Opis:
The article contains an analysis of premises of acquiring uniform direct payments, with special emphasis on the regulations concerning the demand for possessing agricultural lands (covered by the motion for the admission of payment). The aim of the authors’ deliberations is to determine what meanings the notion „possession” is used in the regulations. The legislator of these regulations does not define the term „possession”, referring instead to the definition contained in the civil code. Yet, to satisfy the demand for possessing agricultural lands, additional premises are to be fulfilled. Legal regulations concerning payments introduce a kind of a qualified possession consisting in actual agricultural usage of lands. The article points to some terminological problems on the private–public law border, reflected in judicial decisions. Legal character of payments indicates that direct payments belong to a public–legal sphere, whereas the legislator uses private law notions to define premises of acquiring the right to them.

The axiological notions and assumptions are the necessary part of the analysis the application of law. Author of this article states the most basic axiological question, that is: how should a judicial decision be made? How should a court issue decisions, on what values should it be based, what is and what should be the aim of a decision? The research proposal to these questions is: equity, the equity of the decisions, equity in concreto. Characterizing the axiological bases of the application of law, one need to find a way which would take us to the best resolution. The court and the judge solve, after all, a certain case that exists in reality, and do not present alternative possibilities of choice. The court, while making a decision, makes a choice which should be driven by equity. After all, can we find any other values that would light our way? The judge should strive to find an equitable resolution, they should search for it and not reject it a priori. Justice should be treated as the pillar of equity, but equity is richer and greater.
W artykule zostało podjęte zagadnienie aksjologicznych podstaw stosowania prawa w perspektywie prawa słusznego. Podstawy takie powinny być jasne, pewne, solidne, trwałe i takie daje właśnie teoria prawa słusznego. W opracowaniu wyjaśniono rozumienie prawa słusznego i wartości je fundujących, a są nimi: prawda, dobro, sprawiedliwość, godność człowieka. Wartości te są aksjologicznymi podstawami bytu prawa, tj. wartościami leżącymi u źródeł procesów tworzenia prawa, ale w istocie są też (powinny być) zasadniczymi, podstawowymi wartościami stosowania prawa. W procesach stosowania prawa rola słuszności wiąże się z wymogiem wydania właściwego, godziwego orzeczenia. Sądy w stosowaniu prawa dysponują sporym zakresem/marginesem swobody. Jego wykorzystanie powinno dokonywać się ze „wzrokiem skierowanym na słuszność”, bowiem ustalone w decyzji finalnej skutki prawne dotyczą zawsze człowieka (bezpośrednio czy pośrednio). Rola słuszności może wiązać się z „udoskonaleniem prawa” w sensie jego praktycznej konkretyzacji. Kategoria ta, gdy zachodzi taka konieczność, może być także narzędziem naprawiania, poprawiania prawa, pozwala sprzeciwić się, wyjść poza posłuszeństwo ustawom, słuszność bowiem nie dozwala na podjęcie decyzji niesprawiedliwej. Słuszność spełnia też funkcję korektury stanowionego prawa, niwelującej napięcia między ogólnym charakterem prawa a indywidualnym charakterem przypadków, mogącej też wypełniać luki w prawie. Słuszność w stosowaniu prawa jest zatem wartością korygującą – naprawiającą, udoskonalającą, uzupełniającą prawo i jednocześnie dopełniającą sprawiedliwość. W opracowaniu, w oparciu o model decyzyjny sądowego stosowania prawa, zostały ponadto przedstawione sposoby dochodzenia do decyzji słusznej. Sformułowano też pogląd o możliwości podjęcia jedynej słusznej decyzji. W konkluzji rozważań stwierdzono, iż wartości budujące słuszność, stanowiące zarazem aksjologiczne podstawy stosowania prawa, przeciwstawiają się arbitralności ocen i decyzji sędziowskich.

In the literature and jurisprudence there are distinguished two opposite principles ruling over revealing the truth: a material truth principle (objective) and a formal truth principle (procedural). In the proceedings based on the material truth principle, judicial decisions in the matter of the actual state should reflect the reality. The judge aims to clarify all circumstances essential to solve a case in order to reveal a really existing legal relation bounding both parties to litigation. On the other hand, in proceedings based on the formal truth principle, judicial decisions in the matter of the actual state should only reflect the factual material and evidence gathered by the parties. In the study there is presented an evolution of norms and doctrinal opinions in the matter of the endeavor to establish the truth in civil proceedings connected with amendments to the Civil Procedure Code in 1996, 2000, 2005 and 2012.

The liability of Member States for damages caused by the issuance of a judicial decision in breach of EU law has been shaped in the jurisprudence of the CJEU, as a mechanism to ensure effective legal protection of EU citizens. Its primary purpose is to ensure that in a situation where a court of a Member State causes damage to a citizen by violating EU laws by its ruling, the citizen has a legal remedy to obtain compensation for such a violation. Based on the principle of procedural autonomy of the Member States, such claims can be asserted on the grounds of national procedural rules under the substantive legal grounds laid down by the CJEU in its case law.Research conducted by the authors of the article indicates that despite more than 18 years of Poland’s presence in the European Union, it is extremely difficult to find rulings on liability for damages for breach of EU law by Polish courts. It seems that such a state of affairs may be caused by ambiguities and interpretative doubts that arise on the grounds of Polish procedure in the case of claims for damages for breach of EU law by the courts. Both in the doctrine and case law there are far-reaching divergences as to whether the pre-judgment provided for in the Polish Civil Code should apply to claims for breach of EU law, and if so, when it should be applied. These doubts are reflected in the scant judicial case law on the issue in question. It seems that the indicated procedural doubts and lack of clarity as to the proper procedure in pursuing such claims may deter parties from more frequent initiation of proceedings to obtain compensation for breach of EU law by a national courts in the Polish context.

The article is devoted to the institution of review of court`s decisions on newly discovered or exceptional circumstances, which is considered as a mechanism to ensure the right of everyone to a fair trial. The key features of the institution of review of court decisions on newly discovered or exceptional circumstances, which distinguishes such review from the review by courts of higher instances are considered, such as aim, object and subjects of review. In particular, it was determined that the object of review may be court decisions that have entered into force and which have completed the proceedings; the subject of review is the court of the instance that made the decision, for review of which the applicant requests; the grounds for review may be only the grounds defined by law as newly discovered or exceptional circumstances, and decisions are reviewed not on the subject of judicial error, but in connection with the identification of the outlined circumstances. The general characteristic of the procedure of review of court decisions on newly discovered or exceptional circumstances in the civil process of Ukraine is given.

Traditional philosophical tension between a reason and emotions has been a subject of increasing objections. As a result emotions are defended by pointing their connections with beliefs, value judgments to name just a few strategies. This paper also takes up an attempt of this sort showing that traditional definition of emotions with features of the process of application of law makes a threat from the emotions for the impartiality of a judge much less warranted than it might seem. What is more, an attempt is taken up to argue that feeling can be a chance for impartiality conceived as argumentative openness.

W glosie autor akceptuje trafność tezy, iż kasacja wnoszona przez strony może dotyczyć tylko orzeczenia sądu odwoławczego, a nie orzeczenia sądu pierwszej instancji. To w konsekwencji oznacza, iż można podnieść w niej, wobec orzeczenia sądu ad quem, zarzuty obrazy art. 439 k.p.k. lub innego rażącego naruszenia prawa (art. 523 § 1 k.p.k.), jeżeli mogło ono mieć istotny wpływ na treść orzeczenia. Autor polemizuje natomiast ze stanowiskiem Sądu Najwyższego, wyrażonym w uzasadnieniu wyroku z dnia 9 kwietnia 2015 r., V KK 360/14, iż sformułowany w kasacji zarzut obrazy art. 424 § 1 i 2 k.p.k. w zw. z art. 457 § 3 k.p.k. i art. 6 k.p.k. mógł spowodować uchylenie wyroków sądów ad quem i a quo, skoro dotyczy on wadliwie sporządzonego uzasadnienia wyroku sądu meriti, a nie sądu odwoławczego, i nie był podnoszony w apelacji, wobec tego sąd odwoławczy nie był obowiązany zająć stanowiska w kwestii dotyczącej wadliwości uzasadnienia wyroku sądu pierwszej instancji, gdyż nie miała ona wpływu na treść orzeczenia.
The author of the gloss approves of the aptness of the thesis that cassation appeal may be filed by parties only against the decision of an appellate court and not the decision of a court of the first instance. As a result, it means that it can be filed against the ruling of a court ad quem on the grounds of the contempt of Article 439 of the CPC or any other flagrant breach of law (Article 523 § 1 of the CPC) if it might have a significant effect on the contents of judgement. However, the author argues with the Supreme Court about its stand expressed in the justification of a sentence of 9 April 2015, V KK 360/14, that the charge of contempt of Article 424 § 1 and 2 of the CPC in connection with Article 457 § 3 of the CPC and Article 6 of the CPC formulated in the cassation appeal might result in waiving sentences rendered by the courts ad quem and a quo as it concerns a defective justification of a sentence rendered by a court meriti and not an appellate court, and was not appealed against, thus an appellate court was not obliged to adjudicate on the defectiveness of the sentence justification of the court of the first instance because this had no influence on the contents of the judgement.

The article has been thought as a contribution to the discussion on comprehension of truth within the framework of the domestic jurisprudence. The author, describing philosophical and theoretical assumptions with respect to positivism epistemology indicates - basing on the sources presented in this article - the transformations to which the concept of the so-called ‘objective truth’ was subject and the extent to which various political and social factors influenced the concept mentioned. As he concludes complexity and dynamics concerning transformations of the domestic legal culture, as well as conflicts between the written law and the practice are disclosed in lawyers’ attitude to the truth.

Zgodnie z kodeksową regulacją właściciel nieruchomości powinien przy wykonywaniu swojego prawa powstrzymać się od działań, które by zakłócały korzystanie z nieruchomości sąsiednich ponad przeciętną miarę, wynikającą ze społeczno-gospodarczego przeznaczenia nieruchomości i stosunków miejscowych. Przesłanki warunkujące dopuszczalność bądź niedopuszczalność określonych immisji pośrednich zostały ujęte w formy klauzul generalnych. Dopiero w oparciu o analizę bogatego orzecznictwa sądowego można dokonać właściwej interpretacji omawianej instytucji. Przedmiotem regulacji art. 144 k.c. są zarówno immisje materialne, jak i immisje niematerialne, polegające na oddziaływaniu na sferę psychiki właściciela nieruchomości sąsiedniej. Sam fakt występowania immisji nie jest jednak wystarczający dla domagania się ochrony na podstawie art. 144 k.c. Konieczne jest jeszcze, aby immisja przekraczała przeciętną miarę, wynikającą ze społeczno-gospodarczego przeznaczenia nieruchomości i stosunków miejscowych. Ocena przeciętnej miary powinna być dokonana jednak na podstawie obiektywnych warunków, a nie na podstawie subiektywnych odczuć właścicieli nieruchomości. Winna ona uwzględniać m.in. przeznaczenie obu nieruchomości, częstotliwość zakłóceń, ich porę i intensywność. W przypadku wystąpienia immisji, o których mowa w art. 144 k.c., właścicielowi nieruchomości sąsiedniej przysługuje roszczenie o zakazanie immisji i przywrócenia stanu zgodnego z prawem. W praktyce często może dochodzić do zbiegu roszczenia z art. 144 k.c. z roszczeniem odszkodowawczym w oparciu o art. 415 k.c. czy roszczeniem o ochronę dóbr osobistych na podstawie art. 24 k.c. W pierwszym przypadku domaganie się zaniechania immisji nie wyłącza równoczesnego dochodzenia stosownego odszkodowania. W drugim przypadku wybór odpowiedniego żądania przysługuje stronie poszkodowanej.
According to the code regulation, the owner of the property, while exercising his rights, should refrain from activities that would disrupt the use of properties in the neighourhood beyond the average measure that comes from the socio-economic destination of real estate and local relations. Reasons determining the admissibility or inadmissibility of certain indirect immissions are presented in the form of general clauses. The proper interpretation of the issue can be made only on the basis of the analysis of the rich court jurisprudence in this matter. The art. 144 of civil code regulates the subject, both material and immaterial immunities that influence the psychic sphere of the neighbourhood property owner. However, the mere fact of occurrence of immission is not sufficient to claim protection under art. 144 civil code. It is also necessary that the immission should exceed the average measure resulting from the socio-economic destination of real estate and local relations. The assessment of the average measurement should be made on the basis of objective conditions and not on the basis of subjective feelings of the property owners. It should take into account, among others the purpose of both properties, frequency of disturbances, their time and intensity. In the case of occurrence of the immission referred to in 144 k.c., the owner of the neighbouring property has the right to prohibit the immission and restore the lawful state. In practice, there is the possibility of overlapping of a claim under art. 144 civil code with a compensation claim based on art. 415 civil code or a claim for the protection of personal rights according to art. 24 civil code. In the first case, the demand to stop the immission does not exclude the simultaneous seeking of appropriate compensation. In the second case, the injured party is entitled to choose the right request.

Opis:
The recent development of artificial intelligence (AI) in information technology (IT) is remarkable. These developments have led to claims that AI can be used in courts to replace judges. In the article, the author addresses a matrix of these issues using the concept of explainable AI (XAI). The article examines how regulation can ensure that AI is ethical, and how this ethicality is closely related to (XAI). It concludes that, in the current context, the contribution of AI to the decision-making process is limited by the lack of sufficient explainability and interpretability of AI, although these aspects are adequately addressed and discussed. In addition, it is crucial to consider the impact of AI’s contribution on the legal authority that forms the foundation of the justice system, and a possible approach is suggested to consider conducting an experimental study as AI arbitration.
Niedawny rozwój sztucznej inteligencji w technologii informacyjnej jest niezwykły. Zmiany te doprowadziły do twierdzeń, że sztuczna inteligencja może być wykorzystywana w sądach do zastępowania sędziów. W artykule autor odnosi się do sedna tych problemów, używając koncepcji interpretowalnej sztucznej inteligencji (XAI – Explainable Artificial Intelligence). Analizie poddano to, w jaki sposób regulacja może zapewnić, że sztuczna inteligencja będzie etyczna, a także w jaki sposób ta etyczność jest ściśle powiązana z XAI. Stwierdzono, że obecnie wkład sztucznej inteligencji w proces decyzyjny jest ograniczony przez brak wystarczającej możliwości jej wyjaśnienia i interpretacji, chociaż aspekty te są odpowiednio uwzględnione i omówione. Ponadto kluczowe jest rozważenie wpływu sztucznej inteligencji na autorytet prawny, który stanowi podstawę wymiaru sprawiedliwości. Zasugerowano przy tym rozważenie przeprowadzenia badania eksperymentalnego polegającego na włączeniu sztucznej inteligencji do procesu arbitrażowego.

Niniejszy artykuł ma na celu poruszenie problematyki filozofii prawa i jej wpływu na kształtowanie decyzji sędziowskiej na tle filozofii Gustava Radbrucha. Niejednokrotnie w sposób nieświadomy to przyjmowana przez sędziego postawa filozoficzna wobec prawa determinuje sposób wykładni norm, co wpływa na decyzję finalną. Poprzez analizę filozofii Gustava Radbrucha i zestawienie jej z poglądami Hansa Kelsena dowiedzione zostanie, że poglądy filozoficzne sędziów nie pozostają bez znaczenia dla decyzji sędziowskiej. Do uwidocznienia wspomnianego problemu zostanie wykorzystana analiza artykułu Lona Fullera „sprawa grotołazów”. Posłuży ona do przedstawienia zależności między przyjmowaniem pozytywistycznego paradygmatu a wykładnią formalistyczną, a także paradygmatów realistycznych lub prawonaturalnych a wykładnią antyformalistyczną.  Zatem aby wykazać, że filozofia prawa jest czynnikiem wpływającym na decyzję sędziowską podjęte zostaną dwa zasadnicze problemy – przemiany myśli filozoficzno-prawnej pod wpływem wydarzeń historycznych oraz korespondencja między filozofią prawa a sposobem prowadzenia wykładni przez sędziów.
This article aims to discuss the influence that personal views on philosophy of law held by individual judges exerts on their judicial decisions in a connection with philosophy of Gustav Radbruch. Commonly, the subconscious philosophical position held by the judge towards the law determines the statutory interpretation and, thus, the final decision. Through the juxtaposition of Gustav Radbruch’s and Hans Kelsen’s schools of thinking, it is proven that philosophical outlook of the judges is very much relevant for the process of making judicial decisions. Lon Fuller’s notorious article “The Case of Speluncean Explorers” is used to illustrate the problem and demonstrate the causality between accepting the positivistic paradigm and the preference for formalistic interpretation of the law and, conversely, between the adherence to legal realism or naturalism and the preference for antiformalistic interpretation.  Therefore, two key issues are introduced to prove the significance of philosophy of law for judicial decisions: the developments in philosophical and legal thought under the influence of law held by particular judges. historical events and the relationship between statutory interpretation and views on philosophy of law held by particular judges. historical events and the relationship between statutory interpretation and views on philosophy of

W 2008 r. Islandia stała się jedną z pierwszych ofiar rozwijającego się kryzysu finansowego. Dodatkowo w jej przypadku kryzys miał wyjątkowo gwałtowny przebieg i niósł ze sobą szereg negatywnych skutków nie tylko o charakterze ekonomicznym, ale także społecznym i politycznym. [...] Na bazie tych doświadczeń doszło również do sporu dotyczącego wydawałoby się kwestii wcześniej niebudzącej większych wątpliwości i emocji, a mianowicie zakresu definicji depozytu w prawie islandzkim. W wyniku specyfiki rozwiązań prawnych Porozumienia o Europejskim Obszarze Gospodarczym oraz wskutek obowiązywania dyrektywy 94/19/WE, a także sposobu jej implementacji do prawa islandzkiego kwestia ta została przeniesiona na grunt prawa europejskiego w drodze pytania prejudycjalnego skierowanego do Trybunału Europejskiego Stowarzyszenia o Wolnym Handlu.
The definition of a deposit under Directive 94/19/EC has been perceived as a non-controversial issue. Also during the ongoing work on the revision of the aforementioned directive much more focus has been put on issues concerning the target level of the DGS fund or the reimbursement period. However, under the stressed conditions of the Icelandic crisis, this matter sparked a dispute of significant economic importance. Court proceedings in the case Aresbank S.A. vs. NBI hf., Fjármálaeftirlitid and Iceland have become a major test for both the Icelandic judiciary and the legal system of the European Economic Area. It is also one of the few cases of judicial review of provisions of Directive 94/19/EC. The case of Iceland indicates that bank restructuring is inevitably related to substantial legal uncertainty arising from the discretion of the national authorities, which are susceptible to political and social influence.
