Opis:: In Günther Jakobs’ terminology the term “Feindstrafecht” (enemy criminal law) means a special criminal law designed to fight enemies of society. Unlike traditional criminal law, it is not aimed at regular citizens but at those who deny the legal system, e.g. terrorists and organized criminals. The idea of declaring some people to be enemies of the society leads to new legal, political and philosophical questions: Who are these enemies? How can we identify them? Can these enemies be deprived of their human rights? Answers to these questions need to be found, since elements of “Feindstrafrecht” already exist in today’s criminal law.

Opis:: The origin and the first stage of the construction of St. James’ Church in Toruń in the first half of the 14th century St. James’ Church situated in Toruń’s New Market (Rynek Nowomiejski) is a pearl of Gothic architecture. According to the inscription in the presby-tery, its cornerstone was laid by the bishop Herman in 1309. It is likely that the presbytery has not changed significantly over the centuries. On the basis of photographs and drawings one may notice slight differences in the layout of some buttresses found in the presbytery, the construction of which was com-pleted in approximately 1320. It is hard to state whether there was a chapel prior to the erection of the brick church. Many researchers are astonished by the fact that the city established in 1264 did not have its own temple for almost half a century. Unfortunately, no source evidence to confirm the thesis has been found so far. The issue of the original church constructed before the erection of St. James’ Church is not the only issue which is hard to prove. Other questions involve the foundation and the dedication of the church. The question of the foundation splits researchers down the middle: those who sup-port the thesis that the church was founded by burghers and those who main-tain that it was founded by the Teutonic Order. The dedication of the church becomes a controversial issue if we juxtapose two inscriptions from the inside and from the outside of the presbytery, as they probably bear different patron names. Almost every question concerning the church is problematic. Some of 35 them might be explained by archeological research conducted beneath the whole church, which may be undertaken in the future.
Die Entstehungsgeschichte und die erste Phase des Baus der Kir-che des St. Jakobs in Thorn in der ersten Hälfte des vierzehnten Jahrhunderts Die Kirche des St. Jakobs, die sich auf dem Neuen Stadtmarkt befindet, ist ein Juwel der gotischen Architektur. Der Grundstein des Gebäudes, wurde gemäß einer Inschrift, die um den Altarraum herum platziert ist, vom Bischoff Hermann im Jahr 1309 gelegt. Angeblich hat sich das Erscheinungsbild dieses Teils der Kirche nicht viel im Laufe der Jahrhunderte verändert. Basierend auf den Fotografien und Zeichnungen findet man nur sehr geringe Unterschiede im Verlauf einiger Dienstbündel, die sich in der Kirche befinden. Der Bau des Altarraums wurde ca. 1320 zu Ende geführt. Schwer nachweisbar ist, ob vor dem Bau einer Backsteinkirche an dieser Stelle wenigstens eine Kapelle exis-tierte. Viele Forscher sind überrascht, dass die Stadt, die seit dem Jahr 1264 existierte, keine eigene Kirche über fast ein halbes Jahrhundert besaß. So entstand das Konzept einer früheren Holzkirche, die an der Stelle der heutigen Kirche stehen sollte. Leider gibt es keine Beweise für diese These. Die Frage nach der früheren Kirche ist nicht die einzige, die schwer beweisbar ist. Die nächsten Fragen betreffen die Finanzierung und den Schutzheiligen der Kir-che. Das Problem der Finanzierung der Kirche teilt die Forscher in zwei Gruppen auf: die einen sprechen von der Finanzierung durch das Bürgertum, die anderen von der Finanzierung durch den Deutschen Orden. Der Schutzhei-lige, bleibt aber der Streitfall, wenn wir zwei Inschriften, die bis heute erhalten sind, vergleichen: die aus dem Inneren des Altersraums und die, die außerhalb des Altarraums platziert ist, weil wahrscheinlich auf diesen zwei Inschriften zwei verschiedene Schutzheilige der Kirche genannten wurden. Fast jeder Streitfall im Falle der Kirche ist sehr problematisch. Einige von ihnen könn-ten durch archäologische Forschungen im Rahmen des gesamten Tempels gelöst werden, aber das ist etwas, was erst in der Zukunft geschehen wird.
