The article analyzes three categories: co-existence, co-responsibility and interdependence in the context of contemporary discussions about the role of social pedagogy in building local communities. New possible approaches arise while using these concepts for addressing contemporary conditions of the communities which result in new tasks of education. There are analysed also the consequences of the transformation from the previous rather static (territorial) view of local communities, that had the aim to root people in existing social structures, towards more dynamic, open and diverse spaces. They are not considered only as physical places anymore but as new local relations that are being developed, based on not stable, however increasingly popular forms of sharing experiences. For these changes the studied concepts match the new realities and in consequence demand pedagogical considerations.

Mediation is proving to be an effective way to manage conflicts in a constructive way. But mediation not only helps to solve specific problems, because its potential encompasses aspects of greater complexity. Thus, mediation helps us to know ourselves better, to better understand others, and to use what we have learned to better manage future conflict situations. In a society where there is no culture of agreement and where there is no education in the field of emotions, mediation becomes an adequate and effective tool to resolve conflicts in a peaceful and constructive manner. On the other hand, mediation allows the parties to take responsibility for the resolution of their own conflict, to be active agents in the process. The greater the citizens’ participation in the different decision making processes, the more democratic a society will be. That is why, in the restoration of social peace, citizenship should play a role as an active agent, and mediation is a suitable instrument for this purpose because the individuals in conflict find the way to solve it without third party impositions.

The effects of the coexistence of Controlling and other management methods (benchmarking, BPM, BPR, BSC, Competency-based Management, CRM, ERP, KM, LM, Outsourcing, Six Sigma, TQM) have been analysed. The complexity and dynamics of modern management systems in fact require simultaneous and/or sequential application of many concepts and methods of management. Controlling is a comprehensive method with an interdisciplinary character, which acts as an integrating plane for many methods and techniques. The coexistence of controlling with other management methods depends on the type of relationship between controlling and these methods. In the main, however, coexistence should be beneficial for an organization. Theoretical concepts on the relations between controlling and other methods are thus empirically tested by analysing the effect of using selected management methods, both in conjunction with controlling, as well as separately (business, efficiency, management, social and environmental effects). One-Way ANOVA was used based on a sample of 167 Polish organizations.

This article presents the religious aspects of the community of emigrants from the British Isles, mainly Scots, in Gdańsk. They tried to provide for their religious needs already in the Middle Ages, as evidenced by the existence of chapels and altars in some of the churches in Gdansk. After the success of the Reformation, mainly Scottish Presbyterians settled in Gdansk. Clergymen from their home country were brought in for their ministry. Both the Presbyterian clergy and the wealthy Scottish merchant elite of this denomination ruled the sacred building acquired in 1707, called the English Church. However, only few of the Presbyterians living in Gdansk identified with this building - according to legal arrangements, having the character of an “ethnic” temple - together with the Anglicans. Most Scots - by entering into family relationships - slowly melted into the community of the city on the Motława, using other Calvinist facilities. In addition to Presbyterians and very few Anglicans and Catholics there, English radicals, Chialists and Quakers, also tried to settle in Gdansk, but the city's unfavourable legislation and deterrent actions effectively prevented this transfer.

W artykule przedstawiono istotne przesłanki podjęcia badań w zakresie możliwości zakłócania odbiorników pracujących w sieci GSM-R przez sygnały stacji bazowych operatorów sieci publicznych w Polsce. W poszczególnych rozdziałach opisano skalę zjawiska interferencji na przykładzie doświadczeń innych krajów UE, typy zakłóceń oraz kryteria stanowiące podstawę do identyfikacji miejsc potencjalnych zakłóceń. Wyszczególniono przypadki sprzyjające powstawaniu określonych rodzajów zakłóceń. W podsumowaniu i wnioskach przedstawiono prewencyjne zalecenia innych krajów w zakresie eliminacji zakłóceń sieci GSM-R oraz działań, które mogą być zastosowane w polskich warunkach.
The article presents the essential premises for undertaking research in the evaluation of the possibility of GSMR receivers interference with the base stations of the public networks’ operators in Poland. The following sections deal with the scale of interference problem based on the experiences of other EU countries, types of interference influencing GSM-R receivers and the criteria underlying the identification of potential interference. In the second part of the article cases conducive to the appearance of certain types of interference are specified. In the final part of the article recommended preventive measures used by other countries to eliminate interference of GSM-R network with public networks and the activities that can be used in Polish conditions are presented.

In this paper a collaborative coexistence mechanism for white space base stations is proposed. We look at the case where these base stations operate in geographical areas where the density of used TV channels is such that only one channel is left for broadband access. We show how with cooperative closed loop control and a clustering strategy, it is possible to find feasible power assignments that provide a flexible and stable coverage solution. The framework under which we study our proposal is based on the IEEE 802.22 standard, which provides white space guidelines for applications in broadband access or machine-to-machine communications. We propose and evaluate a self-organized, collaborative power control and design strategy to enable effective coexistence of base stations under extreme bandwidth constraints. Finally, we also portray how proposed approach positively compares against others from different wireless access technologies.

This artistic research was a one-year Master Performing Public Space program at Fontys School of Fine and Performing Arts in Tilburg, Netherlands. Based on concepts of coexistence between nonhumans and humans, it creates new narratives with the models of utopia, symbiocene, empathy. The author, while observing a community of free-roaming cats, co-created a series of interspecies communication and utopian experiments with humans and cats. The work is inspired by the author’s close intertwining with nonhumans and continues her artistic practice based in anthrozoology. It exemplifies artistic co-creation with nonhumans, more-than-human public space geography and the potential of artistic research as a scientific discipline.

The coexistence of anti-synchronization and synchronization in chaotic systems is investigated. A novel algorithm is proposed to determine the variables of the master system that should anti-synchronize with corresponding variables of the slave system. Control strategies that guarantee the coexistence of synchronization and anti-synchronization in the unified chaotic system are presented; while numerical simulations are employed to validate and illustrate the effectiveness of the proposed method.

The paper presents study of a pseudo-magnetic levitation system (pseudo-maglev) dedicated for energy harvesting. The idea rely on motion of a pseudo-levitating magnet in a coil’s terminal. The study based on real prototype harvester system, which in the pendulum dynamic vibration absorber is applied. For some parameters, the stability loss caused by the period doubling bifurcation is detected. The coexistence of two stable solutions, one of which is much better for energy harvesting is observed. The influence of the pseudo-maglev parameters on the recovered current and stability of the periodic solutions is presented in detail. The obtained results show, that the best energy recovery occurs for the high pseudo-maglev stiffness and close to the coil resistance. The amplitude’s excitation, the load resistances and the coupling coefficient strongly influence on the system’s response.

This article uses the example of the Pakistani community to explore the phenomenon of multiculturalism in Spain. Although Muslims of Maghrebi origin constitute the most numerous immigrant group on the Iberian Peninsula, the Pakistanis are special in that they represent an exceptionally distinctive and hermetic community. The article analyses social, economic and cultural determinants of this community’s situation in Spain. The Raval immigrant neighbourhood in Barcelona exemplifies the mechanisms under study. The article focuses on determinants of Pakistani immigrants’ situation as well as the challenges that arise against the backdrop of interaction between this community and the host society. The author also reflects on the issue of the ethnocultural distinctiveness of this group in normative and institutional terms, and analyses the consequences of this distinctiveness.
Artykuł podejmuje problematykę wielokulturowości Hiszpanii w odniesieniu do mieszkającej tam społeczności imigrantów pakistańskich. Na tle liczby wyznawców islamu wywodzących się z regionu Maghrebu zbiorowość ta nie stanowi grupy najliczniejszej, jednak wyróżnia się ze względu na swoją odrębność i hermetyczność. Tekst zawiera analizę wyznaczników społeczno-ekonomicznych i kulturowych, określających sytuację tej społeczności na Półwyspie Iberyjskim. Egzemplifikację charakteryzowanych w artykule mechanizmów stanowi barcelońska dzielnica imigrancka Raval. Rozważania tu zawarte przybliżają determinanty sytuacji imigrantów z Pakistanu oraz wyzwania, które krystalizują się na płaszczyźnie interakcji tej zbiorowości ze społeczeństwem przyjmującym. Artykuł podejmuje refleksję nad problemem odrębności etnokulturowej tej grupy w wymiarze normatywnym oraz instytucjonalnym, a także nad jej skutkami.

Le Maghreb et l'Europe ont toujours entretenu des liens étroits de par leur proximité géographique. Ainsi, l'ensemble du Maghreb a été marqué par la colonisation française ; il n'est donc pas étonnant que la France soit marquée en retour par le Maghreb. Ainsi, la littérature est empreinte de cet échange, à la fois fructueux et houleux, qui existe encore aujourd'hui. Dans cette rencontre entre l'Occident et le Maghreb, les communautés juives ont joué un rôle non négligeable, étant à la fois des intermédiaires, des bénéficiaires et des opprimés. Comme le rappelle Albert Memmi, elles vécurent sous le statut de dhimmi, puis devinrent des colonisés. Si l'émancipation à laquelle la France leur permit d'accéder est certaine, il n'empêche que les Juifs restèrent une communauté de dominés. Tantôt proche des Musulmans par leur condition, tantôt des Européens par leur aspiration, leur statut a été complexe et encore aujourd'hui, il reste difficile à cerner. La population ne partageait pas les mêmes conditions que les élites intellectuelles dont beaucoup d'écrivains font partie et, par conséquent, leurs témoignages peuvent sembler contradictoires. Ainsi, par exemple, Edmond El Maleh nous parle de la coexistence judéo-arabe, car il vient d'EssaouiraMogador où la moitié de la population était juive. Lui-même, issu d'une famille riche, ne rencontre pas les mêmes problèmes qu'Albert Memmi, qui a grandi dans la Hara de Tunis, dans une extrême pauvreté, et dont la famille a vécu des pogroms traumatisants qui ont marqué leur mémoire. Mais qu'ils soient riches ou pauvres, tous les deux ont bénéficié d'une éducation en langue française. En effet, sous l'impact du colonialisme, un réseau impressionnant d'écoles se développe, comme les écoles de l'Alliance Israélite Universelle, où l'enseignement est dispensé majoritairement en français, mais aussi en hébreu, en arabe et en anglais. Une multitude d'écrivains judéo-maghrébins écrit donc en français. Ils sont marqués par l'acculturation à la société française, de façon intense en Algérie et, de façon moindre au Maroc. Il n'est donc pas étonnant qu'on découvre chez eux l'envie de venir en France. En effet, leurs regards "sont tournés" vers la France avant qu'ils ne savent qu'un jour ils vont s'y exiler, "tournant" alors leurs regards vers le Maghreb, terre maternelle à la fois aimée, hostile et regrettée. Le lien entre le Maghreb et l'Occident est donc un élément central dans leur existence et un thème proéminent qui émerge de leurs œuvres littéraires.

„Dziennik Bydgoski” to jedyna polska gazeta, która ukazywała się w Bydgoszczy na początku XX w., kiedy to miasto było silnie germanizowane. Celem gazety było podtrzymywanie tożsamości narodowej Polaków. Artykuł ten ukazuje, jak „Dziennik Bydgoski” kształtował wizerunek polskich i niemieckich mieszkańców miasta, a tym samym jak wpływał na ich wzajemne relacje. Gazeta oficjalnie podtrzymuje stereotyp złego Niemca i prześladowanego Polaka, ale jednocześnie ukazuje rzeczywiste więzi łączące reprezentantów obu narodów – wspólne doświadczenia kulturowe oraz styl życia.
“Dziennik Bydgoski” is the only Polish newspaper that appeared in Bydgoszcz at the beginning of the 20th century when the city was strongly Germanized. The goal of the newspaper was to maintain the national identity of Poles. This article shows how “Dziennik Bydgoski” shaped the image of Polish and German residents of the city and how it influenced their relations. The newspaper offi cially upholds the stereotype of the evil German and the persecuted Pole but at the same time it showed real ties connecting representatives of two nations – common lifestyle and cultural experience.

The presented gloss discusses the judgement file ref. no. IV CSK 598/12 dated November 23, 2012, issued by the Supreme Court concerning the possibility of recognizing the acquirer of a bankrupt undertaking as its legal successor, and the impact of the amount of contractual payments made to date on the validity of a decision issued in connection with the amount of remuneration for the non-contractual use of the leased thing. The Supreme Court underscores that the disposal of an undertaking of a bankrupt company in the course of bankruptcy proceedings with a winding-up option gives rise to events appropriate for universal succession. The position indicating lack of effect of legal succession on the part of the acquirer concerns the case of acquisition of a bankrupt undertaking which retains its legal existence after bankruptcy proceedings are over. However, this does not apply to the special situation connected with the disposal of an entire undertaking of the company in the course of completed bankruptcy proceedings. The Supreme Court found that in assessing the validity of the contested contractual provision, the extent of the contractual performances made to date in the form of lease payments, cannot play a decisive role. The disproportion in payments cannot be contravene the principles of social intercourse. The presented gloss accepts the arguments of the judgement of the Supreme Court; however, attention is drawn to the principle of proportionality between creditors and a debtor, as well as the import of Article 5 of the Civil Code.

Nowela Marii Konopnickiej Mendel Gdański powstała w odpowiedzi na prośbę przyjaciółki autorki, Elizy Orzeszkowej. Utwór wpisywał się w ówczesną kampanię publicystyczną w zaborze rosyjskim prowadzoną po to, aby uświadomić społeczeństwu polskiemu zagrożenia płynące z zaimplementowania mu obcych kulturowo postaw. Carska biurokracja, podżegająca do antysemickich wystąpień, podejmowała te działania w interesie imperium po to, by rozbijać i dzielić społeczeństwo polskie. W artykule zwrócono uwagę na konieczność kontekstowego odczytania noweli. Ukazano, jak ważna jest znajomość realiów historycznych, w jakich powstał utwór, oraz znajomość genezy jego powstania. Autorka scharakteryzowała opisanych przez Konopnicką sprawców zamieszek oraz sąsiadów żydowskiej rodziny, dochodząc do wniosku, że niezbędne jest przesunięcie akcentów w odczytaniu przesłania utworu: nie tyle protestu przeciwko antysemityzmowi jako takiemu, co protestu przeciwko zaszczepianiu Polakom wrogości wobec innych.
Maria Konopnicka’s novella Mendel Gdański was written in response to a request from the author’s friend Eliza Orzeszkowa. The work was a contribution to a publicity campaign in the part of Poland occupied by Russia at that time, conducted in order to make Polish society aware of the dangers of adopting cultural attitudes that were alien to it. Such attitudes were propagated by the tsarist bureaucracy, which, in the interests of the Russian empire, incited anti-Semitism in order to divide Polish society. The article emphasizes the need for a contextual reading of the novella. It shows how important it is to know the historical reality in which the work was written and its genesis. The author gives a characteristic of the perpetrators of the riots described by M. Konopnicka and the neighbors of the Jewish family, concluding that it is necessary to reinterpret the novella’s message, which is not so much a protest against anti-Semitism as a protest against instilling hostility towards others into Poles.

Mesodermal mixed malignant tumours (MMMT) are the rare neoplasms of postmenopausal women, with extremely poor prognosis. They constitute about 1-2% of all gynaecological malignancies and about 2-5% of uterine corpus malignancies. Due to rare frequency, the exact knowledge about their characteristics is difficult. Therefore, the treatment is based on the treatment methods used in endometrial cancer. For most authors, because of their clinical course, they are treated as more aggressive endometrial carcinomas. In the literature, there were described a lot of cases of endometrial cancer and MMMT development after the chronic therapy with tamoxifen, due to breast cancer, but rare data suggest the possibility of coexistence of the two above neoplasms, without the previous therapy with tamoxifen. In this paper, we present the case of woman, aged 78, with tumour mixtus mesodermalis malignus corporis uteri, coexistent with breast cancer, and unilateral lymph nodes metastases, coming from the uterine tumour, with no previous therapy. In the literature we did not meet any case of breast cancer, coexistent with MMMT with the axillary lymph node metastases of MMMT component.
Złośliwe mieszane guzy mezodermalne (MMMT) macicy to rzadkie nowotwory o bardzo agresywnym przebiegu, występujące u kobiet w wieku pomenopauzalnym. Stanowią 1-2% wszystkich nowotworów narządów płciowych kobiecych i 2-5% nowotworów trzonu macicy. Ze względu na niezbyt częste występowanie dokładne poznanie charakterystyki tych nowotworów jest utrudnione. Wobec powyższego, sposób postępowania jest oparty na schematach postępowania w raku trzonu macicy. Przez większość autorów, z uwagi na przebieg kliniczny, są one traktowane jako raki endometrium o agresywniejszym przebiegu. W piśmiennictwie opisano wiele przypadków występowania raka endometrium, jak również MMMT po przewlekłej terapii tamoksyfenem z powodu raka piersi, natomiast nieliczne dane wskazują na możliwość współwystępowania obu nowotworów bez uprzedniej terapii. W pracy przedstawiono przypadek 78-letniej kobiety, u której stwierdzono guza złośliwego mieszanego mezodermalnego trzonu macicy oraz raka piersi z jednoczesnym występowaniem przerzutów do węzłów chłonnych po stronie zdiagnozowanego raka piersi, pochodzących z guza macicy. Nie spotkano natomiast opisu przypadku współwystępowania MMMT i raka piersi z przerzutami MMMT do pachowych węzłów chłonnych.

The aim of the article is an attempt to outline the theory of the conference (scientific), taking into account its actual course, including the reported content, as the ontic basis of its real structure. At the heart of this concept is a myth whose stories form the basis for the emergence of cultural spectacles. In the case of a conference conceived as a spectacle, the founding form (myth) is skholé. The conference itself is shaped in two overlapping areas: firstly, it is subject to the process of ritualization, and secondly, it is subject to the coexistence of universal praxis. In view of the subject of the conference mentioned and analyzed here, this theory takes into account aesthetic and pedagogical interactions (principles), ignoring others (ethics, economy, politics, religion). The conference theory should contribute to the understanding of its coherent thinking and operation structure; the importance of its impact on its participants, the legitimacy of its organization and study; the possibility of consciously shaping its course, in the cognitive - methodological context (I omit the otherwise important socio-cultural aspects).

Artykuł to próba zobrazowania istoty wpływu kilku najważniejszych czynników na tożsamość miejsca poprzez pryzmat przywołania konkretnych przestrzeni. Najistotniejsze przywołane składowe to czas, miejsce, krajobraz, pamięć, dźwięk – wzajemne ich współistnienie tworzy w naszym pojmowaniu obraz, który mimo naszego stałego wyobrażenia o nim nieustannie zmienia się in situ. Rozważania podjęte w treści artykułu odnoszą się zarówno do pojęcia tożsamości niezwiązanej z miejscem, jak również do kilku wybranych miejsc w Polsce południowo-wschodniej.
The article attempts to illustrate the essence of the influence of several key factors on the identity of place through the evocation of specific spaces. The most essential components evoked are time, ‑place, landscape, memory, sound: their mutual coexistence creates, in our understanding, an image that, despite our fixed idea, is constantly changing in situ. The reflections undertaken in the content of this article refer both to the notion of identity not linked to any given place and to a few selected places in south-eastern Poland.

Zaprezentowana glosa dotyczy wyroku Sądu Najwyższego z dnia 23 listopada 2012 r. sygn. akt IV CSK 598/12 w przedmiocie dopuszczalności uznania nabywcy przedsiębiorstwa upadłego za jego następcę prawnego oraz wpływu rozmiaru dotychczas spełnionych w ramach umowy świadczeń na ważność postanowienia w sprawie wysokości wynagrodzenia za bezumowne korzystanie z rzeczy. Sąd Najwyższy podkreśla, że zbycie przedsiębiorstwa upadłej spółki kapitałowej w toku postępowania upadłościowego z opcją likwidacyjną, wywołuje zdarzenia właściwe dla następstwa prawnego pod tytułem ogólnym. Stanowisko wskazujące na brak skutku następstwa prawnego po stronie nabywcy odnosi się do przypadku nabycia przedsiębiorstwa upadłego, które zachowuje byt prawny po zakończeniu postępowania upadłościowego. Nie ma jednak zastosowania do sytuacji szczególnej związanej ze zbyciem całego przedsiębiorstwa spółki w prawomocnie zakończonym postępowaniu upadłościowym. Sąd Najwyższy uznał, że przy ocenie ważności spornego postanowienia umownego nie może mieć decydującego znaczenia rozmiar dotychczas spełnionych w ramach umowy świadczeń w postaci opłat leasingowych. Sama dysproporcja świadczeń nie musi być sprzeczna z normami współżycia społecznego. Niniejsza glosa aprobuje argumentacje zawartą w wyroku Sądu Najwyższego, jednocześnie jednak zwracając uwagę na zasadę proporcjonalności pomiędzy wierzycielami a dłużnikiem oraz rangę art. 5 Kodeksu cywilnego.
The presented gloss refers to Verdict IV CSK 598/12 issued on 23rd November 2012 by the Supreme Court concerning the admissibility of recognizing the acquirer of the bankrupt’s business as his legal successor, and the impact of the extent of the heretofore provided contractual performances on the validity of the decision concerning the amount of the remuneration for the non-contractual use of a thing. The Supreme Court underlines that the disposal of an enterprise of a bankrupt company in the course of bankruptcy proceedings with a winding-up option, results in the events appropriate for a universal succession. The position indicating lack of effect of legal succession on the part of the acquirer refers to the case of acquisition of the bankrupt’s enterprise  that remains its legal existence after the end of the bankruptcy proceedings. However, it shall not apply to the special situation connected with the disposal of the entire enterprise of the company in the finally completed bankruptcy proceedings. The Supreme Court found that in assessing the validity of the contested contractual provision, the extent of the contractual performances heretofore provided in the form of leasing fees, cannot be decisive. The disproportion in performances cannot be contrary to the principles of social coexistence. The present gloss accepts the arguments contained in the verdict of the Supreme Court, however, it also draws attention to the principle of proportionality  between the creditors and the debtor, and the importance of Article 5 of the Civil Code.

The text considers the possibility of functioning of the philosophy of coexistence supported by Stanisław Vincenz  the author of Na wysokiej połoninie (On the high meadow) in the perspective of postwar Polish-Jewish relations. He does that in reference to widely treated historical context  (from the 1940s up to the present times) noting that postwar Polish-Jewish relations are of extremely complex character and are realized between selfless friendship, at times even heroism and xenophobia and aggressive antisemitism. The text also mentions the criteria of strangeness/hostility and familiarity functioning between both nations. The conclusion of the text is a well-argumented statement that in the present Polish reality practical realization of Vincenz’s philosophy showing equality and equality of values in mutual interethnic relations is difficult, however, in the future perspective and „long lasting” (understood in accordance with the intention of Ferdinand Braudel) is not impossible and desired indeed.

Z art. 49 § 2 k.c. wynika, że osoba, która poniosła koszty budowy urządzeń przesyłowych i jest ich właścicielem może żądać, aby przedsiębiorca, który przyłączył urządzenia do swojej sieci, nabył ich własność za odpowiednim wynagrodzeniem. Charakter i treść roszczenia wynikającego ze wskazanego powyżej przepisu wywołuje wiele wątpliwości. W wyroku z 22 maja 2013 roku Sąd Apelacyjny w Szczecinie stwierdził, że przedmiotowe roszczenie nie ma charakteru bezwarunkowego, jednakże sąd w uzasadnieniu swojego rozstrzygnięcia nie wyjaśnił, jak należy rozumieć pojęcie „bezwarunkowy”. W niniejszym opracowaniu przedstawiono stanowisko zaprezentowane przez sąd oraz podjęto próbę jego oceny.
According to the article 49 § 2 of the Civil Code, a person who incurred construction costs of installations and who is their owner, may demand that an entrepreneur who connected installations to his own network, acquires their ownership against an adequate remuneration. Character and content of this claim raise a lot of concerns. Court of Appeal in Szczecin passed a judgement on the 22nd of May 2013 in which stated thatmentioned above claim does not have an unconditional character. However the Court of Appeal has not explained what does mean a term “unconditional”. This paper describes the point of view presented by the Court of Appeal with a comment.
