Opis:
The article discusses the processes of formation of a political stratum in Poland and the results of their actions in the years 1989-2004. The author points to several (direct and indirect) causes of the deficiencies of that stratum: party fragmentation, insufficient programmatic work, fluidity in the composition of successive parliaments. This last development negatively affects the quality of legislative work. At the same time, instability of the executive branch has an adverse impact on the quality of governance. As a consequence of these developments democratic legitimacy of the system is under pressure, populism creeps in and oligarchic tendencies appear in economy. The author suggests that if the political stratum is to perform beneficial role for the social and political system, the party structure and quality of work of individual members must improve. At the end of the article the author discusses the conditions of democratic consolidation and the conditions of effective functioning of Polish politicians in the institutions of European Union.
Podstawowe tezy artykułu mówią o procesach kształtowania się warstwy polityków oraz rezultatach ich działań w Polsce w latach 1989-2004. Fragmentaryzacji a partii oraz niedostateczna praca programowa są wskazane jako przyczyny (pośrednie i bezpośrednie) niepowodzeń, które objawiają się w wielu dziedzinach. Artykuł przedstawia dane o niekorzystnym kształtowaniu się składu kolejnych parlamentów oraz ich płynności, co nie stwarza dobrych podstaw do efektywnej pracy legislacyjnej. Równolegle wskazana jest zmienność rządów jako negatywna cecha rządzenia. Zagrożona jest demokratyczna legitymizacja systemu. Ujawniają się populizm oraz oligarchizacja życia gospodarczego. Artykuł sugeruje potrzebę doskonalenia całej struktury partyjnej oraz merytorycznego doskonalenia się warstwy polityków, jeśli mają oni spełniać właściwą rolę w systemie politycznym i społecznym. W końcowych częściach artykułu dyskutowany jest problem warunków konsolidacji demokratycznej oraz warunków efektywnego funkcjonowania polskich polityków w instytucjach Unii Europejskiej.

Political scientists, in their research work, concentrate on various topics. For some, thoughts and ideas of a famous statesman are fascinating and for others is the future influence of NGO’s on local communities. One thing, one time is said to have enough potential to unite attention of most of political scientists, as this is an event when they may observe how matters that they are especially interested in are apprehended. This mentioned event is, in my opinion, what elections indeed are and some may even say that elections are the festival of politics and sometimes of democracy.

In this paper we address the following question: Taking as decisional units national chapters of European political parties, is there a difference between a priori voting power of national groups in the case of "national" coordination of voting and in the case of "partisan" coordination of voting? By coordination of voting we mean two step process: in the first step there is an internal voting in the groups of units (national or partisan), in the second step there is a voting of aggregated groups (European political parties or national representations) in the EP. In both cases the voting has an ideological dimension (elementary unit is a party group), difference is only in dimension of aggregation (European parties versus national representations). Power indices methodology is used to evaluate voting power of national party groups in the cases of partisan and national coordination of voting behaviour.

A study of the Euro-barometer performed at the end of January and beginning of February 2009 showed that not even 34% of the surveyed in all the 27 countries of the European Union declares the desire to cast their vote in the approaching election to the Euro-community. 15% of the respondents answered that they would de! nitely not vote in the coming election. The participation in the European Parliament Elections has fallen from election to election. This tendency persists and no signs of improvement of the situation can be seen. In 1994, 56.8% of the entitled to vote participated in the elections in all the member countries. Ten years later, only 45.6% of voters cast their votes. New member countries with low level of interest in European matters have considerably contributed to the fall in the level of legitimisation of the European Parliament.

According to Montesquieu tripartite system, formed in the European constitutionalism, the organs of authority, in a democratic state, affect each other in an inhibitory way, balancing mutually. Traditionally, it is understood that the executive power is performed by the Head of State (monarch, president) and government, legislative power belongs to the parliament, whereas the judicial power is exercised by independent courts. Analyzing the political reality of member states it is necessary to note, that the executive participates in the national legislative processes more actively, for example, through executing constitutionally granted right of legislative initiative (usually together with deputies), by issuing acts with the power of law, or incorporating Community directives into the internal legal order.

In 2004, Polish women took part in the elections to the European Parliament for the first time. It was a long road that led them to take seats there. The beginnings of the Polish women’s movement date back to the 19th century when it was closely connected with the struggle for the independence of Poland. It was then that the stereotype of the Polish Mother emerged, the guardian of the hearth and home, and promoter of patriotism. These, among other things, were the social, cultural and political stereotypes that women seeking to increase their presence in public life needed to face up to. Polish women obtained voting rights rela- tively early on, in 1918. Despite their political rights, they did not participate in the political life of interwar Poland on a larger scale. The women’s organizations that emerged after WWII implemented the ideology that was officially propagated in those times, and strictly followed the policies of the authorities. Significant changes in the women’s movement occurred in the 1980s when authentic women’s initiatives formed around the Solidarity movement. At pres- ent, approximately 300 women’s organizations operate in Poland. Polish accession to the European Union has given Polish women an opportunity to intensify their activities in supra- national politics. Polish women took seats in the European Parliament, although their numbers thus far have been relatively low. During the 6th parliamentary term, out of 54 Polish Members of the European Parliament, 7 were women. In the EP elections held in 2009, 11 Polish women were elected as MEPs. Regardless of this low level of representation, Polish women are very active and resilient and seriously committed to working in European Parlia- mentary structures.

Proportionality is an intrinsic feature of parliamentary democracy. It is a principle stating that, depending on its size, each political party has a commensurate ability to influence legislature. This is confirmed by comparative studies which show that proportionality is a significant principle in the distribution of parliamentary posts in a majority of West European states. Consequently, even deputies from the smallest parties can chair commissions or lead sessions of the chambers, and by this token participate in the political decision-making process. This softens the domination of the majority party and – in line with Arend Lijphart’s concept – generates consensual democracy, based on the search for broad compromises instead of simply outvoting the opponent. Given this picture, a question emerges whether the situation is similar in the representative institution of the European Union, i.e. the European Parliament. The paper answers this question positively. The standard of proportionality has strong roots in the European Parliament forming a fundamental principle expressed in terms of d’Hondt’s formula applied to distribute posts among different political groups. This mainly concerns the division of the members of the Presidium and commission chairmen, who exercise the most important decisive functions. The implementation of the idea of appropriate representation may not be ideal, but divergences are rare, insignificant and usually they result from political bargaining that favors smaller fractions. The proportionality principle is also binding when distributing parliamentary posts inside political groups. There is a strong and positive correlation between the size of national delegations and the number of key posts they obtain in the Parliament – members of the Presidium, commission chairmen and coordinators. Only in the case of the latter is proportionality subjected to certain distortions, following from their key political importance. This, however, does not interfere with the general picture of symmetric participation of national groups in appointing parliamentary posts. In conclusion, the standard of proportionality allows all political groups to adequately participate in the work of the European Parliament, which deserves to be emphasized, the more so, as it is not formalized.

Debates and controversies about the democratic legitimacy of the EU have of course accompanied the Union from the very beginning. The “democratic paradox” of the EU exists because while committing itself to promote and scrutinize democracy in its member states, in candidate states, and in third states with whom it enters into contact, it does not display equivalent democratic features in its own functioning. Some commentators tried to define the problem out of existence; by pointing out that the EU is not a state-like polity, they argued that state-specific criteria of legitimacy, such as representative, participatory or deliberative democracy, do not apply. They postulated outcome-based or, at best, public reasons based, conceptions of legitimacy as applicable to the EU, and concluded that it satisfies those standards. But this argument is based on a non sequitur: from the statement that the EU is not a state (not even a quasi-federation or federation in statu nascendi) it does not follow that it should not be judged by the standards of democratic legitimacy. The EU is a complex, untidy polity which amalgamates inter-governmental and supranational elements in its constitution, and therefore this article postulates a bifurcated approach to democratic legitimacy. In so far as the EU contains inter-governmental elements, indirect legitimacy is all that is required, i.e., democratic legitimacy of governments representing their respective states in the Council. The second face of the EU – its supranational character – calls for democratic legitimation of its institutions, in particular, in accordance with the promise contained in Art. 10 TEU, proclaiming representative democracy in the institutional setup of the EU. This requires changes to the electoral system of the EP in order to provide incentives for a more trans-European electoral process; strengthening of the supervisory role of the EP over the Commission; the strengthening of the role of the EP with regard to legislation, and endowing it with the competence of legislative initiative. Overall, the idea is for the institutional setup to resemble a canonical model of separation of powers and inter-institutional accountability, with the EP in a dominant position. Additionally, the first gesture towards direct democracy in the EU, the European Citizens’ Initiative, should be strengthened, both by upgrading the status of successful initiatives and by lowering thresholds and administrative requirements.

Election of Members of the European Parliament on Polish territory for the first time took place in 2004. This election is a historic moment, because Poland and Polish people for the first time we were able to choose their representatives to the European Parliament. For the first time will Parliamentarians have its European family, the structures of the Polish accession to the European Communities, so that we share responsibility for the further development and future of our Europe. The elections were conducted under the Act of 23 January 2004 – Elections to the European Parliament. The literature on this subject is small, they are mainly publications concerning mechanisms for passing laws and discussing its main goals. Existing data do not cover the whole subject, as appeared before the majority of the Ordinance implementing acts. I hope that my article although the closer the issue of electoral law and the holding of elections to the European Parliament, and will be for the reader an introduction to the handbook and knowledge for entry to the course of European integration, European communities law and will bring the functioning of the institutions of the European Union.

Regulation of this matter is based on the specific division of lawmaking powers – in the Fifth Republic, which makes the government superior to the parliament. Although the change in the Constitution in 2008 greatly depleted the government’s prerogatives in the legislative procedure, it also imposed new obligations on the government to draft laws of better quality. The government is still the main actor in the legislative process. It is also responsible for ensuring progress in the implementation of EU legislation in France and for conformity of French national legislation with EU law.

The proposal is worthy of support from the government in the Council of the EU. The draft position of Polish government on the proposed directive does not raise doubts, and the impact assessment of the proposal contained therein is consistent with the assessment by the Bureau of Research of the Chancellery of the Sejm. The draft position was submitted to the Sejm 30 days after the expiry of the time limit specified by the so-called Cooperation Act.

The Kuyavian-Pomeranian Voivodeship constitutes one of the smallest of the Polish voivodeships. It is composed of nineteen land districts and four city counties, including Bydgoszcz, Torun, Wloclawek and Grudziadz. According to the data provided by the Public Electoral Commission (PKW), in 2009 the Kuyavian-Pomeranian Voivodeship was inhabited by more than 2 million people, 1.65 million of whom had the right to vote. Despite the relatively small number of inhabitants, due to provisions of the act regulating the process of voting for the Members of the European Parliament, the voivodeship in question became a separate electoral district with the electoral commission located in Bydgoszcz. This decision was infl uenced mostly by members of the Democratic Left Alliance (SLD) representing this region in the Polish Parliament. This lobbing activity seemed benefi cial from the party’s perspective, since SLD has been gaining extraordinary support in the region. But for this lobbing, the voivodeship under consideration would have been included in one district together with the Pomeranian Voivodeship, where the majority of voters are prone to give their support to the right-wing and centre-wing parties.
