The aim of the article is to define the concept of economic freedom, using the ideas of the most important representatives of this doctrine. The article refers to the chronology and development of the concept of economic freedom, as well as the evolution of the policy of economic freedom along with the specification of the legal foundations determining the status of economic freedom over the centuries. The author refers only to the most important concepts for the issue in question, focusing on: (1) issues related to economic law and economic freedom or (2) aspects relevant to it in a given period. The initial thesis of the research is that economic freedom policy is a dynamic area, as evidenced by the multitude of legal acts implemented or amended every few years. Where specific legal phenomena are studied and need to be qualified at the same time, reference has been made primarily to the existing stock of well-known institutions. Economic freedom is a topic that has been the subject of lively discussion for many years. At its core, at various times, there were difficulties in determining (defining) economic freedom and its position in a given state. The political transformations lasting hundreds of years have caused economic changes in the state, accompanied by legal problems. The issue of economic freedom is related to the formation of relations between various entities operating on the territory of the state, and especially to how the state as an institution relates to entrepreneurs. Economic freedom has a significant impact on modern states, often leading to a change in their organizational model. For this reason, questions arise: What is economic freedom? What was its evolution? What is the attitude of the state to economic freedom? To what extent is economic freedom de facto “freedom” and what does it mean?

This study examines the causal links between improvements in economic freedom and changes in GDP per capita of new EU members in transition in the period 2000-2009. The empirical results suggest significant causality running from changes in monetary and fiscal freedom, trade openness, regulation of credit, labour, and business, legal structure and security of property rights, and access to sound money to movements in GDP per capita, especially in less and moderately developed CEE transition countries. Moreover, we find evidence that improvements in economic freedom are one of the main factors stimulating the convergence of these economies towards rich EU members. The evidence of causality in the opposite direction is much weaker.

The article examines the key aspects of a debate on the concept of the state and the relationship between freedom and the rule of law in economic studies. On the basis of selected research reports, the authors discuss the results of studies on the influence of economic freedom and the rule of law on prosperity. The paper reviews the most common definitions of economic freedom and the rule of law and methods for measuring them. It follows up with a description of the results of studies on how economic freedom and the rule of law influence economic growth. The analysis made in the paper shows that economic freedom and the rule of law are indispensable for sustained economic growth. They have a major positive influence on the rate of growth. Economic freedom promotes innovation in business and prosperity. However, the government tends to limit economic freedom and forces businesses to behave in a specific way to benefit the economy and the public. This works when the government acts in keeping with the rule of law, the authors say. The rule of law promotes business efficiency and leads to lower transaction costs, which results in faster economic growth, the authors conclude.

There are many studies focused on the role of economic freedom in creating conditions supportive for economic growth. Most of the recommendations in this area are based on the observations of the highly developed countries. But is it reasonable to generalize these findings to other countries, independently from their conditions? Contemporarily, the number of the research conducted for the countries outside the world's forefront is growing. Results are varied – some elements of economic freedom seem to be effective unconditionally, some of them bring different results. The aim of the paper is to examine the role of such factors as a stage of economic development, geographical location, and culture in the context of the efficacy of economic freedom. The study was conducted with usage of regression models for panel data and based on the indicators connected with economic freedom and economic growth.

Freedom manifests itself in many areas of social life as a necessary development factor. In economics, freedom is key to ensuring the basic principles of trade and business. In politics, freedom is unfettered exchange of ideas and actions, leading to the best choices authority and directions of social change. Freedom is also necessary for human development, in which individuals realize their life goals and aspirations. The aim of the article is to present the results of research on the impact of freedom on the main areas of social life. It turns out that freedom is a necessary factor of socio-economic development that mobilizes individuals to act. On the other hand, the comprehensive process of socioeconomic development is in essence a process of expanding freedom.

„Wolność gospodarcza” jest terminem, który często pojawia się w publikacjach oceniających wpływ czynników doktrynalnych, politycznych i ustrojowych na gospodarkę poszczególnych państw. W praktyce służy porównaniu, w jakim zakresie i stopniu władza publiczna oddziałuje w nich bezpośrednio lub pośrednio na procesy gospodarcze. Stan faktyczny zostaje skonfrontowany z modelem wolnego rynku, w którym nie ma władczych działań, regulujących nie tylko funkcjonowanie gospodarki, ale nawet otoczenia społecznego, które wpływa na decyzje przedsiębiorców. Termin jest w języku znakiem pojęcia. Wskazuje konstrukcję myślową, w której skupia się abstrakcyjnie ujęta istota oznaczonych nim zjawisk albo idei. W publikacjach posługujących się terminem „wolność gospodarcza” z reguły nie definiuje się treści tego pojęcia. Brak także refleksji metodologicznej nad modalnością jego stosowania. Jest ona jednak potrzebna, gdyż „wolność gospodarcza” występuje w języku kilku dziedzin wiedzy, posługujących się zróżnicowanymi instrumentami opisu rzeczywistości. Ma to istotny wpływ na rozumienie, a zwłaszcza na kreację rzeczywistości gospodarczej przez władze publiczne. Samo pojęcie „wolność gospodarcza” zrodziło się i ustaliło swój zakres w XVIII i XIX wieku jako postulat polityczny oraz doktrynalny ruchów liberalnych. Jego treść była przedmiotem szczegółowej analizy wedle kryteriów ekonomicznych pod koniec XX wieku, gdy nurt neoliberalny znalazł w nim podstawę porównań i ocen wolności w skali globalnej. Wolność gospodarcza stała się jednak również elementem prawnego porządku normatywnego. Na skutek realizacji liberalnych żądań ustrojowych jest dziś chronionym dobrem prawnym traktowanym jako naturalne prawo człowieka. W prawie aparatura pojęciowa odgrywa znacznie większą rolę niż w ekonomii. Stosowanie przepisów dokonuje się w rozumowaniu dedukcyjnym, opartym na zestawieniu pojęć ogólnych i stanów faktycznych. Jeśli brak precyzyjnego pojęcia tego, co należy chronić, nie można w systemie prawnym ustanowić gwarancji prawnych ochrony. Wolność gospodarcza wymaga tymczasem ochrony, co wynika z ocen ekonomistów, niezależnie od opinii w kwestii zakresu ochrony. Analiza zawarta w prezentowanej publikacji prowadzi do wniosku, że uformowane w XVIII i XIX wieku fundamenty doktryny liberalnej wyznaczają nadal podstawy rozumienia wolności gospodarczej w naukach ekonomicznych i naukach prawnych – z jedną różnicą. W naukach ekonomicznych inspiracje neoliberalne doprowadziły do ustalenia kilkudziesięciu składników, które łącznie definiują obecnie treść tego pojęcia. W ekonomii sformułowano złożone i wieloczynnikowe pojęcie, które musi stanowić punkt odniesienia dla innych nauk. Tymczasem nauce prawa oraz prawodawcom i sądom wyniki ustaleń ekonomistów nie są znane. Stosowana przez prawników terminologia jest zmienna i nie ulega wątpliwości, że w prawie brak całościowego pojęcia „wolność gospodarcza”. Wskazuje się w nim tylko niektóre jej aspekty i ustala cząstkowe zakresy ochrony. Nie jest ona zresztą ani pełna, ani konsekwentna. Niezależnie od tego, w jaki sposób należy w przyszłości formułować przepisy gwarantujące wolność gospodarczą w jej ekonomicznym rozumieniu, pierwszym postulatem, który wynika z przedstawionej analizy, jest przeniesienie wiedzy ekonomicznej w tym zakresie na grunt nauk prawnych.
The notion of „economic freedom” very often appears in publications evaluating the influence of political, doctrinal and constitutional factors on the economy of particular countries. The term servers the comparison of the degrees of governmental direct and indirect impact on economic processes in those countries. The actual situation is confronted with a model of free market which is devoid of the state actions regulating the economy, as well as devoid of any social environment influencing entrepreneurs’ decisions. In language a term signifies an idea. It denotes a mental construction in which an abstract idea is contained. Publications on „economic freedom” usually do not define this term. However, a methodological reflection on the modality of its usage is needed, since „economic freedom” appears in vernaculars of a few disciplines of knowledge, each of which describing the reality by means of differing instruments. This fact considerably moulds the understanding, as well as the creation of economic reality by governments. The term „economic freedom” itself was begotten and established in its scope in the 18th and 19th centuries as a political and doctrinal proposition of liberal movements. At the end of the 20th century it was subject to detailed economic analysis when the neoliberal trend took it as the basis for comparisons and assessments on a global scale. Also, economic freedom became an element of legal normative order. Due to the realization of liberal constitutional demands at present economic freedom is taken as a legal interest and a natural human right. In the sphere of law regulations are applies after deductive reasoning consisting in the combination of facts and general notions. In the absence of a precise concept of what is to be protected, it is impossible to establish a guarantee of legal protection. Meanwhile, economic freedom must be protected, which is indisputable among economists irrespective of their opinions on the scope of the said protection. The present analysis leads to the conclusion, that the 18th and 19th century liberal foundations continue to define the concept of economic freedom in the realm of economy and law. There exists, however, one distinction. In economy neoliberal inspirations helped establish a few dozen components jointly defining the discussed notion. This complex definition is a reference point for other disciplines. Nevertheless, in the sphere of law, legislators and justices are unaware of the economics’ approach to the term. The terminology used by lawyers is volatile and undoubtedly lacks a cohesive notion of „economic freedom”. Law accounts for only some of its aspects and determines merely partial scopes of protection, which is neither comprehensive nor consistent. Irrespective of the future formulation of the regulations on economic freedom as defined be the science of economy, the utmost proposition resulting from the present analysis is the transfer of economic knowledge to the realm of law.

These days, economic growth is very important for all countries and this article will discuss the main factors associated with this problem and propose some possible solutions which can be implemented. The importance and relationship of foreign direct investment, economic growth and economic freedom are presented and evaluated by considering literature, and a long run relationship between foreign direct investment and economic freedom in Turkey is empirically analysed in the article. The time period covers the years 1996 to 2018. The data has been obtained from the World Bank and from theHeritage Foundation database. The analysis is based on the time series analysis. An Augmented Dickey-Fuller test hasindicated that the variables are not stationary at levels, but they are stationary at the first difference. The Johansen test hasshown that variables are co-integrated, which means that they move together in the long run.

In this study, effects of political stability, economic freedom and trade freedom of above-stated Fragile Five Countries consisting of Brazil, Indonesia, India, Turkey, and South Africa on the performance of FDI appeal was analyzed with first generation panel data analysis method for the 1996-2017 period. The cointegration analysis between series was conducted by means of Kao (1999) and Pedroni (2004) test. The analyses showed that political stability and trade freedom have a significant positive coefficient on the Fragile Five Countries’ FDI. It was also determined that the impact of economic freedom on FDI was statistically insignificant. Thus, it was concluded that the most important determinant of FDI entry into countries is political stability. Error correction mechanisms of models have been working well. In addition, it was found that political stability, economic freedom, and trade freedom are the cause of foreign direct investment in the long-run

Exploring the stability of states and political systems is of interest to scientists and politicians all around the world. One of the most important questions in this field is the question of the relationship between stability and freedom. This paper considers the relationship between economic freedom and stability with regards to the example of countries of Central and Eastern Europe. The study uses quantitative analysis and the operationalisation of economic freedom through the Index of Economic Freedom (IEF); furthermore, stability is studied through the Fragile States Index (FSI), and the Political Stability and Absence of Violence/Terrorism Index (PSI). The analysis reveals a strong correlation between economic freedom and stability. According to linear regression models obtained by the author, economic freedom has a strong impact on stability. Models show that most of the components of IEF increase stability, whilst some components decrease it. This means that the same factors affect economic freedom and stability in different ways. In particular, taxes have a very positive effect on stability. At the same it is obvious that taxes reduce economic freedom. This fact allows us to resolve the existing contradictions among politicians and scientists, who differently assess the impact of economic freedom on stability. It may be stated that whilst economic freedom has in general a strong positive effect on stability, it can also have a negative effect.

This study empirically investigates the relationship between economic freedom and financial development in EU countries. Using panel data covering the years 2000 2017 and employing fixed effects, random effects, and the generalised method of moments (GMM), the paper examines the effect of economic freedom on financial development. The research results demonstrate that greater economic freedom is conducive to financial development in the EU. These findings remain robust to the use of an alternative index of economic freedom. The results imply that policies which promote economic freedom are likely to raise the level of a country’s financial development.

The author examines the causes behind corruption and checks why strategies designed to combat corruption fail to produce the expected results. The analysis is based on a review of the extensive body of empirical research into the sources of corruption and a descriptive analysis of the effectiveness of anti-corruption measures. The author offers a definition of corruption and presents the most common anti-corruption programs. He also describes problems widely associated with empirical studies involving corruption. The analysis addresses four issues: the overall level of development; the public sector; political institutions; and limitations to a free market and competition. Contrary to popular belief, not all the measures commonly proposed in the ongoing public debate on corruption will work in practice, Goczek says. For example, political reforms are unlikely to produce the desired results. Anti-corruption reforms should be geared toward limiting the room for corruption by reducing the number of transactions subject to arbitrary decision-making and by delegating authority to the market instead of the government. It is necessary to limit the powers of politicians and officials in areas such as the issuance of business permits and licenses, the author says. This should be accompanied by measures designed to limit the government’s monopoly in areas such as barriers to market entry, interventionism, economic freedom and competition. One possible reason why anti-corruption measures fail to deal with the real causes behind the problem is that far-reaching economic reforms are unpopular in Poland, the author says. Many anti-corruption programs are ineffective because they are often only a “smoke screen” designed to hide inaction, Goczek concludes.

This study empirically examines the impact of economic freedom quality and global financial crisis on the banking sector profitability in the Arab region. The analysis is performed by employing system GMM estimation in panel data comprising of 14 Arab countries over the period 1985–2016. The study constructed an economic freedom index based on the economic freedom indicators. The findings indicate that greater economic freedom has positively influenced the profitability of the Arab banking sector. The results also suggest that the more profitable banks are those that have lower operating expenses against asset and income, better capitalized, more diversified and concentrated at economies having growth in the GDP. Furthermore, the global financial crisis in 2008 negatively impacted the profits of Arab banks.

Economic freedom is one of the basic principles of Poland’s economic system and, at the same time, a fundamental rule on which the functioning of the European Union’s internal market is based. In the judgment in Case C-106/16 Polbud, which was issued on the basis of Polish law, the Court of Justice confirmed the possibility for companies to carry out activities in the territories of EU Member States in the form of a cross-border conversion into a company governed by the law of another Member State, and stressed the need for Member States to verify the restrictions imposed on companies in connection with their cross-border activities in terms of their compliance with EU law. The article focuses on analysis of the idea of economic freedom in the context of cross-border business activities of companies and on the presentation of the concept of “imperative requirements in the general interest” as conditions determining the admissibility of restrictions on cross-border activities of companies by the company’s home State in the light of European Union and Polish law.

Opis:
The main purpose of the paper is to describe, diagnose and interpret mutual rela-tions between the idea of economic freedom and the sense of responsibility for the common good in modern societies functioning in the system of a free market economy. The starting point for the analysis is a reference to predominating scientific discourses and their appearance in the public sphere. These discourses also take up the problem of mutual relations between freedom and responsibility, including responsibility for the common good. One specific case of the relation between units and the widely understood common good, including units engaged in economic activity, is their relation to more operational public goods. Therefore, starting from conclusions based on a probing research concerning Polish society’s attitude towards public goods (which is an index of public morality), we will try to prove that an oversimpli-fied and highly ideological understanding of economic freedom can lead to a) perception of market activities’ results in strictly economic categories, b) atrophy of priority values for each society such as the sense of responsi-bility and common good. Therefore the main thesis of the paper can be seen as the following state-ment: for each economic organization to perform correctly, it must be socially embedded in a defined axio-normative order. Economic order is a part of social order while freedom, as the leading objective idea, cannot be treated either in purely scientific or ideological categories.
