Opis:
This article treats about similarities and discrepancies in legal definitions of fencing the computer programs (software) provided by Polish law – especially The Criminal Code and Act of 4 February, 1994 on Copyright and Neighbouring Rights. The penalization of software fencing crime in two (even three) different Polish acts usually causes the confusion for investigators, prosecutors and even judges. The article clearly explains the history (including EU acts) and interplays as well as notifies all differences between the acts. This would help to define the particular crime accurately and prosecute in appropriate way, as well as to avoid the potential confusion in appropriate qualification the particular infringements or crimes. The work is enriched with significant judges, illustrating the given problems and definitions.

Opis:
The article attempts to analyse the phenomenon of signs as implemented in nowadays computers with a cautious look to the future, keeping in mind the historical development and role of the sign in the culture. The drawbacks of the current computer typesetting technology are pointed out. In particular, the insufficiency of Unicode numbering for typography applications, and, most importantly, the “frozen” nature of nowadays glyphs, while such applications as music or calligraphy necessitate either infinite number of glyphs or fundamentally different approach. In his paper, the author supports the latter solution suggesting that the glyphs should be just programs capable of communicating with each other.

The article presents the issue related with a proper preparation of a data sheet for the analysis, the way of verifying the correctness and reliability of input information, and proper data encoding. Improper input or coding of data can significantly influence the correctness of performed analyses or extend their time. This stage of an analysis is presented by an authorship questionnaire for the study on occupational safety culture in a manufacturing plant, using the Statistica software for analyses. There were used real data, obtained during the research on the issue of occupational safety and factors having the greatest influence on the state of occupational safety.

The aim of this article is to experimentally verify higher efficiency of NoSQL databases over typical relational databases. After short introduction to NoSQL, document databases and key-value stores, several efficiency tests were conducted, with the use of YCSB testing benchmark. Results show that the higher the load on the database, the higher the efficiency benefit of using NoSQL, especially for insert and update operations, and for key-value stores. Afterwards, the database efficiency is compared in a real application - a user-based recommendation engine. In this case the usage of NoSQL can boost the application speed at least three times, but the predicted efficiency increase under greater loads is much higher.

The aim of this article is to show how fuzzy logic based algorithms can be applied to analyze large datasets and present its results in a human-friendly form: using natural language. A new concept of linguistic summaries is demonstrated: multi-subject linguistic summaries of relational databases, that extends the classic manner. This paper focuses on new, interesting forms of linguistic summaries, which are represented by equations (4), (11), (15) and (18). This article also contains discussion about calculating degrees of truth of the new forms. From the potential end user point of view simplified form of presenting results using natural language expressions is the most important thing. This paper includes demonstration and description of standalone application that generates analysis of large dataset and presents results using short and intuitive expressions in natural language. Possibilities given by the multi-subject linguistic summaries, e.g. description and comparison of more than one subject in one summarization, makes them great extension and complementation of existing forms of linguistic summaries.

W artykule dokonano przeglądu opracowanych na świecie i w Polsce programów liczących ślad węglowy jaki dany użytkownik emituje do atmosfery. Dokonano podziału ich na trzy grupy, tj. dostępne on-line liczące bezpośredni wpływ na środowisko, liczące bezpośredni i pośredni wpływ, a także specjalistyczne. Analizując je wskazano mocne i słabe strony każdego z nich. Przeprowadzono badanie wszystkich wybranych kalkulatorów pod kątem emitowanego śladu węglowego do atmosfery. Odbyło się to poprzez sprawdzenie ile ekwiwalentu dwutlenku węgla może emitować średniej klasy samochód osobowy. Wykazano, że każdy z kalkulatorów podchodzi do liczenia śladu węglowego inaczej, a wartości skrajne w tym badaniu różnią się o ponad 100%. Rozbieżności takie mogą wynikać np. z braku uaktualniania metodyki CFP w poszczególnych programach, braku identyfikacji wpływu na środowisko produkcji paliwa, czy innych czynników mających wpływ na środowisko, a występujących w łańcuchu dostaw. Oprócz samego badania kalkulatory były sprawdzane pod kątem zgodności z nową normą ISO 14067:2013.
This paper presents a review of international and Polish programs calculating carbon footprint. They were divided into three groups, i.e. available on line and computing a direct impact on the environment, counting direct and indirect effects, and lastly specialized programs. A study was made of the consistency in all the selected calculators with respect to carbon footprint from emissions into the atmosphere. This was accomplished by examining how much carbon dioxide equivalent can be produced by a midsized car. It was shown that each of the calculators arrives at the carbon footprint in a different way. Extreme values in this study differ by more than 100%. Such differences may arise due to the lack of updating the methodology of the CFP calculation in individual programs, the failure to identify the environmental impact of fuel production, or other factors affecting the environment and occurring in the supply chain. In addition to the research, the calculators were evaluated for their compliance with the new norm ISO 14067:2013.

Artykuł porusza zagadnienie dotyczące sfery tworzenia utworów w ramach stosunków pracowniczych. Problematyka jest istotna z uwagi na szeroki zakres praktycznego zastosowania. Szczególnie istotna jest ona z perspektywy podmiotów, których dotyczy, a więc pracownika i pracodawcy. W związku z tym przytoczono ogólną zasadę, w myśl której prawo autorskie przysługuje twórcy utworu, a następnie powołano się na przepisy szczególne ustawy określające wyjątki od powyższej regulacji. Tematem rozważań uczyniono zatem twórczość pracowniczą w ujęciu ogólnym, a następnie dokonano jej konkretyzacji. Poruszono kwestię utworów naukowych stworzonych w wyniku wykonywania obowiązków ze stosunku pracy i przysługującego uczelni pierwszeństwa do publikacji takiego utworu, a także prawa przysługujące pracodawcy do programów komputerowych stworzonych również w wyniku wykonywania obowiązków ze stosunku pracy. Analizie poddano zatem nie tylko przepisy ustawy o prawie autorskim i prawach pokrewnych, ale bazowano również na regulacjach obowiązującego Kodeksu Pracy.
The article explores the aspect concerning the area of creating works within employment relationships. The issue is of substantial value due to its practical use. It is particularly meaningful within perspective of entities it relates to, i.e. employee and employer. Therefore, the general principle has been referred to on the basis of which the authors hold the copyright to the works they have created, and also special provisions of the act which set forth the exceptions to the abovementioned principle have been indicated. The employees’ work in general has been made the subject matter of the article, and then it has been specified. The issue of scientific works created as a result of performing the obligations under the employment relationship and the priority right of the university to publish such works, as well as the right of the employer to computer software created due to the employee’s obligation under the employment contract have been described. The subject of the analysis has been both the provisions of the copyright and related rights act and the regulations of the existing Labor Code.

Technological advances and legal conditions in investments in the financial market have created many innovations at the turn of the century. One of the innovations in the financial market are High Frequency Traders (HFT) that have existed since 2005, and since then rapidly have developed its activity, affecting functioning of financial market. As the positive effects of their activities is acknowledged: possibility to increase liquidity and transparency of financial market, as well as enhancing competition between trading venues, which in turn can lead to lower transaction costs. However, the functioning HFT is also connected with dangers associated with the possibility of a decrease in liquidity on the market (in terms of variation), the collapse of the market as a result of a failure or an error on the handling of orders and restriction of competition among financial market investors.
