    It is evident how disproportions between the underdeveloped South and economically developed countries have been increasing over time, especially seen in the context of processes of globalisation and internationalisation of contemporary international relations. At present it is impossible to give a reasonable, informed answer to the question whether those countries have a chance to overcome their development barriers. Still, the task of solving the problems is also a challenge faced by the entire international community and it undoubtedly influences the EU’ external policy. The purpose of this paper is to analyse the essence of the European Union's development policy. It scrutinizes the principles and functioning of the EU development policy as well as its challenges and obstacles. The author presents also the role and position of Poland in shaping EU policy outside Europe has been also presented. The author specifies the main challenges facing Polish foreign policy towards developing countries. The article aims to verify the assumption that the 1990s and early 21st century marked a significant revaluation of the European Union's development Policy towards Africa. On one hand, EU development policy is becoming more crucial and comprehensive in character. On the other hand, the current premises of EU development policy do not fully match the real needs of African (developing) countries.

    The purpose of this article is an attempt to analyze the European political game concentrated around the problem of African migration, based on the situation in Lampedusa Island in 2011, which we may call a border crisis. The article is focused on demonstrating cooperation in the sphere of relations between individual countries involved in solving the problem of the influx of immigrants, and the process of a transfer of interests of individual Member States to the sphere of the European Union. These considerations are part of a debate on re-bordering and establishing a second border range around Europe. The field of research outlined above will form grounds for formulating conclusions regarding the main questions: Was one of the aims of cooperation with African countries so far, border strengthening through the process of externalization, i.e. the process of establishing a second buffer border on the line of North African countries protecting against the influx of illegal migration? Considering the events taking place in North Africa in 2011, can we observe the consequences of breaking the framework of double borders in Europe? What is the impact of the action taken by individual Member States in limiting illegal migration on the process dynamics in the European Union?

    The article explores the peacekeeping activities of Poland, Hungary, the Czech Republic and Slovakia and the characteristics of their activities on the African continent. The paper examines the African peacekeeping missions carried out by Visegrád countries. The study uses comparative scientific literature and analysis of statements released by these governments and other papers and studies related to the African peacekeeping missions. In addition, I used my own experience from my previous African peacekeeping/peace support missions, and the lessons learned from other African operations published in my previous book about Hungarian peacekeeping missions. In summary, of the Visegrád states with differing levels of training and equipment, Poland was the most active in peace operations in Africa and in the lead, followed by the Czech Republic and Hungary, while Slovakia was the least involved in the African continent. This trend is, moreover, in line with the involvement of the above countries in Africa to date. Although these states cooperate in several areas, this is not the case for African peace operations, although cooperation in this area would be important. The research examines the background to the activities of the V4 countries in peace operations in Africa. The study is particularly important in view of the fact that, for a number of reasons (migration, terrorism), the V4 countries are preparing for greater engagement in Africa, one area of which is peace-support operations.

    The purpose of this paper is to analyze the conditions behind Polish participation in the European Union’s military operations in Africa. The author attempts to describe the evolution of the Polish position on the concept of the Common Security and Defence Policy. The text presents the Polish experiences, gained during operations, and assessments of the outcomes of Polish involvement, against the declared priorities of Polish foreign policy. The author also points out the main causes of changes in the Polish stance against further involvement on the African continent. She draws attention to the transformations within the EU and their reception by the Polish government.
    Celem artykułu jest analiza uwarunkowań udziału Polski w afrykańskich operacjach wojskowych Unii Europejskiej na tle ewolucji polskiego stanowiska wobec koncepcji realizacji Wspólnej Polityki Bezpieczeństwa i Obrony. W tekście przedstawiono polskie doświadczenia z udziału w operacjach, a także ocenę jego konsekwencji w odniesieniu do deklarowanych priorytetów polskiej polityki zagranicznej. Autorka wskazuje także na główne przyczyny zmiany stanowiska polskiego wobec dalszego zaangażowania na kontynencie afrykańskim. Zwraca uwagę na przekształcenia wewnątrz Unii oraz ich odbiór przez stronę polską.

    The European Union has a long history of relations with Africa and Africa has always been a strategic partner for the European Union. Today, however, the European Union’s relations with Africa are at a crossroads and the partnership needs to undergo a profound and rapid change. In order to properly investigate this research problem and to address its research questions concerning the future of the EU-Africa partnership, it is demonstrated that the time has come for change and redefinition of the partnership. Therefore, the overall aim of the article is to provide an insight into the EU’s new partnership with Africa, to explore its complex, fragmented nature and scope, actors, legal bases, constitutive elements and different ways both sides are going to present the new agreement to their respective constituencies. The way this research is pursued combines a number of methods. It involves textual analysis of primary sources – the instruments regulating the EU’s relations with Africa, secondary sources, documentary analysis as well as comparative, contextual and historical analysis. The complexities facing the EU and its African partners encourage curiosity and reflection about the new partnership. The article strongly emphasizes that the EU-Africa partnership does not stand still. It is a process of ever closer partnership. It has evolved from a relatively limited scale into a comprehensive system of normative instruments and institutions. And it has bifurcated into EU-ACP and EU-AU partnerships and today both partnerships are being re-negotiated. The likelihood of the negotiations being completed successfully, optimistically, by the end of 2020, remains open. It is our overall conclusion and prediction that the EU-Africa partnership will be enhanced and move a step closer to an integrated, comprehensive partnership, an effective framework for EU-AU relations.
    Unia Europejska ma długą historię stosunków i strategicznego partnerstwa z Afryką. Dziś jednak stosunki Unii Europejskiej z Afryką są na rozdrożu, a ich partnerstwo musi ulec głębokiej i szybkiej transformacji. Aby właściwie zbadać ten problem badawczy i odpowiedzieć na pytania badawcze dotyczące przyszłości partnerstwa Unii Europejskiej z Afryką, artykuł dowodzi, że nadszedł czas na jego zmianę i redefinicję. Głównym celem tego artykułu jest identyfikacja nadrzędnych ram nowego partnerstwa UE z Afryką, analiza jego elementów konstytutywnych, złożonego charakteru i zakresu, aktorów, podstaw prawnych, i pozycji negocjacyjnych stron nowego partnerstwa. Badania prowadzono z wykorzystaniem wielu metod badawczych, przede wszystkim analizy tekstowej źródeł podstawowych – dokumentów regulujących stosunki UE z Afryką, literatury, analizy dokumentalnej, a także analizy porównawczej, kontekstualnej i historycznej. Trudności przed jakimi stoją negocjatorzy Unii Europejskiej i ich afrykańscy partnerzy, których oczekiwania są często dramatycznie rozbieżne, rodzą ciekawość i refleksję na temat nowego partnerstwa. Autorzy wychodzą z założenia, że partnerstwo Unii Europejskiej z Afryką jest procesem i nie stoi w miejscu. Jest to proces coraz ściślejszego związku, który stopniowo przekształcił się w kompleksowy system instrumentów i instytucji i podzielił się na dwa równoległe partnerstwa – partnerstwo Unii Europejskiej z państwami Afryki, Karaibów i Pacyfiku i partnerstwo Unii Europejskiej z Unią Afrykańską. Oba te partnerstwa są dzisiaj przedmiotem ponownych negocjacji, a prawdopodobieństwo pomyślnego zakończenia negocjacji do końca 2020 roku pozostaje zdaniem autorów pod znakiem zapytania. Niemniej jednak naszym ogólnym wnioskiem i prognozą jest, że partnerstwo Unii Europejskiej z Afryką zostanie wzmocnione i zbliży się o krok do zintegrowanego, kompleksowego partnerstwa i skutecznych ram dla stosunków Unii Europejskiej z Unią Afrykańską.

    The purpose of the paper is to analyse how the progress of the Chinese Belt and Road Initiative (BRI) and the participation of African countries may affect the shape and development of the Joint Africa–EU Strategy (JAES), established in 2007. Since 2013, when BRI was presented to the world for the first time, we have been able to observe increased activity of representatives of the People’s Republic of China (PRC) in promoting and implementing the project. Due to the fact that BRI is going to connect the trade route of China with the countries of East Africa, Central Asia, the Middle East, and Europe, which is supposed to trigger the extension of the Chinese financial and infrastructure activities, it should be considered as a priority for the Chinese government. However, taking into account of still unclear concept of the initiative we should focus on analysing the impact of the Belt and Road Initiative on the European Union’s strategy towards African countries. Celem niniejszego artykułu jest analiza kwestii, jak rozwój chińskiej inicjatywy Belt and Road Initiative (BRI) i udział w niej państw afrykańskich mogą wpłynąć na kształt oraz rozwój strategii współpracy Unii Europejskiej (UE) z państwami Afryki, która powstała w 2007 r. pod nazwą The Joint Africa–EU Strategy (JAES). Od 2013 roku, gdy po raz pierwszy przedstawiono BRI światu, widoczna jest wzmożona aktywność przedstawicieli Chińskiej Republiki Ludowej (ChRL) w promowaniu, a także wdrażaniu projektu w życie. Z uwagi na to, że inicjatywa ma na celu połączyć szlakiem handlowym Chiny z krajami Afryki Wschodniej, Azji Środkowej, Bliskiego Wschodu oraz Europy, co w konsekwencji ma powodować rozszerzenie działań ChRL w zakresie finansowym i infrastrukturalnym, należy ją uznać za priorytetową dla chińskiego rządu. Jednak, uwględniając nadal niejasną koncepcję analizowanej inicjatywy BRI, a także wzmagające się wyzwania i wzrastające możliwości, uwaga w niniejszym artykule została skupiona na wpływie BRI na strategię Unii Europejskiej wobec państw afrykańskich

    The surge of diversified forms of regionalism and regional integration within the past few decades has stimulated the reappraisal of the conceptual tools traditionally designed to bench-mark and monitor region-building processes across the world. More recently, the Brexit negotiations have become a reminder that the EU remains an unfolding experience. This article argues that the study of African regionalisms constitutes a timely invitation to revisit the experience of the EU and its contribution to the world of regionalisms. After a brief survey of the classic definition of the region, we will discuss the ongoing relevance of European integration and the implications of the analytical distinction between regionalism, regionalisation and regional integration, before drawing from the study of Africa five threads which set the basis for a comparative study of regions and regionalisms beyond the classic emphasis on the EU or the world of regions.

    This paper is dedicated to the involvement of Poland in the European Union’s military operations in Africa in the 2010s. The development of military capabilities is not one of the European Union’s priorities. Nevertheless, the EU is an active participant of the international communities’ efforts to aid African states, including the use of armed forces. The vast majority of such EU missions have been undertaken in Africa. Despite the fact that this region is not a priority of Poland’s foreign and security policies, Poland has actively participated in such actions, primarily due to the peculiarities of contemporary security threats and Poland’s approach to the process of European integration. However, after initial experiences, Poland limited its involvement, due to the limited impact on the achievement of national objectives related to the EU Common Security and Defence Policy. This has been reflected in both official documents and political practice associated with deploying troops on foreign soil. The author sets forth a thesis that these limitations are too substantial, and that there are reasons for greater Polish involvement in the European Union’s military missions.

    The paper gives an overview of the South African Corporate Leniency Policy which is a whistleblowing tool used by Competition agencies to detect and punish cartel behavior. The leniency applicant provides vital information to the competition authorities to fulfill the needs of this Policy. This information would be of great assistance to a claimant harmed by the cartel and who wishes to submit a claim for follow-on damages. Revealing this information results in serious implications for both leniency applicants and civil damages plaintiffs and poses a dilemma to Competition authorities. This paper questions whether the interest of the leniency applicant should be protected or should the information be handed over to the claimant to pursue a case for damages. After considering the status quo of the South African legal context, a survey of the EU and USA position on this is provided. The paper concludes on how a balance should be struck.
    L’article donne un aperçu de la politique sud-africaine en matière de la clémence des entreprises qui est un outil d’alerte utilisé par les agences de compétition pour détecter et sanctionner le comportement de cartel. Le demandeur de clémence fournit les autorités de la concurrence en informations essentielles pour satisfaire les besoins de la présente politique. Ces informations seraient d’une grande aide à un prestataire lésé par le cartel et qui souhaite présenter une demande pour obtenir les dommages par la suite. La révélation de ces informations résulte en conséquences graves pour les deux demandeurs de clémence et les plaignants des dommages civils, et pose un dilemme aux autorités de la concurrence. Cet article pose la question si l’intérêt du demandeur de clémence doit être protégé ou peut-être l’information devrait être remise au demandeur afin de poursuivre une affaire de dommages-intérêts. Après avoir examiné le status quo du cadre juridique d’Afrique du Sud, une enquête de la position de l’UE et les Etats-Unis sur cette question est prévue. L’article se termine sur la façon dont un équilibre doit être trouvé

    The aim of this paper is to present and describe the EU’s policy with regard to environmental protection and countering climate change in Africa, in the context of the broader objective of reducing, or eliminating poverty. It is increasingly accepted that we need an integrated approach to climate change and development; only by linking these issues together can we show the entire complexity of the multidimensional issue of poverty. Global development requires taking into account issues related to susceptibility and adjustment to climate change. The paper seeks to answer the questions of the extent to which climate change is a serious and lasting threat to devel- opment, and about the relations between climate change and development. It presents the role and significance of climate change and environmental protection in EU development policy; it describes the major relevant documents and decisions. The author focuses particularly on discussing the issues of climate change and development in the relations between the EU and Africa, and points out the key challenge related to the implementation of policies combining climate and development. Although there is a general conviction about, and awareness of the interrelation of these two phenomena (processes), still too few of the necessary actions are being taken, and the activities related to development and climate are often approached and executed separately.

    In recent years, the approach to the functions of law in economy has significantly changed and is perceived more and more often as a tool (instrument) to accomplish various strategic goals of development policy. The aim of the paper is to discuss such legislative efforts as the latest and, given the EU perspective, the most interesting examples of instrumentalizing public procurement through the implementation of the ‘local content’ concept. Key observations from characterization of the US and South Africa relevant regulations were considered with respect to the legal environment in the EU and Poland. The main goal of this paper is to advance conclusions concerning the legal framework in which enacting local content requirements (LCRs) would be acceptable in the light of EU law. The paper shows that the applying of LCRs in public procurement procedures may be permitted in the EU, albeit to a limited extent. In the tender procedures taking place in the EU Member States, such solutions must respect the principle of proportionality in line with the EU public procurement law, stem from objectively justified needs of the contracting authority and – in all certainty – cannot pursue protectionist interests by limiting access to the procedure for contractors who do not meet certain LCRs.
    Ostatnimi laty sposób myślenia o funkcjach prawa w gospodarce podlega istotnym przemianom. Jest ono coraz częściej postrzegane również jako instrument realizacji strategicznych celów polityki rozwoju. Celem artykułu jest omówienie najnowszych, a przez to szczególnie interesujących – w szczególności z perspektywy UE – przykładów instrumentalizacji zamówień publicznych poprzez wdrażanie koncepcji local content. Kluczowe wnioski z analizy doświadczeń USA oraz RPA zostały odniesione do dotychczasowego dorobku UE oraz Polski dotyczącego problematykitzw. preferencji krajowych. Głównym zadaniem podejmowanym w artykule jest scharakteryzowanie ram prawnych, w których stosowanie tzw. wymagań treści lokalnych (local content requirements – LCRs) można uznać za zgodne z unijnym prawem zamówień publicznych. W tekście wskazano, że tego rodzaju rozwiązania w postępowaniach o udzielenie zamówienia publicznego organizowanych w państwach członkowskich UE muszą respektować zasadę proporcjonalności wynikającą z unijnego prawa zamówień publicznych, muszą mieć podstawy w obiektywnie uzasadnionych potrzebach zamawiającego, a z całą pewnością ich głównym celem nie może być protekcjonizm rozumiany jako ograniczenie dostępu do postępowania wykonawcom niespełniającym określonych LCR.

    W artykule poddano analizie problematykę terroryzmu w Afryce Subsaharyjskiej i działania podjęte przez Unię Europejską w celu jego zwalczania. Opisano przesłanki i uwarunkowania terroryzmu w tym regionie, wskazując ich polityczne, społeczno-ekonomiczne oraz kulturowe źródła. Przedstawiono instytucjonalne i prawne podstawy współpracy UE z państwami Afryki Subsaharyjskiej dotyczącej zapobiegania aktom terroru na kontynencie afrykańskim. Omówiono również charakter i formę pomocy finansowej, jakiej UE udziela im w walce z ugrupowaniami terrorystycznymi, w szczególności Instrument na rzecz Pokoju w Afryce oraz Instrument na rzecz Przyczyniania się do Stabilności i Pokoju. Przedstawiono trzy najważniejsze ugrupowania terrorystyczne operujące w Afryce Subsaharyjskiej: Boko Haram, Al-Shabaab i Al-Ka’idę w Islamskim Maghrebie. Na tle wyzwań i zagrożeń związanych z ich działalnością w Afryce Subsaharyjskiejscharakteryzowano główne założenia polityki UE. W tym kontekście omówiono podejmowane przez nią działania z jednej strony mające na celu ograniczenie zdolności bojowych ugrupowań terrorystycznych w regionie, z drugiej – zapewniające trwały i stabilny rozwój na kontynencie afrykańskim i tym samym ograniczające różne negatywne zjawiska. Teoretycznym narzędziem zastosowanym w tym studium przypadku w stosunku do UE są koncepcje „roli aktora” (actorness), „obecności” (presence) oraz „mocarstwa niewojskowego” (civilian power). Podkreśla się w nich dysponowanie przez UE możliwościami aktywnego i celowego podejmowania działań wobec pozostałych aktorów na arenie międzynarodowej i realnym wpływem na sprawy międzynarodowe dzięki stosowaniu środków głównie ekonomicznych, finansowych i politycznych. Artykuł jest próbą odpowiedzi na następujące pytania: Jaka jest rola i znaczenie UE w przeciwstawianiu się terroryzmowi w Afryce Subsaharyjskiej? W jakim stopniu podejmowane przez UE działania wpływają na ograniczenie tego zjawiska? Jakie są główne słabości i wyzwania w europejskiej (unijnej) polityce antyterrorystycznej wobec Afryki Subsaharyjskiej? Czy przyjęte przez UE dokumenty przekładają się na skuteczność podejmowanych przez nią działań i inicjatyw? Jaki jest charakter i stopień instytucjonalizacji współpracy między obu regionami w zakresie zapobiegania aktom terroru w Afryce Subsaharyjskiej?
    The article analyses the issue of terrorism in Sub-Saharan Africa and the actions undertaken in this respect by the European Union. It describes the reasons for and determinants of terrorism in this region, pointing out their political, socio-economic and cultural sources. It discusses the institutional and legal bases of the EU’s cooperation with the countries of Sub-Saharan Africa in preventing acts of terror in Africa. Furthermore, it discusses the nature and form of financial assistance the EU provides to African countries in their struggle against terrorist groups, focusing on the two major instruments of the EU’s external action in this regard: the Peace Facility for Africa and the Instrument contributing to Stability and Peace. The article focuses on presenting the three major terrorist groups that operate in Sub-Saharan Africa: Boko Haram, Al-Shabaab and Al-Qaeda in the Islamic Maghreb. Against the backdrop of challenges and threats arising in relation to the activity of terrorist groups in Sub-Saharan Africa, the author has characterised the EU’s key objectives in this respect. In this context, he further discusses the actions undertaken by the EU with the aim to, on the one hand, reduce the combat capabilities of the terrorist groups in Sub-Saharan Africa and, on the other hand, ensure lasting and stable development on the African continent and, consequently, eliminate various negative phenomena. The theoretical tools applied in this case study with regard to the EU are the concepts of ‘actorness’, ‘presence’ and ‘civilian power’. It is stressed in this context that the EU is capable of ‘actively and purposefully undertaking actions towards the other actors in the international arena’ and having ‘real influence on international affairs’ by using mainly economic, financial and political measures. The article is an attempt to answer the following questions: what is the role of the EU in addressing the problem of terrorism in Sub-Saharan Africa; to what extent do the actions taken by the EU contribute to eliminating this phenomenon in Sub-Saharan Africa; what are the main weaknesses of and challenges to the European (EU) antiterrorist policy towards Sub-Saharan Africa; do the documents adopted by the EU translate into effectiveness of the EU’s actions and initiatives; what is the nature and degree of institutionalisation of the cooperation between the two regions in terms of preventing acts of terror in Sub-Saharan Africa.
