The Rule of Law serves, under a broadly accepted notion of justice, the enforcement of property rights and a relative predictability of citizen affairs, i.e. it fosters Public Value. However, it is subject to risks that materialise in weakened institutions, uncertainty and transaction costs. The connection between Public Value and the Rule of Law becomes salient when understanding how the latter degenerates at the expense of the former. This article provides two theoretical frameworks that explain the connection between the two concepts, as well as three manifestations of the Rule of Law’s decay. These comprise the excess of legal-formalism, the excess of discretion in enforcement and the instrumentalisation of the law, i.e. when it embodies injustice. Although they vary depending on the legal system, these aspects build a conceptual body that illustrates how contingent legal outcomes affect society, developing Daly’s (2019) concept of democratic decay in the economics and business literature.

This paper focuses on reconstructing the history of the so-called Russian Formalism and the avantgarde context of OPOYAZ’s inception in Petersburg in 1914. Victor Shklovsky’s lecture-manifesto titled “The resurrection of the word”, which he presented in the café “Brodyacha Sobaka” (“The Stray Dog”) in Petersburg, marked the symbolic beginning of this movement. The anniversary of the foundation of the Russian Formal School as well as the international congress commemorating this anniversary, which was organized in Moscow in 2013 (titled “The 100th Anniversary of Russian Formalism: 1913–2013”) provide a starting point for discussing the legacy and topicality of the Russian Formalism in contemporary literary studies.

The aim of the paper is to present the history of the Moscow Linguistic Circle whose membershave laid the foundations for themodern, linguistic-oriented literary theory since 1915. The goal of the thesis is to follow the process of establishing the literary theory as an autonomous scientific discipline with its specific research subject, appropriate tools, and terminology. The case of the Circle illustrates that the scientific intuitions of young scholars from Moscow were often ahead of many trends in the twentieth century humanities (e.g. structuralism, statistical poetics, urban studies, sociolinguistics). For this reason the discussion on the intellectual heritage of the Moscow Linguistic Circle is also the reinterpretation of the history of the modern literary theory – necessary in the light of the available, yet poorly recognized archival documents.

W artykule zostają przybliżone argumenty nieomawianej dotychczas szerzej w polskich badaniach debaty metodologicznej toczonej w ramach współczesnych adaptation studies. Autor opisuje trzy tendencje charakterystyczne dla najnowszych teorii adaptacji: metateoretyczne próby przeramowania pojęcia adaptacji, krytykę podejścia typu medium specificity oraz otwieranie się na konteksty kulturowe, społeczne i ekonomiczne. Zdaniem autora jednym z największych wyzwań stojących przed studiami nad adaptacją jest przełamanie obowiązującego w obrębie dyscypliny podziału na badania tekstualne i kontekstualne (na który zwracała uwagę Kamilla Elliott). Kategorią, która może stanowić pomost między ujęciami formalistycznymi a kulturoznawczymi, jest pojęcie dyskursu, które nie było dotąd przedmiotem poważnej debaty w ramach dyscypliny. Posługując się przykładami polskich adaptacji z ostatnich lat, autor wskazuje na możliwe sposoby zastosowania tej kategorii w badaniach porównawczych.
The article presents the methodological debate in contemporary adaptation studies, which has not been discussed in greater detail in Polish research. The author describes three trends characteristic of the latest adaptation theories: metatheoretical attempts to reframe the notion of adaptation, criticism of medium-specificity approach, opening up to cultural, social and economic contexts. According to the author, one of the greatest challenges that adaptation studies faces is to overcome the discipline’s division into textual and contextual research (which was noticed by Kamilla Elliott). A category that could link formalistic and cultural approaches is, as the author argues, the category of discourse, which has not been the subject of a broader debate within the discipline so far. Referring to the examples of the latest Polish film adaptations, the author indicates possible ways of applying the concept of discourse in comparative studies.

To calculate the transmission coefficient of ultrasonic waves through a multi-layered medium, a new approach is proposed by expanding it into Debye’s series. Using this formalism, the transmission coefficient can be put in the form of resonance terms series. From this point of view, the relative amplitude of the transmitted wave can be considered as an infinite summation of terms taking into account all possible reflections and refractions on each interface. Our model is then used to investigate interaction between the ultrasonic plane wave and the N-plane-layer structure. Obviously, the resulting infinite summation has to be reduced to a finite one, according to some level of accuracy. The numerical estimation of the transmission coefficient using the exact expression (Eq. (1)) is then compared to the one of our method in the case of two or three plane-layer structure. The effect of the order of the finite summation on the calculated value of the transmission coefficient is, as well, studied. Finally, our proposed method may be used, with the decomposition into Gaussian beams of a pressure field created by a circular source, to draw a 3D image of the pressure field transmitted through a multilayered structure.

The article explores the polarisation within the body of twentieth century criti-cism surrounding Samuel Beckett’s work: A polarisation between strict forma-list approaches which tend to see Beckett as very much part of a modernist tradition and poststructuralist theorists who seek to categorise his work in terms of postmodernism. As an unfortunate result of extreme critical standpoints, the philosophical thinking of Schopenhauer, which had such a profound and lasting influence on both Beckett’s approach to writing as well as to the theatre, has been largely ignored or simply pushed to one side.

Time-symmetric formulation of quantum mechanics—the two-state vector formalism—is presented as a tool for studying past behaviour of quantum systems. A role of weak measurement and weak values in the Cheshire Cat effect and a nested (Vaidman) three-path interferometer are discussed. Interpretation of a particle’s faint trace indicating possibility of discontinuous paths of particles passing the Vaidman interferometer is given. Consistent histories are presented as one of alternative approaches. Multitude of controversial issues is briefly reviewed and discussed.

Zasada efektywnej ochrony sądowej stanowi element unijnego porządku prawnego, systemu konwencyjnego oraz występuje w systemach krajowych. Podstawowym elementem skutecznej ochrony prawnej jest prawo do sądu (art. 47 zd. 1 Karty Praw Podstawowych Unii Europejskiej, art. 6 ust. 1 Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności). Zasada sprawnej egzekucji stanowi istotę prawa do sądu. Sprawna egzekucja sprzyja pogłębianiu zaufania obywateli do organów wymiaru sprawiedliwości. Zdaniem Trybunału Konstytucyjnego wykonanie orzeczenia jest integralną częścią procesu. Postępowanie rozpoznawcze stanowi tzw. „fazę wstępną”, zaś egzekucja służy właściwej realizacji efektywnej ochrony sądowej. Postępowanie egzekucyjne służy zaspokojeniu roszczeń wierzyciela, których nie udało mu się uzyskać dobrowolnie. Zasada sprawnej egzekucji w pełni realizuje interes wierzyciela, nie zaś dłużnika. Egzekucja sądowa, stanowiąca istotę postępowania egzekucyjnego, powinna przebiegać w sposób sprawny i szybki. Sprawność egzekucji gwarantują stosowane przez organy egzekucyjne, tj. komornika oraz sąd, środki przymusu przewidziane w ustawie procesowej. Zasada prawa do sądu (art. 45 ust. 1 Konstytucji RP) oraz zasada demokratycznego państwa prawnego (art. 2 Konstytucji RP) chronią egzekucję prawomocnych wyroków. Postępowanie egzekucyjne wyróżnia działanie dwóch naczelnych zasad postępowania cywilnego, tj. zasady formalizmu oraz dyspozycyjności.
The principle of effective judicial protection constitutes an element of the EU law, the Convention system and is found in national systems. The right to a court is a fundamental element of effective legal protection (Article 47/1 of the Charter of Fundamental Rights of the European Union, Article 6, Paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms). The principle of effective enforcement is the essence of the right to a court. Efficient execution enhances citizens’ confidence in the law. According to the Constitutional Court, the execution of a court ruling is an integral part of the trial. Examination proceedings constitute the so-called “preliminary stage”, and the execution serves the proper implementation of effective judicial protection. Enforcement proceedings serve the fulfillment of the creditor’s claims, which he has not been able to obtain on a voluntary basis. The principle of effective enforcement fully serves the interests of the creditor, not the debtor. Court enforcement, which is the essence of enforcement proceedings, should be conducted in a fast and efficient manner. The efficiency of enforcement is ensured by enforcement bodies, i.e. bailiffs and courts, coercive measures provided for by the law of civil procedure. The principle of the right to a court (Article 45, Paragraph 1 of the Constitution of the Republic of Poland) and the principle of democratic rule of law (Article 2 of the Constitution of the Republic of Poland) protect the execution of final judgments. Enforcement proceedings is distinguished by the operation of two main principles of civil proceedings, i.e. the principle of formalism and availability.

The essay deals with the complex issue of voluntary formalism, regulated in the articles 1326 paragraph 4 and 1352 of the Italian Civil Code, and the exegetical problems connected to it. The study aims to verify whether the voluntary formalism occupies the same role or not and fulfills the same functions as the legal formalism. Then the relationship between the voluntary forms and the classic pathologies related to contracts has been investigated in order to verify the possibility of tracing the whole theme of the forms chosen by the parties within the different problem of the formation of the contractual agreement.

The dynamics of elastic plane waveguides is studied on the basis of the extended formulation of the plate theory of Nth order. The plate model is based on the Lagrangian formalism of analytical dynamics combined with the dimensional reduction approach and the biorthogonal expansion of the spatial distribution of the displacement. The boundary conditions shifted from the faces onto the base plane are interpreted as constraints for the variational formulation of two-dimensional plate models. The normal wave dispersion in plates is modelled, the convergence of the approximate solutions is studied using the known exact solution for a plane layer as a reference. The proposed plate theory is used to analyse the normal wave dispersion in power graded waveguides of both symmetric and asymmetric structures, the locking phase frequencies for various power indices are computed.
