It is commonly known that family law in each country is based on tradition, culture, religion and that it reflects the society in each country. It is certain that anywhere in the world family law cannot be changed, so as to say, over night and at all costs, and even less so by the experimental institutions. However, after the second world war, due to works of Czechoslovak-Polish Commission, a lot of changes occurred in Czech Family Law. Some of them were positive, some negative: Czech family law was designed according to the Soviet model. Of course, the key changes in the Czech legal order – and in family law – have already occurred and had to occur immediately after the year of 1989, especially in the light of human rights standards in Europe. Despite radical changes in the countries of the disintegrated Soviet Union and countries of its political influence, the Czech lawmakers have been hesitating from day to day with recodification of family law within new Civil Code. The result of the development after the year 1989 is a bleak provisional situation. At present family law is included in the draft of Civil Code, which is now discussed in the parliament. The Czech family law is returning to European legal tradition.

After World War II Polish law was based on law of the USSR. Family law played important role in the reception of Soviet law, because it was the first example of applying Soviet rules. According to Soviet doctrine and legislation, family law was treated as an independent branch of law, separated from civil law. The construction of private law was rejected. The process of adapting Soviet rules started in 1949, when Polish and Czechoslovak lawyers were working together on draft of Family Code. No one of important Polish lawyers supported the idea of separation of family law from civil law at the beginning of works. Later they were forced to change their views and some of them (especially Seweryn Szer) supported the idea of separation of family law strongly. In the late 50’s the discussion about localization of family law was very emotional and open. It was the result of changing political situation (fall of the Stalinism). However, there was no political consent to prepare one civil code and that’s why two codes were passed in 1964: Family and Guardianship Code and Civil Code. The reception of Soviet rules in Polish family law was superficial. According to the prevailing opinion, the existence of separate Family code did not create independent branch of law and family law was regarded as a part of civil law. The supporters of the idea of separation were not able to construct the convincing theory about it. Present attempts to retain separated family code have no historical justification.

The subject of this article is to discuss the notion of family within the procedure of enacting and applying the law. The authors analyze the way of defining the said notion by the legislator in a selection of legislative acts situated in the context of the provisions of the Polish constitution as well as the Family and Guardianship Code pertaining to the notion of family. Additionally, the authors take into consideration the Polish judicial practice related to the court interpretation of the said notion. The article contains several suggestions and proposals de lege lata and de lege ferenda. The authors propose, among other things, an amendment to the procedure of law enactment by agreeing upon a single definition of family within the entire legal system, which has already been introduced in the Family and Guardianship Code, so that the definition would not need to be modified depending on the subject of the provision of law, and so that the legislator would be allowed to distribute the rights related to the family also to other entities without having to incorporate the aforementioned entities in an “unnatural” way into the notion of family.

This text attempts to present the legal structure of parental authority. It is a historical description. Describes all elements of parental responsibility. Both substantive and procedural issues. First and foremost, in the text, parental authority was introduced in Polish law. The analysis has been subjected to the following terms: parental control, the content of power, deprivation, suspension, restriction and cessation of parental authority. The boundaries of that power are outlined. The problem of the Polish law concerning the family. The most important issues related to mutual rights and family responsibilities and relationships between parents and children who are not dependent on parental responsibility are discussed. The basic features of proper parental responsibility are shown. The issue of parental responsibility has been approximated.

The paper deals with the specific organization of the shared custody regime in Spanish Law. This requires a separate analysis of two aspects: how the physical organization will be and how the time will be distributed among the parents. With regard to the first question, there are two possible alternatives for the physical organization of the shared custody regime: that the children remain in the same home and the parents rotate, or that the children rotate between their parents' homes. Both possibilities are analyzed, considering the advantages and disadvantages of each, as well as their practical repercussions, through the study of the judgements of our courts. With regard to the second aspect to be analyzed – the distribution of time between parents, as we know, shared custody does not necessarily imply an equal distribution of time, although it does seem to be similar, as this is the main data that allows it to be differentiated from an exclusive custody regime that involves a wide regime of visits for the non-custodial parent. The paper attempts to determine the necessary time requirement to be able to speak of shared custody and addresses the issue of the specific duration of periods of alternation – which may be long and extended in time or, on the contrary, short and frequent. For this, once again, the jurisprudence emanating from our courts is taken into account, as well as the doctrine of the authors who have worked on this issue.

The purpose of this article is to provide an exhaustive analysis of selected intertemporal issues arising in connection with the approval and entry into force of Article 119 [1a] of the Polish Family and Guardianship Code (KRO). In particular, its aim is to answer whether a consent for adoption, as specified in former Article 119 KRO, would remain binding after the entry into force of the amendment. Consequently, whether the court in which the adoption process was started under the former provision, would be bound by a consent expressed on its grounds even after the entry into force of the new Article 119 [1a] KRO. It was established that the consent to the adoption, expressed according to Article 119 KRO, would remain valid under the new (current) state of law. Consequently, it is binding on the court hearing the adoption application, even if the proceedings had not been completed before the entry into force of the Article 119 [1a] KRO. This binding aspect, of course, does not impose on the court an obligation to make an adoption order in favour of an entity (entities) named in the declaration of consent made by parents (on the basis of relevant provisions of KRO, the court may recognize, in particular, that it would be contrary to the interests of the child), however, it excludes an adoption order in favour of others. Firstly, this result appears to be completely unambiguous in the light of linguistic interpretation principles. Secondly, the linguistic result is, again unambiguously, confirmed by the system directives as consistent with principle of non-retroactivity (lex retro non agit) which is not only normatively understood but also descriptively recognized.

The draft of legal regulations about consanguinity and guardianship was supposed to be a part of the codification of civil law, consisting of five parts (so called: books): general part, family law, property law, law of obligations and inheritance law. In the proposed draft the family law was placed as book II, according to pattern coming from the Swiss code. The draft was based on the decrees from 1945–1946, which unified Polish civil law. The authors of this draft have not changed much in the existing law. The proposed changes were improving the legal situation of children coming out of wedlock, there were also some changes in the property relations between parents and children proposed. Few amendments referred to law of adoption. The guardianship law was unchanged. The draft was presenting very high level of civil law. However, the works on the draft code were interrupted in 1949, because the communist authorities declared draft as “bourgeois” one and not suitable in the new political situation of Stalinist Poland.

According to the communis opinio the classical Roman law did not know any formal procedure of concluding a marriage, since its conclusion required only the mutual consent of a man and a woman (affectio maritalis, consensus). Nonetheless, the Roman culture developed a number of ritual acts related to the conclusion of a marriage, most of them deeply rooted in Roman tradition and history and being of a great symbolic significance. The central moment of a wedding ceremony seems to be deductio in domum mariti i.e. a ritual introduction of the bride into her future husband’s household. The significance of such a ritual is reflected in the field of language, since the expression uxorem ducere (to lead a wife) is the most common expression used as a synonym of “to marry” and also in the field of law since, according to some jurists, when deductio in domum mariti had been accomplished, the couple was considered duly and legally married. The main function of the deductio was thus to give proof that the wedding had taken place and to manifest mutual affectio maritalis. Deductio in domum mariti played a special role in the case of the conclusion of a marriage inter absentes (although it seems that the only person permitted to be absent could be the groom and not the bride). In this case, the formal ceremony of deductio seems to be an indispensable act constituting the only way in which a mutual affectio maritalis could be expressed. Since the bride’s procession to her new husband’s house was considered to be the public declaration of a consensus necessary for concluding a legal marriage, in the case of a “groomless” wedding such a ceremony was necessary as a proof that mutual affectio maritalis had been expressed and thus a marriage had taken place. Nonetheless, the necessity of leading the bride to her husband’s home in the case of a matrimonium inter absentes could not be misunderstood with the constitutive character of deductio in domum mariti. A consensus still remained the only constitutive element and deductio in domum mariti constituted only the formal way in which, due to the particular circumstances, this consensus had to be expressed.

Od ponad pół wieku Europa doświadcza zasadniczych zmian demograficznych. Wiele z tych zmian dotyczy rodziny, w tym sposobu jej formowania. Wśród przyczyn stopniowego odchodzenia od małżeństwa na rzecz związków partnerskich demografowie wskazują m.in. zmiany kulturowe zachodzące w społeczeństwach europejskich. Rzadko natomiast jako czynnik wpływający na zachowania jednostki traktuje się kontekst instytucjonalny, w tym stopień rozwoju uregulowań prawnych w zakresie związków innych niż małżeńskie. W artykule opisano ewolucję zmian w prawie rodzinnym w odniesieniu do związków partnerskich oraz porównanie rozwiązań w państwach, w których regulacje dotyczące takich związków są najpełniejsze (tj. w Holandii i Francji). W ostatniej części artykułu omówiono również regulacje obowiązujące obecnie w Polsce (stan prawny na 30 czerwca 2014 r.).
Since more than 50 years we can observe significant changes in family formation and development in Europe. The changes are usually explained stressing the role of cultural factors and the level of development of institutional context – i.a. the legal norms concerning different forms of unions is often neglected. The article presents the progress of statutory regulation of extra-marital cohabitation in Europe as well as the providing the description of the most advanced legal systems concerning registered partnership (France and the Netherlands). The regulation in Poland is also mentioned.

The time after 1945 is one of the most important moments in the process of developing children’s rights, because for the first time in the history of Polish legislation the established law had equalized the legal position of all children, abolishing all differences between those who were born in and outside of marriage. The analysis carried out in the text shows that the law established at that time was not only progressive in relation to the past, but it also kept up to date, about which, after the liberal breakthrough of 1989, we do not want to remember. The developed principles of exercising parental authority, with parents’ rights and duties equated, caused the concept of the child welfare to play a leading role in the interpretation of family law. The child welfare has therefore become the basic value that requires priority treatment. It is also important that after 1945 the process of eliminating children’s corporal punishment from the pre-school and school environment, and now also from the family circle, was initiated.

In this article, I examine the division of space in private and public spheres according to gender in the context of present-day Morocco. One of the many male-dominated spaces in Moroccan society is the Café culture, which in turn has implications for the male domination of the public sphere as a whole. The café not only occupy the actual part of an area but also creates a purely male territory where women are often not welcomed. Any women’s attempt to trespass into this territory is an exception that is in some cases can amount to cultural suicide. This article investigates parts of the history of Moroccan women’s attempt to reclaim public spaces, which can be said to coincide with the first phase of women movement. This article also attempts to create a link with the conceptualization of Harem as a historical and physical limitation to women’s access to public space. The article will trace this limitation back to the first Moroccan family law adopted in 1947, which only confirmed the traditional role of women and men. It will be argued that the last modification of the law in 2004 finally gave more rights to women.

In this paper, I investigate the change in the term of a family in the context of modern Chinese family law, with a consideration of its historical- cultural context. The article concludes that the changes in family law in the recent four decades presents both a individualization tendency and familistic tendency. However, the two tendencies appear in laws and regulations concerned with different family relationships. Between the spouses, an obvious individualization inclination was gradually introduced. Whereas, facing a social reality of aging society and highly mobile life style, which causes providing for elders more difficult than before, the law intends to support intergenerational ties, and in this way promote a familistic outlook.

This paper discusses changes in the functioning of foster care since it was reformed in 1999. Its focus is to demonstrate changes in Polish law and evolution in pedagogical views as well as in administrative practice in the context legal standards of foster care set forth in international documents (Convention on the Rights of a Child, European Convention on Human Rights and many others) and in the constitutional principle of subsidiarity. Much attention was also devoted to provisions of the Act of 9 June 2011 on support for Families and Foster Care system as well as to new laws of the Family and Guardianship Code. Of paramount importance is the right of children in care to return to their families (family reintegration), a right that derives from international standards. In this context evolution in pedagogy and the significance of social care were emphasized. The author highlights emotional problems of foster families which hinder efforts aimed at supporting children’s parents.
Artykuł omawia zmiany, jakie zaszły w funkcjonowaniu pieczy zastępczej, począwszy od rozpoczęcia jej reformowania w 1999 roku. Akcent położono na pokazanie zmian polskiego prawa i ewolucji pedagogicznej oraz administracyjnej praktyki, w kontekście standardów prawnych pieczy zastępczej wyznaczonych w międzynarodowych dokumentach (Konwencja o Prawach Dziecka, Europejska Konwencja Praw Człowieka i wiele innych) oraz w konstytucyjnej zasady pomocniczości. Szczególnie wiele uwagi poświęcono uregulowaniom Ustawy z 9 czerwca 2011 roku o wspieraniu rodziny i systemie pieczy zastępczej oraz nowym przepisom Kodeksu rodzinnego i opiekuńczego. Najistotniejsze znaczenie ma wynikające z międzynarodowych standardów prawo wychowanków rodzin zastępczych i placówek opiekuńczo-wychowawczych do powrotu do rodziny (reintegracja rodziny). Na tym tle pokazano przemiany w pedagogice i znaczenie pracy socjalnej. Autor zwraca uwagę na emocjonalne problemy rodzin zastępczych, które odmawiają działań wspierających rodziców wychowanków.
