    Opis:
    One of the aims of the European Union is to create a common space of freedom, security and justice for its citizens and for legally residing citizens of third countries. The means are regulations to guarantee an appropriate level of security after the lifting of border controls on EU internal borders, including regulations to prevent human trafficking. Legislation by EU authorities in this field is binding not only for UE institutions, services and agencies, but also for the member states. All the national authorities – in the legislative, judicial and executive branches – are bound by EU legislation and hence they become elements of a supranational system of power. The article analyzes the nature and extent of obligations the member states have in the light of EU laws on the prevention and elimination of human trafficking.

    Opis:
    This article investigates the engagement of EU law with the interests represented and pursued by the Member States within the framework of the European Union. In principle, because the interests which the Member States feed into the EU governance machinery are formulated in political processes at the national level, and thus possess paramount political legitimacy, EU law may only interact with those interests when a clear and sufficient mandate has been provided for doing so. Such mandates follow from Treaty provisions or EU legislation. They embody common political agreements among the Member States by which they commit themselves to realising the specific interests they share, as well as achieving related common policy objectives. In practice, however, the boundaries of EU law’s mandate are difficult to determine with precision, and this may weaken the legitimacy of EU law’s interventions. The weaker legitimacy of the law raises particular problems in the law of the Single Market, where the interests pursued by national governments are subjected to filtering, moderation, and even transformation by the Court of Justice.

    Opis:
    Ecological security is a state in which air quality compliant with the standards of air protection is ensured for members of society. An air quality plan is a legal instrument serving the restoration of air quality to the level required by law as soon as possible in case of the emergence and the persistence of exceedances of such standards. Members of society fearing the influence of bad quality air on their health have the right to demand judicial control of the effectiveness of such a plan. The possibility of demanding the restoration of ecological security in such a way results from the guarantees given them at the constitutional and EU level. National courts in Poland, which is an EU Member State, are obliged to respect those guarantees.
    Bezpieczeństwo ekologiczne to stan, w którym członkowie społeczeństwa mają zapewnioną jakość powietrza zgodną ze standardami ochrony powietrza. Program ochrony powietrza to instrument prawny służący przywracaniu jakości powietrza do poziomu wymaganego prawem tak szybko jak to możliwe, w razie zaistnienia i utrzymywania się przekroczeń takich standardów. Członkowie społeczeństwa, obawiający się o wpływ niewłaściwej jakości powietrza na swoje zdrowie, mają prawo żądać sądowej kontroli efektywności tego planu. Możliwość żądania przywrócenia w taki sposób bezpieczeństwa ekologicznego wynika z gwarancji przyznanych im na poziomie konstytucyjnym i unijnym. Sądy krajowe w Polsce, będącej państwem członkowski UE, są zobowiązane do respektowania tych gwarancji.
