the law. With regard to its subject matter of protection within the frameworks of any movable, immovable and archeological monument, historic relics such as geographical, historical or traditional names of the premises, buildings, streets or settling units may be subject to the protection on the proposal of the legislator. Yet it ought to be indicated that the theory of the preservation of historical sites distinguishes the notion of the immaterial monument and its immaterial value. On the basis of the law in force both the immaterial monuments such as geographical, historical and traditional names and in the framework of preservation of material immobile monuments the immaterial values are pointed as a subject of protection; nevertheless it did not cause to make an attempt to create even the doctrinal definition of immaterial monument. However following P. Dobosz the immaterial monument can be define as unique, historical immaterial values which because of theirs social, artistic or scientific character should be preserve in the name of public policy. Considering the subject of protection the immaterial monuments constitutes: names, immaterial creations of art, traditional manual skills, customs (including manners, ceremonies and rituals) and also traditional functions of mobile and immobile things and moreover literature, music and philosophy. It is necessary to stress that the subject of protection of immaterial monuments in administrative law is determined much wider than the notion of law of immaterial goods in civil law. It concerns both monuments, consider as immaterial products of creative activity of human mind fixed in material form and personal goods and moreover unspecified notion such as traditional manual skills or customs. Polish administrative law includes regulations which are related to immaterial goods which are not taken directly or indirectly under protection as monuments. This group involves: Polish emblem, anthem and flag which are regard as the basis of national identity. On the basis of the law in force there are four forms of protection of monuments: entry in monument register, acknowledgement as a historical monument, creation of cultural park or establishment of protection in local plan of spatial arrangement.

The formation of soviet law in Ukraine was inevitably connected with the spread of soviet power. Along with the soviet institutions, legislative acts of Soviet Union were spread on the territory of Ukraine and replaced the earlier normative acts. The legal system in Ukraine was in fact formed on the basis of the ideological foundations created by the Soviet Union. However, it is a fact that the system of law in Russia after the October Revolution of 1917 did not emerge from scratch, but was built on already existing legal traditions. They are based on three basic sources: German legal tradition, which influenced pre-revolutionary Russian legal culture, Russia’s own legal culture and, of course, official socialist ideology, as well, which provided the legal system with a link to the legal past, which in turn ensured the advancement of the legal system. The legal development of Ukraine during the soviet period was based on the adapting of Ukrainian legal past to the needs of the soviet period. Accordingly, this approach confirms the preservation of the link between the Ukrainian legal past and the present. That means, that the processes that are happening nowadays in the legal system of the modern Ukraine cannot be analyzed without taking into account the initial state of legal institutions that were formed Before and After the soviet period. Therefore, the preservation and analysis of the Ukrainian SSR’s law as a legal heritage of Ukraine will make it possible to ensure progress in the evolution of the modern Ukrainian legal system.

Paper’s aim deals with defining the role of the category of the system both in the essence of the law and in its implementation and interpretation. The course of deliberations starts with the notion of the legal system, being followed by the analysis of basic dimensions of the systemic analysis of law (systematization of the normative acts as well as vertical and horizontal structure of law) and of the role of the systemic (both structural and axiological) rules of the legal interpretation conducted in the process of the application of law. The results of these considerations are then confronted with the various divisions of the legal system, taking especially the position of the administrative law into account.
Opracowanie ma na celu określenie roli kategorii systemu w postrzeganiu istoty prawa oraz jego wykładni i stosowaniu. Stąd, po zasygnalizowaniu kwestii pojęciowo-konstrukcyjnych, przedmiotem analiz stały się podstawowe wymiary systemowości prawa (systematyka aktu normatywnego oraz struktura pionowa i pozioma systemu), które pozwalają na dostrzeżenie roli reguł systemowych w wykładni prawa dokonywanej w procesie decyzyjnym stosowania prawa. Ustalenia co do powyższych zagadnień zostały następnie skonfrontowane z przedmiotowymi podziałami systemu prawa, ze szczególnym uwzględnieniem w jego ramach pozycji prawa administracyjnego.

The purpose of this study is not a detailed analysis of the proposed legal solutions concerning Courts of the peace, especially since at the time of writing this article the legislative process is at an early stage. On November 4, 2021, the Sejm received the draft Act on Magistrates' Courts presented by the President of the Republic of Poland, the first reading of which took place on December 2, 2021, as well as the draft provisions introducing the Act on Magistrates' Courts. The presidential project is not the only one being processed. Despite this, it is worth making a preliminary analysis of the proposed assumptions, as well as possible future objections that may be raised after the adoption of the regulations, because the basic issues are unlikely to change radically. Regardless of this, the study is an attempt to initially determine the possible consequences of introducing the described legal solutions to the legal system for the judiciary.
