Issues concerning homosexuality is well known both in the documents of the Catholic Church, as well as in the case law of the Roman Rota and the judgments of the ecclesiastical tribunals. Currently, homosexuality is a serious social problem, psychological and legal. The issue of homosexuality more often appears in ecclesiastical tribunals, as a cause of inability of people to take the essential obligations of marriage. Homosexuality causes inability to distinguish carefully the particular subject of matrimonial consent and conduct a critical assessment of the person affected by these disorders, which is unable to transfer the rights and assume the obligations of marriage.

In the ecclesiastical courts, classical methods, such as psychological conversation and assessment, are used as they are considered the most valuable psychological means. The testing methods and questionnaires are of great importance to the legal expert as well. However, they do not always constitute a crucial addendum like in other psychological researches. The investigational techniques mentioned above are merely to help the legal expert to resolve his doubts. The fact that those methods are implemented does not raise the value of the final motion, even though it is important that the techniques used by the expert touch upon not only the present mental state of the person being tested but also the past.

In the decision of the Roman Rota c. Jarawan the case of invalidity of the marriage due to inability to take up significant marital obligations by the respondent was examined and decided (a negative decision was issued in the first instance and a positive in the second instance). The Rotal judges subjected the decision of the second instance to decisive criticism by, i.a., a few experts, and decided that it indicates the acceptance of relative inability by the court, which is clearly inconsistent with the canonical norm 1095, n. 3 of the Code of Canon Law.

From the analysis of the cases for the annulment of a marriage result that encephalopathy as a personality disorder causes a serious lack of discretionary judgment concerning the essential matrimonial rights and obligations mutually given and accepted (can. 1095 CIC No. 2 of 1983) and the inability of people to take up and fulfill the essential obligations of marriage (can. 1095 CIC No. 3 of 1983). In the judgments of ecclesiastical tribunals Judging College, opinions can be found which point to a defective functioning of personality traits, in this specific case of encephalopathic personality, which is a consequence of damage to the central nervous system. Disturbed encephalopthic personality does not always automatically lead to the inability of people to take the essential obligations of marriage, yet its impact on the psyche and consequently the ability to make a covenant marriage is quite significant as evidenced by studies of psychiatric and religious processes. This article presents decisions of the ecclesiastical courts which show that the disturbances caused by encephalopathy result in the inability to create positive and lasting marriages. In addition, people with this type of personality were not able to give valid consent, despite the declared willingness to persevere in marriage and made promises to change their current behavior.

Opis:
One of the most important tasks of the Social Insurance Institution (ZUS) is its mandate and obligations in the field of auditing. First of all, the ZUS verifies whether contributions are paid, and whether obligations related to social insurance are complied with. Furthermore, the ZUS carries out audits of the judicature on temporary inability to work with regard to the regularity of medical certificates and sick leaves, and formal control of medical certificates. Findings of such audits are the basis for decisions that impose on the auditees certain obligations or force them to concrete behaviours.

This article shows that addiction to work (workaholism) can be a potential cause of person’s inability to contract marriage in the light of canon law. Workahlism is one of contemporary addictions, in which an individual gets addicted to certain actions and not substances. Nevertheless, addiction in consideration causes particular effects, also mental, and it strongly influences person’s functioning. It mainly causes damages to interpersonal bonds, personal life disruptions, health deterioration, reduction of happiness and even the loss of life. This paper describes the phenomenon of workaholism (a concept, diagnostic criteria, stages of development, causes and consequences of addiction to work). Next it presents how workaholism affects ability to take upon significant marriage duties. Presented analysis is based on Canon 1095 of The Code of Canon Law. This article might be of use for Church courts employees, in terms of interpretation of The Code of Canon Law: Canon 1095 in the context of addictions. It may also have scientific application.

The paper presents an attempt to analyze the interview with Natalia within the framework of sociology of poverty and from a social exclusion perspective. The information about the origins of Natalia’s interview is delineated. In the main part of the text, the author refers to the concept of the badge of ability, described by Richard Sennett and Jonathan Cobb, as a tool of social categorizing and valuing and introduces the corresponding notion of the badge of inability, ascribed to the unprivileged group members. Furthermore, the influence of both kinds of badges on the situation of Natalia’s family of origin, on her life course, and self-description are indicated with some remarks on the narrator’s biographical and identity work. The last part of the paper presents the narrator’s understanding of the world of poverty and social exclusion, its mechanisms, and conditionings.

The presented study includes a detailed analysis of the sentence of the Roman Rota c. Arokiaraj of 6th July 2011 issued in the case of Senogallien which stated the plaintiff's inability to undertake significant marital obligations due to his homosexuality. According to the author, the positive resolution of the rotal turnus was in principle influenced by the consistent opinions of the experts. The diagnoses made by experts were coherent with the image of the person outlined in the statements of the parties and testimonies of the witnesses with whom the plaintiff was associated. In the assessment of the facts, the turnus under the leadership of Xawier Leo Arokiaraj took into account all the evidence. On the basis of the analysis of the verdict’s content, his editor pointed out that the professed members of the Roman Rota recognized not only primary homosexuality but also dependent personality whose sources they saw in toxic family conditions. Thus, the inability to marry was confirmed not only by primary homosexuality as an autonomous unit but by the combination of the indicated disorders. Bearing these facts in mind, the author of the study made the following recommendations for the courts of lower jurisdiction: the approach of the experts involved in the cases, if possible, should not be one-dimensional but rather multi-faceted since this point of view will enable them to sketch an integral image of the person.
W zaprezentowanym opracowaniu dokonano szczegółowej analizy wyroku Roty Rzymskiej c. Arokiaraj z 6 lipca 2011 roku wydanego w sprawie Senogallien. z tytułu niezdolności do podjęcia istotnych obowiązków małżeńskich wynikających z homoseksualizmu powoda. Według Autora, na pozytywne rozstrzygnięcie turnusu rotalnego wprawdzie zasadniczo wpłynęły zgodne opinie biegłych. Diagnozy sporządzone przez ekspertów były koherentne wizerunkiem osoby były koherentne wizerunkiem osoby nakreślonym w oświadczeniach stron oraz zeznaniach świadków z którymi powód obcował. W ocenie stanu faktycznego turnus rotalny pod przewodnictwem Ksawiera Leona Arokiaraja wziął pod uwagę wszystkie środki dowodowe. Na podstawie analizy treści wyroku jego redaktor wykazał, iż powołani w Rocie Rzymskiej biegli rozpoznali u powoda nie tylko homoseksualizm pierwotny, ale również osobowość zależną, której źródeł upatrywali w toksycznych uwarunkowaniach rodzinnych. Na orzeczoną zatem niezdolność do zawarcia małżeństwa wpłynął nie tylko homoseksualizm pierwotny jako jednostka autonomiczna, ale połączenie wskazanych zaburzeń. Mając na uwadze te fakty Autor opracowania wysunął następujące zalecenie dla sądownictwa niższych stopni jurysdykcyjnych: biegli biorący udział w procesach, o ile to możliwe, na występujące zaburzenia osobowości powinni spojrzeć nie tylko jednoaspektowo, ale wieloaspektowo. Taki punkt widzenia bowiem umożliwi im nakreślenie integralnego wizerunku osoby.

Opis:
One of the most important subsystems of the vehicles and machines operating currently in industry and transportation are the rotating subsystems. During the subsystems operation, due to the forcing factors influence, the technical state of them is changing and the failure can occur. In order to avoid such a situation the technical state should be identified online. To do this the analysis of the subsystems vibrations is performed. The identified technical state should be considered in a context of the ability and different inability states. Therefore, the first step of the diagnostic procedure is the ability and different inability states identification. In the article, it is proposed to accomplish this goal by the vibrations analysis in time domain. The described research started with the vibration signals acquisition using the experimental stand. In this way, the vibration signals for ability and different inability states were obtained. Afterwards, the signals were divided into learning and testing data sets. For each signal from learning data set, several characteristics were calculated, and they selected the most significant among them. Using the selected characteristics, the signals from the testing data set were analysed. Thanks to it, the testing vibrations signals were counted among the signals collected on the rotating subsystem operating in ability or selected inability state. The result of the performed studies and the accuracy of the technical state of the tested system identification can be found at the end of the article.

W niniejszym tekście przedstawiona została problematyka z zakresu prawa małżeńskiego odnosząca się do skutków epilepsji w kontekście ważności małżeństwa. Wykorzystana została literatura z zakresu neurologii, psychiatrii oraz kanonistyki. Rozważania zostały podzielone na trzy części. Pierwsza z nich ukazuje definicję omawianej choroby. W tejże części wskazane zostały także rodzaje epilepsji oraz przyczyny jej występowania. Następnie przedstawiono, jakie zaburzenia psychiczne mogą towarzyszyć lub być konsekwencją tej choroby. Ostatnia część zawiera analizę przepisów Kodeksu Prawa Kanonicznego, dotyczących niezdolności konsensualnej do zawarcia małżeństwa. Wskazane zostały przesłanki powodujące niezdolność do ważnego wyrażenia zgody małżeńskiej.
In this text shows the marriage law issues relating to the effects of epilepsy in the context of the validity of the marriage. Literature has been used in the field of neurology, psychiatry and canon law. Considerations have been divided into three parts. The first one shows the definition of the disease. In that part of it are also types of epilepsy and the reason for its occurrence. Then shows what psychiatric disorder may be accompanied by or be a consequence of this disease. The last part contains an analysis of the Code of Canon Law regarding consensual incapacity to marry. It has been the conditions for causing inability to consent a valid marriage.

Autor artykułu odpowiada na pytanie: Co rozumiemy przez niezdolność owocnego przyjęcia sakramentu bierzmowania? Jest to brak warunków niezbędnych do pomnażania łask wynikających z przyjętego sakramentu. To rodzaj odporności na wykorzystanie wszystkich darów, które są związane z przyjęciem sakramentu. Niemożność ta powoduje utratę siły danej przez Pana. Autor omawia przyczyny tej niezdolności, a jednocześnie pokazuje czynniki, które mogą zwiększyć owocne przyjmowanie sakramentów, koncentrując się na sakramencie bierzmowania. Wśród czynników stojących na przeszkodzie pełnego przyjęcia daru autor przedstawia: netoholizm, fonoholizm (uzależnienie od Internetu i telefonu komórkowego), defamiliaryzację (pomniejszanie wartości rodziny), „nieodpowiedzialność”, dewocję, psychobójstwo i duchobójstwo, natręctwo globalnych trendów i brak kreatywności duszpasterskiej w pracy ze współczesną młodzieżą. Ukazuje również czynniki, które mogą wspierać zdolność nastolatków w skutecznym przyjęciu sakramentu bierzmowania. Należą do nich metody ewangelizacyjne, współczesna afirmacja integralnego rozwoju „plastyczność” osobowości, pragnienie wspólnoty wynikające z potrzeby rozwoju, tęsknoty za sacrum i szukaniem drogi życiowej.
The author of the article answers the question: What do we mean by one’s inability to receive fruitfully the sacrament of Confirmation? It is a lack of the conditions necessary to multiply graces associated with a particular sacrament. It is a kind of resistance to the use of all the gifts that are connected with the reception of the sacrament. This inability causes one to become a person who wastes the power given by the Lord. The author then discusses the reasons for this inability and simultaneously shows the factors which can enhance a human being’s fruitful reception of the sacraments, especially of the sacrament of Confirmation. Among the factors of inability, the author includes: netoholism, phonoholism (addiction to the internet and the cell phone), defamilization (the undoing of the family), “irresponsibilism”, epidermal (superficial) religiosity, psychocide and spiritocide (the killing of the psyche and the spirit), intrusiveness of global trends and the lack of pastoral creativity for today’s youth. The author also reveals factors which can promote the ability of teenagers to make the sacrament of Confirmation effectively: the multiplicity of methods of evangelization, modern affirmation of integral development, “plasticity” of personality, the desire for community resulting from development, the longing for the sacred and the search for a way to live.

The article presents possible application of the theory of semi-Markov processes in creating the eight-state model of the process of appearance of the propulsion systems ability and inability states on sea-going vessels performing transportation tasks in a relatively long operating time t (t → ∞). The model has been proved to be able to be successfully used for determining the reliability of the abovementioned systems. The probability of faultless operation in time t was assumed the measure of system reliability. Operating situations of sea-going vessels were characterised, with special attention being paid to the fact that the loads of propulsion system components of these vessels are of random nature. These loads lead to damages which for this reason were also considered random events. It was also assumed that the damages provoke the appearance of states of inability of particular ship propulsion system components which means that these states are random events as well. The states of ability of a given ship propulsion system have been assumed to exist when all components of this system are in the state of ability. In case when at least one component is in the state of inability, the entire system is in the state of inability. Conditions were formulated for the reliability model of an arbitrary system to be able to be worked out in the form of the semi-Markov process. The need for the use of technical diagnostics in reliability examination of sea-going ship propulsion systems was indicated. In conclusions, certain qualities of the article were highlighted which are, in author’s opinion, of highest importance in reliability examination of sea-going ship propulsion systems.

Opis:
This study was to determine the main health-related reasons, age and occupation of those who took early retirement due to total work inability. This was done through an analysis of the data from Poland’s Social Insurance Institution (ZUS) from 2000 and 2001. An analysis of these data showed an increase in the number of certificates confirming total inability to work in people over 40 years old. Over 50% of certificates work were issued to workers in 2 age-groups: 45–49 and 50–54. Diseases of the circulatory system, musculoskeletal system and connective tissue as well as mental and behavioural disorders are the main causes of early inability to work. Approximately 70% of people who obtained certificates confirming total inability to work had blue- and blue-and-white-collar jobs.
