The main subject of this article is an attempt to resolve whether and on what principles active financial market participants were entitled to continue their activities related to trading in financial instruments during the so-called transition period determined by the provision of Article 29 of the Act of 1 March 2018 amending the Act on Trading in Financial Instruments and certain other acts (Dz.U. [Journal of Laws] of 2018, item 685). To this end, the authors have interpreted this provision in the context of the overall regulation of the amending act, with particular attention paid to the new wording of the definition of trading in financial instruments. The analysis of the indicated issues is carried out primarily from the point of view of active participants of the financial market, which constitutes a significant enrichment of the studies that have so far dealt with the discussed problem. Against the background of the above considerations, the authors draw attention to the influence of the Polish Financial Supervision Authority (Financial Supervision Commission) on other financial market participants, especially in relation to the supervisory proceedings conducted by the Authority and the supervisory measures applied. As a result of the conducted deliberations, the authors notice that the imprecision and incompleteness of the content of the analysed legal acts may be connected with significant negative consequences for the financial market participants, primarily in the form of financial sanctions.

Purpose: The purpose of the paper is to identify the factors that affect the development of the models of financial market state supervision and to identify the factors that have influenced the evolution of the supervision model in Poland. Methodology: critical analysis of literature, legal provisions and documents. Findings: The completely integrated and the fully dispersed model of supervision are located at the opposite ends of the spectrum. A variety of the hybrid models can be identified between them. Factors that affect supervision organization are both economic and non-economic. Factors that have influenced the Polish model of supervision include political aspects, administration costs and, in due course, also the development of the financial market. Research implications: The variety of state supervision structures, combined with the ambiguity and multiplicity of factors that affect their evolution create a new research challenge. Significant problems in accessing documents have been identified. Originality: The author presents an overview of models of state supervision of financial markets and factors affecting the evolution and structure of supervision. Conclusions drawn from the analysis were used to identify factors that influence the evolution and supervision of the Polish financial market.

Many countries in Latin America and the Caribbean now publish financial stability reports. They use FSRs as a tool for financial surveillance and communication. This study reviews their latest issues to assess their content, quality, and transparency, and the extent to which the country’s macrofinancial and institutional context affect the quality of the publications. While some reports provide a strong analysis of risks and vulnerabilities, there are significant cross-country differences, and many reports could be improved by adopting a more comprehensive, forwardlooking, and thematic assessment of financial stability. A well thought out communication strategy, including a regular and predictable publication schedule and an easily accessible website, is also important to enhance the impact of the reports. Data gaps, particularly at the disaggregated level, are material and need to be urgently addressed.

Purpose – The article was written to outline of the evolution of the Polish financial system supervision model evolution in the context of the 30 years of economic transformation and substantial changes of the institutional environment. Research methodology – The conducted historical analysis shows that several global trends influenced local solutions starting from neoliberal self-regulation sectoral approach to the more statecontrol oriented integrated model. The author describes the mechanism that drove the evolution of the Polish financial system and presents how the financial supervisory responded to these changes. The most important part of the article is devoted to the description of the Polish financial sector’s response to the last financial crisis and the role that the financial supervisory model played in finding successful solutions for complex risks transmitted from international financial markets. Finding – The article allows to understand better the financial system’s role in the sound economic development and the new systemic perception of the financial stability and encourages researchers to search for new financial and macroeconomic paradigms to be able to explain free-market failure in ensuring proper functioning of financial intermediation and finding a new solution that make the local and global financial system immune to inevitable future shocks. The main scope of the research is concentrated around the extended institutional supervisory framework with macroprudential policy as a new driving force for post-crisis regulatory order that the Polish banking sector must join. Originality/value – According to the knowledge of the author, it is one of the few articles concerning development of the Polish financial system and financial supervision in the context of institutional changes in the global and local regulatory framework after post-socialist transformation and 2007+ crisis.

The Polish Financial Supervision Authority (hereinafter: KNF) is the key element of the economic security system of the Polish State. By establishing the KNF, the Polish legislator applied the concept of integrated financial supervision (covering bank supervision, insurance supervision and capital market supervision) located outside the central bank. The KNF has been vested with a broad mandate, including powers to supervise authorised entities. However, the scope and nature of measures available to the KNF in the prevention of economic crime are determined by the institutional position of the KNF, which has not been established as a law enforcement authority or a uniformed or special service but rather an institution engaged in the fight against economic crime by providing expertise, supporting other state services specialised in this area. The KNF and the Office of the Polish Financial Supervision Authority (hereinafter: UKNF) actively support, among others, the police units that fight crime in the financial market and work to increase the economic security of the Polish State. Therefore, it is imperative to ensure broad and efficient cooperation between the police and the KNF. However, such collaboration must not be limited to relations between the institutions’ management; it should also involve, as far as possible, working and operational activities carried out at both institutions by individuals responsible for day-to-day tasks. This paper provides a closer perspective on the formal and organisational framework of said cooperation and discusses its examples.

Present article discusses some of the key issues introduced to the US federal law in 2010 to ensure the stability of the financial sector in the United States. Special attention was paid to two issues, i.e. the rules and procedures under which the FSOC may considered a non-banking finance company to be important from the point of view of stability of the US financial sector (and in such situation trigger supplementary supervision by the FRS) and the procedure for controlled liquidation of a financial company considered by the FSOC to be a risk to the stability of the US financial system.

This article presents certain aspects of the banking supervisory process in selected European countries. The aim of the author is to analyze historical and present organizations of supervision models in France and Switzerland. The economic situation in Europe after last financial crisis (2007–2009) has resulted in a large number of transformations in supervisory organizations, both on the European level and in individual countries. In practice the most changes was addressed on the model based on two pillars, where the first institution is responsible for prudential supervision (both macro and micro) and the second – for overall functioning supervised institution. The main goal is to present if the transformation on the European level – in fact – determine similar direction in transformation of organization of financial supervisory model in two selected countries. This analysis is concentrated on one of the financial area – banking services.
W artykule przedstawiono niektóre aspekty procesu nadzoru bankowego w wybranych krajach europejskich. Celem autora jest analiza organizacji historycznych i obecnych modeli nadzoru we Francji i Szwajcarii. Sytuacja gospodarcza w Europie po ostatnim kryzysie finansowym (2007–2009) zaowocowała dużą liczbą przemian w organizacji nadzoru, zarówno na poziomie europejskim, jak i w poszczególnych krajach. W praktyce większość zmian została skierowana na model oparty na dwóch filarach, gdzie pierwsza instytucja jest odpowiedzialna za nadzór ostrożnościowy (zarówno makro, jak i mikro), a druga – za ogólne funkcjonowanie nadzorowanych instytucji. Głównym celem jest pokazanie, czy transformacja na poziomie europejskim – w rzeczywistości – określa podobny kierunek transformacji organizacji modelu nadzoru finansowego w dwóch wybranych krajach. Analiza ta koncentruje się na jednym obszarze finansowym – usług bankowych.

Stabilizacja systemu finansowego i przeciwdziałanie kryzysom gospodarczym są współcześnie jednymi z najważniejszych wyzwań i obszarów aktywności władzy publicznej. Na przestrzeni ostatnich lat, w wielu państwach można było zaobserwować procesy instytucjonalizacji nowej „perspektywy makroostrożnościowej”, która w przeciwieństwie do dotychczasowych rozwiązań obejmuje cały system finansowy. Równocześnie powstała pewna nowa siatka pojęciowa, która jednak zdaje się ignorować dotychczasowe konwencje terminologiczne. W szczególności błędnie używa się pojęcia „nadzór” zamiast „polityka” lub niekiedy pojęcia te traktuje się jako synonimy. Teza ta dotyczy zarówno aktów prawnych UE, jak i prawa krajowego (np. w Polsce), a także nazewnictwa stosowanego w literaturze, gdzie brakuje pogłębionej, interdyscyplinarnej analizy w tym zakresie, jak również zestawień porównawczych pozwalających uporządkować używane pojęcia. Dlatego celem tego opracowania jest usystematyzowanie najważniejszych terminów stosowanych w obszarze stabilności finansowej oraz doprecyzowanie ich znaczenia poprzez wskazanie właściwych desygnatów pojęciowych.
Stabilization of the financial system and counteracting economic crises are among the pressing challenges and public authority tests. In recent years, in many rankings, it was possible to see that the institutional paths of the new "macroprudential perspective", which in the letters to the supplements to date, cover the entire financial system. Simultaneously, a new conceptual network has emerged, which seems to ignore the existing terminological conventions. In particular, the term "supervision" is misused instead of "policy" or is sometimes used synonymously. The thesis also applies to EU legal and national law (e.g., in Poland) and the nomenclature used in the literature, where there is no in-depth, interdisciplinary analysis in this area and comparative summaries of the terms used. Therefore, the purpose of this paper is to systematize the most important terms used in the area of financial stability and to clarify their meaning by indicating the correct conceptual designations.

The article discusses problems created by the introduction of foreign currencies mortgage loans (especially indexed to the Swiss Franc) into the mass consumer market in Poland (mainly in years 2005–2008). Approximately 900 thousands of Polish consumers have their mortgage loans indexed to foreign currencies. This kind of loan became very popular due to lower interest rates. However, indexation of mortgage loan to foreign currency has also exposed borrowers to foreign exchange risk of which consumers were insufficiently informed. This risk has materialised to some extent with sharp increases in CHF exchange rate in 2009 and 2015. The article reports the unsuccessful attempts of self-regulation of the banking sector as well as delayed actions undertaken by regulatory bodies, namely the Banking Supervision Authority, and subsequently, the Polish Financial Supervision Authority, which tried to limit the scope of such risky loans on the consumer market. As political attempts to solve the problem have also been unfruitful, the individual litigations in civil courts have become of particular significance. The courts have not reached a common approach to individual claims yet. In some judgments such loans are declared null and void, in others orders are issued to perform the loans but disregarding the unfair terms of indexation. There are also judgments that declare such contracts perfectly legal. The author discusses the present case-law and presents a preferred direction of action which in his opinion may provide full protection of consumers against unfair contract terms which would be at the same time in line with the requirements of the Court of Justice of the European Union.

The correct risk identification, its measurement and setting its acceptable level are the basis for credit risk management in every bank, as well as the whole banking system. The last subprime crisis in the USA clearly showed that irresponsible behaviour of market participants may destabilise the financial system, causing serious consequences, both social and economic, not only for the banking system of a particular country, but also for the global financial system. The new areas of risk which are emerging nowadays force local as well as international regulators and supervisors to take serious actions in order to limit this risk and prevent any future crisis. In the following dissertation actions taken by the Polish banking supervisor, concerning mortgage loans, have been analyzed in order to establish the impact they have had on the development of the mortgage market, as well as quality and safety of its credit portfolio for the Polish banking system. The considerations were mostly based on the analysis of supervisory recommendations published by Polish Financial Supervision Authority. They describe good practices in the field of retail credit risk management (Recommendation T) as well as residential mortgage loans and loans secured by mortgage (Recommendation S). The content also includes references to EU regulations.

Celem niniejszego artykułu jest analiza organizacji oraz działania Europejskiego Systemu Nadzoru Finansowego – instytucji zapewniającej zaufanie do systemu finansowego jako całości oraz odpowiedniej ochrony konsumentów. Autor postanowił przeanalizować stwierdzenie, że Europejski System Nadzoru Finansowego jest odpowiednią instytucją nie wymagającą zmian, która zapewnia konsumentom odpowiednią ochronę. W artykule przedstawiono na podstawie analizy literatury przedmiotu, istotę działania Europejskiego Systemu Nadzoru Bankowego, zdefiniowano pojęcia dotyczące nadzoru finansowego oraz wskazano jak wpływa ten organ na ochronę konsumenta. Dokonano podsumowania, w którym została zawarta tabela z porównaniem instrumentów ochrony konsumenta stosowanych do poszczególnych europejskich urzędów nadzoru oraz Komisję Nadzoru Finansowego.
The purpose of this article is to analyze of the organization and operation of the European System of Financial Supervision – an institution that ensures trust in the financial system as a whole and adequate protection of consumers. The autor decided to analyze the statement that European System of Financial Supervision is an appropriate institution that does not require changes, which provides consumers with adequate protection.

The COVID-19 pandemic has significantly influenced the functioning and organisation of financial institutions in Poland and the cybersecurity mechanisms associated with it, due to the change in the model of functioning of these institutions. Changes to the way institutions function have been introduced under the influence of evolving restrictions and regulations, often in a manner which went beyond previously planned scenarios of action. The experience gained in this way should be included in the business continuity plans and procedures of financial institutions. It is also worth considering what changes should be permanently implemented by financial institutions, and what adaptations in the field of cybersecurity will be required. These adjustments should take place in interaction with the Polish Financial Supervision Authority, to maintain an appropriate level of security and quality of services rendered.
