The object of this paper is to provide an opinion on the regulation of conscience clause in relation to doctors, nurses and pharmacists under Italian law. The opinion was based on the legislative texts available on the websites of the Italian government and the Ministry of Health. Conscience clause is governed by Article 9 of Legge 22 maggio 1978, Norme per la tutela sociale della maternità e sull’interruzione volontaria della gravidanza (Legge 194/1978), under which a doctor or nurse may re‑ 194/1978), under which a doctor or nurse may refuse to provide and participate in carrying out abortions, should they submit a statement – subject to Article 5(3). Conscience clause is governed by Article 16 of Legge 19 febbraio 2004, n.40 standard in materia di procreazione medicalmente assistita (Law 40/2004), under which a doctor or nurse may refuse to participate in medical procedures and assisted conception treatments.

In Polish medical law, the conscience clause is understood as both a moral and legal norm which gives consent to selected medical professions (doctors, nurses, midwives, and laboratory technicians) to withdraw certain activities due to ethical objections. The explanation given for the conscience clause is not sufficient. There is no detailed information on the difference between compulsory and authorized benefits and the conditions for resignation from medical treatment. These problems not only lead to interpretational errors, but also to the abuse of law. Medical attorneys, among others, Andrzej Zoll, Mirosław Nesterowicz, Leszek Bosek and Eleonora Zielińska, present different opinions on the understanding of refusal to perform health care services by health care workers, and the lack of agreement leads to conflicts. In this article, I compare the views of ethicists and lawyers on the conscience clause. I present differences in the interpretation of medical law, and to all considerations I add my own opinion.

Opis:
Discussion of the conscience clause at schools concerns the possibility to refuse the teacher’s actions incompatible with his conscience. This possibility, though questioned by many as unlawful, results from Polish legislation and international law. It is a consequence of freedom of conscience guaranteed by the Constitution of the Republic of Poland and a number of international and national legal acts. There are many situations in which reveals the conflict between the duty of performing a given program or command of educational authorities and their own convictions. They concern mainly the same vision of the school and its functions, school programs and the underlying concept of the human being and interpersonal relationships at the level of professional work of the teacher. In all these situations, the teacher should be a person of conscience, i.e. to follow his voice, which sometimes means opposition to the content of curricula and textbooks, orders of superiors or the prevailing customs.

Sumienie nie pełni tylko roli osobistego autorytetu moralnego, ale jest również filarem godności i wolności człowieka w przestrzeni życia społecznego. Umożliwia ono bowiem wspólne poszukiwanie prawdy i rozwiązywanie dylematów moralnych przez członków ludzkiej społeczności. Po przedstawieniu różnych interpretacji sumienia, autor omawia związek sumienia z godnością człowieka. Godność sumienia stoi u podstaw jego wolności. Jednocześnie godność człowieka jest afirmowana w poszanowaniu wolności jego sumienia. Praktycznym wyrazem tej wolności jest prawo do sprzeciwu sumienia. Problem ten występuje najczęściej w kontekście pełnienia obowiązków przez pracowników służby zdrowia. Poszanowanie ich osobowych praw domaga się uszanowania również ich prawa do klauzuli sumienia, kiedy właściwe im postępowanie implikuje ich odpowiedzialność moralną rodzącą konflikt sumienia.
Conscience acts not only as a personal moral authority, but it is also a pillar of dignity and human freedom in the social life. It allows the joint search for the truth and resolve moral dilemmas by members of the human community. After presenting different interpretations of conscience, the author discusses the relationship of conscience with human dignity. The dignity of conscience is the basis of human freedom. At the same time human dignity is affirmed by the respect for freedom of conscience. The practical expression of this freedom is the right to conscientious objection. This problem occurs most often in the context of the duties of health professionals. Respect for their personal rights also demands respect for their right to conscientious objection when the proper procedure implies their moral responsibility which creates a conflict of conscience.

Conscience clause permits not to perform professional actions or not to provide certain services for reasons of religion or conscience. The opponents of this law argue that there is a duty to fulfil one’s legal needs, regardless of one’s own ethical stances. In fact, in the democratic state this regulation protects not only subjective convictions but also the right hierarchy of values and the dignity of the person. The Christian religion urges believers to make spiritual and legal efforts to guarantee conscience clause. It needs also dialogue with secular ethicists and representatives of other religions.

Artykuł traktuje o tym, czym jest „sumienie” oraz jakie problemy pozostają w kręgu jego oddziaływania. Rozważania dotyczą również różnych przedsięwzięć podmiotów (pojedynczych osób czy też grup ludzkich), które wpłynęły na unormowanie tego zagadnienia. W celu wyklarowania niejednoznaczności, które budzi potoczne rozumienie pojęcia „sumienie”, a także dla lepszego zrozumienia szerokiego spektrum tego terminu wyodrębniono jego pola semantyczne. Ponadto przedstawiono wybrane unormowania aktów prawnych i zestawiono je z aktami oporu, tj. sprzeciwem sumienia, obywatelskim nieposłuszeństwem oraz klauzulą sumienia. Przeprowadzone badania stanowią próbę odpowiedzi na pytanie, czy zasadne jest powoływanie się na „sumienie” w każdej dowolnej sytuacji.
The article deals with what is “conscience” and what problems remain in its sphere of influence. The considerations also apply to various undertakings of entities (individuals or groups of people), which have influenced the normalization of the issue. In order to clarify the ambiguities that aroused by the colloquial understanding of “conscience”, as well as to better understand the broad spectrum of the concept, its semantic fields have been distinguished. Selected norms of legal acts have also been presented and juxtaposed with acts of resistance, i.e., the conscientious objection, civil disobedience and conscience clause. The research conducted is an attempt to answer the question whether it is justified to invoke “conscience” in any situation.

Greater human longevity is one of the biggest achievements of medicine. Timely medical interventions save countless human lives. But some of them, especially those undertaken in the face of imminent death, often generate serious ethical dilemmas. After reaching a certain critical point, the otherwise welcomed and blessed possibilities of prolonging life sometimes degenerate into a painful prolongation of dying. A spontaneous moral intuition, as well as a more balanced, careful ethical reflection – for which human life constitutes the highest value – permits withdrawal of ineffective therapy. But just what are the criteria for making that crucial decision to terminate a medical therapy? How does one define them? The article opens with the overview of terminology applied to medical interventions that fall into the category of inadequate treatment, both from the perspective of medical futility (futile treatment), the standpoint of the physician (overzealous treatment) and the actual suffering of the patient (burdensome treatment). It then examines the criteria for the termination of treatment, among which the prognosis of imminent death and disagreements over the extent of the basic medical care play crucial roles. The final parts of the article focus on some additional, though by no means less important, issues relating to end of life, like the truth at the sickbed, patient’s advance decision concerning the extent of medical interventions he is willing to accept and the physician’s conscience clause.
