The research presented in the article aims to assess the scope of the normative freedom of EU Member States when implementing non-conviction based confiscation. This study was based on the case law of the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECHR). The study shows that despite the broad discretion of the Member States resulting from the position of the CJEU, domestic regulation of this type of confiscation falls outside the scope of EU law; the extensive jurisprudence of the ECHR sets quite precise boundaries concerning the concept of confiscation without prior conviction. Thus, it limits the discretion of Member States in this regard, providing both safeguards for individuals and guidelines for national legislators that intend to develop non-conviction based confiscation regimes in their domestic legal system.

Opis:
An effective implementation of mutual recognition in the Area of Freedom, Security, and Justice requires mutual trust between the Member State. Mutual trust has been eroded in some Member States due to the rule of law crisis. However, it is not only the rule of law crisis, but also the departure of the Member States from the shared values of respect for fundamental rights, as well as the differences in the prosecutorial systems of individual Member States, that have caused changes in the perception of the principle of mutual recognition. This paper will examine the evolving approach to the principle of mutual recognition based on the recent Court of Justice of the European Union rulings on the European arrest warrant. The analysis concludes that the CJEU attaches more importance to the protection of the principle of mutual recognition, the prosecution of perpetrators of crime, and the unwavering presumption of respect for fundamental rights by the Member states than to the effective protection of fundamental rights.

The aim of this article is to present the development of Polish and EU regulations on child pornography. Four amendments to the Polish Criminal Code, which were passed with the purpose of effecting tools to protect children, are strictly connected with the changes in the EU law – from the Green Paper of 1996 to Directive No. 2011/92/EU of the European Parliament and of the Council. The paper presents the current definition of child pornography, the understanding of which has evolved since the 90s. Changes in the EU law and the Polish regulations can be divided into three stages – first attempts at specifying instruments on child protection, widening the scope of the definition of child pornography and stiffening sanctions for child pornography. Amendments tothe Polish Criminal Code reflect the actual tendency to adopt more precise tools to prevent children from sexual exploitation. However, it does not lead to desired effects. Child pornography is a growing problem due to the relentless technological development but current regulations in their casuistic form are not a suitable tool to combat sexual exploitation of children.

The paper analysis the principle of proportionality, which is widely applied in the EU legal order and is therefore one of the fundamental principles of the system of the European Union. It is one of the legal principles that govern decision-making processes and common strategic objectives, and which are applicable when establishing European Union legislation and transposing it into national law, including in the area of criminal law, although the current analyses do not often focus on discussing this aspect. Due to its complexity and significance for the processes of establishing and applying the law, the principle of proportionality requires detailed and separate discussion, especially in the context of European criminal law.

Opis:
European Union law determines the development of the internal law of the Member States directly or indirectly in almost every area of their activity. One of the important functions of the state is to protect the environment. Th e establishment and implementation of the principle of sustainable development, as well as intensifi ed by the European Union for last several years environmental policy, has forced changes aimed at improving the fi ght against crimes against the environment. Th e changes introduced by the Directive 2008/99/EC of the European Parliament and of the Council of 19 November 2008 on the protection of the environment through criminal law had an impact on crime policy in Poland. Th is article was devoted to discussion of changes in the Polish Criminal Code that have taken place under the infl uence of this directive. At the same time article contains the explanation of the directive, as an act constituted by the EU institutions and its role in the creation of domestic law in the Member States.
Prawo Unii Europejskiej determinuje rozwój prawa wewnętrznego państw członkowskich pośrednio lub bezpośrednio, praktycznie w każdej dziedzinie ich aktywności. Jedną z istotnych funkcji państwa jest ochrona środowiska naturalnego. Powstanie i wdrażanie zasady zrównoważonego rozwoju, a także zintensyfi kowana od kilkunastu lat przez Unię Europejską polityka ochrony środowiska wymusiła wprowadzenie zmian, których celem jest skuteczniejsze zwalczanie przestępstw przeciwko środowisku naturalnemu. Zmiany wprowadzone poprzez dyrektywę Parlamentu Europejskiego i Rady 2008/99/WE z dnia 19 listopada 2008 r. w sprawie ochrony środowiska poprzez prawo karne miały wpływ na politykę kryminalną w Polsce. Niniejszy artykuł poświęcono omówieniu reformy polskiego kodeksu karnego, która dokonała się pod wpływem tego aktu wtórnego prawa UE. Artykuł zawiera w sobie objaśnienie roli dyrektywy, jako aktu stanowionego przez instytucje UE, w kształtowaniu prawa wewnętrznego państw członkowskich.

As of 27 November 2017 the deadline passed by which the European Union Directive 2013/48/EU on the right of access to a lawyer should have been implemented by the Member States in their respective legal systems. Poland completed the said responsibility only ostensibly, for no legal norms which regulate the standard of the right to formal defence contained in Polish Code of Criminal Procedure have been amended. This very situation makes it necessary to consider whether the norms of the directive in question may cause the so-called direct effect in Poland’s domestic legal system, particularly: whether prosecuted individuals may directly invoke the directive in order to, based on its content, seek the assistance of a lawyer in the course of criminal proceedings. Therefore, it stands to reason that, at least in relation to some of the competences envisioned in the directive, such eventuality exists, whereas in remainder of the cases the judicial bodies are obliged to interpret the respective norms of the Code of Criminal Procedure in pro-EU manner, thereby elevating the standard of right to formal defence present in Polish criminal proceedings. Nonetheless, the real transposition of this directive should be postulated, since invoking its direct effect cannot exempt a Member State from implementing it in accordance with EU treaties as a way to harmonize domestic legal systems.
