The crisis of parliamentary democracy in the Weimar Republic reached its peak in 1932. Successive governments, especially of Brüning and von Papen, took steps towards independence of the executive from parliamentary power. Their activity was supported by the policy of the President of the Hindenburg Reich. This alliance was supposed to theoretically ensure strong executive rule and consolidate the political superiority of conservative forces. The instrument of these actions was Article 48 of the Constitution, under which Hindenburg could issue emergency ordinances by bypassing the parliament. Conservatives were also supported by representatives of the legal sciences, who saw Article 48 as an effective instrument of dictatorship. The opposition was relatively weak and, what is more, it saw a political interest in supporting conservative governments. The conservatives, united occasionally against the left, fought for power against the Nazis. The conflict between the Reich and Prussia, which ended with the judgment of 25 October 1932, was the quintessence of this process. It aimed at the subordination of Prussia to the Reich and relied on a policy of applying the facts made justified by normative acts contrary to the constitution. Proceedings before the Supreme Court also revealed the political attitudes of representatives of the science of law. A group of conservative professors legitimized without any resistance the illegal order established in Prussia. The break-up of democracy in Prussia opened the way to the dictatorship of Adolf Hitler. In most cases, the representatives of the legal science started to legitimize the new order against the traditions and values of the rule of law.

Opis:
A distinctive trend developed in 19th and 20th century Europe, which saw the universalisation of principles of state political systems. This tendency expressed itself in proclaiming in the constitutions of individual states and in the practical application by European democracies of the political principles inspired by the ideas of the Enlightenment. Over a period of over two centuries, the constitutions of many countries developed with a similar catalogue of principles of government, in a similar legal form. These principles express the same ideas and political values and aim at developing an identical model of government structure based on liberal-democratic ideals. It is characteristic that during the last decade of the 20th century there was a sudden increase in this tendency and the spreading of those principles to over twenty countries.

Usurpations were not unusual situations in Ancient Rome. However, the term “tyrranus” was understood differently from its modern meaning. This word technically means “someone who came to power unlawfully”, but in fact a person defeated by a new ruler was called an usurper, regardless of a way he had come to power. In such a way, e.g. Licinius was declared “tyrranus” although he had come to power as a legal augustus. Constitutions against usurpers in the Theodosian Code do not constitute a homogenous group. We could divide them into acts regarding an usurper’s legislation, acts regarding civil law actions (e.g. slave emancipations), acts regarding public law actions (e.g. nominations of magistrates) and acts regarding the emperor’s sentences. It is meaningful that there is no usurper against whom all the above-mentioned types of constitutions were promulgated. Civil law acts and sentences were generally upheld. In most cases, legislation was abolished only to the extent in which it was contra ius. Only Constantinus against Licinius (CTh. XV, 14, 1) and Honorius and Theodosius II against Heraclianus (CTh. XV, 14, 13) decided to abrogate the entire the legal output of the usurpation. Valenitianus II, Theodosius II and Honorius were the only emperors (except CTh XV, 14, 13) who abrogated all sentences of the usurpers. In almost all cases, nominations made by the usurper were annulled. However, while all usurpations (except Licinius’s usurpation) had taken place only in its Western Part, it should be noticed that all the analyzed constitutions were promulgated by all simultaneous rulers of the Empire even after 395 AD. The question is why Theodosian compilers decided to include the analyzed constitutions into the Code. In my opinion, the most probable answer is that the Chapter De infirmandis... should have served for the legitimation of the rules of the current Emperor, as until the end of the Empire there were no rules of succession of power. In all analyzed constitutions, the legal emperor referred to an output of the illegal ruler. Theodosius, evoking those constitutions and demonstrating his continuity with their authors, presented himself as the legal ruler and put all his opponents in the position of usurpers.

Wacław Komarnicki (1891–1954) was an outstanding Polish lawyer and academic. He was a constitutionalist and served in government in the II and III terms of the Second Polish Republic (1918–1939). Educated in Lyviv and at Dopat, Komarnicki taught law at the University of Stefan Batory in Vilnius, where he became a professor, and at the School of Political Science in Warsaw. He was also a member of the Polish Academy of Sciences, a political activist and Minister of Justice in the Polish Government in Exile in London, where he later died. His academic research and personal contribution in rela- tion to the March Constitution of 1921 and its amendment in August 1926, is deserving of particular attention.

The judgement of the Polish Constitutional Court of 26 June 2013 compared with the judgment of the German Federal Constitutional Tribunal of 18 March 2014 indicates that some significant amendments should be introduced into the Polish Constitution. Both amending procedures foreseen by the Treaty of Lisbon and the “Schengen method” used to reform the Eurozone imply a necessity to differ between the ordinary revision procedure and the simplified revision procedure also in national constitutional law. Taking into a account German constitutional provisions and jurisprudence of the German Federal Court such an amendment allows to concentrate on a question how to effective secure an influence of Polish constitutional institutions, especially the Sejm, on integration process.

Analiza semantyczna terminu „legitymizacja” jest zagadnieniem szczególnie doniosłym z uwagi na to, że ustalenie rozumienia tego terminu ma fundamentalne znaczenie dla dalszych rozważań nad tak ważnymi kwestiami, jak legitymizacja władzy sądowniczej czy pozycji ustrojowej sędziego. W doktrynie prawa konstytucyjnego brakuje pogłębionych analiz semantycznych, które pozwoliłyby na precyzyjną eksplikację tego, co myślą prawnicy, gdy używają terminu „legitymizacja”. Nawet pobieżna analiza literatury z tego zakresu pozwala na wyciągnięcie wstępnego wniosku, że w znacznej części rozpatrywanych spraw brak jest refleksji nad znaczeniem samego pojęcia „legitymizacja”. W niniejszym opracowaniu autor dokonał analizy definicji tego pojęcia, które pojawiają się w słownikach języka polskiego, a następnie skonfrontował ustalone znaczenia z rozumieniem „legitymizacji” w języku prawnym i prawniczym. We wnioskach autor wskazuje na dwa podstawowe sposoby rozumienia pojęcia „legitymizacja” i zaproponował ich rozróżnienie poprzez przypisanie jednemu z tych znaczeń terminu „legitymizacja”, a drugiemu „legitymacja”.
The semantic analysis of the term “legitimisation” is a particularly major issue, because determining the understanding of this term has a fundamental meaning for further considerations of such important issues as the legitimisation of the power, the judiciary or the systemic position of a judge. In the doctrine of the constitutional law there are lacks in-depth semantic analyzes that would allow a precise explication of what lawyers think when they use the term “legitimisation”. Even a cursory analysis of the literature in this field could allow us to draw a preliminary conclusion that when we discuss about this term, in a significant part of the cases considered, there is no reflection on the meaning of the concept of “legitimisation” itself. In this study, author analyzed definitions of this concept, which appears in the dictionaries of the Polish language, and then confronted the established meanings with the understanding of “legitimisation” in the legal and lawyers’ language. In conclusions, author points two basic ways of understanding the term “legitimisation” and proposed to distinguish them by assigning the phrase “legitimacy” to one of these meanings, and “legitimisation” to the other.

The opinion presents major differences in the legal situation of clients- entrepreneurs in relation to (legally privileged) recipients being household owners and consumers. Moreover, the author presents legal arguments for an extension of the protection standard regarding privileged entrepreneurs to micro-entrepreneurs and small entrepreneurs under the European Union legislation and in compliance with the national one. The opinion contains arguments for a specific national legislation, which would provide content to the state obligation to provide assistance to the development of entrepreneurship, in particular the micro-entrepreneurs, and which would facilitate an effective use of liberties of a uniformed EU market in the trans-border dimension.

The use of references to foreign law and jurisprudence by the constitutional courts around the world currently gains more and more attention from scholars. The admis-sibility and usefulness of conducting such a horizontal dialogue between various juris-dictions raises controversies in other countries, but not in Poland, where no significant academic discussion on the legal basis and justification for using comparative arguments in constitutional jurisprudence has been conducted. The reasons for this lack of contro-versy seem to lie in the roots of the 1997 Constitution, and the way in which the Polish legal system is constructed. The Polish Constitutional Tribunal is quite prone to using comparative references in its reasoning. However, it rarely clearly indicated their role or significance for the resolution of the case before it. The analysis of the case-law of the Tribunal indicates that references to foreign law concern constitutional provisions, legislation, and the judgments of other constitutional courts. The purpose of the refer-ences stresses the universality of particular constitutional norms and deciphering their meaning, as well as gathering data significant for the assessment of the proportionality of a national law, as well as at drawing inspiration from the decisions taken by foreign courts. However, the persuasive use of a comparative argument demands that the meth-odological problems which can be noticed in the case-law should be addressed. They in-volve in particular: the need to justify the choice of comparative material that is analysed, the fragmented nature of the analysis, and the lack of a clear indication what role these kind of arguments have in constitutional argumentation.

This text is a record of a speech given during the Third Polish Conference of Chairs and Departments of Political Systems. The main subject of this paper is the need to carry out research on political systems using diverse methods and takes, both legal and “humanistic”. The paper shows how important in terms of methodology it is to compare particular legal status with reality using examples when legal analysis is not sufficient, for example, on the account of social rebellion. The text identifies challenges that researchers of political systems face due to that fact. In this context is also discusses the problems related to studying such institutions as, for example, the Ukrainian Maidan.

The Representation of the Special Committee for Fighting Corrupt Practices and Economic Sabotage in Lublin (RSCL) was a typical organ of the Stalinist terror system in the postwar Poland. The area of action of the RSCL was Lublin and Lublin province. The institution was created on the legal basis of the decree dated 16th November 1945 on creation and range of the Special Committee for Fighting Corruption Practices and Economic Sabotage (Dziennik Ustaw 1945 No. 53 item 302). The Representation started its activities on 15th January 1946 and ended on 5th February 1955. It was the specific, extraconstitutional administrative body which dealt with justice unlawfully.

Human dignity is a well-known concept among Western countries since after World War II, when states, in an effort to create a new platform of cooperation with a view to guaranteeing peace, were looking for an axiological foundation of the new order. The findings described in the article may serve to underpin the following notions, which have to be the object of further research on relations between the human dignity principle and rules of criminal liability, guilt in particular. First, the “guilt standard” is obligatory, whenever a state intends to punish a person. Second, punishment can be meted out only to an offender with an ability to bear responsibility. In other words, only a person whose characteristic derived from the principle of dignity is fully actualized can be punished. Third, punishing should be preceded by an analysis of the degree of guilt. The more eager the perpetrator was to act against the legal system and against the values protected by it, the severer punishment should be meted out. Finally, law should provide for exclusion of culpability when the human dignity principle demands one to act in a manner that is outwardly criminal, but was committed due to a motivation that ought to be excused in the light of the dignity principle.

The aim of this article is to guide the Justice Antonin Scalia’s originalism concept of the interpretaion of the Constitution of the United States, in contrast to the views on the interpretation of constitutional provisions, in particular the concept of judicial activism and a living (breathing) constitution. The author points out the danger of increasing the significance of the political dimension of judges’ activism on the level of interpreting constitutional and international law.

The article presents rudimentary information on how the right to privacy is understood in the doctrine and case law of the European Court of Human Rights, the Polish Constitutional Tribunal, the Supreme Court and common courts. In the first place, the author will discuss protection of the right to privacy in light of the acts of international law and the Constitution of the Republic of Poland. Then, selected judgments linked with the right to privacy in certain aspects will be discussed. The article ends with conclusions on how the right to privacy is understood as well as the observable contemporary threats to its protection.

In the Hungarian legal system, the anti-hate speech rules of media law provide an ad-ditional (administrative) proceeding for the media authority in parallel with proceedings under criminal law and civil law. The media authorities, over the past twenty years, have consistently set media law sanctions at a lower intervention threshold than criminal law did, and in many cases, they established media law violation in cases where criminal proceedings for incitement against a community were not initiated or ended in acquittal. The fundamental aim of media law regulation is to shape media content and the edit-ing practices of media players with a view to ensure respect for human dignity, and to prevent media from becoming an ‘amplifier’ of hateful communications. In the first four-teen years of the Hungarian media regulation, the scope of interpretation concerning anti-hate speech media law restrictions developed gradually. The authority reacted not only to individual cases, and individual communications, but also carried out targeted investigations in cases that can be described as a phenomenon in the media coverage. Besides reviewing news and information programmes, it also acted against hateful con-tents of the entertainment programmes. The new media regulation, which entered into force in 2011, partially amended the content of the former anti-hate speech regulation: in addition to the provisions of “incitement to hatred”, the former category of “offending or prejudiced content” was replaced by the prohibition of “exclusion”. The practice of the media authority has not changed as regards the assessment of the media law standard, as the authority has continued to apply it differently from the criminal law standard, con-sidering it as a lower intervention threshold. However, in comparison with pre-2010 practice, the authority initiated considerably fewer proceedings and its approach in terms of law enforcement became less characterised by adjudicating problems that can be de-scribed as phenomenon in the media coverage, no targeted proceedings of this kind were initiated. Its practice can be characterised by a couple of high profile cases with extreme sanctions, which attract great attention. These cases are important as they designate the boundaries of public communications, but in this way, media law measures are not really suitable for making any substantial changes to the characteristics of the media coverage.

The paper is dedicated to describing the way of reception by the Polish Constitutional Tribunal of the “chilling effect”, i.e. an institution related to such activities of public authorities that form an indirect act of deterrence regarding the execution of constitutionally guaranteed rights and freedoms, esp. the freedom of expression. The discussed concept has originated in judicial decisions of the US Supreme Court and has spread into many contemporary legal systems, including jurisprudence of the European Court of Human Rights. Although it is evident that the Tribunal “took over” that concept from the ECHR, it in fact developed its own, unfortunately internally inconsistent, understanding of the chilling effect. Four different ways of application of chilling effect may be noticed in judicial decisions of the Polish CT, while only two of them reflect the perception of this institution by the US Supreme Court and the ECHR.

In establishing the thematic scope of this work, I assumed that its subject would be the process of the formation of border services in interwar Poland. This means a deliberate and complete disregard for the essentially distinct administrative role played by the border guard. The presentation of the Border Guard from an administrative perspective changes the situation so profoundly that a thorough discussion of its implications would certainly double the volume of the publication. A superficial treatment of the administrative issue would lead to misunderstandings. Furthermore, a superficial omission of the administrative issue was deemed necessary because the formations were mainly military in nature. Before going into details and elaborations, I would like to present my main research objective, which is the following question: what was the evolution of the legal status of Polish border formations in the inter-war period? In view of this objective, it is necessary to present the work from a historical perspective. The chronology of the facts is important for the subject matter, as it serves to systematise the considerations. The structure of the work and the research method were adjusted to the above-mentioned assumptions of the publication, which shows the reasons for the creation and the process of transformation of the border formations in relation to various types of institutional solutions, up to the moment of the creation of the Border Protection Corps and the Border Guard Corps, operating under these names until 1939. The potential conclusions resulting from this chapter concern: the presentation of the institutional construction of the border formations in the years 1918–1939 and the demonstration that in the interwar period they were the main organs of the Second Polish Republic, which guaranteed the inviolability of state territory and the security of the citizens on the subordinate territory.

Przez 100 lat niepodległości Finlandii jej ustrój konstytucyjny charakteryzował się zrównoważeniem, a wszelkie zmiany miały postać bardziej ewolucji niż rewolucji. O jego stabilności świadczy też fakt, że pierwsze akty prawne stanowiące podstawy funkcjonowania ustroju obowiązywały przez ponad 80 lat „pierwszego okresu konstytucyjnego”. Uchwalone w okresie międzywojennym (w latach 1919–1928), przetrwały II wojnę światową, a także istotne przemiany polityczne w okresie powojennym. Dopiero w 2000 r. weszła w życie nowa, jednolita ustawa zasadnicza będąca jednak w pewnym sensie syntezą ewolucji ustroju państwa, bowiem jej przyjęcie nie miało charakteru przełomowego, a bardziej porządkujący wszystkie dotychczas przyjęte nowelizacje. Nawet najdalej idące zmiany, jak chociażby wzmocnienie parlamentaryzmu poprzez przesunięcie punktu ciężkości władzy z prezydenta, osłabiając jego pozycję, na rzecz parlamentu, były zmianami powszechnie oczekiwanymi i akceptowanymi. Tym samym rozpoczęto „drugi okres konstytucyjny” w historii ustroju Finlandii.
For 100 years of Finland's independence, its constitutional system was characterized by sustainability, and all changes took the form of an evolution rather than a revolution. Its stability is also evidenced by the fact that the first legal acts constituting the basis for the functioning of the system were in force for over 80 years of “the first constitutional period". Adopted in the interwar period (1919–1928), they survived the Second World War as well as the significant political changes in the post-war period. A new, uniform basic law came into force in 2000. However, in a sense, it was a synthesis of the evolution of the state system as its adoption did not have the character of a breakthrough, but it rather gave order to all the amendments that had been adopted previously. Even the most far-reaching changes, such as the strengthening of parliamentarism by shifting the centre of gravity of power from the president by weakening his position in favour of the parliament, were widely expected and accepted. Thus, the “second constitutional period” in the history of the Finnish system began.

Recurrent events of a terrorist character, especially those occurring not in arenas of armed conflict or in countries that are not – at least formally – at war with others, make it necessary not only to consider a redefinition of the state security systems, but also to reflect deeply on the human rights-inspired paradigms accepted hitherto. Regardless of one’s convictions and interpretation of current events, it is difficult to avoid repeating questions concerning the efficiency of public authorities and our legal system in the context of European experiences with terrorism. It is necessary to examine whether the commonly recognized constitutional and human rights standards facilitate the development by the state of instruments aimed at the effective prevention of terrorism. In the process of enacting and applying anti-terrorist laws one must pay heed to the mutual relations between goods protected and violated by a given regulation. As noted above, there is no freedom without security, but also there is no security without freedom. This tension makes a proportionality test very troublesome. The legislator should, above all, harmonize the axiological contexts of the provisions constructed thereby, so that they are orientated towards the protection of both security and freedom.

During the IX World Congress of the International Association of Constitutional Law (Oslo, June 2014), the workshop was organised entitled “Constitutions and Financial Crisis”. The purpose of the discussion was to critically analyse responses to fiscal crises with a view to better understanding the phenomenon, the options for dealing with it and its implications for the basic principles of democracy. It was observed that the overall effect of a fiscal crisis and the responses to it may have profound constitutional significance for the constitutional system of the state authorities, as well as for individual state institutions, supranational and international institutions. A representative of the Polish SAI presented the paper entitled “Constitutional mechanisms that may serve establishing a fiscal policy and settling its execution”.
