The paper analysis the principle of proportionality, which is widely applied in the EU legal order and is therefore one of the fundamental principles of the system of the European Union. It is one of the legal principles that govern decision-making processes and common strategic objectives, and which are applicable when establishing European Union legislation and transposing it into national law, including in the area of criminal law, although the current analyses do not often focus on discussing this aspect. Due to its complexity and significance for the processes of establishing and applying the law, the principle of proportionality requires detailed and separate discussion, especially in the context of European criminal law.

The paper concerns the principle of mutual trust and its interpretation by the Court of Justice of the European Union as well as two other important European courts: the European Court of Human Rights and the German Constitutional Court. The paper presents the important change of direction in interpretation of the principle of mutual trust by the CJEU. Initially, the belief in the existence of mutual trust between member states was firm. Over time, however, it has turned out that even in the EU – which follows from a number of judgments of the ECtHR – violations of human rights sometimes happen. This dramatically undermines trust in foreign judicial systems. This led the CJEU to the conclusion that the principle of mutual trust is rebuttable and that in some circumstances limitations to the principles of mutual recognition and mutual trust can be made. This conclusion can be treated as an answer in the specific ‘judicial dialogue’ of the CJEU with the ECtHR and the German Constitutional Court – the two latter courts seemed to notice earlier that mutual trust between member states cannot be blind and unconditional.

The paper discusses the problem of the ne bis in idem principle stipulated in the Convention Implementing the Schengen Agreement (CISA) and the Charter of Fundamental Rights of the European Union. Article 54 of the CISA makes the application of the principle ne bis in idem subject to the condition of execution of the penalty. An analogous condition is not provided for in the Charter. These differences caused doubts regardingthe application of the ne bis in idem principle and were subject of the question for preliminary ruling in the Spasic case (C-129/14 PPU). The paper contains a critical review of the reasoning of the Court of Justice of the European Union in this judgment. In addition, the article also contains an analysis of the CJEU’s decision in Case C-398/12 M. in which the CJEU has analysed the meaning of “final disposal” of the judgment in the context of the ne bis in idem principle. Based on the above judgments, the article presents arguments indicating that the reasoning of the CJEU on the conditions for the application of the ne bis in idem principle in judicial cooperation in criminal matters in the EU is not consistent.

The paper focuses on the competence of the European Parliament and the EU Council to adopt directives in the area of substantive criminal law provided in Articles 83 and 84 of the TFEU, which confirm the earlier ECJ rulings on the subject. The competence granted to those institutions also ensure greater effectives of the adopted directives in combating serious crimes within the European Union. The creation of certain ‘emergency brakes’ and application of the principle of proportionality taking into account the fundamental principles of criminal law systems of individual Member States, has enabled the EU institutions to establish common definitions of most serious crimes.

The proposal is part of the package of documents submitted by the European Commission to improve the institutional system of protection of the interests of the Union. As concerns the organization of the European Public Prosecutor’s Office, the author contests the decentralized nature of that authority proposed by the European Commission. He points out the vague wording of some pars of the proposal. In his view, doubts relate to the independence of prosecutors exercising the functions of European Delegated Prosecutors. He opts for limiting the jurisdiction of that authority. According to the author, the proposed regulation does not violate the principle of proportionality. He concludes that joint investigation and prosecution of perpetrators of offences against the Union’s financial interests are in common interest of both Poland and the EU.

Criminal law as it’s traditionally seen is a set of standards defining socially harmful acts, referred to as crimes, determining the responsibility for these acts and the penalties, sanctions and protective measures applied against the perpetrators. More than any other branch of law, criminal law reflects social attitudes towards specific cultural, moral and financial issues, demonstrating susceptibility to social changes, in principle denying its inter-culturalism, and exemplifying an extremely strong rooting in a specific culture. The concept of the European integration, together with ongoing globalization, have caused a shift in the way of thinking about the functioning of not only global society, countries or international institutions, but have also been changing the feeling of identity of individuals and their identification with a specific group or community. At the same time, the free flow of persons supporting the phenomenon of multi-culturalism, so characteristic for the concept of the European integration, has been determining the transnational nature of crime to a greater extent than before. This transnational character enforces, simultaneously, the development of the tools habitually designed for counteracting crime, including, first of all, traditionally understood criminal law. One example is the Erasure of Conviction in the Polish Criminal Law from the Perspective of the European Criminal Records Information System.

This paper canvasses some of the limitations and possible negative consequences of globalization of criminal procedure. The references to specific examples in this paper assume generally the framework of the legal systems of the European Union and its member states. This, however, is done with the idea in mind that at least some of the remarks made here could be also relevant in a wider international context, when other legal systems are taken into consideration. In the paper, particular attention is paid to possible negative consequences of globalization tendencies. Assuming this perspective was intentional, in order to draw the reader’s attention, references are made to those issues which are especially important from the point of view of legal certainty of an individual but seem to attract less attention in the literature on the subject than general analyses of the phenomenon of synergy of legal systems and the benefits stemming therefrom.

This article shows the basic European Union and national regulations with regard to international shipments of waste, such as the Resolution No. 1013/2006 and the Act of 2007 on international shipments of waste in Poland. Procedures which may decrease the negative infl uence of waste on the environment, especially during shipments of hazardous waste, play an important role in this area. For the observance of these procedures, the penal sanction system is useful because it prevents illegal activities in this area. However, an analysis of the statistics of the Supreme Chamber of Control and Police shows that the effectiveness of criminal instruments is not very high. This is evidenced by the low percentage of proceedings under Article 183 of the Penal Code as well as by the poor detection of offenders, and despite the increase in the number of convictions imposed by courts of general jurisdiction, criminal penalties are too lenient.
