This article is devoted to current practices concerning the application of general principles of law in the light of their function in the international legal system. As a means of the application and interpretation of both treaty and customary law, general principles of law perform a crucial function in the system of international law, which is understood as set of interrelated rules and principles – norms. Te role played by general principles of law in the international legal order has been discussed by academia for years now. Initially they were used to ensure the completeness of the system of international law. However, at the current stage of development of international law, when many of them have been codified, they are usually invoked by international courts for the interpretation of treaties and customary law and/or the determination of their scope. This means that despite their ongoing codifcation they do not lose their character as general principles and are still applied by international courts in the process of judicial argumentation and the interpretation of other norms to which they are pertinent. References by international courts to general principles of law perform the allimportant function of maintaining the coherence of the international legal order, which is faced with the twin challenges of fragmentation and the proliferation of international courts.

The main assumption behind this study is that the relationship between language and international law is particularly interesting due to the complexity and special nature of this relationship when compared to national law. The author focuses on some selected issues connected with the fact that from the legal point of view the multiplicity of languages in international law is an important factor affecting its interpretation. Due to this, apart from the issue of the dominant position of the English language in international law, the major focus of the study is on the specific problems associated with the interpretation of international treaties. The study suggests that there are certain intrinsic tensions and contradictions involved in the relationship between language and international law. The dominant position of English language in international law is at odds with the principle of sovereign equality laid down in the UN Charter, which entails equal opportunities for all nations to participate in the global legal discourse. Moreover, the interpretation of plurilingual treaties involves significant problems when it comes to the interpretation of authentic texts made in various languages, which need to be reconciled. In turn, the tensions between the meaning of terms used in international legal norms and their corresponding meaning in national legislation are addressed through the use of the autonomous method of interpretation. Moreover, considering the growing importance of the legitimacy of international law, the role of the language of international law in this context is also considered. The problems related to the problems of language in the context of international law outlined in this study confirm the need for further continuous and in-depth research in this field.

This article deals with the question of demilitarization and neutralization of the ?land Islands in respect to international law regulating this issue. In this paper it was not intented to go into details of all historical phases and changes of the ?land's status, but rather to concentrate on international treaties regulating this question, which are still in force. ?land is an autonomous, demilitarized and neutralized region of Finland with a largely Swedish-speaking population. The ?land Islands form an archipelago in the Baltic Sea. They are situated in the entrance to the Gulf of Bothnia. Its legislative autonomy and a strong protection for its population's Swedish language and culture are enshrined in the Finnish constitution. The ?land Islands are located in a very strategically important place. There are three problems under international law connected with the ?land Islands: that is to say, demilitarization, neutralization and autonomy of ?land. After the Crimean war it was decided that Russia should not fortify the ?land Islands. The strategic position was one of the factors that influenced the decision of the Paris Peace Conference in 1856 to demilitarize the ?land Islands. After the Crimean War (1854-56) an appendix to the 1856 Treaty of Paris forbade Russia from establishing fortifications, maintaining or building up a military presence and naval forces on the islands. In 1917 Finland gained independence from Russia and ?land became for a number of years a source of controversy or even conflict between Finland and Sweden as a result of the ?landers' demand for ?land's reunification with Sweden. In 1921 the League of Nations resolved the ?land question. ?land remained a part of Finland but gained autonomy along with the historically rooted principles of neutrality and demilitarization. In October 1921 the Convention relating to the non-fortification and Neutralization of the ?land Islands was signed by Denmark, Estonia, Finland, France, Germany, Italy, Latvia, Poland, Sweden and the United Kingdom. The Western powers did not regard Bolshevik Russia as a sovereign state after the revolution of 1917 and Russia (the Soviet Union) was not a party to this convention. The treaties that regulatedthe demilitarization and neutralization were: 1) the 1856 Convention on the Demilitarisation of the ?land Islands (annexed to the 1856 Paris Peace Treaty), 2) the 1921 Convention on the Demilitarization and Neutralization of the ?land Islands, 3) bilateral treaty of 1940 between Finland and Russia (the Soviet Union) on the demilitarization of the ?land Islands and 4) the 1947 Paris Peace Treaty. There is no cause to doubt the continuance in force of the demilitarization and neutralization of ?land. The treaties and agreements of 1921,1940 and 1947 are still in force. ?land's demilitarization and neutralization remain beyond question, despite the changes in the political context. The ?land Islands are both demilitarized and neutralized, the main purpose is to keep it completely outside the armed actions of armed conflicts. ?land's status received renewed attention in the 1990s in view of the changes taking place in Europe. The 1994 treaty on Finland's accession to the EU recognizes in its Protocol No. 2, that the ?land Islands enjoy a special status under international law. Furthermore, another legal regulation dealing with this question is the Additional Protocol I to the 1949 Geneva Convention on the protection of war victims (Article 60) obligates States Parties to respect demilitarized zones during international armed conflicts. ?land's demilitarized and neutralized status has a strong foundation and position in the international law. Some experts and writers have described this status as a example of a "permanent settlement" or "objective regime" in international law. According to another experts (H. Rotkirch), the special status of the ?land Islands is of such long standing " that it has without doubt become part of customary international law and is thus binding on the international community as a whole". Since 1970, ?land has had its own representation in the Nordic Council and participates in the work of the Nordic Council of Ministers. Since 1989, ?land is a member of the Council of Europe. One might also mention the fact that, ?land stands outside the EU tax union and has retained the limitations on ownership of land and operation of business.

The extension of international instruments in the field of human rights to embrace a bioethical perspective constitutes a response from international organisations to the social consequences of the development of genetics. These initiatives led in turn to the formation of universal norms of a declarative nature, as well as legally binding norms for the states of the Council of Europe. The author focuses on the basic principles of: the Universal Declaration on the Human Genome and Human Rights, the International Declaration on Human Genetic Data, the Universal Declaration on Bioethics and the Human Rights United Nations Declaration on Human Cloning, and the Convention on Human Rights and Biomedicine – presenting the foundations of international bioethics law with regard to the social consequences of the development of genetics.

Among the kinds of CB Weapons, the chemical one might be considered as the one with the longest history of widespread warfare applicability, whereas the biological one as the developed problem of the recent two centuries but also having its roots in ancient eras. The consequences of the usage of CBs are acknowledged by the international conventions dealing with the CB phenomenon. Although the provisions provide solutions and declarations of the minimised usage of CB weapons as the method of warfare and the limited laboratory testing in accordance to the sake of all mankind, the problem still exists. Nowadays, it is especially discussed after the events of 11.09.2001, which brought about the airborne attack on the the two towers of the World Trade Centre in New York and the proceeding events of the Bacillus anthracis4 intoxication spread across the United States of America.

The Deputies’ Bill on Marital Equality provides for the possibility of marriage between two people regardless of their sex. It introduces the possibility of adopting children by a single-sex couple. It does not regulate matrimonial property relationships. The opinion presents the jurisprudence of the ECtHR and international regulations which indicate that they do not contain a clear and commonly accepted definition of marriage. As a result, it cannot be claimed that the parliamentary draft law breaches, international law.

The article describes the most important international law issues related to the annexation of the Crimea by the Russian Federation. The first part of the text concerns with the infringements of the international law made by Russia (infringement of the principle pacta sunt servanda, the principle of non intervention and the principle of the prohibition of aggression). The second, essential part of the text concerns the inadmissibility of self-determination of people in the case of the Crimea. Russian involvement in the Crimea results the illegality of self-determination in this case. It is also impossible because the case of Crimea does not meet the required conditions. This causes the inadmissibility of the secession of this territory.

The analysis points out that the Crimean peninsula remains an integral part of the territory of Ukraine, as the annexation of the area by the Russian Federation is null and void under the law due to the breach of generally applicable rule of international law concerning the prohibition of aggression. Therefore, only Ukraine is authorized to manage the airspace above the region. In case of any aviation accident in the territory of Crimea, it is not permissible for International Civil Aviation Organization (ICAO) to recognize the competence of Russia in relation to carry out the investigation. Moreover, such recognition cannot ensue from an agreement between Russia and Ukraine, except for the delegation of responsibilities to investigate the accident in which a Russian plane has been involved.

The aim of the article is to provide an overview of the achievements of selected representatives of Poznań studies on international law, whose writings have been published in the previous volumes of the Ruch Prawniczy, Ekonomiczny i Socjologiczny [Journal of Law, Economics and Sociology]: Bohdan Winiarski, Alfons Klafkowski, Krzysztof Skubiszewski, Bolesław Wiewióra, Jan Sandorski, Jerzy Tyranowski, Tadeusz Gadkowski, and Anna Michalska. The article considers a selection of papers representative for the main directions of research conducted by three generations of international lawyers from Poznań's Department of Public International Law. The topics covered are as follows: the relationship between international law and national law, the sources of international law, international river law, international law of armed conflict and international responsibility, the law of international organizations, international protection of human rights, territory and recognition in international law, and nuclear law.

Many modern legal systems declare, that protection of human dignity plays an important role in its construction. Therefore, a question may be asked if the concept of dignity is similar in different legal systems. The following paper presents the results of the research on human dignity concepts in reasoning of national (Polish and German Supreme Courts) and international courts (ICC, ECHR). Both national systems provide a constitutional protection of human dignity, Rome Statute, which constitutes the ICC, prohibits behaviours infringing dignity (model of Geneva Conventions), whereas the European Convention of Human Rights does not include the term “human dignity”, only prohibition of torture or “inhuman or degrading treatment”, what is understood as protection of dignity. On the basis of the research there could be stated, that each legal system has developed its own concept of human dignity, although all concepts have a similar core, as nearly all ways of understanding “protection of human dignity” are combined with a commitment to respect each person. This kind of respect could be assumed as a basis of human dignity protection.

This article is about concepts, circumstances, the impact of technology upon life, the emergence of new problems which bring new challenges to our peoples and our planet in our pursuit of sustainable development. New challenges call for new solutions and different ways of using already existing resources, tools and mechanisms. So we revisit and compare bibliography through time; recall the work (and product of) of several ILA International Committees on the subject and especially its New Delhi Declaration of Principles of International Law as Relating to Sustainable Development; turn to new initiatives, namely, the Earth System Governance Project and Future Earth. And conclude on the urgency of bridging “hard” and “social” sciences in the quest for these solutions, given the holistic character of the problem, if we expect them to be democratic and sustainable – bearing in mind, always, that politics creates and law consolidates.

In this paper I thoroughly discuss the possibility of committing crimes which would fall under the Rome Statute, with regards to the very notion of cybersecurity. I conclude that we need extensively empirical research and solution to many aspects pointed out in my paper. First, we need to find an acceptable definition of cybersecurity to work with this process, and in order to understand the world and possibilities it creates for us. Furthermore, the 1998 Rome Statute needs an update, because the world of the internet creates opportunities never seen before, and the international case law is unable to cope with such distinct acts. Therefore, I believe that we need to find the next „Nuremberg Trials”, the next generational solution to a world and crimes never seen before. We need the theoretical and legal revolution which did come after the World World II, and after the ICTY, ICTR and Sierra Leone ad hoc Courts. I truly hope that this short and hence mashup summarizing paper is just an indicator of papers and conferences to come, with solutions and more and more ideas on how we solve these two phased problems, namely having to find 1. An ultimate definition for cybersecurity 2. Having a solution of how to interpret it to the classical notion of International Criminal Law. if we conclude that we are unable to handle this issue, I suggest to create a panel on international or V4 level on either the reorganization of customary international criminal law under the Rome Statute or on the ever-changing definition of cybersecurity.

In the universal sources of modern international law, the regime of cross-border pipelines is set out only in general terms. It is true even regarding the 1982 UN Convention on the Law of the Sea, which provides the most developed regulations relating to laying such pipelines. National legal rules applicable to laying pipelines, however, in practice provide for additional requirements which go beyond conventional rules. Relevant national laws are often based on international environmental law, including multilateral environmental treaties. Existing regional treaties providing regulations on cross-border pipelines are most often also of a framework nature.

The active development of technology enbled mankind to realize new programs for the exploration of previously inaccessible areas of the universe hundreds of thousands of kilometers away. The emergence of this new field created the need to ensure its special legal regulation, which would correspond to the specific characteristics of this business. But now we have entered into a phase of re-evaluation of existing legislation of space and we must realise that alongside countries operating in space an has arisen entirely new entity - the private sector. Therefore it is necessary to ask ourselves whether the privatization and commercialization of outer space is legally possible and if it is not pre-cluded by existing treaties. The draft of the latest US Commercial Space Act is undoubt-edly a great advance for key areas of the private sector activity such as remote sensing and new space missions. It provides a sense of confidence for entrepreneurs by strictly regulating issues related to the supervision of private sector entities. However, on the in-ternational scene the question has arisen of whether this act is contrary to international law, especially principles contained in existing space law treaties.

Certain aims of international criminal justice, such as prosecution and the punishment of perpetrators of international crimes, can be achieved through the international institutions created to administer justice. However, one of the essential requirements is to ensure the suspect’s presence at trial. The measures provided for in the Rome Statute to facilitate the International Criminal Court in fulfilling this condition and initiating proper proceedings include the issuance of arrest warrants and subsequent requests for arrest and surrender. Although a binding legal obligation exists under the Rome Statute with respect to States Parties, nonetheless inter-state cooperation has proven extremely difficult to obtain. There are many reasons for this, however problems of a legal and political nature are identified as the two main areas of obstacles. There are some measures that can be taken in order to prevent the occurrence of problems relating to arrest warrants. The Office of the Prosecutor and the Pre-Trial Chambers have certain powers that can positively affect the execution of arrest warrants. These organs aim to establish a positive cooperation network, both with the States Parties and non-Party States. By using the powers of external bodies, the ICC may attempt to establish favourable circumstances which would increase the effectiveness of arrest warrants.

This article aims to present the different approaches of countries around the world regarding the legal regulations of cyberspace. The creation of a unified legal system for cyberspace will be a difficult process due to major conflicts of interest. International organizations such as the EU and NATO, which bring together countries that have a similar vision of the world and how it should function, contribute to the unification of legal norms governing cyberspace in specific countries. On the other hand, vague initiatives of the world’s largest organization – the UN as well as the lack of implementation of newly adopted regulations by all member countries, unfortunately slow down the fight against cyberterrorism and cybercrimes that are transnational in nature. All countries around the world are increasing financial investment in improving information networks, creating new institutions to combat threats in the digital space and adapting laws to a dynamically changing world.

International law reflects systemic conditions compatible with its essence, which means that a space must exist inside the borders of that order for the presence of the phenomenon of general principles. The assumption that international law is a legal system ipso facto means that general principles must exist within its borders. A general principle of law is a necessary element of every legal order. It is a form and a tool in which the efforts of the individual seeking to comprehend a given phenomenon are materialized through imposing order on it rather than by breaking it down into unconnected and independent elements. Since law is an expression of order, law therefore applies general principles. The systematicity of law, and therefore of international law as well, creates the primary source of the binding force of any norm. Considerations of natural law or positive law justifications for the presence of general principles in international law are of little consequence, as the source of general principles is the systemic nature of the law. Order and hierarchy are part of the rationalized system in which norms of law present themselves. This dependency applies also to norms of international law. The role of the judge is to fill in the appropriate normative content (general principles) in fields constituting at one and the same time both a necessary element and a consequence of the systemic character of the international legal order. Within this context the principle of good faith constitutes one of the bases for considerations concerning the extent of the international legal order. The extent of international law reaches as far as the extent to which evidence of good faith are present among the subjects of international law. The impossibility of describing relations between two states by the use of the determinants of good faith, translated in turn into a normative general principle, determinates the limits of international law.

In March 2012 the ICC delivered its first and long-awaited judgment in Prosecutor v Lubanga. Trial Chamber I found Thomas Lubanga guilty as co-perpetrator of the war crimes of conscripting and enlisting children into the armed forces. The guilty verdict was followed by a reparations decision on 7 August 2012. This article examines the extent to which the ICC has successfully fulfilled its mandate to formulate reparations principles. The position of reparations within international law generally is discussed. This is followed by an explanation of how the ICC reparation regime functions. The bifurcated reparations mandate of the ICC is also explained. The focus of the article is on a critical assessment of the Lubanga reparations decision. The Court’s treatment of the harm requirement and the requirement of causation is examined. It is argued that the Court’s failure to clarify the requirements of “harm” and “causation” meant that it did not fulfil its mandate to formulate reparations principles.

This article considers the different interpretive methods used to deal with the phenomena of the constitutionalization and fragmentation of international law. While the technique of ‘constitutional’ interpretation has traditionally been developed and applied with reference to the UN Charter, the expansion of other constitutionally-oriented regimes at both universal and regional levels has multiplied the threat to the coherence of the international legal order, dramatically enhancing the problem of its fragmentation. To cope with this problem, the principle of systemic integration has been proposed as a legal panacea for the coordination of different normative layers of international law. Insofar as systemic integration aims at minimizing normative conflicts and is predicated on the presumption of compatibility between the different rules at stake, it can be posited that the principle of ‘consistent interpretation” represents one of its fundamental conceptual underpinnings. However, consistent interpretation as a legal technique has been traditionally conceived for a constitutional legal environment, and its application at the international level is likely to produce unintended ‘constitutionally-oriented’ legal effects. This article concludes that the various interpretive methods considered, through their dynamic of reciprocal interferences, operate in a creeping fashion to promote, rather paradoxically, both the constitutionalization and fragmentation of international law. As such, they are symptomatic of legal pluralism and of the complexities that characterize modern international law.

The self-proclamation of Kosovo’s independence announced on February 17 invites us to some general considerations that may be linked to the specific event. The IL principle of Self-determination will be on the focus of this article to considering it as one of the way to archive the creation of new IL entity. Self-determination is a more recent principle then the others but its history, theory and practice is immense. The origin of the term and idea also is in discussion and debating among historian and lawyer. The term have been used simultaneously in the same period (end of WW I) by the US President Wilson and the USSR Premier Lenin referring to the right of the non self-governed territory like colony and occupied regions.

The term ‘hybrid war’ is not a legal term. It belongs to the terminology and concepts used in the studies on international relationships. Due to its popularization in mass media it has recently started to be used in new contexts. The purpose of the article is to ascertain the precise meaning of the term, and to determine the legal implications which a particular understanding of it may have in international public law. Certain understandings or interpretations of a given term determine its legal consequences and allow the assessment of their implications from the point of view of international law. Therefore in the first part of the article, a review and an examination of different ways of understanding the term ‘hybrid war’ have been conducted. Although the definitions that had been analyzed are noteworthy and they emphasize some aspects of the ‘hybrid war,’ they lack a definition of the term that would take into consideration all the dimensions of the issue of a hybrid war. Thus the attempt taken by the author to propose his own definition, aggregating all observations and insights made by the international relations experts so far, and enumerating the distinctive characteristics of hybrid wars. After that, some typical elements of a hybrid war are analyzed from the point of view of international public law. The paper investigates the possibility of qualifying hybrid methods as the ‘use of force,’ an ‘aggression’ and an ‘armed attack’ within the meaning of the United Nations Charter. It also examines the admissibility of a counter-attack within the framework of the right to self- defence. The issue raises many doubts particularly with regard to activities from below the threshold of war that are distinctive characteristics of a hybrid war. The legal implications of the use of a non-state actor to conduct an armed activity under international law were also raised, being referred to as proxy war.

New Zealand has demonstrated strong support for Ukraine since the Russian invasion of February 2022. From logistical support to infantry training, the NZDF has been a key player in helping to deliver on the New Zealand government’s general statements of support. Though located far from the conflict, New Zealand’s traditional values of support for international law, democracy and collective security in the face of external aggression have all been major drivers for these deployments. But certain other drivers, such as recent problems with recruitment and retention in the armed forces, are perhaps lesser known but also important in rounding out an understanding of why and how New Zealand has responded to the situation.

The Arctic is a place which generates widespread interest on the international stage. This region, which was seemingly forgotten after the end of the Cold War, has again become a place of great rivalry. The reason for this is primarily the shrinking of the Arctic ice cap, which has opened up the possibility of exploiting the region’s rich natural resources and using new, attractive, maritime routes.The problem which arises in connection with these possibilities is the lack of a specific legal status for this area. Arctic countries, in this case meaning the big five of the Arctic, which are the states which have direct access to the Arctic Sea: Denmark (via Greenland), Canada, Norway, Russia and the United States, have submitted their own proposals for the regulation of the legal regime around the North Pole. The most important issues are considered to be: the concept of sectors, the common heritage of humanity and the rule of law subjecting the Arctic sea. These three issues arise from different periods and though many of their elements are varied, they also have convergent points. It is likely that the status of this strategic area will be based on one of them.

The judicialisation of international law is a relatively recent phenomenon that gained momentum in the 1990s and 2000s. Coupled with the trend towards widespread compulsory jurisdiction, it has been crucial in strengthening the commitment of states to adhere to their international obligations. Another important effect of judicialisation on international law is that at least certain international norms have acquired an “objective” nature, detached from the will of states. This is because the interpretation and application of these norms is no longer dependent solely upon the subjective discretion of states, but is subject to consideration and examination by independent judicial bodies. The process of judicialisation, while contributing to the international rule of law, has undoubtedly changed the face of international law a great deal as a result of some other factors. The multiplication of international courts has led to the expansion of the judicial institutional layer, making international law less horizontal. Also, as a result of the growing case-law of these courts, the system of international law is becoming more complex and developed, and thus also more mature. The natural aspect of the judicial function is the development of international law. Despite the problems and risks involved, the proliferation of international courts and tribunals can be perceived as one of the important components of the dynamic transformation of international law during the recent decades.

The purpose of the article is to assess how the provisions resulting from international programmatic norms in the field of human genetic data are implemented. The presented study, adopting the perspective of institutional rationalism extended to the paradigm of legalism, considers examples of the implementation of these standards in selected legal systems – Germany, the United States of America and France. The selection of the research paradigm is preceded by a theoretical introduction, which presents three ways of conceptualizing the notion of soft law in the legal sciences. Following an outline of this legal regime in positivism, and the theories of rationalization and constructivism, the author focuses on the provisions of the International Declaration on Human Genetic Data of 16 October, 2003, which are compared with the legislative initiatives of Germany, the United States of America and France, to show the influence that the choices of states has on selection of the implemented standards and how they are implemented.

In recent years, there has been a great interest of states and international corporations in the problem of obtaining raw materials from celestial bodies. Space mining is a future branch of industry that does not exist yet, related to the extraction of natural resources from celestial bodies. Although we currently bring from space at most samples of material for research, serious companies have been established that deal with the development of technologies related to the extraction of raw materials. Today, space mining is treated as an inevitable and important element of the future world economy. Moreover, it is already a source of conflicts. Space mining is of interest mainly to those countries which have not been endowed by nature with deposits of rare raw materials sufficient to meet the needs and ambitions, and private entities encouraged by the scale of potential profits. The flagship example of the first type is the United States, for which the ultimate goal of the space programme is the expansion of humanity throughout the solar system; it also counts on quick and big profits. For years, the Americans have been concerned about maintaining freedom of action, e.g. by remaining outside the regime of the Moon Treaty; they even introduced in their domestic legislation preliminary regulations regarding extraterrestrial extraction and ownership of raw materials.

Przez stulecia kwestia wzajemnych relacji między prawem międzynarodowym a prawem krajowym nie wzbudzała większego zainteresowania; fakt ten był ściśle skorelowany z tym, że działały one na różnych płaszczyznach. Prawo krajowe regulowało stosunki wewnętrzne w państwie, zaś międzynarodowe było głównie prawem wojny. Dziś w zasadzie nie ma już dziedziny, której prawo międzynarodowe nie obejmowałoby swoimi regulacjami, dlatego też zagadnienie miejsca i roli norm prawnomiędzynarodowych w wewnętrznym porządku prawnym ma dziś coraz większe znaczenie praktyczne. Dotyczy to sfery gospodarki, relacji dyplomatycznych i konsularnych, norm związanych z przestrzenią kosmiczną, prawa konfliktów zbrojnych, a w szczególnym stopniu ochrony praw człowieka. Właśnie ze względu na tak szerokie spectrum regulacji prawa międzynarodowego już na etapie formułowania definicji napotykamy na szereg problematycznych kwestii. Współczesne prawo międzynarodowe nie może już dłużej być charakteryzowane jedynie jako normy regulujące wzajemne relacje międzypaństwowe, nawet jeśli opis ten połączony jest z zastrzeżeniami czy wyjątkami. Prawo rządzące stosunkami między państwami jest bowiem jedną z wielu, lecz nie jedyną, większą jego kategorią. Prawo międzynarodowe to specyficzny porządek prawny zorganizowanej społeczności globalnej ustanowionej na bazie państwowej, dzięki czemu normy te spełniają wielorakie funkcje poprzez szereg międzynarodowych regulacji czy też instytucji o charakterze powszechnym, regionalnym i wielostronnym. Dlatego właśnie obecnie przyjmuje się, że prawo międzynarodowe to zbiór norm prawnych regulujących stosunki wzajemne pomiędzy państwami, państwami a innymi podmiotami, a także między innymi podmiotami prawa międzynarodowego.
For hundreds of years mutual relationships between the international and the national law had not aroused much interest, which was closely connected with the fact that they existed at different levels. The national law regulated internal relationships within the state whereas the international law was predominantly the law of war. Currently, there is no area that is not covered by regulations of the international law. Therefore, the issue of place and role of legal international standards in the internal law is currently is gaining practical significance in the areas like economy, diplomatic and consular relationships, standards for the cosmic space, the law of military conflicts, and protection of human rights in particular. Due to such a wide range of areas covered by the international law, numerous problems arise at the stage of formulating a definition. Current international law can no longer be regarded as only regulatory standards of mutual international relationships, even if the description includes reservations or exceptions. The law regulating relationships between states constitutes one of its many significant parts, but not the only one. The international law is a specific legal system of organised global society established on the state basis, due to which these standards fulfil various roles through a number of international regulations or institutions acting at common, regional and multi-lateral level. Therefore, it iscurrently assumed that the international law is a set of legal standards regulating mutual relationships between states, states and other entities as well as other entities under the international law.

In the European legal culture evolved into a model of justice. Th is model refl ects a legal tradition derived from Roman law and Canon law. It was based on the so-called principles, which include: openness of procedures, impartiality, discretion, professionalism and openness of procedures and the same proceedings. Th ereby, it aspire to objectifi cation procedural steps, while judges detach from judgments or decisions. Th ese standards have been saved in a number of acts of international law and in the constitutions of the various states, including the Constitution of Polish Republic. Modern judicial system provides advanced and equal access for all people not only to courts and tribunals but also to a just and public assessment of the case by a proper, independent and impartial court. In other words, it is one of the most fundamental human rights.
W europejskiej kulturze prawnej wykształcił się pewien model wymiaru sprawiedliwości. Jest on odzwierciedleniem tradycji prawnej, wyrosłej na gruncie prawa rzymskiego i prawa kanonicznego. Został oparty na tak zwanych zasadach, do których zalicza się: jawność postepowania, bezstronność, dyskrecja, profesjonalizm oraz jawność procedur i samych postępowań. Przestrzeganie tych zasad ma na celu dążność do obiektywizacji czynności procesowych i oderwanie sędziów od subiektywnych ocen czy decyzji. Standardy te zostały zapisane w wielu aktach prawa międzynarodowego, a także w konstytucjach poszczególnych państw, w tym w Konstytucji RP. Nowoczesny wymiar sprawiedliwości zapewnia na wyższym poziomie równy dostęp wszystkich ludzi do sądów i trybunałów oraz do sprawiedliwego i publicznego rozpatrzenia sprawy przez właściwy, niezależny i bezstronny sąd. Jest to jednocześnie jedno z najbardziej fundamentalnych praw człowieka.

This article examines the legal and philosophical foundations of international environmental law. It analyses the legal regime of the Common Heritage of Mankind (Humankind) (CHM), Common Concern of Mankind (Humankind) (CCM), and the principles of intra- and intergenerational equity. The regime of CHM covers the Moon and other celestial bodies and the “Area” under the 1982 United Nations Convention on the Law of the Sea. The regime of CCM relates to areas such as climate change and biodiversity. Both CHM and CCM are based on a premise that certain areas of human activities are held in common interest for the whole community of States. In this context, the article claims that the underlying, foundational principles of international environmental law have the common theme of intra- and intergenerational equity.

The aim of this paper is to reveal the evolution of basic principles of international law and main approaches of great powers to regulation of regional conflicts on the basis of analysis of Crimea and “Novorossiya” cases. The works of Nicu Popescu and Andrew Wilson about the special aspects of the Russian power were used as the theoretical foundation of this paper. After the Second World War international law was based on the principle of inviolable borders. And now this principle is being revised. This causes the raise of separatism in all multinational states. And this serves well for the Russian foreign politics. At that time it became a priority for the politicians in the Kremlin to regain geopolitical control of the areas adjacent to the Russian Federation and rebuild the spheres of influence which existed back in the Soviet times. Russian soft power is built on bedrock of historical and cultural affinity - the presence of Russian minorities in neighbourhood countries, the Russian language, post- Soviet nostalgia and the strength of the Russian Orthodox Church. The Russian and the Western soft power differ fundamentally. Russian soft power, civil society, expert networks or analytic schools by definition are not equivalent or similar institutions as those in the West. They serve different functions, namely propaganda. The vectors Russia’s soft power, including the Russian-speaking minority organisations, have organised the referendum in Crimea, and have been destabilising the eastern regions of Ukraine. The proponents of “Eurasianism” claim that there exists a separate civilization and historical community in the territory corresponding to the area of the former Russian Empire. They ascribe a cultural meaning to the Russian-speaking community (so-called Russian world). The concept of “nation” is expanded to include areas where the Russian language and culture are dominant. This ideology has become an instrument for managing the conflicts in the post-Soviet area (Abkhazia, South Ossetia, Crimea, and Novorossiya). On March 6, 2014, the Parliament of Crimea adopted a Resolution No.1702-6/14 that provided for a referendum on secession to be held on March 16, 2014. The referendum was characterized by a complete lack of transparency. Claims on legality of the annexation of Crimea have nothing to do with international law. However, it was reported in Russia that the decision to join Russia was supported by more than 97% of voters. In other words, in Crimea a unilateral secession took place. Even after annexation of Crimea the problem of Russianspeaking is still dangerous for the stability of Ukraine, because they are actively supported by Russian Federation. The notion of “Novorossiya” denotes the confederation of the self-proclaimed republics of Donetsk and Luhansk. Putin first called this part of Ukraine “Novorossiya on 17 March, 2014 after the annexation of Crimea. Russia is not interested to de jure separate Donbas from Ukraine, but interested to make the region economically more viable. In future Russia might return to the plans of carving out a more sizeable Novorossiya. Minsk agreements (February 12, 2015) foresee, among other things, the removal of military hardware from the separatist regions and the monitoring of the Russia-Ukraine border. Some commentators and even some Ukrainians suggested a radical solution: abandoning Donbas altogether. This would free Kyiv so it could focus on reforms and spare it a real economic and political burden. But independence for Donbas is probably unrealistic: many forces in Ukraine would be against it, and so would the West. And it is an option that Moscow neither expects nor wants. Russia wants leverage over Ukraine, not burdensome new obligations. Russian policy that Europe have followed up to now, based on the assumption of cooperation and the respect of commonly agreed rules, is done for the time being. Russia is no longer a partner for stability in the European neighbourhood. For example, the Budapest Memorandum collapsed after Russia annexed the Crimea. Despite that both European and American leaders called on Russia to stop – at 11 first by terminating support to the “men in green”, later by ceasing conflict escalation and supply of weapons, and not carrying out unilateral humanitarian operations – withdrawal from all these “red lines” was made, because the West avoided getting into a direct confrontation with Russia. The situation after the 2008 conflict in Georgia allows Russia to assume that after the end of the conflict in Ukraine, relations with the West will eventually revert to the “business as usual” situation. Russia hopes to repeat this scenario again. It is important to emphasize that the “business as usual” concept includes not only normalization of economic relations, lifting of sanctions, and renewal of the political dialogue, but also recognition of Russia as a veto holder in the security architecture of Europe. The practical manifestation of such recognition could be that the expansion of the transatlantic institutions further to the post–Soviet space would not be possible without Russia’s approval. The Ukraine crisis has altered Europe’s security structure. Europe is now far less secure, and its security architecture altogether is less stable, less predictable. At the same time, Europe has a better chance to exist peacefully if it succeeds in binding Russia into a cooperative order.

This article deals with the interpretation of Security Council powers under the UN Charter, and analyses available interpretive options. The various approaches, inspired by the textual, teleological, “subsequent practice”, and “systemic” methods of interpretation, as well as the complementary means of interpretation supplied by the preparatory works of San Francisco Conference, are successively considered and their relative advantages and shortcomings comparatively assessed. The article argues that recourse to one or the other from among the available interpretive methods can be influenced in individual cases by political and judicial contingencies, and that as a whole the interpretation of Security Council powers under the Charter is an evolving process, the variations of which may depend on the changing needs of collective security and of the international legal order at large.

Recently Polish courts have started to attach bank accounts of foreign embassies for the purpose of enforcement of judgements against embassies of foreign States in e.g. employment cases. The courts have applied the same principle to jurisdictional State immunity and immunity from enforcement and recognized that if state activities giving rise to the claims examined by courts were of private-law character, they are not protected either by jurisdictional or enforcement immunity. This standpoint is contrary to the dominant trend in other states’ practice, confirmed by the International Court of Justice in 2012 (Germany v. Italy: Greece Intervening). While in the field of jurisdictional immunity, the nature of an act as iure imperii or iure gestionis is decisive, in a case of immunity from enforcement – the allocation of the property against which enforcement measures are sought. Embassy bank accounts are generally covered by immunity from enforcement. In this situation Polish courts should develop convincing and exhaustive reasons why it is necessary for the protection of an individual to overrule the ne impediatur legatio principle. The judgements are not sufficiently reasoned and there is no good argument to support this stance. They expose Poland to international liability.

The aims of this contribution is to check the validity of the old theory, which goes back to Jellinek but is still dominant, which states that secession as well as the process of forming a new state, fall under the scope of a “simple fact” and thereby escape through definition to any law of way. According to this theory, secession is not a question of “Law” but a question of pure fact, failure or success: if a secessionist movement succeeds in establishing a new effectiveness, that is to say, puts in place the “Constituent elements” of a state, a new state is born. It is interesting to observe that with the phenomenon of the rise or the collapse of States, from the global perspective of international order and especially from the point of view of international law, the States concerned are, in practice, not simply left to their fate. On the contrary, the rise or the collapse of a State anywhere in the world is seen as a matter of concern for the international community, since the international system as a whole is felt to be affected. In such cases, international reactions have not been manifested primarily through the States as such, either indi-vidually or together. Basically, these reactions had to cope with the dilemma of choos-ing between two fundamental principles of legitimacy in international law: on the one hand, the sovereignty and equality of States and, on the other, the right of peoples to self-determination.

This paper aims to point to the transition from international law to transnational law that, on the one hand, is caused, and on the other, is strengthened by the growing role of cities in the fight against COVID-19. Various interactions between cities and other international actors give rise to new trends and challenges on the international plane. One of such terms, transnational law, refers to developments beyond the nation-state and includes “all law which regulates actions or events that transcend national frontiers”. It is characterized by a plurality of overlapping normative systems and a growing role of new actors in the international arena, which are cities. The authors give examples of cities bypassing or complementing states with special emphasis on European cities (Polish including) as well as of cities’ transnational cooperation to fight COVID-19 pandemic, filling the gaps in inter-governmental multilateral cooperation.

The modern international law is considered an offshoot of European intellectual contributions as its basic foundation is deeply imbued with the political and social upheavals took place in European history. As an example, the Westphalian order emerged in the culmination of thirty years war in 1648 was regarded as the most pivotal mile stone in modern history of international law. Yet the European domination and its intellectual contribution to the development of international law systematically excluded non-European nations from international law and its protection, which finally paved the path to use international law in the 19th century as a tool of legitimizing the colonial expansion. This paperseeks to trace the historiography of modern international law and its dubious nature of disdaining non-Europeans and their civilizational thinking. Furthermore, this paper argues how European historical encounters carved the map of international law from a vantage point, which gave an utter prominence upon the European intellectual monopoly. The results emerge from this paper will strongly suggest the need of an alternative scholarship to unveil the history of international law.

Cyberspace is a realm without defined geographic or political boundaries and is highly interactive. This article indicates the important role of cybersecurity in the context of building the information society and presents the most important legal regulations, both international and national, along with the indication of the proposed directions of changes at the national level, which would help to increase cybersecurity. The article emphasizes the importance of legislative and organizational regulations in the field of the addressed issues.

This article explores the issue of sovereignty of States in the context of legitimacy of international law. Sovereign statehood is today increasingly challenged. The article examines if an essential incompatibility exists between international law conceived as a true, that is, legitimized, system of law and State sovereignty. To this end, it seems necessary to determine a meaning and importance of sovereignty in and for international law. The article seeks to argue that the idea of State sovereignty, deprived of orthodox positivistic justification, can still perform an important cognitive function in international law. In a world in which non-State actors suffer from a “democratic deficit”, democratic accountability and responsibility remains concentrated in States. States are, therefore, still the main source of legitimacy of political decisions. It is sovereign States that are the legal subjects assuring the public underpinnings within the international legal order. Consequently, there is no contradiction between the sovereign status of States in international society, and international law conceived as a legitimized legal order.

The paper deals with internal conflicts, their internationalisation and a hybrid war. In the 1990s many military conflicts could have been regarded as domestic conflicts or internationalised internal conflicts. According to the authors internationalised internal conflicts and a hybrid war have much in common. The purpose of the paper is to compare and confront distinctive characteristics of internationalised internal conflicts with the model of hybrid war. The authors scrutinize definitions of an internal, domestic conflict and a hybrid war, and the possibilities and likelihood of their occurrence. Finally the issue is analysed in terms of international public law. ‘Hybrid war’ is a term not defined in public international law. However it is commonly used not only by media and politicians, but also by academics in a sci- entific discourse. A question arises to what extent it is justified to use a term in the context of different military conflicts, like for instance the one in the East Ukraine that has been going on since 2015. Therefore it is necessary to explain what the term ‘hybrid war’ means. In order to do so, it is necessary to try to define the term. Its distinctive characteristics must be indicated. Then, many military conflicts will be analysed to determine whether they satisfy the requirements for qualifying them as a ‘hybrid war’ or an internationalised internal conflict. The research leads to a conclusion that an internationalised internal conflict gives many opportunities for applying to it methods characteristic of a hybrid war. In the course of an internationalised internal conflict there are many ways in which the aggressor can evade international liability and the authors attempt to answer how to prevent this.

This theoretical and practical part is related to the analysis and studies of the contractual obligations under the private international law. This work is divided into three parts, where respectively, the first part deals with the general part of the contractual obligations; the second part deals with the specific contracts, which are actually found also in a general regulation under law No. 10428, dated 02.06.2011 “Private International Law”; and the third part deals with the international and national jurisprudence aspect. This work as based on the ex-positio sinkronik system aims at giving a minimum contribution in the application of the international private law and clarifies the omission, collision and legal problematic aspects in practice. At the end of this work, there are our conclusions which serve as a deduction over the analysis and studies done to this part of the private international law.

This article examines the phenomenon of internal displacement from the perspective of the existing legal framework and those measures which should guarantee protection for internally displaced populations worldwide. With this aim in mind, the article begins by assessing the role of international law and try to ascertain which legal norms are applicable to protect internally displaced persons. As a second step, it analyzes the question of responsibility for the protection of internally displaced persons, i.e. whether this lies with the state of origin through its national law, or rather with the international community, and examines the relevant provisions of international law. While concluding and identifying the existing gaps in the current legislation, the article demonstrates that internally displaced persons should become the objects of a specific system of law and legal protection. At the same time, the text intends to contribute to the contemporary debate promoting efforts to strengthen the protection of internally displaced persons and to disseminate knowledge about this vulnerable group of people.

There are different views in the literature on the meaning of the term international economic law. In author’s opinion it encompasses regulations, which at the same time: are considered law (even soft-law), regulate relations with international element and regulate economic activity. Such laws do not necessarily have to originate from the sources of international law. In this understanding international economic law is a broader term than public international law and private international law in an economic area. The same is true for unpopular in Poland international business law. On the other hand transnational economic law, as understood by Jessup, should be considered equivalent to international economic law. Since international economic law is vast in terms of subjects, sources and norms, it is reasonable to divide it for academic reasons into public international economic law and private international economic law. Both subsections can be further divided. For instance public international economic law would embrace public international trade law, public international financial and monetary law, public international investment law and public international development law.

The notions of culturalization of human rights law and the concept of right to culture are fairly new issues, arising from the changes in the area of application and understanding of international law as well as from the signs of growing sensitivity to the sphere of culture, but also the need to take into account the broad cultural context. As a result of these changes international bodies, courts and institutions pay more attention to the role of culture in human rights. Based on this process, we can observe the emergence of the concept of the right to culture as one of the fundamental human rights. This article thus seeks to answer questions as to what the right to culture might be, how is understood, whether it is rooted in international law, and how it might be being given effect to. Considering that this is a very broad and multifaceted issue, the goals here have been limited to a very general indication of the key issues related to the emerging concept of the right to culture. Hence, due to the current debate the article’s aims it to highlight the foundation of the right to culture, give overview how the right might be perceived and where we can find elements constituting the right to culture (here e.g. international bodies judgments).

Problematyka państwowości Palestyny pozostaje jednym z najbardziej kontrowersyjnych zagadnień współczesnego prawa międzynarodowego i stosunków międzynarodowych. Mimo stanowiska prezentowanego w rezolucjach Zgromadzenia Ogólnego ONZ, a także przystąpienia Palestyny do wielu ważnych umów międzynarodowych, na prawach takich samych jak powszechnie uznane państwa, część państw wyraża nadal wątpliwości, jeśli chodzi o istnienie Państwa Palestyńskiego. Niniejszy artykuł ma na celu ukazanie, że Palestyna spełniła kryteria państwowości, a państwa, które do tej pory nie dokonały jej uznania, dopuszczają się tzw. uznania spóźnionego. W pierwszej części artykułu są więc krótko omówione wzajemne relacje między instytucją uznania a zjawiskiem państwowości. Dalej scharakteryzowana jest obecność Palestyny na forum ONZ. Kolejna część poświęcona została omówieniu spełnienia przez Palestynę kryteriów państwowości. Następnie przedstawione są przykłady relacji bilateralnych Palestyny i nieuznających jej państw, co służy wskazaniu, czym jest uznanie spóźnione i dorozumiane. Palestine's statehood remains one of the most controversial issues of contemporary international law and international relations. Despite the position presented in resolutions adopted by the UN General Assembly as well as Palestine having joined many important international agreements under the same conditions as universally recognised states, some states still express doubts about the existence of the State of Palestine. The aim of this article is to show that Palestine has met the criteria of statehood and that states which have not so far recognised it are guilty of belated recognition. The first part of the article will briefly discuss the mutual relations between the institution of recognition and the phenomenon of statehood. Then the author shall characterise Palestine's presence in the United Nations. The next part will be dedicated to discussing how Palestine meets the criteria of statehood. Following that the author shall present examples of bilateral relations between Palestine and the countries that do not recognise it, which shall be later used to elaborate on the definitions of belated recognition and implicit recognition. The last part has been devoted to issues related to belated recognition.(original abstract)

The article sets out the nature, the history and the general structure of the crime against humanity and provides a comprehensive analytical commentary of the elements of such crimes as a problem of international law. The contextual element determines that crimes against humanity involve either large-scale violence in relation to the number of victims or its extension over a broad geographic area (widespread), or a methodical type of violence (systematic). This excludes random, accidental or isolated acts of violence. In addition, Article 7(2) (a) of the Rome Statute determines that crimes against humanity must be committed in furtherance of a State or organizational policy to commit an attack. The plan or policy does not need to be explicitly stipulated or formally adopted and can, therefore, be inferred from the totality of the circumstances. In contrast with genocide, crimes against humanity do not need to target a specific group. Instead, the victim of the attack can be any civilian population, regardless of its affiliation or identity.

The article deals with the issue of the Beijing reform of international criminal aviation law. The author analyses the relevant applicable international law and confronts it with the new legal regulations adopted at the International Civil Aviation Organisation (ICAO) conference in Beijing in 2010. As a result, the author states that the basic change involves the expansion of the catalogue of acts subject to criminalisation as well as the expansion of the circle of persons participating in or supporting actions involving the commission of acts that pose a threat to the safety of civil aviation; the system also specifies the responsibility of collective entities (the so-called ‘Al Qaeda’ clause). The author is deeply convinced that the development of the Tokyo-Hague-Montreal-Beijing system, which is part of the whole international legal system of combatting terrorism, including its financing, is fully justified. The new regulations also make this system more coherent. It is also worth adding that the adoption of the Beijing Convention and the Beijing Protocol is part of the implementation of the Global Counter-Terrorism Strategy adopted by the United Nations.

The Holy See (Sancta Sedes) is the specific subject of the international law. The acknowledgement of the legal subjectivity is related to the possession of the legal capacity and the capability of the legal international proceedings. The Holy See is treated as an autonomous subject which has its own rights and obligations concerning the international affairs. It has right to send and receive the minister residents (ius legationis), to enter into the international contracts (ius tractandi), to participate in the conferences and to be member of the inter-national organizations (ius foederum).

Opis:
The aim of the research presented in the article is both to describe and analyse the problem of use of the anti-personnel mines in armed conflicts and the subsequent effects that landmines, in particular anti-personnel mines, have on human health and life. The article discusses a number of problems to solve related to the land mine use long after the end of the armed conflict. The basic source of knowledge concerning legal regulations determining the use of anti-personnel mines are international conventions. In Polish scientific literature, it is difficult to find materials that contain, apart from the contents of the documents themselves, comments and interpretations on the application of international law. In order to explore the above-mentioned issues, it was necessary to make use of the studies of international organizations. The issue of anti-personnel landmine threat and the support to their victims is widely presented in the work of the International Committee of the Red Cross (ICRC), the International Campaign to Ban Landmines (ICBL), human rights organizations, and others.

In such a complex and uncertain world, it may help to think like a Hindu, and accept contradiction as more in keeping with social and political reality than is finding a right answer to complex policy puzzles. What is almost impossible for those trained within Western frames of reference is to grasp that there are diverse perspectives of understanding that may result in seemingly contradictory recommendations despite shared values and goals. Civilizational perspectives and personal experience inevitably color what we feel, think, and do, and so being likeminded when it comes abolishingnuclear weapons is often coupled with somewhat divergent views on what to advocate when it comes to tactics and priorities.In this spirit, this paper tries to depict a set of reasons why the goal of nuclear disarmament will never be reached so long as arms control and nonproliferation of nuclear weaponry are seen as the pillars of global stability in the nuclear age.

Opis:
State immunity is based on the principle of sovereign equality of all states which is one of the main principles of international legal order. Predominant jurisprudence of national courts as well as international courts and tribunals follows the position that in case when a claim is submitted in a court in the forum-state due to war crimes and crimes against humanity, a foreign state possesses state immunity which excludes jurisdiction of national courts. There is a strong tendency in international law to limit state immunity and exclude from its scope claims concerning the aforementioned crimes, in case they were committed on the forum-state’s territory). However the International Court of Justice assumed that the immunity is of a procedural nature and it has to be evaluated in each case on the day of adjudication. Hence, in future cases relating to war crimes and crimes against humanity may be considered in forum-state’s courts.

On 26 April 1994, the Lithuanian and Polish presidents signed in Vilnius the Treaty between the Republic of Lithuania and the Republic of Poland on friendly relations and good neighbourly cooperation. The Lithuanian press devoted much attention to the progress of negotiations in drafting this document and to its ratification by the Lithuanian Seimas in October 1994. During 1993–1994, the Lithuanian newspapers Lietuvos rytas, Respublika, Lietuvos aidas, Tiesa, Kurier Wileński, also several smaller newspapers, such as Voruta, Gimtasis kraštas, Atgimimas, SSI, Amžius, published the articles devoted to a discussion of the Lithuanian-Polish relations. This publication aims at conducting an analysis of the Lithuanian press and reviewing the articles devoted to the drafting, signature and ratification of the Treaty between the Republic of Lithuania and the Republic of Poland on friendly relations and good neighbourly cooperation, as well as to the political situation in Lithuania at the time of the drafting and signature of the mentioned agreement.

In the 21st century ageism is becoming the most widely spread phenomenon. It has become so extensive that presently many more seniors in Europe are exposed to ageism than other people to sexism or racism. Contrary to other vulnerable groups, the elderly do not enjoy any binding instrument that could protect them and their dignity against ageism in the same way that women and racial groups are protected against sexism and racism. Unfortunately, the UN General Assembly resolution, supposed to be a first step to drawing up such a convention, was adopted with a significant number of abstentions, leaving the fate of a potential treaty on the rights of the elderly uncertain. On the other hand, in 2014 the Committee of Ministers of the Council of Europe adopted a new recommendation, and in June 2015 members of the Organisation of American States adopted a treaty protecting the elder’s rights. Taking into account these new circumstances, the idea underlying this article is to investigate the ability of international instruments to limit ageism and protect older persons’ dignity, as well as to indicate existing gaps.

Opis:
The purpose of this article is to set out the multiannual process for establishing the European Ombudsman's office and the reasons for its establishment. It presents the history of the first European Ombudsmen and the history of the European Communities from a legal perspective. The author goes back to the reasons for setting up the European Ombudsman's body, which were the lack of legitimacy in the European Union. The role of bodies such as the European Ombudsman is to ensure that citizens' rights are actually respected. The European Ombudsman strengthens the rule of law in the European Union and complements the role of the courts by providing a cheap, accessible individual remedy and, on the other hand, complements the representative function of the European Parliament by becoming the centre of independent critical assessment and improvement of the quality of European administration. The rule of law serves to maintain the EU system as a supranational system. It is the construction of the axis of integration. If there is a lack of trust in the community in this respect, it begins to be treated differently. It is therefore important that the European Ombudsman fulfils his Treaty obligations as a body of the European Union effectively.

This article analyzes the problems of enforcing international law in terms of fundamental principles of international law, sovereign states and the United Nations. The issue of law enforcement is a problem not only in individual states, but also with in the United Nations. The whole process of peaceful settlement of disputes through the courts in particular, is therefore irrelevant if the final decision, which the state does not want to submit to and fail to enforce. On the other hand, law enforcement mechanisms and capacities of WTO represent complex system of procedural norms of coercion, which could serve as an example for the innovation of UN law enforcement procedures.

The Yugoslav Act of 1982 on resolving conflict of laws with regulations of other countries is still in force in the Republic of Serbia. The law drafted over 40 years ago was considered as innovative at the time of its adoption. At present, the Serbian academic community signals the need to update the current provisions of private international law, both in the spirit of approximation with the law of the European Union and in the need to better embed this law in the present legal order of the Republic of Serbia. The draft of a new act on private international law, prepared in 2014, was not adopted yet, although it was not formally rejected as such in Serbian legislative procedures (as of April 13, 2023) either. Though not formally binding, the draft law has been cited in recent years in the Serbian law journals, being an important point of reference for considerations on questions related to private international law in Serbia. It must be admitted that the progressive Serbian academic community turned out to be an active inspirer, creator and is now also a tireless advocate of changes in the field of private international law in Serbia.Serbia, which has been an EU candidate since 2013, has no particular obligation to introduce specific solutions in the field of private international law into its national law neither before nor after accession. EU law in the field of private international law is contained in regulations that will be automatically and directly applicable in Serbia when it becomes a member of the European Union. This is a dilemma whether to adopt the provisions which, in principle, will have to be repealed after the accession. At the same time, there are several benefits of approximating the law before the accession, including accustoming legal practitioners in Serbia to apply solutions similar to those in the EU, and increasing legal certainty by applying similar solutions of private international law in transactions between entities from Serbia and the European Union (regardless of the accession prospects).The author describes and summarizes the current state of regulations in Serbian private international law and analyses the main changes proposed in the draft law of 2014. The article also presents agreements binding Serbia in the field of private international law, including the still binding 1960 Polish-Serbian agreement.

There are different meanings and functions of what is called a “general principle of law.” This article seeks to address their importance as the basis for the systemic integration of the international legal order. When international law is considered as a legal system, its normative unity and completeness seems essential. This article argues that general principles of law are a necessary, although less visible, element of international legal practice and reasoning, which secure the systemic integration and longlasting underpinnings of international law. In this sense they may be seen as the gentle guardians of international law as a legal system.

Public servants are at times portrayed as appeasing political masters while aiming for illegitimate political and personal interests (an example that was featured in the British comedy “Yes, Minister”). This misperception demonstrates the balancing act required by public administrations, especially if they truly seek to serve the public. Adding inter- national law, global governance and modernization to the melting pot of EU members renders matters particularly challenging. The paper explores the issues’ theoretical and practical perspectives.Debate begins by examining international law and globalization components of global governance relevant to domestic public administration, including global administra- tive law. This definitional stage is followed by theorizing on how developments affect EU members’ public administration. Moving from theory to practice, the paper next discusses influences of the new global governance, non-state actors on public adminis- tration structures, legal environments and interrelationships. We end the discussion by offering policy proposals, food for thought and proposals for future research directions. In the past, European public servants were subject only to local laws serving local con- stituencies. Today, the same public servants are an integral part of an EU-Global mod- ern public administration serving the globe. This development creates great uncertain- ties, but with proper policies it can be a true blessing for both public administration and the EU-Global public

The terms ‘characterization’ (‘classification’) and ‘exercise of characterization’ refer in particular to the efforts made to determine which conflict of law rule - and in the sense presented in this paper, also rule on jurisdiction - which is part of the law of the forum State, should be applied to the circumstances of a particular case. In relation to the norms of private international law of the European Union, the triumph of an autonomous characterization at first sight seems undeniable. The term autonomous characterization (in principle - ‘autonomous interpretation’, the case law usually does not distinguish between exercise of characterization and exercise of interpretation) has been referred to over the last fifty years in order to describe the vast majority of operations of interpretation undertaken in relation to the norms of EU private international law. The contemporary concept of characterization in private law of the European Union, although consistently referred to as ‘autonomous’, does not fully meet the criteria thereof. The papers argues that while the starting point was the autonomous characterization in its pure form (stage one), over time it partially gave way to the place of characterization according to the EU law-oriented legis fori (stage two), and finally it was enriched with new elements which gave it the form of a specific functional characterization (stage three). It is not so much about the consistency of the results of the exercises of characterization with the universal understanding of certain concepts. Exercises of characterization are carried out through the prism of their effects, so as to ensure the effectiveness of the norms of EU law (effet utile) other than rules on conflict of laws and on jurisdiction.

The tiny Hans Island, claimed by both Canada and Denmark, is the latest disputed land in Arctic. The aim of this article is to analyse whether this sovereignty question can be resolved by referring to the doctrine of occupation. The methods used are historical analysis and the dogmatics of international law. The historical examples and doctrinal views lead to the first level conclusion that in certain circumstances a land that belongs to no one can be occupied by a state merely by means of symbolic actions. Further considerations focus on the questions of whether Hans Island should be considered as possessing such certain qualities and if so, whether any of the contestants has ever performed any actions that can be interpreted as taking it into its possession. The conclusion points out that although it is very unlikely that analyzed solutions would be used to determine the fate of the Island, it is still crucial to realise that doctrines of international law, which may seems archaic, are to some extent still applicable and could be used in the Arctic disputes.

The article summarizes the situation related to the armed conflict in Ukraine in the context of the destruction of monuments and cultural objects as a war crime. The considerations relate to the provisions of international and European law, as well as to the positions developed by international case law. The stands of the international organization and community alongside the bodies of the European Union have been indicated. Poland’s efforts to help Ukrainian monuments are also discussed. Reference is made to the activities of the Polish Support Center for Culture in Ukraine established in Poland, within the structure of the National Heritage Institute and the Committee for Aid to Museums of Ukraine.

The Supreme National Tribunal, which operated in Poland between 1946 and 1948, tried 49 Hitlerite criminals who had committed crimes against Poland and Poles during World War II. It was tasked not only with bringing individual perpetrators to justice but also with publicizing these matters to the world. It was in effect the Polish equivalent of the Nuremberg Tribunal. However, the suppression of the Warsaw Uprising, including the Wola Massacre (Wola Slaughter), was not covered by these trials, even though initially The Tribunal planned to try Germans responsible for the crimes committed during the Uprising. In practice. these crimes were carefully omitted from the seven trials conducted by the Tribunal. Even when the high officials of the occupation administration in Warsaw were tried, the period of the Warsaw Uprising was not, as a rule, the subject were subsequently tried by the Polish common courts. The fact is that the then Polish authorities were not keen to publicize the martyrdom of those who had taken part in the Warsaw Uprising because this would have inevitably led to questions as to why USSR military forces did not come to the aid of the Warsaw residents being murdered by the Germans and also to what was happening to the Polish Home Army soldiers who had fought vigorously at that time and who, after the war, were subject to persecution by the new authorities installed in Poland by the Soviet Union. The Tribunal, whose task was to judge the perpetrators of the most significant German crimes, ceased its activities without even considering what was probably the largest single massacre of civilians in Europe during World War II, and the largest single act of extermination in the history of the Polish Nation: the Wola Massacre.

Current approaches to subjectivity do not stress the notion of attributes of international subjectivity. The definitions of subjectivity embrace this category in general terms (concentrating on the implication of rights and obligations directly from international law), granting such status mainly to individual entities. The resultant increase in the number and quality of potential international entities would make international turnover virtually impossible. This would in turn imply granting international subjectivity to concerns and carriers of domestic law, thus obscuring the scope and subjectivity of particular structures. Hence, clear research assumptions are needed as well as efforts to determine what subjectivity is. These are tentatively formulated in this article with the subjective attributes (i.e. the most essential and constituting qualities) emphasised. The range of subject categories is wide (states and their in statu nascendi forms, international organisations, recognised entities other than states and organisations, international bodies and conferences). An analysis of the normative aspect and implementation of international subjectivity makes it possible to exclude entities and persons from having such status.

Opis:
In the face of technological development, the relationship between freedom, including freedom of speech, and security – especially its digital variety, namely cybersecurity – is a particularly difficult relation. It should be pointed out that the international plane is an indispensable dimension of human rights protection, since it is in the international plane that new standards in the field of human rights are created, which are then brought into the system of domestic law and the practice of states. Meanwhile, the existence of international legal regulations increasingly often becomes a guarantee of the effectiveness of domestic legal systems. International institutions often become the institution of appeal for individuals and a lever to force state governments to respect fundamental human rights and freedoms. Support for individuals, communities or nations fighting for their rights, and their success in this struggle, contribute to the formation of a new democratic international order.
