Opis:
The preliminary reference as an appeal of the Court of Justice of the European Union presents many complexities and complicated interpretations over time, given that we have a national judge in the scene of the appeal process, often creating problems but also solutions for greater effectiveness of the law of the European Union and respect for domestic law. The preliminary ruling aims to resolve disputes between internal jurisdictions and evaluate compatibility with EU law, especially in the national procedural sector. Ensuring a postponement of the EU and, above all, protecting the rights of individuals in a concrete, complete and effective way is still questionable research, not so much on a theoretical level but also on a procedural one.

In the author’s view, the judgment of the FCC concerning activities of the European Central Bank regarding the primacy of EU law over national law is of significance, due into the authority of the German constitutional court. However, it does not translate directly to foreign conditions. The view expressed in the judgment is that the ultra vires doctrine forms limits to the principle of primacy of European Union law over member state law. As a result, the principle of primacy may only be binding within the scope of the European Union law. Moreover, criteria of assessment of EU’s legislative activity and ECJ’s jurisprudence are drafted from the perspective of the ultra vires doctrine.

Opis:
Financial sanctions against Member States for infringement of Euro-pean Union law can amount to millions of euros. They are imposed by the Court of Justice of the European Union, either as a periodic penalty payment or a lump sum. The paper presents the procedure for enforcing the Court’s judgements and discusses the interpretation of Article 260 of the Treaty on the Functioning of the European Union in the case-law of this institution: from a precedent allowing the joint imposition of a periodic penalty payment and a lump sum, by changing the method of calculating both penalties as a result of the entry into force of the Lisbon Treaty, to the interpretation of the expression failu-re to fulfil its obligation to notify transposing measures referred to in Article 260 (3) TFEU.

The author attempts to analyse selected rulings of the European courts concerning religious symbols in order to answer the question whether freedom of religion is still respected in Europe. The analysis is based on the reflection on the context of contemporary European cultural landscape: diversity of constitutional models of particular states, the concept of neutrality in the matter of religion, and the ability of contemporary political elites and judges to understand the sphere of the sacred (sacrum). The selection criteria for the rulings have been cases concerning objects related to practising religion: (i) the hijab – an Islamic headscarf, (ii) the burqa – a garment covering practically the entire body, and (iii) the crucifix hung on a classroom wall. The review brings up important questions about lack of tolerance, pluralism and acceptance of religious diversity in contemporary Europe, and ‘reasonable accommodation’ as a possible solution.

Nowadays law is considered to be an effective instrument of shaping social reality. In this context special attention must be paid to gender equality law and jurisprudence which setting protection against unequal treatment because of someone’s gender intend to make a balance between individual’s identity and social expectations related to his or her role. These social preconceptions based on gender stereotypes must be contested insofar as they serve as an instrument to rationalize inequality between women and men. The aim of the article to explore the gender stereotypes in the anti-discriminatory judgments of the Court of Justice of the European Union. The article claims that the CJEU’s case law is unambiguous with respect to this. On the one hand the Court contributes to eradication of stereotypes based on gender in some cases, on the other – it reinforces them in the other. The article starts with explanation of the role of the gender equality principle in the EU legal system. It also makes some general remarks on stereotypes, biases and discrimination. The second part is devoted to the CJEU case law in which the Court, explicitly or implicitly, avoids applying the gender stereotypes lens to equality issue. The third part of the article analyses those of the CJEU judgments which, unfortunately, can be considered as perpetuating gender stereotypes and as such discrimination based on them.

This paper explores the concept of legal translation as a Third Space through the lens of the ‘multilingual’ Court of Justice of the European Union (ECJ). In many ways legal translation at that Court fits readily with the characterisation of translation as a Third Space. Due to complex internal production processes the ECJ produces texts which are undoubtedly hybrid in nature, and which exhibit distinctive features on a lexical and textual level marking them out as a product of cross-fertilisation of influences from source and target languages and legal cultures. Even the teleological approach taken towards legal reasoning at the ECJ occupies a space outside the strict confines of the texts involved. Both the processes and the product of the ECJ’s language system appear to bear all the hallmarks of translation as a Third Space. However, translation at the ECJ also challenges the concept of a Third Space. The prevailing definitions of translation as a Third Space fail to effectively conceptualise additional nuances of the specific nature of drafting and the complex nature of translation at the ECJ. This paper uses original empirical data to demonstrate that translation at the ECJ places constraints on the undefined, vague and fluid nature of the Third Space, warping the forces at work within that space. In this regard, rather than an amorphous space, the Third Space is better thought of as a determinate area which is delimited by elements of translation process which constrain it. This adapted framing of the Third Space can consequently be used to better understand and illustrate the dynamics at play in other areas of legal translation where the current concept of the Third Space is equally inadequate for encompassing the specific nature of translation practices which impact on that space-in-between.

Article has been focused on the notion of human dignity as interpreted by the CJEU and its evolution during history of European integration. In the beginning the competence conferred on the European Communities pertained generally to the economic area so the possibility of affecting the rights of individuals was not apparent. The expressive recognition of the principle of human dignity by the CJEU occurred rather late with the ruling of 2001 regarding the Directive on the legal protection of biotechnical inventions. The CJEU’s judgement in Omega was of crucial importance because it confirmed that a fundamental right to human dignity is part of EU law. The Brüstle judgement of 2011, regarding the context of bioscience and biotechnology, brought more light on the CJEU positon with reference to the issue of human dignity. In this case the age-old problem of the moral status of the embryo is the central issue. Today this decision is seen as a justification and vindication of the principle of human dignity.

The text comments on the Court of Justice of the European Union judgment of 26 February 2015 in the case C-472/13, Andre Lawrence Shepherd v Bundesrepublik Deutschland. The judgment was delivered within the framework of the preliminary ruling procedure following the request from the Bayerisches Verwaltungsgericht München. A.L. Shephered was a former US soldier who had deserted from the US Army and applied for refugee status in Germany as he opposed further service in Iraq due to the fear of committing war crimes. The judgment commented on places itself within the growing case-law of the CJEU interpreting the secondary EU legislation in asylum policies. As such – although remaining to some extent untypical – it deserves analysis that results in identification of some shortcomings of the reasoning.

Dyrektywa 2005/29/WE o nieuczciwych praktykach handlowych obowiązuje od ponad 15 lat. W tym czasie interpretowana była w literaturze przedmiotu, wytycznych Komisji Europejskiej oraz orzecznictwie Trybunału Sprawiedliwości UE. W niniejszym opracowaniu przeanalizowano 12 orzeczeń TSUE z ostatnich pięciu lat (2016–2021). W pierwszej kolejności omówiono stanowisko TSUE w przedmiocie relacji dyrektywy 2005/29/WE do innych instrumentów unijnych i krajowych. Następnie przedstawiono dorobek TSUE w kwestii podmiotowego zakresu stosowania dyrektywy 2005/29/WE. Z uwagi na fakt, że dyrektywa zmierza do ochrony zarówno konsumentów, jak i profesjonalistów funkcjonujących zgodnie z prawem, ma ona znaczenie dla – bez mała – ogółu obywateli UE. W tym kontekście precyzyjne określenie zakresu jej stosowania jest niezwykle istotne dla przedsiębiorców, konsumentów oraz wszystkich praktyków interpretujących prawo krajowe w świetle przepisów dyrektywy (zwłaszcza sądów), a także – choć w mniejszym zakresie – dla ustawodawców krajowych.   During the fifteen years since its adoption, Directive 2005/29/EC on unfair commercial practices has been interpreted in the subject literature, the guidelines of the European Commision and in the case-law of the Court of Justice. The paper analyses 12 judgements of the CJEU imposed in the last five years (2016–2020) in the context of the scope of Directive 2005/29/EC. First, the CJEU’s take on the relationship between Directive 2005/29/EC and other union and national regulations is discussed. Then the CJEU’s acquis regarding the subjective scope of the Directive is presented. In light of the fact that the Directive leads to the protection both consumers and traders operating legally, it is of importance for almost all UE citizens. Thus the precise determination of the scope of Directive 2005/29/EC is tremendously important for traders, consumers and all practitioners interpreting national law in the light of the Directive’s provisions (especially courts), but – also although to a lesser extent – for Member States’ legislators.
