Research background: As part of the creation of an effective mechanism for managing financial stability, the tasks of providing an inter-level and cross-sectoral financial equilibrium remain unresolved. So far, clear and unambiguous criteria for financial stability have not been formulated, with which monetary and prudential policies could be related, as well as measures to minimize systemic and individual risks. The problem of creating a system of indicators comes to the fore, allowing the creation of new effective instruments for regulation of financial flows that contribute to the prevention of financial crises. Purpose of the article: The paper proposes a system of indicators of financial stability, which allows for solving the tasks of inter-level and cross-sectoral equilibrium in the selection of regulatory tools for monetary and prudential policy. Methods: We have used real interest rates as a measure of financial stability at the macro level. The real rates have been calculated from time series with nominal interest rate and inflation in the credit market (divided into loans to financial and non-financial organizations and individuals), and in the bond market (divided into corporate, municipal, and federal bonds). The analysis of the market and institutional financial stability of the USA, Russia, Japan, Switzerland, Australia over the period 1984?2014 was done. Then, comprehensive investigation on the financial stability in the Russian Federation in 2014?2017 was conducted. The results have been compared against financial stability of individual banks, which was measured using profit to risk ratio. The latter has been calculated from bank?s financial reports using our method, which had been developed earlier. Findings & Value added: We have developed criteria for qualitative assessment of financial stability and the risk map, which helps to identify the level of accumulated imbalances in the market and institutional environment, as well as in the levels and sectors of the economy. The criteria for selecting monetary and prudential regulatory instruments have been formulated depending on the amount of accumulated risks. The criteria for forming a portfolio of regulatory instruments with regard to their rigidity are proposed.

Many countries in Latin America and the Caribbean now publish financial stability reports. They use FSRs as a tool for financial surveillance and communication. This study reviews their latest issues to assess their content, quality, and transparency, and the extent to which the country’s macrofinancial and institutional context affect the quality of the publications. While some reports provide a strong analysis of risks and vulnerabilities, there are significant cross-country differences, and many reports could be improved by adopting a more comprehensive, forwardlooking, and thematic assessment of financial stability. A well thought out communication strategy, including a regular and predictable publication schedule and an easily accessible website, is also important to enhance the impact of the reports. Data gaps, particularly at the disaggregated level, are material and need to be urgently addressed.

The article presents the outcome of the research executed by the author, which formed the position of the European Financial Congress (EFC) in relation to the Financial Stability Board’s consultative document on Funding Strategy Elements of an Implementable Resolution Plan. The position, was based on the opinions of stakeholders of Polish financial market, represented by banks, regulatory bodies, law firms and the academia. The consultative document set out proposed guidance on the development of a plan for funding banks in resolution. The research revealed a wide array of challenges in the development of firm capabilities to facilitate the execution of the funding strategy in resolution. Additional issues were raised regarding relevant aspects for estimating liquidity needs in resolution process. There were indicated numerous obstacles to the mobilisation of assets that could be used as collateral for particularly private sector backstop sources of funding. All those blocking points could be removed by public sector support funding, subject to certain conditions. Moreover, there are a number of actions that could be taken by G-SIBs and authorities to support the development and implementation of resolution funding and there are also some other aspects of funding strategy which shall be also considered.

Financial stability inside the European Monetary Union (EMU) is a trendy topic in most developed countries around the world. From the moment the EMU was brought to life, there was much speculation about its imperfections, inadequate management, and vulnerability. Some of them have turned out to be true, while others have been proved invalid. Nevertheless, the debt crisis has demonstrated inadequacies in the EMU’s structure and proved that a higher degree of integration is necessary in order to guarantee the robustness of the common currency and fully utilize its potential. This article summarizes the most serious doubts with respect to the functioning of the monetary union and evaluates their credibility over time. New financial stability-securing solutions are also described and analyzed as to whether they are sufficient to prevent Europe from stumbling from one crisis to another. The subject is analyzed over different periods of time - firstly describing the term “financial stability”, along with the major concerns about the process of introducing the euro at the time of its finalization and implementation. Secondly the article describes how these preceding doubts have been verified during the following fourteen years of the EMU’s functioning. The revealed weaknesses of the EMU are also underlined in order to prove the need of further integration. The final section summarizes the solutions implemented in response to the crises that have hit Europe during the time of the Euro’s functioning.

We built a logistic regression Early Warning Models (EWM) for banking crises in a panel of 47 countries based on data from 1970–2014 using candidate variables that cover macro and financial market indicators. We find that VIX, a proxy of global risk-premium, has a strong signalling properties and that low VIX (low price of risk) increases likelihood of crisis. It does not only mean that stability leads to instability, but that this tends to be a global rather than a domestic phenomenon. We also find that particularly high contribution of financial sector to GDP growth often precedes crises, suggesting that such instances are primarily driven by excessive risk taking by financial sector and may not necessarily be sustainable. Other variables that feature prominently include credit and residential prices. Models using multiple variable clearly outperform single variable models, with probability of correct signal extraction exceeding 0.9. Our setting includes country-specific information without using country-specific effects in a regression, which allows for direct application of EWM we obtain to any country, including these that have not experienced a banking crisis

The main aim of this article is to provide a critical analysis of selected provisions of the Directive and Regulation in respect of the capital requirements for banking and finance sector in the European Union. It focuses on the analysis of the following aspects: (i) proposed regimes, mechanisms and legal structures creating the European framework on the capital requirements; (ii) implications of the new legislation for the banking sector and for the national regulatory authorities; (iii) certain similarities between the Third Basel Accord prepared by the Basel Committee on the Banking Supervision and the proposed EU capital requirements package; and (iv) implications of the legislation for the Polish banking and finance sector. As the global financial crisis reshaped the approach to the banking institutions throughout the world, the authorities started to be more concerned about the safety and creation of certain mechanisms preventing the sudden issues of the banks and financial institutions, which were in consequence resolved by the taxpayers. The cooperation between EU authorities and the Basel Committee on Banking Supervision resulted in the creation of the new framework on the capital requirements for the European Banking sector. To a certain extent, the EU proposal is a part of global, legal framework setting out harmonized rules ensuring the general stabilization in the banking and finance sector. It also constitutes a continuation of the EU policy on ensuring the safety of the European banking and finance sector.

Purpose – The article was written to outline of the evolution of the Polish financial system supervision model evolution in the context of the 30 years of economic transformation and substantial changes of the institutional environment. Research methodology – The conducted historical analysis shows that several global trends influenced local solutions starting from neoliberal self-regulation sectoral approach to the more statecontrol oriented integrated model. The author describes the mechanism that drove the evolution of the Polish financial system and presents how the financial supervisory responded to these changes. The most important part of the article is devoted to the description of the Polish financial sector’s response to the last financial crisis and the role that the financial supervisory model played in finding successful solutions for complex risks transmitted from international financial markets. Finding – The article allows to understand better the financial system’s role in the sound economic development and the new systemic perception of the financial stability and encourages researchers to search for new financial and macroeconomic paradigms to be able to explain free-market failure in ensuring proper functioning of financial intermediation and finding a new solution that make the local and global financial system immune to inevitable future shocks. The main scope of the research is concentrated around the extended institutional supervisory framework with macroprudential policy as a new driving force for post-crisis regulatory order that the Polish banking sector must join. Originality/value – According to the knowledge of the author, it is one of the few articles concerning development of the Polish financial system and financial supervision in the context of institutional changes in the global and local regulatory framework after post-socialist transformation and 2007+ crisis.

The paper discusses the role of monetary policy in preventing financial crises and offsetting their implications. The paper provides a critical evaluation of views on the relationship between monetary policy and financial crises. The author looks at this issue in the context of practical experiences, especially those coming from the U.S. market, where the analyzed ties seem to be the most prominent. The author concludes that a monetary policy exclusively focused on the prices of goods and services and oriented toward keeping inflation in check in the short term, may create an environment conducive to the outbreak of a financial crisis. The probability of such a situation is especially high if the financial market is heavily liberalized and poorly supervised, Koronowski says. However, the main conclusion is that a financial crisis may be prompted by an excessive, prolonged increase in the liquidity of the banking sector after a decline in financial stability or as a result of failed central bank attempts to stimulate credit expansion and economic growth. Yet another conclusion is that monetary policy must be stable not only in terms of inflation, but also in terms of the price of money, Koronowski says. This is indispensable for a healthy financial sector and robust economic growth, the author adds.

Banks in Poland have survived global financial crisis which began in 2008, much better than banks in many other countries in Western and Central Europe. The author lists and analyzes factors which contributed to maintain liquidity and financial stability of the banking sector. The most important include inter alia: strong macroeconomic bases of economy before the crisis, relatively less reliance on foreign capital and lower dependence on external trade, a lower level of households debt, a relatively high capitalization of banks and appropriate policy intervention. As the author suggests, maintaining stability of this sector will require new regulatory decisions.

The rapid pace of change in economic phenomena combined with the high volatility of financial markets and the growing importance of irrational behavioral factors, encourages a wider use of expert knowledge in macroeconomic forecasting. The aim of the article is to present the results of the fourth edition of the project Macroeconomic challenges and forecasts for Poland. The survey was conducted in the period November 8, 2019 – December 6, 2019. The article presents the prognostic consensus of experts cooperating with the European Financial Congress. In addition to classic macroeconomic forecasts for Poland, it contains threats to sustainable economic development and financial system stability, together with estimates of the subjective probability of implementation. Using the knowledge and competences of experts cooperating with EKF, recommended actions for economic policy were formulated, aimed at weakening the impact of identified threats in the future.

The financial security of economic entities is part of the financial security of the state since the enterprise creates added value, which forms a gross domestic product at the state level. In addition, businesses are the main taxpayers that affect the formation of state and local budget revenues. Therefore, a high level of financial security of an enterprise provides the state opportunities to perform its functions, ensures economic development, and improves social standards. In the context of economic and political instability, in addition to the variability of micro- and macro-environment factors that affect the activity of the enterprise, the assessment of financial security is a particularly pressing issue. The aim of the article is to develop a mechanism for managing the financial security of enterprises in accordance with the actual conditions of business conducted by Ukrainian enterprises. The management mechanism is considered as a certain system, which consists of a certain set of interrelated elements and involves taking actions to achieve financial interests by the timely reduction of financial risks and counteracting external as well as internal threats. In each enterprise, an urgent task is to develop an effective strategy for the development of financial security, which is characterized by the close relationship and interdependence of its individual components. In these conditions, in order to increase the level of financial security of enterprises, the following measures are proposed: reducing the amount of receivables, controlling short-term debt, limiting the need for financial sources, reassessing fixed assets, increasing production volumes and product sales, reducing costs and others.

The crisis begun in 2007 exposed the weakness of the existing regulations, revealing challenges for legislators all over the world. Financial stability started to be understood as an essential value for the proper operation of the financial market. It has become important to address the question as to how to protect financial markets from more crises, or at least alleviate their effects. The idea of supervision of a financial market has undergone thorough transformation. Particular emphasis has been placed on protecting buyers of financial services. Adequate customer protection has been recognized as a sign of trust in the market and its stability and has gained systemic importance and relevance for the European financial system. There is a growing tendency to enlarge the group of subjects eligible for special protection. it is becoming an increasingly common idea that not only consumers but all non-professional customers should be protected. The idea is becoming widespread that the weaker party to a legal transaction can be not only a consumer [natural person] but also a non-professional market entity. Such a solution is certainly appropriate. Narrowing down the ‘consumer’ to a natural person may seem artificial and out of line with market realities, not to mention the serious consequences of bad financial decisions taken by non- professional financial market participants. Another important challenge facing the modern financial market is to establish a system of institutional safeguards to ensure security for all market entities and to enforce fair play rules. However, even the best provisions of substantive law, though necessary, may prove to fall short. Therefore, there is a pressing need for strong and competent both state and international institutions duly equipped with auditing and supervisory powers to deal with the present situation. They should also have the possibility of enforcing substantive laws in a way that allows for flexible responses to any emerging threat to the protected values. The shift towards a regulatory and supervisory method of protection sets a more serious tone for the supervision model adopted for the financial market. In it, the market is responsible not only for ensuring that the supervised entities operate correctly, but also for the quality of services that they provide.

One of important financial stability risks in Poland is relatively high share of bank loans denominated in foreign currency extended to unhedged borrowers. Banks engaged in FX lending are exposed to indirect exchange rate risk (as a component of credit risk) through currency mismatches on their clients’ balance sheets. A significant depreciation of Polish zloty would translate into an increase of value of outstanding debt (also in relation to the value of collateral) as well as in the flow of payments to service the debt. As a result, the debt-servicing capacity of unhedged domestic borrowers would deteriorate, leading to a worsening the financial condition of the private sector. The reduction of borrower’s ability to service the loan and lower recovery rate affects the loan portfolio quality, increases banks’ loan losses. This effect can be mitigated or intensified by foreign interest rates of extended FX loans (i.e. LIBOR). The borrower’s ability to service such loan depends strongly on FX rate but also on monetary authorities from abroad. Therefore both risks are linked and should be considered together. This paper presents the statistical analysis of the dependence of foreign interest rates and FX rate of Polish zloty using measures of dependence, amongst others, copula function approach.
Jednym z najważniejszych zagrożeń stabilności finansowej w Polsce jest stosunkowo wysoki udział kredytów bankowych w walutach obcych udzielonych niezabezpieczonym kredytobiorcom. Banki które udzielały kredytów walutowych są narażone pośrednio na ryzyko kursowe (jako element ryzyka kredytowego) za sprawą niedopasowania walutowego w bilansach swoich klientów. Znacząca deprecjacja złotego przekłada się na wzrost wartości zadłużenia (również w stosunku do wartości zabezpieczenia), jak również na bieżące płatności kredytobiorcy. W rezultacie, zdolność obsługi zadłużenia przez niezabezpieczonych kredytobiorców krajowych uległaby pogorszeniu, co prowadzi do pogorszenia się kondycji finansowej sektora prywatnego. Zmniejszenie zdolności kredytobiorcy do obsługi kredytu i niższy poziom odzysku mają wpływ na jakość portfela kredytowego i zwiększają straty kredytowe banków. Efekt ten może być zmniejszony lub zwiększony przez zagraniczne stopy procentowe obowiązujące dla udzielanych kredytów walutowych (np. LIBOR). Zdolność kredytobiorcy do obsługi takiego kredytu zależy nie tylko od kursu walutowego, ale również od władz monetarnych z zagranicy. Dlatego oba ryzyka są ze sobą powiązane i powinny być rozpatrywane łącznie. W artykule przedstawiono analizę statystyczną zależność zagranicznych stóp procentowych i kursu złotego przy użyciu miar zależności, między innymi, podejście za pomocą funkcji copula.

Purpose – Financial stability has become a focal point for central banks since the global financial crisis. However, the optimal mix between monetary and financial stability policies remains unclear. In this study, the “soft” approach to such policy mix was tested – how often monetary policy (in inflation reports) analyses financial stability issues. This paper aims to discuss the aforementioned objective. Design/methodology/approach – A total of 648 inflation reports published by 11 central banks from post-communist countries in 1998-2019 were reviewed using a text-mining method. Findings – Results show that financial stability topics (mainly cyclical aspects of systemic risk) on average account for only 2%of inflation reports’ content. Although this share has grown somewhat since the global financial crisis (in CZ, HU and PL), it still remains at a low level. Thus, not enough evidence was found on the use of a “soft” policy mix in post-communist countries. Practical implications – Given the strong interactions between price and financial stability, this paper emphasizes the need to increase the attention of monetary policymakers to financial stability issues. Originality/value – The study combines two research areas, i.e. monetary policy and modern text mining techniques on a sample of post-communist countries, something which to the best of the authors’ knowledge has not been sufficiently explored in the literature before.

The paper adds to the discussion of social costs of financial crises through theoretical elaboration, arguing for the position that supporting the stability of financial systems, if combined with public confidence in financial markets and banking, leads to a reduction of social costs by reducing the frequency of crises associated with the long-term development of the financial sphere in the world. Following the theoretical function proposed by Adrian, Covitz and Liang [2014], the author elaborates that prudential regulation may lower the social costs of crises. This calls for an active role of regulating the financial sector and that of the central banks, as the preferred sensitivity of the financial system to shocks may be achieved by prudential regulation and the increasing of transparency of the system, as well as by the management of social perception of stability (security) of this system. The paper postulates the abovementioned relation by reviewing selected empirical studies and framing the discussion in theoretical elaboration on social costs and financial stability.

The main aim of this paper is to reconstruct all new legal components of the legal term „financial stability” and to underline its multilevel understanding and possible meanings of that term, which should framed the new Financial Stability Safety Net in the new supervisory architecture of the EU, where the financial stability is considered as a prerequisite of creation and market law application. The main thesis of this paper is assertion that the financial stability is multielement, multilevel and multifunctional term, which could and should be refered to both, the EU and domestic level as a whole, to financial institutions and supervisors and also to the clients of the financial market. This shows the opinion, that the legal term „financial stability” is to fulfil as a result of the balance, compromise andaccomplishment of the financial market participants legal interests.

The article discusses the issue of the influence of public interest on the regulation of the financial market. The basic challenges for regulators associated with the dynamic development of this market are presented. Anew regulatory paradigm aimed at introducing and implementing values necessary for the proper functioning of the financial market is discussed. The need to protect non-professional participants of this market is emphasized in particular. A new approach to the consumer model is taken into account where the rational consumer has become more susceptible to emotions and irrational behaviors. The special role of financial market stability is highlighted, which has become a kind of public good that is subject to special protection. The way in which public interest materializes in financial market regulations, not only in statutory law but also in soft law norms, is also discussed.

The main objective of the paper is to assess the financial stability of selected business entities using a choice of financial indicators and their modified versions. A review of the literature and the figures describing the research sample allowed for defining the proposed concepts and building selected financial formulae. The study showed that the financial stability assessment of these entities was not unequivocal, though, as there were substantial discrepancies between the values of the individual indicators. This was mainly caused by the seasonality of production or sales, which played a significant role considering the business profile of the food business operators examined. Still, however, the entities that demonstrated financial stability could be told from those that did not. The financially stable group comprised one company, while considerable financial difficulties – including the loss of stability – could be shown for two companies. The results of the study are presented in Figures. The paper is summarized with conclusions from the research.

The aim of this paper is to identify and assess, on a comparative, intra-country basis, the existing practices and developments in central bank accountability for financial stability, from a new–macroprudential policy–perspective. The paper aims to contribute to the ongoing debate on institutional arrangements for macroprudential policy. The debate as to whether the combination of monetary policy and financial supervision within one institution is not new. Nevertheless it is far from being resolved. The paper points to the need to establish clear, formal and robust mechanisms of central bank involvement in the process of executing macroprudential policy, at least as a data collection and analyzing institution.

In the article, the scientific literature on risk accounting when assessing a bank’s financial stability has been analyzed. The necessity of the bank’s financial stability estimation methods improving with consideration of risk factors has been identified. The set of indicators – “risk indicators” - which can be calculated on the basis of the bank’s annual reports, has been proposed. The proposed indicators have been tested on the example of three Ukrainian banks. This paper presents a detailed account of the rich set of macroprudential measures (MPPs) implemented in Bulgaria, Croatia, Romania, and Serbia during their synchronized boom and bust cycles in 2002–12, and assesses their effectiveness in managing credit growth. Only strong MPPs helped contain domestic credit growth during the boom years, but circumvention via direct external borrowing offset their effectiveness to a large extent. MPPs taken during the bust had no discernible impact. The paper concludes that (i) proper calibration of MPPs is of the essence; (ii) only strong, broad-based MPPs can contain credit booms; (iii) econometric studies of macroprudential policy effectiveness should focus on concrete policy measures rather than on instruments use; and (iv) in so doing should allow for possible non-linear and state-contingent effects.

The macroprudential regulatory framework of Basel III imposes the same minimum capital and liquidity requirements on all banks around the world to ensure global competitiveness of banks. Using an agent-based model of the financial system, we find that this is not a robust framework to achieve (inter)national financial stability, because efficient regulation has to embrace the economic structure and behaviour of financial market participants, which differ from country to country. Market-based financial systems do not profit from capital and liquidity regulations, but from a ban on proprietary trading (Volcker rule). In homogeneous or bank-based financial systems, the most effective regulatory policy to ensure financial stability depends on the stability measure used. Irrespective of financial system architecture, direct restrictions of banks’ investment portfolios are more effective than indirect restrictions through capital, leverage and liquidity regulations. Applying the model to the Swiss financial system, we find that increasing regulatory complexity excessively has destabilizing effects.These results highlight for the first time a necessary change in the regulatory paradigm to ensure the effectiveness and efficiency of financial regulations with regards to fostering the resilience of the financial system.

European Supervisory Authorities’ decisions were, from the outset, of particular doctrinal interest, especially in the context of the formal legitimacy to issue them. There are questions as to whether the Agency’s competences in this field should be more on a clearer (than Article 114 TFEU) basis in the primary law of the European Union. It is not surprising that, in 2012, the Court of Justice of the European Union received an action for annulment of the provision of secondary legislation authorizing European Securities and Markets Authority to issue binding decisions prohibiting or restricting short selling of certain financial instruments. Although the proceedings in the case C‑270/12 were completed, it is necessary to make a few comments on the direction of the settlement. The starting point of this is the Court of Justice of the European Union decision in the case Pringle – a key judgment relating to the EU system.

The article deals with reforms aimed at strengthening the financial stability of the eurozone and the EU. First, it refers to the “original sin” of the eurozone and the errors committed during its construction in the early 1990s. Then, the lessons from the double crisis of 2007–2009 and 2010–2012 are analysed, and the four main dilemmas that the EU faces in the area of institutional reforms are formulated. The overview of the implemented reforms and their proven impact on the macroeconomic imbalances leads to the conclusion that – although the above-mentioned double crisis combined with the global pandemic crisis have already mobilised the EU to introduce many important changes – the reform agenda is still not finished.

Celem artykułu jest analiza, na przykładzie Polski, związku między stabilnością finansową a makroekonomiczną. Opracowanie ma teoretyczno-empiryczny charakter. Najpierw omówiono definicje i metody pomiaru stabilności finansowej i makroekonomicznej. Następnie przedstawiono przedmiot, zakres czasowy badania i metodę badawczą. W ostatniej części zawarto wyniki analizy relacji między stabilnością finansową a makroekonomiczną. Analiza literatury doprowadziła do wniosku o braku jednorodności w definiowaniu oraz mierzeniu obu rodzajów stabilności. Warto podkreślić, że o ile w definiowaniu stabilności finansowej podkreśla się jej istotną rolę w kształtowaniu stabilności gospodarczej, to na poziomie definicji stabilności makroekonomicznej kwestia stabilności systemu finansowego jest często pomijana. Przeprowadzone badanie nie potwierdziło istnienia wpływu sytuacji systemu finansowego na stabilność makroekonomiczną, natomiast został potwierdzony związek odwrotny, tzn. stan koniunktury gospodarczej przekłada się na stabilność systemu finansowego.
The aim of the article is to analyze the relationship between financial and macroeconomic stability in the Polish economy. The article has a theoretical and empirical character. In the first part the definitions and the methods of measuring the financial and macroeconomic stability are described. Then the subject, time range of the conducted research are presented, as well as the applied research method. The results of an empirical analysis of the bilateral relationship between financial and macroeconomic stability are contained at the end of the article. The conducted analysis of the literature leads to a conclusion that there is no uniformity in defining and measuring financial and macroeconomic stability. The conducted research confirms the existence of impact of the economic situation on the stability of the Polish financial system, while the reverse relationship, the impact of the situation in the financial system on the macroeconomic stability of Poland, has not been confirmed.

Stabilizacja systemu finansowego i przeciwdziałanie kryzysom gospodarczym są współcześnie jednymi z najważniejszych wyzwań i obszarów aktywności władzy publicznej. Na przestrzeni ostatnich lat, w wielu państwach można było zaobserwować procesy instytucjonalizacji nowej „perspektywy makroostrożnościowej”, która w przeciwieństwie do dotychczasowych rozwiązań obejmuje cały system finansowy. Równocześnie powstała pewna nowa siatka pojęciowa, która jednak zdaje się ignorować dotychczasowe konwencje terminologiczne. W szczególności błędnie używa się pojęcia „nadzór” zamiast „polityka” lub niekiedy pojęcia te traktuje się jako synonimy. Teza ta dotyczy zarówno aktów prawnych UE, jak i prawa krajowego (np. w Polsce), a także nazewnictwa stosowanego w literaturze, gdzie brakuje pogłębionej, interdyscyplinarnej analizy w tym zakresie, jak również zestawień porównawczych pozwalających uporządkować używane pojęcia. Dlatego celem tego opracowania jest usystematyzowanie najważniejszych terminów stosowanych w obszarze stabilności finansowej oraz doprecyzowanie ich znaczenia poprzez wskazanie właściwych desygnatów pojęciowych.
Stabilization of the financial system and counteracting economic crises are among the pressing challenges and public authority tests. In recent years, in many rankings, it was possible to see that the institutional paths of the new "macroprudential perspective", which in the letters to the supplements to date, cover the entire financial system. Simultaneously, a new conceptual network has emerged, which seems to ignore the existing terminological conventions. In particular, the term "supervision" is misused instead of "policy" or is sometimes used synonymously. The thesis also applies to EU legal and national law (e.g., in Poland) and the nomenclature used in the literature, where there is no in-depth, interdisciplinary analysis in this area and comparative summaries of the terms used. Therefore, the purpose of this paper is to systematize the most important terms used in the area of financial stability and to clarify their meaning by indicating the correct conceptual designations.

The banking sector’s stable operation contributes to healthy economic development. Any waver of confidence in the sector may lead to serious economic problems, as seen during the 2008 crisis. The aims of this original retrospective and exploratory study are: (1) to describe the concepts of corporate social responsibility, a term familiar for companies and to interpret it the operating practice of commercial banks and (2) to describe a potential manner of CSR implementation in central banks’ task performance as well. The authors provide a survey of the relevant literature and study how the theory is supported by empirical evidence based on previous researches about commercial banks and the practice of central bank of the United States of America (FED) and the European Central Bank (ECB). Our survey indicates that CSR has clearly become part of the financial sector and it is an increasingly important topic in international banking. Furthermore, the stress laid on the banking sector’s corporate responsibility may be instrumental in restoring confidence in the sector and improving social welfare.

The present study examines the impact of earnings management on financial stability and reporting transparency among Shariah and Shariah-non-compliant firms in India from 2008 to 2023. The Study uses Kothari and Roychodhury models to estimate earnings management proxies. Earnings manipulation and bankruptcy of the sample firms were estimated using Beneish’s M-score and Altman’s Z-score models. The Study reveals that compared to non-Shariah firms, the Shariah-complaint firms are less prone to earnings management and bankruptcy, and it was also found that they are more transparent in reporting their results. Overall, the study confirms that more than a religious indexation, Shariah screening is effective in maintaining ethical conduct of business practices that enhance the protection of investors. The findings of this study aid managers in policy formulations, and it will be helpful for potential investors in making investment decisions based on Shariah principles.

Jako cel opracowania przyjęto ocenę znaczenia skali i zakresu korzystania przez różne typy jednostek samorządu terytorialnego z budżetowych transferów zewnętrznych, z punktu widzenia ich stabilności finansowej. Jako kryteria stabilności przyjęto: wskaźnik udziału zobowiązań w relacji do dochodów budżetowych; tempo wzrostu udziału zobowiązań w dochodach w latach 2009–2012; wskaźnik udziału wydatków majątkowych w wydatkach ogółem. Analizę tego zagadnienia przeprowadzono na przykładzie jednostek samorządu terytorialne-go w województwie podkarpackim. Na podstawie analizy sytuacji finansowej podkarpackich samorządów można stwierdzić, że transfery z budżetu państwa, a także płatności ze środków Unii Europejskiej były w latach 2009–2012 ważnym źródłem dochodów budżetowych każdego ze szczebli i typów jednostek samorządowych, ale największe znaczenie w strukturze dochodów miały w przypadku samorzą-dów powiatu i gmin wiejskich. Można zatem na tej podstawie sformułować wniosek o stabiliza-cyjnej roli transferów zewnętrznych. Równocześnie jednak w analizowanym okresie uwidoczniła się tendencja do szybkiego przyrostu zadłużenia samorządów mierzonego udziałem zobowiązań w dochodach budżetowych. Bardziej zagro-żone są tu samorządy powiatów i gmin wiejskich, które w latach 2009–2012 charakteryzowały się najsłabszym tempem przyrostu dochodów, przy relatywnie wysokiej dynamice zadłużenia. Są to jedno-cześnie typy samorządów, które w największym stopniu korzystały z transferów zewnętrznych.
Financial stability belongs to the main tasks of local government authorities, as well as responsibil-ity for local and regional public infrastructure improvement. Local governments activity is limited by a level of budget incomes, including financial transfers from central budget or European funds. From one side external transfers are an important part of incomes for the most of local communities, and from the other – it is not very regular source of incomes. In this context, it is necessary to analyze an influence of the level of financial transfers for financial stability of local governments. This type of analysis was made for the local communities in Podkarpacie region in a period 2009–2012. The main conclusion is that external transfers have had a positive influence on financial sit-uation for the most of local governments (specially for the rural communities), but higher level of stability was observed among these types of local governments which have got relatively great part of their own incomes (from the personal and property taxes).

The paper aims to identify factors determining the level of spread in light of the latest theories. The author examines theories related to spread by classifying individual concepts into several categories and looks at theoretical approaches in the context of the latest financial crisis on the U.S. market. Niedziółka checks to what extent the breakdown of spread at a time of financial instability testifies to its “decomposition” on the basis of data collected before the crisis. The study makes use of rating agency data on the probability of default depending on the rating. The author also uses rating transition matrices and the theory of Markow chains to determine the share of the default component in spread identified as the difference between the profitability of corporate and Treasury securities. The main advantage of this method is that it adopts a realistic assumption about a gradual change in the quality of debt in a given time period, Niedziółka says. Considering the limitations linked with the use of the rating transition matrix mentioned in the article, the results of research into the structure of spread at a time of financial instability lead the author to formulate the following conclusions: 1) In accordance with the heuristic approach, the share of the default component is subject to reduction in favor of the liquidity component even though the default factor increases in absolute terms; 2) An increase in the volatility of spread is chiefly determined by the liquidity factor; 3) The proportion of the default component increases with the maturity of bonds; however in each case the share of the default component in spread during a period of financial instability is lower than during a period of financial stability.

The article discusses the potential impact of sustainable finance initiatives on financial stability. A careful literature review on the subject of sustainable development and stability of the financial sector is performed in order to identify potential gaps in policies and regulations. Existing considerations around the impact of sustainable development efforts focus exclusively on the consequences of climate change for the portfolio of assets held by the financial sector, whereas the author examines the growing market for sustainable financial instruments as a potential threat. The results indicate that sustainability features of new financial instruments are not methodically evaluated in the context of their credibility and may therefore suffer from sudden loss of value that is not accounted for under the existing supervisory mechanisms. Inconsistent definitions and no single perception of sustainability further enhance the risk for investors and issuers and that risk needs to be accounted for under the mechanisms safeguarding financial stability.

W artykule poruszany jest problem stabilności działania funduszy pożyczkowych. Przeprowadzono w nim wstępną analizę parametrów pośrednich i bezpośrednich, przyjętych jako czynniki mające istotny wpływ na wewnętrzną (finansową), instytucjonalną i zewnętrzną stabilność systemu finansowego jako całości. Rozważono jakość portfela pożyczkowego jako istotnego elementu wpływającego na stabilność finansową funduszy pożyczkowych, jak i systemu finansowego. W opracowaniu zastosowano metodę analizy szeregów czasowych, metody analizy finansowej oraz podstawowe metody statystyki opisowej.
The article discusses the problem of the stability of the loan funds. The author has carried out a preliminary analysis of indirect and direct parameters adopted as factors having a significant impact on the internal (financial), institutional and external stability of the financial system as a whole. The article analyzes the quality of the loan portfolio as an important element affecting the financial stability of loan funds and the financial system. The article uses the method of time series analysis, financial analysis methods and basic methods of descriptive statistics.

Research background: Increased regulations reducing systemic risk are essentially underpinned by the understanding of the global nature and sources of instability of the financial system. In the economic literature, there are many arguments presented by critical supporters and opponents of measuring and reporting global systemically important entities. Purpose of the article: In response to the requirements of regulators, the article seeks to identify systematically important regulated stock markets for selected global stock exchanges by developing a composite ratio. Additionally, it provides empirical evidence concerning their risk exploration. Methods: The proposed method uses weighted average values of indicators grouped in four categories: (1) market size, (2) cross-jurisdictional activity and interconnectedness, (3) substitutability, (4) complexity. The research covers stock exchanges, reported to WFE, spanning the period 2008?2017. Findings & Value added: The study finds that the problem of systemic risk on global stock exchanges is growing despite numerous prudential regulations. In order to obtain a more complete assessment of market systemic sensitivity, regulators should take into account a wider range of indicators and calculations such as cross-jurisdictional activity and market complexity.

In this paper the system of factors influencing the formation of financial solvency was investigated, the financial sustainability of agricultural enterprises of Ukraine was evaluated, and an approach was developed to define and help ensure the financial sustainability of enterprises in the face of contemporary economic and market challenges. According to the research, the main principles for maintaining financial sustainability are: responsiveness to internal and external changes; governance systems; risk management; analysis of financial ratios; real assessment of the financial solvency of the enterprise; integration with the overall management system; orientation towards achieving the strategic goals of the enterprise; use of qualitative methods to inform financial decisions in the face of uncertainty and risk.
W artykule zbadano system czynników wpływających na kształtowanie się wypłacalności finansowej, oceniono stabilność finansową przedsiębiorstw rolnych Ukrainy, opracowano podejście do określenia i zapewnienia stabilności finansowej przedsiębiorstw w obliczu współczesnych wyzwań i zagrożeń. Stwierdzono, że głównymi warunkami utrzymania stabilności finansowej są: reagowanie na zmiany wewnętrzne i zewnętrzne, systemy zarządzania, zarządzanie ryzykiem, wykorzystanie wskaźników w celu oceny sytuacji finansowej, rzeczywista ocena wypłacalności finansowej przedsiębiorstwa, integracja z całym systemem zarządzania, orientacja na realizację strategicznych celów przedsiębiorstwa, opracowywanie i wykorzystywanie narzędzi jakościowych do podejmowania decyzji finansowych w obliczu niepewności i ryzyka.

This paper analyses the influence of financial development on income inequality. Throughout this work, one may find the overview of theoretical and empirical literature as well as the empirical model using fixed panel data method. This research paper tries to disentangle the opposing views on the relationship between finance and income distribution, by evaluating the impact of the different dimensions of financial development on the level of income inequality. The important added value of this research is the usage of quintiles of income distribution as a dependent variable that may help to recognise the effect of financial development on the poorest and richest. Another novelty of the paper is the consideration of the effects of financial variables on Gini coefficient in the long and short run. The main results of the analysis using dataset from 2003 to 2014 indicate that financial access decreases income inequality.

This article presents the position of the European Financial Congress in relation to the European Commission’s consultation document on the supplementary supervision of credit institutions, insurance undertakings and investment firms in a financial conglomerate. From 9th June till 20th September 2016, the EC ran a public consultation on the evaluation of the financial conglomerate directive (FICOD), whether it delivers on its objective to identify and manage group risks, i.e. multiple gearing, excessive leveraging of capital, contagion, complexity management, concentration and conflict of interest. Financial conglomerates were originally represented by bancassurance. Over time financial institutions have expanded into investment banking, asset management and other financial activities, with separate segment supervisions. Now, they are getting bigger, more complex and international, expanding into the real economy, outsourcing critical processes to non-regulated external offshore companies. Moreover, manufacturing companies are developing competencies in banking area and traditional financial institutions are being challenged by expanding fintech projects. The evaluation of supplementary supervision shall lead to better regulation in terms of relevance, effectiveness, efficiency, coherence and added value. As a result, the legislation shall contribute to enhanced financial stability, safeguard creditors’ and policyholders’ interests, and promote the competitiveness of financial conglomerates within the EU and at international level. From the Polish perspective, FICOD shall protect the financial system from the import of group risks and lead to secure growth of local financial conglomerates, enjoying a level playing field in the EU. The EC consultation paper was addressed by representatives of different groups of stakeholders in the Polish financial market, including in particular: universal banks, auto loan companies, insurance undertakings, regulatory bodies, consulting firms and academia.

Central and Eastern-European countries are strongly linked to the international economic and financial systems, which results in their dependence on foreign capital and on the upturn in the global markets. This situation also makes them vulnerable to external shocks. Resilience of the economies of CEE countries was additionally diminished by their relatively quick and uncompromising opening up to the process of globalization and European integration. All the economies subject to scrutiny have quite a substantial external debt level (reaching 55–139% of GDP), their net international investment position is quite strongly in the negative (constituting 25–71% of GDP). They are also characterized by high level of foreign liabilities (85–350% of GDP), a significant degree of trade openness (export and import of goods and services amounting to 41–94% of GDP), considerable rate of foreign liquid portfolio investments (even as much as 32% of GDP). Another common feature is the strong financial support received from the EU budget, with CEE countries being its net beneficiaries (with the accumulated value of funds received from the EU budget in 2004–2015 at the level of 21–42% of GDP). It should be borne in mind that Lithuania, Latvia, Estonia, Slovenia and Slovakia are members of the Eurozone, i.e. operate an international currency, which improves their creditworthiness and augments the trust of the global markets. What seems not without significance for investors is the fact that the IMF classified these five CEE countries – as well as the Czech Republic – as advanced economies. In light of the above, it should be stated that the Polish economy is characterized by a relatively strong external exposure relative to the creditworthiness the country boasts. This exposure increases Poland’s vulnerability to shocks and makes it less immune thereto. These circumstances partially explain the higher estimation of the risk premium for investments in Poland, which reduces the state’s opportunities and prospects of development in comparison with other CEE economies. It should be stressed that when assessing the external exposure one must take into account not only its particular characteristics, but also the economic and political stability of a given country – or, more specifically and importantly, their assessment by financial markets.

The article aims to answer a number of research questions. The first question concerns some major gaps in financial system regulation and in the safety net that have been exposed by the latest global financial crisis. Another question is how the banking sector will be influenced by the ongoing reforms in financial regulation and supervision. The article also examines the impact of the first three recommendations issued by the European Systemic Risk Board (ESRB) and the use of macroprudential tools on the functioning and stability of the financial system and the financial services market in the EU. The research methods used by the author include a literature review, empirical studies, and a comparative method. The analysis of the first three recommendations issued by the ESRB and the potential use of macroprudential tools by national authorities leads the author to conclude that these recommendations and tools can have a significant impact on the functioning of the EU’s financial system. On the plus side, they can help strengthen financial stability and reduce systemic risk and the so-called contagion effect. However, this could take place at the expense of a negative effect on lending at the level of individual financial institutions. Other negativeimplications could include limited growth opportunities and constrained availability and variety of financial products and services offered, accompanied by increased supervisory and disclosure requirements. The benefits and the costs are likely to be unevenly distributed in time, according to the author. His analysis of reform measures so far indicates that benefits should be visible at the macroeconomic level, while the costs are likely to affect individual institutions at the microeconomic level. The emergence of a banking union in the EU will have a profound impact on the functioning of the ESRB, Smaga says, as the European Central Bank (ECB) acting as a pan-European supervisor will become the target of the ESRB’s recommendations, which requires changes in the current relationships between the ESRB and the ECB. The challenges faced by the ESRB also include the need to develop an effective policy mix with the ECB’s monetary policy, compile a list of Systemically Important Financial Institutions (SIFIs), and develop a universal and objective method to assess the effectiveness of implementing ESRB recommendations.
Celem artykułu jest odpowiedź na następujące pytania badawcze. Po pierwsze, na jakie najważniejsze luki w regulacjach i sieci bezpieczeństwa wskazał przebieg ostatniego globalnego kryzysu oraz jakie konsekwencje dla sektora bankowego może mieć ich eliminowanie przez reformy w sferze regulacji i nadzoru. Po drugie, jaki wpływ na funkcjonowanie i stabilność systemu finansowego oraz warunki prowadzenia działalności na rynku usług finansowych w UE mogą mieć wydane przez ESRB trzy pierwsze rekomendacje i użycie narzędzi makroostrożnościowych. W artykule wykorzystano metodę analizy literatury, badań empirycznych oraz metodę porównawczą. Analiza pierwszych trzech wydanych przez ESRB rekomendacji i możliwych do zastosowania narzędzi nadzoru makroostrożnościowego przez władze krajowe, prowadzi do wniosku, że mogą one mieć znaczący wpływ na funkcjonowanie systemu finansowego UE. Z jednej strony, pozytywne odziaływanie może m.in. sprzyjać wzrostowi stabilności finansowej, zmniejszeniu ryzyka systemowego i efektu zarażenia. Jednocześnie, z drugiej strony, może się to odbyć potencjalnie wyższym kosztem prowadzenia akcji kredytowej, ograniczeniem możliwości rozwoju i swobody oferowania produktów oraz usług finansowych, zwiększonymi obciążeniami informacyjnymi i nadzorczymi na szczeblu instytucji finansowych. Korzyści i koszty będą najprawdopodobniej nierównomiernie rozłożone w czasie. Analiza reform prowadzi do konkluzji, że korzyści najprawdopodobniej będą odczuwane w skali systemu, a koszty ponoszone przez poszczególne instytucje. Utworzenie unii bankowej w UE będzie miało istotny wpływ na funkcjonowanie ESRB, gdyż EBC jako paneuropejski nadzorca, stanie się adresatem jej rekomendacji, co warunkuje zmianę dotychczasowych relacji między ESRB a EBC. Do wyzwań stojących przed ESRB można również zaliczyć potrzebę wypracowania efektywnego policy mix z polityką pieniężną EBC, stworzenia listy SIFI oraz opracowania uniwersalnej i obiektywnej metodologii oceny skuteczności implementacji wydawanych przez nią rekomendacji.

The aim of the paper is to explain the interference of public and private norms in the financial market on the example of legal relationships created under financial market law. This paper shows the reasons and opinions regarding the doctrinal need to create such a concept and recognises the urgent need of its institutionalisation in the doctrine. Privity in financial market law that arises between parties is significantly different from the civil and administrative law relations and due to doctrinal, judicial and didactic reasons requires an autonomous approach. The analysis conducted in this paper presents the views and ideas of how to better evolve and explain the legal relationships existing in the financial market law, also theoretically, and is expected to ignite a serious doctrinal discussion on this subject.
Celem artykułu jest pokazanie interferencji, zazębiania się wątków publicznych i prywatnych w ramach prawa rynku finansowego na przykładzie tworzonej konstrukcji finansowego stosunku prawnorynkowego. Dla realizacji tego celu w opracowaniu zebrano i poddano analizie argumenty za zasadnością tworzenia konstrukcji stosunku prawnorynkowego, zaproponowano analizę struktury prawnej stosunku prawnorynkowego, jako charakteryzującego się tak znacznymi odrębnościami od stosunku cywilnoprawnego i stosunku administracyjnoprawnego oraz wykazującego tak dalece idącą specyfikę prawną, że wymagającego autonomicznego ujęcia, z uwagi na potrzeby doktrynalne, orzecznicze oraz dydaktyczne. Taka propozycja doktrynalnego ujęcia stosunków prawnych na rynku finansowym – zdaniem autorki – wydaje się wierniej odzwierciedlać założenia prawodawcy i nadzorców krajowego i unijnego oraz pozwala również od razu dostrzegać wewnątrzsystemowe uwarunkowana i powiązania natury podmiotowej i funkcjonalnej oraz zwłaszcza – lepiej i w ekonomiczno-gospodarczym kontekście – zrozumieć finansowe treści prawnorynkowe.

Celem artykułu jest identyfikacja wyzwań stojących obecnie przed siecią bezpieczeństwa finansowego oraz weryfikacja tezy, że w wyniku doświadczeń wyniesionych z kryzysu następuje zmiana paradygmatu stabilności finansowej. Wykorzystane zostały metoda porównawcza i analiza literatury. Artykuł przedstawia kolejno zmiany przed kryzysem i po nim w odniesieniu do systemu finansowego, stabilności finansowej i systemu regulacji oraz nadzoru. Można zaobserwować dynamiczny wzrost rozmiarów systemu finansowego i powstawanie SIFI, nadmierny poziom dźwigni i większą rolę sektora bankowości równoległej. Wzrosło znaczenie stabilności finansowej jako celu polityki gospodarczej (rozwój polityki makroostrożnościowej). W przypadku systemu regulacji oraz nadzoru nastąpiła ich intensyfikacja oraz podejmowane są próby zniwelowania luk w regulacjach i wzmocnienie roli banków centralnych.
Th e aim of this paper is to identify challenges faced by the fi nancial safety net and to verify whether, as a result of the fi nancial crisis, there is a signifi cant paradigm shift of fi nancial stability. To do so, the author uses a comparative method and literature review. Th e paper presents changes in the fi nancial system, fi nancial stability, regulation and supervision before and after the crisis. One can observe a dynamic increase in the size of the fi nancial system, the emergence of SIFIs, excessive leverage, and the rise of shadow banking. Th e importance of fi nancial stability increased as an objective of economic policy (introduction of macroprudential policy). In regulation and supervision, there are important attempts to bridge the gaps and to strengthen the role of central banks in safeguarding fi nancial stability.

The Financial Stability Committee ensures protection of the financial system stability in Poland. The article discusses the competences of the Financial Stability Committee in the area of macroprudential supervision and systemic risk. In addition, the rights and obligations arising from its organization and operating mode. The author presented de lege lata comments and de lege ferenda postulates. The subject of the work is undoubtedly timely and important because the financial systems, which are the dominant element of most economies, are characterized by high susceptibility to disturbances of stability.
