    The author analyzes and compares various meanings of the concept of equity such as they were conceived by prominent personalities of the history of the juridical, ethical and philosophical ideas in order to deduct their common contents. Having ethical and juridical connotations, the vision on equity and on applying its principles into the law-making process, into achieved the act of justice and in all kind of public authorities decision-taking process are differently designed at micro-groups level compared to the macro-social layer. The practical achievement of equity and justice is the privilege of the just person. The rightful person’s personality in the contemporary democratic societies may be considered as an ideal prototype which should be found in a larger extent, in the effective functioning of the institutions under the rule of law – at the level of human resources, with as much possible appropriate compliance with this prototype.

    Eugeniusz Bautro (1891–1961) is one of the less known Polish lawyers in the field of theory of law in the pre-war period. He is classified as a representative of a gnoseologistic theory of law, based on Kant’s theory of law. Many other famous lawyers and philosophers, such as E. Husserl, H. Kelsen, A. Merkl, G. del Vecchio, R. Stammler, H. Höffding, B. Bauch and G. Radbruch were connected with this school of philosophy. E. Bautro’s views are an original attempt to create new theory of law. It is based on the ideas such as: linguistics, semantics and others. E. Bautro wrote about legal consciousness as a reminiscence and form of so called „subconscious and shortened thinking”. He used elements of logics, symbolics, universalism to build his theory. According to Kant, he acknowledged spheres of Sein and Sollen and separateness of law and morality. Being under influence of Italian philosopher G. del Vecchio, he analyzed the possibility of application of the critical method in the jurisprudence.

    Eugeniusz Jarra (1881–1973) was a historian of philosophy of law, working on Warsaw University till 1939, then he emigrated to France and subsequently to England. Although he wasn’t a member of Kant’s school of philosophy, but you can find distinct connections with Kant’s philosophy. Jarra was closer to Christian philosophy and to social doctrine of the Catholic Church. He believed that the natural law is a psychical experience and this places him among the representatives of so called gnoseological theories of natural law with changing content. For him the natural law was the internal „voice of equity” and also the ideal pattern of positive law. Eugeniusz Jarra treated natural law as a demand addressed to legislative power and as an element of state’s policy of law. Jarra also saw connections between Kant’s conception of state as „unification of human beings under the power of acts” with his idea of citizens’ unity. The concept of state presented by Jarra, in which citizens’ duties play dominant role, can be close to authoritarian or even totalitarian concept of state. This shows that Jarra was only superficial in sharing Kant’s views.

    Celem artykułu jest analiza pojęcia antynomii idei prawa, które stanowi element siatki pojęciowej filozofii Gustawa Radbrucha. W pierwszej części artykułu analizuję najbardziej szczegółową eksplikację tego pojęcia, którą G. Radbruch zawarł we fragmencie Filozofii Prawa. Wskazuję jakie elementy składają się zdaniem G. Radbrucha na ideę prawa oraz jakie są jego zdaniem źródła ich antynomiczności. Drugą część artykułu poświęcam na ogólną rekonstrukcję pojęcia antynomii poprzez odwołanie do wykorzystanie tego pojęcia w historii filozofii i logiki, a szczególności do jednego z najważniejszych filozoficznych zastosowań antynomii w Krytyce czystego rozumu Immanuela Kanta. Przeprowadzona analiza pozwala na dostrzeżenie specyfiki pojęcia antynomii, którym posługuje się G. Radbruch i dostrzeżenie jego odmienności w porównaniu do antynomii kantowskich. Spojrzenie na antynomie idei prawa z szerszej perspektywy filozoficznej pozwala na krytykę niedoskonałości siatki pojęciowej przyjmowanej przez G. Radbrucha i niezależne od dotychczas występujących w literaturze uzasadnienie ich reinterpretacji.
    The main purpose of the paper is to analyse the notion of antinomies of the idea of law developed in Gustav Radbruch’s philosophy. In the first part of the paper, I analyse the most detailed explication of the notion of antinomy contained in part of Radbruch’s Philosophy of Law. I emphasize which elements, according to Radbruch, constitute the idea of law and what are the sources of their antinomianism. I indicate what elements constitute, in Radbruch's opinion, the idea of law and what, in his opinion, the sources of their antinomianism are. In the second part of the paper, I focus on a general reconstruction of the notion of antinomy. I refer to the use of this notion in the history of philosophy and logic, in particular to one of the most important philosophical uses of antinomy in Immanuel Kant's Critique of Pure Reason. The analysis carried out allows me to recognize the specificity of the notion of antinomy used by Radbruch and to see its distinctiveness in comparison with Kantian antinomies. Looking at the antinomies of the idea of law from a broader philosophical perspective allows me to criticize the inadequacy of the conceptual net adopted by Radbruch, and to justify their reinterpretation independently of what has been discussed in the literature so far.
