    The results of the referendum regarding the UK leaving the European Union indicated that the majority of British citizens, who are also citizens of the EU, decided to leave the European Union. The citizens’ decision has serious legal consequences arising from Article 50 of the Lisbon Treaty. This is the first case of a state leaving the European Union, which raises many questions. In the presented material, the institution of referendum is being analyzed as a form of direct democracy as well as, in this context, the effects of Brexit affecting directly the citizens of Great Britain – ex-citizens of the European Union.

    Prawo pobytu na terytorium UE jest jednym z podstawowych uprawnień przysługujących obywatelom UE i członkom ich rodzin. Uprawnienie to wynika bezpośrednio z art. 21 Traktatu o funkcjonowaniu UE. Szczegółowe reguły dotyczące jego stosowania zostały zawarte w dyrektywie 2004/38/WE w sprawie prawa obywateli UE i członków ich rodzin do swobodnego przemieszczania się i pobytu na terytorium państw członkowskich. Przepisy traktatowe oraz wynikające z dyrektywy są przedmiotem bogatego orzecznictwa Trybunału Sprawiedliwości UE. Trybunał postanowienia dyrektywy stosuje wobec stanów faktycznych zawierających wyraźny element transgraniczny. Przepisy traktatowe mają zastosowanie również do spraw, w których taki element nie występuje, ale ich okoliczności faktyczne wpływają na naturę i istotę praw przysługujących obywatelom UE. W świetle orzecznictwa Trybunału Sprawiedliwości obywatele UE korzystający ze swobody przepływu osób mogą liczyć na bardzo korzystne rozwiązania prawne wynikające z dyrektywy 2004/38/WE, które nie znajdują zastosowania do obywateli UE, którzy nie przemieszczają się na terenie UE.
    The right of abode in the European Union is one of the fundamental rights of the EU citizens and their family members. The entitlement results directly from Article 21 of the Treaty on the Functioning of the EU. Detailed rules of the right are defined in the Directive 2004/38/EC on the right of citizens of the European Union and their family members to move and reside freely within the territory of the Member States. The regulations that are laid down in the Treaty and the Directive are the subject matter of abundant judicial decisions of the Court of Justice of the European Union. The Court makes use of the provisions of the Directive towards actual situations with an evident cross-border element. The Treaty regulations are also used in cases without such an element but when actual circumstances have impact on the nature and essence of the rights of the citizens of the EU. In the light of the decisions of the Court of Justice, the citizens of the EU exercising their right to move freely can count on very favourable legal solutions resulting from Directive 2004/38/EC, which are not applicable to the citizens of the EU who do not move within the EU territory.

    Opis:
    The right of family members of Union citizens to live with them in the host Member State has always been considered essential for an effective freedom of movement of citizens. However, the provisions of Directive 2004/38/EC contain a different description of the scope of rights of family members of Union citizens taking advantage of the freedom of movement of persons as to the possibility of accompanying or joining EU citizens taking advantage of the freedom of movement of persons, depending on whether they belong to the circle of ‘closer’ or ‘distant’ family members. This issue acquires particular significance in the context of family members who are not citizens of any Member State of the Union. For individuals belonging to the circle of ‘closer’ family members, the EU legislator grants the subjective right to accompany or join a Union citizen exercising the right of the freedom of movement of persons. In the latter case, the legislator only obliges the host Member States to facilitate entry and residence for such individuals in accordance with their national legislation. The glossed judgment, by determining the status of individuals under legal guardianship within the framework of the Algerian kafala system as a ‘distant’ family member of a Union citizen, clearly touches upon a significant issue in the context of the Union’s freedom of movement of persons.

    The text is dedicated to legal protection of fundamental rights of the citizens of the European Union. The first part defines and characterize citizenship of the European Union. Second part introduces individual right and its protection in the European Union. Next, third one, is about development of protection of fundamental rights in the European Union. Fourth part characterize Charter of Fundamental Rights as basic source of individual rights in the European Union. Fifth part, which is the last one, describes mechanisms of enforcement of individual rights under European Union law. The paper finishes with conclusions and list of references and sources.

    Article „Languages – a tool in the hands of nationalists and globalists – the current situation in Europe” is going to present the current problem that appears on the Old Continent in the area of using the case of knowledge of languages to present the political situation.     Artykuł prezentuje uwarunkowania i wykorzystanie instrumentu demokracji przedstawicielskiej w Unii Europejskiej, jakim jest europejska inicjatywa obywatel-ska. Punktem wyjścia przeprowadzonych rozważań jest przedstawienie prawnych wymogów odnośnie przedłożenia inicjatywy, jednak zasadnicza część odnosi się do zaprezentowania praktyki w tym zakresie i próby oceny czynników, które bezpośrednio wpływają na efektywność wykorzystania tego instrumentu prawnego. W tym kontekście postawiono tezę, że obecne regulacje prawne nie dają obywatelom możliwości realnego oddziaływania na Komisję Europejską w zakresie przedłożenia wniosku legislacyjnego, a mobilizacja i aktywność obywateli Unii Europejskiej nie są efektywnie wykorzystywane.
    The article presents the conditions and use of the representative democracy instrument in the European Union, which is the European Citizens' Initiative. The starting point of the considerations is the presentation of legal requirements regarding the submission of the initiative, but the main part refers to the presentation of the practice in this respect and attempts to assess factors that directly affect the effectiveness of using this legal instrument. In this context, a thesis was put forward that the current legal regulations do not give citizens the possibility of real impact on the European Commission in submitting a legislative proposal, and the mobilization and activity of European Union citizens are not effectively used.

    The year 1993 marked the establishment of formal EU citizenship and, subsequently, special relations were forged between the earlier status of the individual, a subject of internal market freedoms, and the notion of political EU citizenship. The social and welfare rights of individuals were strengthened, thus enabling a deeper integration. The social rights in the EU’s legal system play a special role in the construction of EU citizenship as they add meaning to the notion of citizenship and go beyond the traditional, economic dimension of integration. What links the constructs of market citizenship and social citizenship is the strong emphasis on the individual’s right to their status, and to rights which can be exercised effectively. Recently, political and economic citizenships have merged. However, this process has been confronted with resistance from some member states, particularly the ones with wealthy social protection systems. This has been caused by the abuse of rights by migrants from other member states, i.e., through so-called social tourism.

    The aim of the article is to analyse legal regulations on the conditions for pursuing the European Citizens’ Initiative. First, the requirements for pursuing the initiative and collecting the necessary statements of support and submitting an initiative to the Commission are presented. Afterwards, the scope of responsibilities (and discretion) of the Commission in relation to the pursued initiatives is discussed. In addition, the article proposes a thesis that the European Citizens’ Initiative is an important instrument to support democratisation in the European Union, but the possibilities of real impact of European Union’s citizens on the European Commission in the area of submitting a legislative proposal seem insufficient. Finally, some modifications of the European Citizens’ Initiative are recommended, which could increase its effectiveness significantly. Celem artykułu jest analiza regulacji prawnych w odniesieniu do warunków przedłożenia europejskiej inicjatywy obywatelskiej. Z jednej strony, rozważaniom poddano wymogi prawne w zakresie zgłoszenia inicjatywy, zbierania niezbędnych deklaracji poparcia oraz przedłożenia inicjatywy Komisji. Z drugiej zaś – zakres obowiązków (i uznaniowości) Komisji w odniesieniu do przedłożonych inicjatyw. W artykule postawiono tezę, że europejska inicjatywa obywatelska jest ważnym instrumentem wspierania demokratyzacji w Unii Europejskiej, jednak możliwości realnego wpływu obywateli Unii Europejskiej na Komisję Europejską w obszarze przedłożenia wniosku legislacyjnego wydają się niewystarczające. Dla zwiększenia efektywności europejskiej inicjatywy obywatelskiej jej obecne ramy prawne wymagają istotnych modyfikacji.

    Europeanism exceeds the political and social mindset, it also provides the way of thinking about Europe, the Europeans, their identity, culture and homogeneity, which is paradoxically constituted on the basis of heterogeneity (“unity in diversity”). One may distinguishes two contrary approaches towards the UE: Euroscepticism and Euroenthusiasm The first orientation is very vivid in the British society and it is reflected not only in the words of politicians but also in the mood of the nation, expressed in the Brexit referendum. The latter orientation is common among Poles who enjoy the privilege of joining to the exclusive club. The European and citizenship education reflect these antagonistic approaches. The aim of the paper is an attempt to reconstruct and analyse the contemporary debate on citizenship education in the perspective of European Union. The analyse of educational trends about Europe and Europeanism is significant if Brexit is taking into the consideration.

    The EU freedom of movement of persons is identified with the essence of the European Union in both intuitive and legal terms. This freedom is a fundamental right of EU citizens in the objective scope Freedom of movement of EU citizens is in fact limited by the provisions of primary law and adopted within the framework of primary law – secondary legislation. Each EU member state has the ability to effectively limit the freedom on the grounds of public policy and security. This limitation has an increasing approval of European societies.
    Unijna swoboda przemieszczania się osób utożsamiana jest z istotą Unii Europejskiej zarówno w ujęciu intuicyjnym jak i prawnym. Swoboda ta pozostaje wobec tego podstawowym prawem obywatela unijnego w zakresie przedmiotowym. Nie ma ona jednak charakteru idealistycznego czy absolutnego. Swoboda przemieszczania się obywateli unijnych pozostaje bowiem ograniczona przepisami unijnych aktów prawa pierwotnego oraz przyjętymi w ramach ich zastosowania postanowieniami aktów prawa wtórnego. Każde z państw członkowskich może przy tym skutecznie ograniczyć wymienioną swobodę uzasadniając to względami porządku oraz bezpieczeństwa publicznego, na co, w chwili obecnej, jest coraz większe przyzwolenie pośród europejskich społeczeństw.

    It must be accepted that Poland has used 25 years of political and economic freedom to generate the development of country in many areas. Th e passage of years has confi rmed the stability of Polish and our credibility for investors, which is one of the most important determinants of development. Currently, aft er the election campaign for the European Parliament, it can be observed, that in Poland, despite the noticeable economic growth, rising the living standards and a numbers of similar circumstances, Polish society falls into irrational contestation, negation and they change the current achievements into the populist and dangerous socio-economic fi gures. Poland in its stability is a young country and it needs to maintain the exchange course toward stabilization. It is essential, urgent and economically safe for Poland to access to the euro zone. Th e political factor supporting this idea is exhausted and sometimes in crises. Th erefore, it is necessary to give the support to activities that promote the entry into the euro zone. Th at kind of support should be given by the institution of higher education – colleges and universities with of economic, fi nancial or political profi les, A good example of such activities in that fi eld are action undertaken by the Alcide De Gasperi University of Euroregional Economy in Józefów.     Artykuł analizuje możliwość potraktowania postanowień Karty Praw Społecznych Rady Europy jako standardu określającego minimalny poziom ochrony uprawnień socjalnych w skali kontynentu europejskiego. Uprawnienia te są analizowane jako element obywatelstwa europejskiego. Brak jednolitej koncepcji obywatelstwa UE sprawia, że poszczególne państwa członkowskie EU nie realizują wspólnego modelu przestrzegania praw socjalnych. Taka sytuacja sprzyja interwencji unijnych i krajowych organów wymiaru sprawiedliwości, albowiem stosowanie w praktyce trzech różnych standardów ochrony praw społecznych a limine uzasadnia wątpliwość równego traktowania i nasuwa podejrzenie o naruszeniu przepisu o zakazie dyskryminacji obywateli Unii Europejskiej ze względu na przynależność państwową. W artykule przeanalizowano następujące prawa regulowane postanowieniami Europejskiej karty społecznej: prawo do ochrony zdrowia, pomocy społecznej, mieszkania i edukacji.
    The article analyzes the possibility of treatment of the Charter of Social Rights of the Council of Europe as a standard specifying the minimum level of protection of social rights in the scale of the European continent. These rights are analyzed as part of European citizenship. Because of the absence of a uniform concept of the Union citizenship, the individual Member States of the European Union do not apply the common model of compliance with the social rights. The effect of this is the intervention of the Union and domestic judicial authorities, since the practical application of the three standards of protection of social rights a limine puts in doubt the equal treatment and gives rise to the suspicion that the provision prohibiting discrimination of the Union citizens on grounds of nationality is violated (article 18(1) TFEU). Claims for social benefits regulated by the European laws are no longer treated by the EU judiciary as privileges which may be satisfied at the sole discretion of the competent public authorities. The article analyzes the following rights regulated in the provisions of the European Social Charter: the right to health care, social assistance, housing and education.
