This Article investigates how the European Court of Human Rights becomes competent to make decisions in cases concerning (or taking roots in) 'historical situations' preceding the ratification of the European Convention by a given Member State or even the enactment of the Convention. 'Historical situations' refer to events that occurred in the period of Second World War or shortly thereafter. In all such cases, the preliminary question arises whether the Court is competent temporally (ratione temporis) to deal with the application. This group of cases concerned usually allegations touching upon the right to life and the right to property. The Court had to decide if the allegation in question related to a temporally closed event (making the Court not competent) or rather to a continuous violation (where the Court could adjudicate). A specific set of legal questions arose vis-a-vis the right to life, first of all that of the autonomy of the procedural obligation to conduct an efficient investigation. The Strasbourg case law did not provide a clear answer. However, following two crucial judgements rendered by the Grand Chamber, the Court has established an interesting legal framework. Article analyses also two other situations having a historical dimension: bringing to justice those accused of war crimes or other crimes under international law (in light of the alleged conflict with the principle of nullum crimes sine lege) and pursuing authors of pro-Nazi statements or speech denying the reality of Nazi atrocities.

None of the provisions guaranteeing the right to a fair trial contained in the principal international agreements were explicitly drafted to assure such a right to victims of crimes. Therefore, over the last two decades one could observe a shift in the attitude of the European Court of Human Rights towards the rights of victims, in order to extend the protection granted under the provisions of the European Convention on Human Rights to victims taking part in criminal proceedings. The Court directly extends the rights of victims by elaborating the procedural obligations of States (mainly under Articles 2 and 3 of the Convention), and through a broader understanding of the concept of civil rights and obligations, which enables the extension of the guarantees granted under Article 6 to victims participating in criminal proceedings. The purpose of this analysis is to attempt to answer the questions: under what circumstances in criminal proceedings may victims benefit from the right to a fair trial, and to what extent are they entitled to claim the protection of the guarantees provided for under the Convention?

Objective. The aim of the article is a critical presentation of the typology of consents included in the European Convention on Bioethics and in other formal solutions concerning the gathering of genetic material in institutions called Biobanks. Materials and method. Existing types of Acts of Consent are inaccurate in their scope and possess insufficient information regarding the gathering of genetic material (application, usage, processing) and their final (future and diverse) use. Results. Lack of precise legal regulations on the broad future use of genetic material may result in various formal problems relating both to research participants as well as those commissioning the research. Ultimately, it may lead to various complications with the appropriate legal interpretation of consent and possible claims on behalf of the donors. Conclusions. The presented proposition of consent with a terminal premise is to be applied eventually to legal and formal aspects of the collecting of genetic material. It is a possible solution which would clarify the issue of informed consent, and may be implemented in the regulations of the Convention as well as constitute a self-contained legislative solution to this matter. For example, Polish law in its current form, without the ratification of the Bioethical Convention, allows the collecting of material for genetic testing for determination of the risk of genetic defects in common genetic material from people who are planning to have a child.

The article demonstrates how references to Nazi and Soviet past are perceived and evaluated by the European Court of Human Rights. Individual cases concerning Holocaust and Nazism, which the Court has examined so far, are compared here to judgments rendered with regard to Communist regime. The article proves that the Court treats more leniently state interference with freedom of expression when memory about Nazism and Holocaust is protected than when a post–Communist state wants to preserve a critical memory about the regime. The authors of the article agree with the attitude of the Court which offers a wide margin of appreciation to states restrictively treating references to Nazism and Holocaust, including comparisons to the Holocaust, Nazism or fascism used as rhetorical devices. At the same time they postulate that other totalitarian systems should be treated by the Court equally.

The present gloss refers to the thesis and considerations expressed in the Supreme Court judgement of 28 February 2023, I KZP 13/22, concerning the exception to the rule of speciality stipulated in Article 14(1)(b) of the European Convention on Extradition. The author presents arguments concerning the broad international legal context of the analysed regulation, which develops and confirms the accuracy of the Supreme Court’s stance on a broader than lexical interpretation of the term ‘final discharge’. Moreover, the paper discusses the nature of the exception in question in the light of the standard of protection laid down in Article 52(4) of the Constitution of the Republic of Poland.

The present contribution looks at the protection of fundamental rights under EU law, paying special attention to the Charter of Fundamental Rights of the European Union (the Charter) which, since the entry into force of the Treaty of Lisbon, enjoys “the same legal value as the Treaties”. First, by looking at the recent case law of the European Court of Justice, it explores the scope of application of the Charter. Second, it examines the conditions that the limitations on the exercise of the rights and freedoms recognised by the Charter must fulfil in order to be valid. Third, it looks at the interaction between, on the one hand, the Charter and the European Convention for the Protection of Human Rights and Fundamental Freedoms and between, on the other hand, the Charter and the constitutional traditions common to the Member States. Finally, a brief conclusion contains some remarks as to the requirements private applicants must fulfil in order to build strategic human rights cases successfully.

The author of this article, the lead lawyer for the applicants in the case relating to the 1940 Katyń massacre (Janowiec and Others v. Russia), provides a personal account of the case that was heard twice by the European Court of Human Rights, first as a chamber of seven judges and then in its Grand Chamber formation. The case concerned the key question of whether the Strasbourg Court is competent to adjudicate on the effectiveness of a domestic investigation when the triggering act (killing) precedes the ratification date of the European Convention on Human Rights. For the first time in its entire history, the Strasbourg Court examined whether its competence could be based on the “need to ensure the respect for the Convention’s founding values”, one prong of the test elaborated in the Silih judgment in 2009. The critical assessment of the Grand Chamber’s Katyń judgment offered in this article is based on two considerations: what the Court omitted (the applicants’ arguments referring to the relevant international law practice) and what the Court finally elaborated as its understanding of the two tests establishing the Court’s competence ratione temporis (the “genuine connection” test and “Convention values” test).

The article discusses the point of interconnection between historical policy and international human rights law standards on the example of a so-called decommunisation Act enacted in Poland in 2016 that reduces retirement pensions and other benefts to individuals who were employed or in service in selected state formations and institutions in 1944-1990, amending the Act adopted in 2009. The Act of 16 December 2016 is analyzed in the light of the standards of the European Convention on Human Rights (ECHR), including relevant standards on coming to terms with the past as an element of transitional justice. The examination concludes that there is a discrepancy between the rationale for adopting this legislation in Poland, namely to reckon with the communist past and as such increase social trust in state institutions, and the legal solutions contained in the 2016 Act.

During Perestroika, Russian authorities admitted publicly that, during Stalinism, a single order led to the extrajudicial execution of 26,000 Polish nationals (in what became known as the “Katyń forest massacre”). In 1990 Russia commenced criminal investigations, but they were discontinued and results were classified as secret in 2004. Following years of silence under communism, families of the victims demanded information from the Russian authorities, without results. The ECHR entered into force in Russia in 1998. This article analyzes the case Janowiec and Others v. Russia, brought before the Strasbourg Court by the relatives of the victims of the Katyń massacre. The applicants maintained that Russia violated the ECHR by discontinuing the investigation and failing to account for the fate of prisoners. In their opinion, Article 2 (right to life), and Article 3 (prohibition of torture and inhuman treatment) had been violated. This article compares the reasoning of the Court in the Chamber (2012) and Grand Chamber (2013) rulings. The latter produced a reformatio in peius with respect to the applicants’ interests. Grand Chamber ruled it had no competence either over the atrocity or over the subsequent improper treatment by Russian authorities. With this verdict, it deprived the applicants of the only claim upon which the Chamber had earlier ruled in their favour.

Prior to its ruling in Janowiec and Others v. Russia, the Grand Chamber of the European Court of Human Rights had recognised a “humanitarian exception” to the general rule by which the procedural obligations imposed by articles 2 and 3 of the European Convention only arise if the substantive violation of the Convention occurs after the entry into force of the Convention for the respondent State. In Janowiec, the Court was invited to apply this “humanitarian exception” to one of the great unpunished atrocities perpetrated on European soil in the past century. The Court declined to do so, mechanistically imposing its own temporal limitation on the “humanitarian exception” by which the substantive violation of the right to life and the prohibition of ill treatment must take place after the adoption of the Convention on 4 November 1950. The essay concludes that this limitation is questionable, that the reasoning behind it is dubious, and that the result is a regrettable confirmation of a situation of impunity.

The European Court of Human Rights ruled on whether Russia is responsible for human rights violations in relation to the Katyń massacre. Two of the major issues that had to be dealt with were the Court’s competence ratione temporis to assess the violation of the procedural obligations related to the right to life, and whether the applicants could be considered victims of inhumane treatment because of the failure of Russian authorities to provide information on the fate and whereabouts of their relatives. If the first judgment issued by the Chamber on 16 April 2012 was criticized because of its restrictive approach, the one issued by the Grand Chamber on 21 October 2013 took an even more controversial turn. The reasoning of the Court does not seem to be particularly sound and the outcome is a denial of justice. The comparison with the jurisprudence of the Inter-American Court of Human Rights in similar cases makes this all the more evident, suggesting that the application of different interpretative criteria would have been possible.

In the Janowiec and Others v. Russia case, the European Court of Human Rights (ECtHR), trying to find its way between the Scylla of humanitarian ideals and the Charybdis of State sovereignty, demonstrated its unwillingness to deal in detail with the black pages of Europe’s past, handing this right over to historians. The article first draws parallels between temporary jurisdiction of the Inter-American Courts of Human Rights and the ECtHR. Both of them found ways to overcome the non-retroactivity principle, but by using different techniques. Secondly the article analyzes how the presumption of death became the factor severing the link between the substantive and procedural limbs of violation of the right to life, turning the latter aspect into a detachable autonomous obligation. Finally, the author of the article expresses his regrets that the Court and the applicants missed the chance to develop the “right to the truth”, using, inter alia, the potential of Art. 10 of the European Convention on Human Rights.

The Polish Government’s proposal, submitted in autumn 2017, for a comprehensive reprivatisation bill revived the international discussion on the scope of Polish authorities’ obligations to return property taken during World War II and subsequently by the communist regime. However, many inaccurate and incorrect statements are cited in the discussions, e.g. the argument that the duty of the Polish authorities to carry out restitution is embedded in the European Convention on Human Rights and its Protocol No. 1. This article challenges that claim and analyses the jurisprudence of the Convention’s judicial oversight bodies in cases raising issues of restitution of property taken over in Poland before the accession to both of the above-mentioned international agreements. In the article I argue that there is no legal basis for claiming that there exists a legal obligation upon the Polish State stemming directly from international law – in particular human rights law – to return the property and that the only possibly successful legal claims in this regard are those that can already be derived from the provisions of the Polish law applicable to these kinds of cases. In its latest rulings, issued in 2017–2019, the European Court of Human Rights determined the scope of responsibility incumbent on Polish authorities in this respect.

The analysis of the materials show that the CIA prisons, where the members of Al-Kaida were kept and interrogated, were founded in Poland in 2002 when the country was governed by SLD. The PiS politicians who were in the following government knew about the fact but did not want to reveal it to the public. The party of PO which has been governing the country since 2007 has not solved the problem yet. European Court Of Human Rights held in its verdict of 24 July 2014 that there had been the CIA prisons in our country. According to that verdict Poland violated the European Convention on Human Rights and its ban on torture. Poland has not solved the problem, prolonging the investigation 15 times. It is extended until 11 April 2015. On 23 October 2014 our country appealed to European Court of Human Rights to hear the case again.

The principle of nullum crimen sine lege expresses an old idea that only the law can prescribe a particular act as punishable. It is commonly understood as a requirement of sufficient definiteness of an offence, in particular – of a statutory description of an offence before it has been committed (lex scripta, lex praevia), and of clarity and precision in criminal provisions so as to enable an individual to conform with them (lex certa), as well as their strict interpretation (lex stricta). Nowadays the principle is an internationally recognized human right to foreseeable criminalization, guaranteed by, inter alia, Article 7 of the European Convention on Human Rights. However, the European Court of Human Rights seems to formulate two slightly different requirements on its basis, namely that the application of criminal law must be foreseeable for an individual and coherent with the “essence of an offence”. One may question whether this can serve as an adequate “shield” from arbitrariness on the part of State authorities. Nevertheless, the core aim of such a flexible approach is not to promote legal security for potential perpetrators, but to achieve better protection of human rights in general.

This article provides an overview of “memory laws” in Europe, reflecting upon what may be called the “asymmetry” of such laws. It then looks at the special case of Poland and its troubled experience with memory laws; it considers the question of whether, in the eyes of the law – genocide, and in particular the Holocaust – is so “special” that its public denials warrant legal intervention. It also looks at the case law of the European Court of Human Rights and its (not necessarily coherent) “doctrine” on memory laws and their consistency, or otherwise, with the European Convention for the Protection of Human Rights and Fundamental Freedoms (and in particular with freedom of expression as laid down in Art. 10). The article concludes by asserting that even if we take the law as an indicator of European public memory, there is no consensus on the past, except perhaps for the special case of the Holocaust. The main challenge lies in determining whether memory laws, defined by some as social engineering and the imposition of “imperative” versions of memory, are consistent with the principles inherent in open, democratic and free societies in Europe. This challenge remains unmet.

This article aims to analyze the contemporary problem of respecting human rights in the actions of public administration. To that end, it aims to show the causes of the issue in question and propose solutions. The article opens with a description of the legal aspect of human rights from the general perspective as a matter of rules and elements of the legal system. This part of the article presents the legal grounds for and obstacles to incorporating human rights and the acts that regulate them into the actions of public administration. In the subsequent sections, the analysis shifts to a detailed perspective. The first one concerns the reliance of the public administration’s actions on Art. 6 point 1 of the European Convention on Human Rights and shows the issues with applying it to administrative cases, as noted in the literature and jurisprudence. The second addresses the issues associated with incorporating human rights regulations into the application of the substantial law. This problem is analyzed from the standpoint of legal regulations, values and interpretation. At the same time, the article aims to show that while on the one hand public administration is responsible for safeguarding rights, on the other it is also entitled to breach and limit.

The aim of this article is to present the liability of Russia and Ukraine regarding Crimea under the European Convention on the Protection of Human Rights. The author analyzes pending and possible prospective cases originating from the conflict around Crimea between Ukraine and Russia. Due to the inconsistency in case law of the EC-tHR it is difficult to clearly determine what state will be considered responsible for the violation of the rights of residents of Crimea resulting from the Convention. In author’s opinion the ECtHR could determine that the Russian Federation may be held respon-sible, as well as Ukraine. However, as it seems, the liability of Ukraine will be limited to the positive obligations under the ECHR.

Following the current situation caused by the coronavirus pandemic, this study brings to light the way in which the traditional school (the notion “school” was used in this paper with reference to all levels of learning, both schools and universities) was replaced, in a somewhat forced way, with online school in a society pursuing the tradition of face-toface education. Given this aspect of e-learning and a possible higher exposure of their private life, for both students and teachers, the study will seek to answer the question: “Does online school represent a limitation of the right to private life?” through a series of legal arguments. However, before an answer is found, the right to private life and the right to education, as seen through Romanian legal regulations, as well as through the perspective of the European Convention on Human Rights, will be studied in detail. Last but not least, the concept of online school will be subject to analysis, from the perspective of both main parties involved in the education act, closely following the concept of private life.

The issue of restrictions imposed on ownership of a monument is an excellent example illustrating the tension between the unrestricted use of a property and the public interest manifested by the necessity to protect historical monuments. Monuments represent one of the most fundamental elements of the State’s cultural heritage. The protection of this heritage is an element of raison d’état, including the need to foster the memory of the cultural identity of the nation. The aim of the article is to pinpoint the basic problems connected with the balancing of the conflicting values concerning the protection of ownership rights and those regarding the assurance of continuity of the cultural heritage of the State and whole huanity. The Author addresses the issue of monument ownership restrictions from the perspective of the basic standards of ownership protection enshrined in the Polish Constitution and the European Convention on Human Rights. The considerations make reference to the notion of a restricted right of ownership (with particular regard to the principle of proportionality) and the problem of compensation for having one’s monument ownership restricted.

This article attempts to discover the key elements of the democratic principle, as described by the judges sitting in Luxembourg and Strasbourg, whose case law reveals the underlying idea of democracy at the supranational level. Until recently the debate on democracy was limited to the national level. But things are changing, and this article shows the gradual emergence of a process led by supranational courts, in which the application of the democratic principle finds multiple grades and variations. In this way the supranational/international courts have opened a new chapter in the process of constitutionalization of international law.

Poland has been accused of participation in the extraordinary rendition program established by the United States after the September 11, 2001 attacks. It is believed that a secret CIA detention facility operated on the Polish territory, where terrorist suspects were transferred, detained and interrogated with the use of torture. Currently, Poland has found itself in a unique situation, since, unlike in other countries, criminal investigation into renditions and human right violations is still pending. Serious doubts have arisen, however, as to the diligence of the proceedings. The case was incomprehensibly prolonged by shifting the investigation to different prosecutors. Its proper conduct was hindered due to state secrecy and national security provisions, which have covered the entire investigation from the beginning. This article argues that Polish judicial authorities, along with the government, should undertake all actions aiming at explaining the truth about extraordinary rendition and seeking accountability for human rights infringement. Otherwise, Poland may face legal responsibility for violating the European Convention on Human Rights. This scenario becomes very probable, since one of the Guantanamo prisoners has already lodged a complaint against Poland with the European Court of Human Rights.

The specific topics tackled by the author include: free speech and the problem of criminalization of certain acts (e.g. the offence of defamation of public officials), hate speech, freedom of expression and the right of an individual to protect his or her good reputation (including the issue of libel laws), freedom of expression and the right to privacy (including the right to prior restraint on publication), free speech and internet, and the right to privacy versus national security.

In 2012 and 2013 the European Court of Human Rights announced two verdicts, dealing with important cases in Ukraine. They both concerned the leading Ukrainian politicians, that is Yuliya Tymoshenko and Yuriy Lutsenko. Y. Tymoshenko is the leader of the Batkivshchyna political party and of Yulia Tymoshenko’s Bloc. From 18 December 2007 to 3 March 2010, she held the position of Prime Minister of Ukraine. Y. Lutsenko, during the period from 18 December 2007 to 29 January 2010 was Minister of the Interior and the leader of the opposition party Narodna Samooborona. They were accused of abuse of power during their terms in office. The circumstances of the two cases are similar. Both applicants argued that their arrest and detention had been politically motivated and unlawful. In light of the cooperation between Ukraine and the EU, as well as the advancement as a democratic state, these judgements are very important. Significantly, the local and international observers concluded that their conviction was an element of political play. The Court ruled that the Ukrainian authorities violated the article 5 of the European Convention of Human Rights.

Artykuł porusza problematykę statusu życia ludzkiego w prenatalnej fazie rozwoju. Przeprowadzona analiza treści odwołuje się do wybranych dokumentów Rady Europy z lat 1976–2003, dotyczących ludzkiej biogenezy. Najistotniejszym z nich jest Europejska Konwencja Bioetyczna. Przeprowadzony przez autora dyskurs ma charakter interdyscyplinarny, a poddawane badaniom zagadnienia wykraczają poza ramy nauk prawnych i społecznych. Istotą sporu, z prawnego punktu widzenia, jest brak koherentnej definicji terminów „istota ludzka” i „osoba”, stosowanych m.in. w EKB. Rozważania merytoryczne zamyka przykład orzecznictwa Europejskiego Trybunału Praw Człowieka, ilustrujący kondycję prawa międzynarodowego w omówionym zakresie, jest to orzeczenie w sprawie Thi-Nho Vo przeciwko Francji (sygn. 53924/00), złożonej przed Europejskim Trybunałem Praw Człowieka.
The following article is the result of deliberations on the interdisciplinary debate conducted around the the status of prenatal human life in selected documents of the Council of Europe. The methodological basis for the studies was the content analysis of selected legislative documents announced by the CoE between 1976 and 2003. All divagations are taken from the legal and social perspective and focused on the European Convention on Human Rights and Bioethics. In this paper, I made a brief presentation of selected deeds established by the CoE that apply for the protection of human life in its prenatal stage. I have endeavored to present the difficulty of developing a coherent definition of the following concepts: “human being” and “person”. There is not any legal designation of this two terms. Furthermore, the following paper raise the topic of human rights and the scope of its protection. The summarization of this article contains of a verdict of the European Court of Human Rights of 8th July 2004 on Vo v. France.

The order of the Second Senate of the German Federal Constitutional Court (the FCCt) of 14 October 2004 is a good example for a functioning of European legal community in an interpretation by German courts. Analyzing of effects of the European Court on Human Rights’ (the ECHR) decision in the Görgülü case on application of law by the state bodies, the FCCt emphasizes an openness of the German legal order towards the European law but parallel forms some legal restrictions on it, as it also does in European Union cases. On one hand in the German legal system, the European Convention on Human Rights (the Convention) in the interpretation of the ECHR has the status of a federal statute, and it must be taken into account in the interpretation of domestic law, including fundamental rights and constitutional guarantees. The authorities and courts of the Federal Republic of Germany are therefore obliged, under certain conditions, to take account of the Convention as interpreted by the ECHR in making their decisions. On the other hand this commitment takes effect only within the democratic and constitutional system of the Basic Law. The standard of protection of basic rights guaranteed by the Basic Law forms an important part of this constitutional system. What is more the state bodies must take into consideration effects of the ECHR’s decision on the national legal system. It means that taking into account decisions of the ECHR is possible only within the scope of the applicable law of procedure and the state bodies must evaluate decision’s effects, in particular in family law, the law concerning aliens, and also in the law on the protection of personality. It is worth to mention that an influence of the Görgülü case may be seen also in German legislation. In 2006 the German Code of Civil Procedure was changed. According to the section 580 of the above mentioned Code an action for retrial of the case may be brought: 8. Where the European Court of Human Rights has established that the Convention or its protocols have been violated, and where the judgment is based on this violation.

The article provides arguments supporting the thesis that the current regulations of the Code of Criminal Procedure do not guarantee full access to the cassation stage of the criminal proceedings for the accused deprived of liberty and repre- sented by an ex officio defence counsel. In order to lodge a cassation appeal the accused is required to file a motion for written reasons of the appellate judgment within the prescribed time-limit indicated in Article 524 § 1 second sentence of the Code of Criminal Procedure. It is argued that in order to fulfil this requirement the accused must have fully effective right to acquire the content of the judgment or to take an informed decision to waive this right. The Author argues that this standard is not provided for by the current regulation of the Code of Criminal Procedure. The analyses take into account standards stemming from the case-law of the European Court of Human Rights.

More and more Member States of the Council of Europe are becoming interested in drone technology. Currently, a number of them either possess or wish to obtain unmanned aerial vehicles equipped with missiles. Due to the increased number of targeted killing operations committed with the use of drones by countries such as the United States or Israel, there is a probability that Member States might also use them for such operations, especially if their forces will be subject to joint command. Although the issue of targeted killings with the use of drones has not yet been subject to the scrutiny of the European Court of Human Rights, there are two main reasons why this may change in the near future. First, the Court has already ruled on the extraterritorial applicability of the European Convention on Human Rights, and second, the Convention places strict limits on any attempts to carry out targeted killings and leaves only a limited space for their use, even in the context of warfare. In this article we assess whether the Member States of the Council of Europe might be ever justified under the European Convention on Human Rights to carry out targeted killing operations using drones.

W artykule podjęto próbę odpowiedzi na pytanie, czy w XXI w. działalność Europejskiego Trybunału Praw Człowieka (ETPC) stanowi zagrożenie dla suwerenności państw podlegających jego jurysdykcji, czy może wpływa pozytywnie na system prawa, wymiar sprawiedliwości i funkcjonowanie tych państw. Rozważania oparto m.in. na ocenie legitymizacji ETPC, analizie skutków orzeczeń ETPC dla państw-stron Konwencji, a także charakterystyce doktryny marginesu oceny. Ważną część opracowania stanowi również analiza wyroku ETPC w sprawie Hirst przeciwko Zjednoczonemu Królestwu (2) w kontekście słuszności argumentacji ETPC i reakcji Zjednoczonego Królestwa na to orzeczenie.
The article attempts to answer the question whether in the 21st century the activities of the ECtHR pose a threat to the sovereignty of states under its jurisdiction, ornwhether it positively affects their legal systems, judiciaries and overall functioning. The considerations were based, among others, on the assessment of the legitimacy of the ECtHR, analysis of the effects of ECtHR judgments on the High Contracting Parties of the Convention, as well as the description of the margin of appreciation. An important part of the study is also the analysis of the ECtHR’s judgment in the Hirst v. United Kingdom (2) case in the context of the validity of ECtHR’s arguments and UK’s reaction to this judgment.

The author discusses the legal basis, the cope of application, the content and the concurrence of procedural guarantees in the event of an expulsion of an alien under the European Convention. These guarantees stem from Article 1 of Protocol No. 7, Article 4 of Protocol No. 4, Articles 13 and 34 of the Convention as well as from the concepts of positive obligations and tests of legality and necessity, developed in the case law of the Strasbourg Court. Guarantees under Article 1 of Protocol No. 7 and Article 4 of Protocol No. 4 are the only ones that are applicable regardless of whether an expulsion results in the violation of an alien’s rights or the limitation of the freedoms arising from the Convention. Moreover, they do not apply to extradition proceedings, whereas the other guarantees do. However, in the context of the guarantees resulting from Article 13 of the Convention and the concepts of positive obligations as well as the tests of legality and necessity, a common standard of procedural requirements in an event of an expulsion of an alien seems to have emerged. It includes the alien’s right to information on the specifi c reasons for expulsion; available remedies and a possibility of obtaining legal assistance; the right to submit arguments against expulsion; the right to be represented; the right to have the case reviewed; the right to an independent and impartial authority competent to decide in the case. In the event where an expulsion puts an alien in danger of irreversible damage to his/her rights, the person concerned should have, in addition, access to a remedy with automatic suspensive eff ect. This standard is also quite common to guarantees stemming from Articles 1 of Protocol No. 7 and Article 4 of Protocol No. 4. However, since “competent authority” under Article 1 of Protocol No. 7 need not be the authority with whom the fi nal decision on expulsion rests and because it is possible to expel an alien before the exercise of his/her rights under this Article, the author is of the opinion that the latter should apply only to expulsions that do not threaten conventional rights.

Z uwagi na ten fakt wniesienie skargi w sprawie Cláudia Agostinho przeciwko Portugalii i 32 innym państwom do Europejskiego Trybunału Praw Człowieka w Strasburgu nie jest zaskakujące, tym bardziej że w ostatnim czasie złożono wiele skarg tego rodzaju przeciwko rządom na całym świecie. Prezentowany artykuł zawiera szczegółowe omówienie tytułowej skargi, a także próbę odpowiedzi na pojawiające się pytania, m.in. czy Trybunał strasburski uzna skargę za zasadną, a jeśli tak, czy dokonując interpretacji Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności, weźmie pod uwagę traktaty dotyczące zmian klimatycznych.
Climate changes are a major threat to human life. In this connection, submission of a complaint in the case Cláudia Agostinho against Portugal and 32 other states to the European Court of Human Rights in Strasbourg is no surprise, especially as a number of such complaints have been raised against governments worldwide recently. This paper discusses the complaint in detail and attempts to answer some of the questions raised, such as, will the Strasbourg Court find the complaint reasonable and, if so, will it address treaties on climate changes when interpreting the Convention for the protection of human rights and fundamental freedoms?

The purpose of this article is to determine the relationship between the principles of subsidiarity and effectiveness and an effective remedy for the excessive length of proceedings within the legal order of the European Convention on Human Rights. The article assumes that these key principles of the ECHR’s legal order have an impact on such a remedy, both in the normative and practical dimensions. This assumption has helped explain many aspects of the Strasbourg case law regarding this remedy. Concerning the relationship of this remedy with the principle of subsidiarity, it raises issues such as: the “reinforcing” of Art. 6 § 1; the “close affinity” of Arts. 13 and 35 § 1; and the arguability test. In turn, through the prism of the principle of effectiveness, the reasonableness criterion and the requirement of diligence in the proceedings are presented, followed by the obligations of States to prevent lengthiness of proceedings and the obligations concerning adequate and sufficient redress for such an excessive length of proceedings. The analysis shows that an effective remedy with respect to the excessive length of proceedings is not a defnitive normative item, as the Court consistently adds new elements to its complex structure, taking into account complaints regarding the law and practice of States Parties in the prevention of and compensation for proceedings of an excessive length.

Attempts of the European Union for accession to the European Convention for the Protection of Human Rights and Fundamental Freedoms have been made for years, which proves the task is very difficult in the context of the institutional and legal issues. In view of the complexity of the issue and limitations as to the scope of this paper the focus is on selected legal acts sui generis, as passed by the EU institutions and by the Council of Europe. The analysis covered the stance of the Court of Justice of the European Union and it was based on the legal opinions formulated on the basis of the primary law. The question whether the said accession is still possible remains unanswered.
Już od lat jesteśmy świadkami podejmowania prób przystąpienia Unii Europejskiej do Europejskiej Konwekcji Praw Człowieka i Podstawowych Wolności jak się okazuje jest to zadanie szczególnie skomplikowane ze względu na problemy instytucjonalno-prawne. Z uwagi na złożoność zagadnienia i na ograniczenia objętościowe niniejszej publikacji skupiono się na analizie wybranych aktów sui generis wydanych przez instytucje UE jak i organy Rady Europy. Przeanalizowano stanowisko Trybunału Sprawiedliwości Unii Europejskiej opierając się na wydanych przez niego opiniach prawnych, podpartych aktami prawa pierwotnego. Pozostawiając otwarte pytanie Czy przystąpienie do konwencji jest nadal możliwe?

Zasada poszanowania praw człowieka należy do podstawowych wartości integracji europejskiej. Jednakże stosowanie standardów ochrony praw człowieka, wywodzonych z europejskiej Konwencji Praw Człowieka (EKPC) oraz z orzecznictwa Europejskiego Trybunału Praw Człowieka, wciąż napotyka na ograniczenia w państwach europejskich. Przedmiotem niniejszego artykułu są podstawy prawne stosowania EKPC w niemieckim systemie prawnym, w szczególności art. 1 ust. 2 Ustawy Zasadniczej RFN, ale przede wszystkim orzecznictwo Federalnego Trybunału Konstytucyjnego RFN dotyczącego tego zagadnienia.
In the process of European integration human rights protection has become one of the most prominent values. Nevertheless, the application of standards derived from the European Convention on Human Rights (ECHR) and from case law of the European Court on Human Rights still meets some obstacles at a national level. This article examines the legal nature of the foundation for the application of ECHR in Germany, especially Art. 1 para. 2 of the German Basic Law, but mostly focuses on the application of ECHR from the point of view of the German Constitutional Court.

The present gloss refers to the thesis and considerations expressed in the Supreme Court judgement of 28 February 2023, I KZP 13/22, concerning the exception to the rule of speciality stipulated in Article 14 par. 1 (b) European Convention on Extradition. The author presents arguments concerning the broad international legal context of the analysed regulation, which develops and confirms the accuracy of the Supreme Court’s stance on a broader than lexical interpretation of the term ‘final discharge’. Moreover, the paper discusses the nature of the exception in question in the light of the standard of protection laid down in Article 52 par. 4 Constitution of the Republic of Poland.

Human impacts on landscapes pose serious threats to Central European landscapes (e.g. urban sprawl, land consumption and loss of landscape diversity and biodiversity) and consequently, influence quality of life as landscapes are a key factor in individual and social well-being and affect everybody. Therefore, public participation is an issue of great significance when elaborating visions and action plans for sustainable landscape development. In order to implement participatory discussion of landscape issues, "landscape dialogues" in the Austrian LEADER region Mühlviertler Kernland were organised in the framework of the VITAL LANDSCAPES project. The introduced method proved to be an adequate instrument to create awareness and to give local people a forum to elaborate on visions and concrete actions for sustainable landscape development. In the course of the "landscape dialogues", complex issues of landscape development, e.g. the renewal of village cores, the cultivation of low-productive grasslands, the management of small-structured landscape elements as well as the increase of renewable energy use were addressed and gave impulses in some involved municipalities to continue the discussion in communicative and participatory planning processes within the Local Agenda 21 framework.

W artykule została omówiona problematyka związana z prawem do manifestowania przekonań religijnych na podstawie obowiązujących norm prawa europejskiego, których konkretyzację stanowi orzecznictwo ETPC. W sposób szczególny zwrócono uwagę na bardzo istotną rolę, jaką spełnia odpowiedź na pytanie, czy dane zachowanie stanowi manifestację przekonań religijnych, czy też jest nimi jedynie inspirowane bądź też jest kwestią osobistego wyboru. Jako przykład w trudności w odpowiedzi na to pytanie przywołano wyrok ETPC w sprawie Eweida i inni przeciwko Zjednoczonemu Królestwu, w którym kwestia ta zajmowała istotne miejsce. Trybunał uznał noszenie krzyżyka przez N. Eweidę i S. Chaplin za formę manifestacji ich wiary. Odrzucił jednocześnie stanowisko sądów brytyjskich, które zredukowały krzyżyk do biżuterii, a jego noszenie uznały za osobisty wybór skarżących.
The article examines issues related to the right to manifest religious beliefs on the basis of existing European legislation, which is expressed especially in jurisprudence of the European Court of Human Rights. In particular, it highlighted the very important role of giving the answer to the question whether the behavior is a manifestation of religious beliefs, or is it only inspired by them or is only a matter of personal choice. As an example of the difficulties in answering this question, there was invoked the judgment of the European Court of Human Rights in case Eweida and others against the United Kingdom, where this issue has occupied an important place. The Court considered wearing a cross by N. Eweida and S. Chaplin as a form of manifestation of their faith. The Court rejected the position of the British courts, which reduced cross for jewelry, and his wearing considered as a personal choice of the applicants.

The purpose of this paper is the presentation of some selected issues connected with the right to a fair trial (the right to court, the right to legal proceedings), which is a key element of human rights protection and serves to provide procedural means to safeguard the rule of law. The right to a fair trial is generally guaranteed in acts of international law and in democratic constitutions. The Author of this paper compares regulations of this issue in the European Convention on Human Rights, in the Charter of Fundamental Rights of the European Union and in the Constitution of the Republic of Poland. Because of the extent of the presented subject, article was divided into two parts – the first one, which contains the introduction to the subject of the right to a fair trial and the analysis of this issue in the European Convention on Human Rights and the second part, which presents the regulation of the right to a fair trial in the Charter of Fundamental Rights of the European Union and in the Constitution of the Republic of Poland.

The article’s purpose is to present the concept of a potential victim of violations of the rights and freedoms of the European Convention on Human Rights. A group of complainants is treated as a victim, even though the violation affects society. The qualification of complainants as victims of human rights violations can be treated as the creation of European human rights law. The role of the Court is to apply the so-called ‘push’ and ‘pull’ factors, which cannot only effectively contribute to the implementation of the principles of the ECtHR. The article addresses the problem of the assumptions of the living instrument doctrine and the interpretation of the law currently associated with the active activity of judges (judge-made law). The concept of the potential victim of human rights violations represents an opportunity for the postulated expansion of the catalog of fundamental rights.
Celem artykułu jest przedstawienie koncepcji potencjalnej ofiary naruszeń praw i wolności Europejskiej Konwencji Praw Człowieka oraz skutków dopuszczalności tych skarg w perspektywie katalogu praw podstawowych. W pracy scharakteryzowane zostały warunki dopuszczalności skargi, zwłaszcza nadanie statusu ofiary. Coraz częściej wpływają skargi obywateli, którym nadaje się status potencjalnych ofiar naruszeń praw człowieka. Grupa skarżących jest traktowany jako ofiara, mimo że naruszenie dotyczy na przykład całego społeczeństwa. Kwalifikacja skarżących jako ofiary naruszeń praw człowieka może zostać potraktowane jako tworzenie prawa europejskiej ochrony praw człowieka. Rolą Trybunału jest między innymi stosowanie tzw. ‘push’ and ‘pull’ factors, które mogą nie tylko skutecznie przyczyniać się do realizacji zasad funkcjonowania ETPC. W artykule poruszono również problem założeń doktryny living instrument oraz interpretacji prawa wiążącej się obecnie z aktywną działalnością sędziów (judge-made law). Koncepcja potencjalnej ofiary naruszeń praw człowieka to nowa instytucja, stanowiąca szansę na postulowaną rozbudowę katalogu praw podstawowych.

The article is devoted to the issue of killing an attacker in self-defense. The considerations are based on the interpretation of Article 25 § 2 of the Penal Code, from which it follows that the method of defense must be commensurate with the danger of attack. The authors are looking for a catalog of legal interests that can be defended by harming the attacker’s life. They also analyze Article 2 (2a) European Convention of Human Rights, according to which deprivation of life shall not be regarded as inflicted in contravention of this Article when it results from the use of force which is no more than absolutely necessary in defence of any person from unlawful violence. The authors draw attention to the role of this provision in the interpretation of the signs of necessary defense, especially the sign of proportionality of the means of defense to the danger of assassination. In the article, they also defined the concept of a countertype (justification) and briefly characterized the remaining features of necessary defense
Artykuł jest poświęcony problematyce pozbawienia życia napastnika w obronie koniecznej. Rozważania prowadzone są w oparciu o wykładnię art. 25 § 2 Kodeksu karnego, z którego wynika, że sposób obrony musi być współmierny do niebezpieczeństwa zamachu. Autorzy poszukują katalogu dóbr, których można bronić godząc w życie napastnika. Analizują ponadto art. 2 ust. 2 lit. a Europejskiej Konwencji Praw Człowieka, zgodnie z którym pozbawienie życia nie będzie uznane za sprzeczne z tym artykułem, jeżeli nastąpi w wyniku bezwzględnego koniecznego użycia siły w obronie jakiejkolwiek osoby przed bezprawną przemocą. Autorzy zwracają uwagę na rolę tego przepisu w interpretacji znamion obrony koniecznej, zwłaszcza znamienia współmierności sposobu obrony do niebezpieczeństwa zamachu. W artykule definiują ponadto pojęcie kontratypu oraz scharakteryzowali krótko pozostałe znamiona obrony koniecznej.

The article explores the concept of the positive and negative obligations of the state in securing human rights, recognized in human rights literature, and in the judgments of the European Court of Human Rights. The concept is then applied to show the importance of securing freedom of expression in regulating Internet access services and enforcing pertinent regulations in EU Member States. The author is of the opinion that economic arguments should not overshadow the need to secure the freedom of expression of the end-users of Internet access services.
L’article explore le concept des obligations positives et négatives de l’État en matière de défense des droits humains, reconnu dans la littérature sur les droits humains et dans les arrêts de la Cour européenne des droits de l’homme. Le concept est ensuite appliqué pour montrer l’importance de garantir la liberté d’expression dans la réglementation des services d’accès à Internet et dans l’application des réglementations pertinentes dans les États membres de l’UE. L’auteur est d’avis que les arguments économiques ne doivent pas occulter la nécessité de garantir la liberté d’expression des utilisateurs finals des services d’accès à Internet.

W artykule przedstawiono unormowanie prawne Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności w zakresie ochrony prawa do strajku. Warto podkreślić, że Konwencja nie wyraża wprost prawa do strajku. Jednak prawo to zostało ujęte w Europejskiej Karcie Społecznej. Art 11 EKPC stanowi, że każdy ma prawo do swobodnego, pokojowego zgromadzania się oraz do swobodnego stowarzyszania się, włącznie z prawem tworzenia związków zawodowych i przystępowania do nich dla ochrony swoich interesów. W ostatnim czasie Europejski Trybunał Praw Człowieka podjął dwa istotne rozstrzygnięcia, w których wskazał, iż art. 11 EKPC chroni także prawo do rokowań zbiorowych, a także prawo do strajku. W swoich rozstrzygnięciach Trybunał nawiązał do dorobku Międzynarodowej Organizacji Pracy. Trzeba jednak dodać, że również Konwencje MOP nie przewidują wprost ochrony prawa do strajku.
This article gives an overview of the European Convention of Human Right’s protection of the right to collective action. It is very important to underline that European Convention does not express directly the right to strike. However, the right to strike is expressly recognized only in the European Social Charter. Art. 11 ECHR states only that everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests. But two recent rulings by the European Court of Human Rights (ECHR) state that the exercise of the right to form and join trade unions includes the right to collective bargaining and the right to strike. With these cases the ECtHR found guidance with the ILO standards and followed its recommendations and jurisprudence. It should be added that the right to strike is not explicitly mentioned that there is no clear guarantee of the right to strike in the ILO Constitution or Conventions.

Artykuł ma na celu podjęcie problemu moralnej dostępności prawa w zestawieniu ze standardem nullum crimen, nulla poena sine lege możliwym do wywiedzenia z orzecznictwa Europejskiego Trybunału Praw Człowieka oraz pomocniczo także innych sądów i trybunałów w sprawach dotyczących przewidywalności bezprawnego i karalnego charakteru czynów składających się na zbrodnie międzynarodowe. Dwa pytania wyznaczają zakres prowadzonych analiz. Po pierwsze, analizie poddane zostaje to, do jakiego stopnia karalność zbrodni międzynarodowych była i jest przewidywalna dla zwykłego adresata normy karnoprawnej. Po drugie zaś, artykuł podejmuje kwestię, w jakim zakresie uzasadnione jest powoływanie się na argument z tzw. dostępności moralnej komunikatu kryminalizacyjnego w celu zrekompensowania pewnych niedociągnięć formalnych charakterystycznych dla legislacji międzynarodowej. Badane są ponadto poszczególne kryteria zasady legalizmu w zestawieniu ze zbrodniami międzynarodowymi. Szerszemu omówieniu poddano także trzy rozpatrywane przez ETPC sprawy (Kononov, Vasiliauskas oraz Korbely) odnoszące się kolejno do zbrodni wojennych, zbrodni ludobójstwa oraz zbrodni przeciwko ludzkości.
The aim of this article is to address the problem of the moral availability of the law in relation to the standard nullum crimen, nulla poena sine lege, which may be derived from the case law of the European Court of Human Rights and other courts and tribunals in cases concerning the predictability of the unlawful and punishable nature of acts constituting an international crime. Two questions determine the scope of this inquiry. First, I examine to what extent the punishability of international crimes has met the predictability criterion as far as the ordinary addressee of a provision of criminal law is concerned. Secondly, the article raises the question of the extent to which it is justified to rely on an argument on the grounds of the “moral availability” of criminalization to compensate for certain formal shortcomings characteristic of international legislation. In addition, I examine particular criteria of the principle of legality in relation to international crimes. In this respect, I discuss three cases heard by the ECHR (Kononov, Vasiliauskas and Korbely) concerning war crimes, the crime of genocide, and crimes against humanity respectively
