The institution of a public authority is governed above all in art. The first paragraph of Article 51 TFEU, under which the provisions of this chapter [the right of establishment editor. the author] shall not apply to activities which in a MemberState are connected, even occasionally, with the exercise of public authority. This provision therefore shows that, to put it briefly, to qualify an activity as an exercise of public authority excludes me from the regime of rules governing the right of establishment, which in turn means that these activities can be carried out bynationals of any Member State. The issue of a public authority under the provisions of EU law, especially theprimary law was repeatedly the subject of litigation pending before the Court ofJustice of the EU. It should be noted that the previous decision for the subject toexercise of public authority referred to the different activities, it being noted that several judgments, the subject of which was the profession of lawyer is evaluatedfrom this perspective. It should be noted that the Court, in decisions that were made in 2011 for the profession of a notary public has unequivocally stated that the notary does not exercise public authority, which is a clear contradiction of existing generally accepted views of the doctrines of law of EU Member States in this regard.

In a situation of a customer’s demands a cost reduction from the creditor in the case of an early repayment of a consumer credit, for proper assessment of the case, the position of the CJEU adopted in the judgment of 2019 regarding the interpretation of directive on credit agreements for consumers should be taken into account, as well as the expiry of the deadline in 2010 transposing the provisions of this Directive. Based on the analysis, the author states that the interpretation of the provisions of the Consumer Credit Act, which is incompatible with the conclusions of the CJEU’s judgment, is not binding. Thus, starting from 11 June 2010, creditors are obliged to reduce all costs included in the total cost of a consumer credit in case of its early repayment by the customer.

The paper aims to comment on the judgment of the International Court of Justice of 2nd February 2012 in the case of Jurisdictional Immunities of the State between Germany and Italy from the perspective of the problem of jurisdictional immunity. In its decision concerning compensation for atrocities suffered by Italian citizens during World War  II granted by Italian courts against the German State as well as the execution of the analogical decisions of Greek courts, the International Court of Justice upheld the immunity of the German State. The compensation sought by the plaintiffs in the national proceedings was to redress massacres on the civil population, deportations and forced labour. In its decision the Court analyzed the exception proposed by Italy in three strands which, according to the Respondent, cumulatively would result in an exception to the rule of state immunity. Firstly, the acts giving rise to the Italian claims constituted grave violations of humanitarian law; secondly, the rules of law violated constitute peremptory norms of international law; thirdly, no other form of redress was available rendering the exercise of jurisdiction by the Italian court to be a measure of a last resort for the victims.

The Israeli radical judicial overhaul program, aiming to seriously weaken the judiciary, has led the country to the brink of chaos and violence, with hundreds of thousands of demonstrators in the streets, society tearing itself apart and numerous sectors of society, such as medical service or reservists of IDF, announcing a suspension of their service to a nation they fear will no longer be a democracy. Despite the strong social protest, Knesset – representing an extremely right-wing coalition – adopted on the July 24, 2023 the amendment to Basic Law: The Judiciary to bar the judiciary from striking down decisions of the government and its ministers on the grounds of such decisions being unreasonable. The measure known as the reasonableness clause (standard) is rooted in English and American case law and it is frequently used in Israel to control administrative activity. It allows the courts to strike down governmental and administrative decisions and their regulations seen as having not taken into account all the relevant considerations of a particular issue, or not given the correct weight to those considerations – even if they do not violate any particular law or administrative rulings. The current right-wing coalition, led by Benjamin Netanyahu, argues that the clause as it stands gives too much power to the judiciary, especially the Supreme Court sitting as a High Court of Justice, to interfere with the actions of the executive, and that the powers of judges, who are not elected by the public, remain out of control in this procedure. Opponents of the government’s amendment argue that this standard is crucial in helping to protect civil rights that are not fully defined in Israeli law. Eliminating the standard of reasonableness will be another step towards giving the government unlimited power. It violates not only the separation of powers principle and the rule of law but it also harms the right to good administration. Irrespective of the Supreme Court’s decision on the constitutionality of the government’s amendment, the struggle to maintain the democratic principles of the Israeli system will continue.

Article elaborates on how Court of Justice of European Union treats its precedential rulings. Its principal purpose is to examine the distinction between precedent of solution and precedent of interpretation and assess whether the distinctionmay serve the purpose of reconciliation of Court of Justice’s heavy reliance on precedent with reluctance toward recognising precedent as a formal source of law manifested by civil law lawyers. According to some scholars, Court of Justice’sprecedents are merely precedents of interpretation, therefore they are not instance of judge-made law. Herein, it is argued, that the distinction is insufficient to prove their conviction is right.

This article assesses the impact of legal rules aimed at preventing genocide. The specific features of the legal obligation to prevent genocide are analyzed in light of the current debate on the “responsibility to protect” and the ICJ’s stance on the issue in Bosnia v Serbia. While the content of positive obligations such as the one under discussion is usually elaborated through the case law of judicial or quasi-judicial bodies, the ICJ refrained from doing so, stating that only manifest breaches of the obligation to prevent genocide give rise to international responsibility. The author seeks an explanation for the reasons underlying such an approach, and tries to identify other ways in which legal standards in the field of genocide prevention could be developed.

The opinion supports the Court’s decision that a different treatment of digital books supplied electronically and books supplied in tangible media is sufficiently justified and does not infringe the rule of neutrality and the rule of equal treatment. The judgement argues that to allow the Member States to apply for a diminished VAT rate to electronically supplied digital books would hamper the consistency of the Union’s aim to exclude all electronic services from the category which is subject to a diminished VAT rate. According to the author of the opinion, in the current state of matters, states are not legally allowed to engage in legislative activities with an aim to modify the way of taxation of e-publications

The authors discuss the legal measures taken by Ukraine in connection with the invasion of the Russian Federation. The paper is focused on discussing grounds for restricting the freedom of establishment as settled by the CJEU in C-55/94, Gebhard. The analysis shows that the possibility of imposing restrictions on economic activity should be carefully examined at the stage of adoption of national law, as it falls to the Member State to prove that national provisions meet conditions laid down in the EU legislation and the CJEU case law.
