    Opis:
    The paper aims to analyse selected legal and economic issues connected with control of concentration in the banking sector in Poland. The antitrust law aims to counteract the monopolisation of the market. Undertakings, including banks, can take actions which lead to mergers or takeovers which can strengthen the market power of some of them. The antitrust authority has normative instruments to influence the market in order to counteract its monopolisation. These instruments usually concern control of the concentration of companies (also banks).  In Poland, the antitrust authorities (the President of the Office of Competition and Consumer Protection – UOKiK) also have a legal instrument which can counteract the anticompetitive actions of banks. Because of the specific features of the financial market and financial services, general characteristics of these issues are presented in the paper. Moreover, the methods of measurement and aims of control of concentration are analysed. The main legal instrument of limiting the concentration is connected with an administrative procedure. Therefore, general provisions of these procedures are also shown in the paper. To illustrate the above-mentioned theoretical issues the statistical data concerning the level of concentration in the Polish banking sector is also analysed.

    Opis:
    During the global financial crisis, regional banks – dependent on local savings and only able to lend these savings to customers within their respective regions – helped avoid a credit crunch in some countries; while in others, they did not fulfil this function. This paper elaborates governance structures that influenced the success of regional banking systems in Spain, with regard to regulation principles, the overall economic and political structures, and self-organisation of regional banks. With respect to the high importance of the decentralised banking sector in Germany, the paper compares the state of decentralised banking between Spain and Germany, concluding that the regional principle in Germany, a decentralized state structure with mechanisms of regional balance, and the self-governance of regional banks are important factors.

    Opis:
    The energy market is one of the network industries, where competition can not develop under natural conditions. The energy market in Poland is one of the sectors that are subject to regulation and reglamentation. Regulatory authority has been created to bring competition and provide universal services/essential facilities, on this part of monopolistic market. The regulator has a lot of law instruments to create a competition market where every entrepreneur will be able to effectively undertake an economic activity and prices will be shaped by the market. If the regulator will use all legal instruments, he must be independent of other private entities operating in the market. In particular he must be independent of the government, which is pursuing to implement particularistic policies of each Member State. How Polish regulator can be independent if the government can create a national energy policy? On the basis of European law and the rights of Polish, indicated that the regulatory authority should not implement government policy as a whole, but take into account only government general policy guidelines. Prime Minister or member of the government cannot impose resolution of the case in a particular way if regulatory authority performs his own regulatory duties and powers. However, Prime Minister supervises the regulator and he may issue him binding guidelines and recommendations, which do not apply, however, the regulatory tasks.
