In recent years, the question of population migration has become more present in the Polish social and political life. One of the examples of this phenomenon was the set of events at the turn of 2021 and 2022, when thousands of people tried to illegally cross the Polish-Belarusian border and enter the Republic of Poland. The state reacted by reinforcing border services, deploying soldiers and police officers to serve on the border. The circumstances of the deployment, conditions of service and related impressions of participants became the subject of research, the results of which are presented in this article. Most of our respondents were deployed to the border by order and were scarcely or completely unprepared to the service. The social and living conditions during service are evaluated as rather good, although leisure activities were poorly organised. Among the feelings and impressions from service, the most highly appreciated were the team atmosphere and cooperation and the attitude of superiors. Nevertheless, what prevails is a moderate dissatisfaction with the job, with a vast majority of participants unwilling to repeat such service.

Zapewnienie bezpieczeństwa granic zewnętrznych Unii Europejskiej warunkuje realizację jednego z jej głównych osiągnięć, czyli swobody przemieszczania się osób i towarów wewnątrz wspólnej przestrzeni Wolności, Bezpieczeństwa i Sprawiedliwości. W trakcie Mistrzostw Europy w piłce nożnej EURO 2012 organizowanych przez Polskę (państwo członkowskie) i Ukrainę (państwo trzecie) zadanie to okazało się szczególnie ważne, zwłaszcza w obliczu przewidywanej intensyfikacji ruchu granicznego i podwyższenia poziomu zagrożeń związanych z nielegalną migracja, przemytem, czy zorganizowaną przestępczością transgraniczną. Celem niniejszego artykułu jest analiza przyjętych koncepcji oraz realizacji przedsięwzięć podjętych przez służby odpowiedzialne za bezpieczeństwo granic państwowych w wyjątkowych warunkach wynikających z organizacji masowej imprezy sportowej. Na plan pierwszy wysuwają się zagadnienia związane z funkcjonowaniem granicy polsko-ukraińskiej i inicjatywy zrealizowane we współpracy z tym państwem sąsiednim będącym jednocześnie współgospodarzem Turnieju, takie jak m.in. polska i ukraińska odprawa graniczna oraz celna w jednym miejscu, wspólne patrole, punkty konsultacyjne. Poruszono także kwestie związane z zarządzaniem bezpieczeństwem pozostałych odcinków wschodniej granicy zewnętrznej – z Federacją Rosyjską i Republiką Białorusi. Omówiono także organizację i wyniki Wspólnej Operacji EUROCUP 2012 koordynowanej przez Unijną Agencję FRONTEX. W odniesieniu do granic wewnętrznych opisano wykorzystanie podczas EURO 2012 unijnego mechanizmu tymczasowego przywrócenia kontroli na granicach wewnętrznych.
Security of the European Union’s external borders is a condition for providing one of its fundamental achievements, which is the free movement of persons and goods within the common area of Freedom, Security and Justice. During the European Football Championships EURO 2012 organized by Poland (Member State) and Ukraine (third state) this task proved to be of particular importance, especially in view of the anticipated intensification of border traffic and increase in the level of threats related to illegal migration, smuggling or organized cross-border crime. The aim of this article is to analyze the adopted concepts and undertakings carried out by services responsible for the security of state borders in the extraordinary situation connected with organization of the mass sporting event. Priority is granted to the issues concerning the operation of Polish – Ukrainian border as well as the initiatives implemented in cooperation with this neighboring country which was at the same time the co-host of the Tournament, such as i.e. Polish and Ukrainian border and customs control in shared place, joint patrols and consultation points. Moreover, the problems regarding the security management of remaining sections of the European external eastern border – with Russian Federation and the Republic of Belarus – are taken into account. Moreover, the article discusses the organization and results of the Joint Operation EUROCUP 2012 coordinated by FRONTEX Agency. Finally, with regard to internal borders’ security management, the use and results of the mechanism of temporary reintroduction of internal border control during EURO 2012 is described.

The main non-military criterion of border surveillance is border control; due to the geopolitical situation in Ukraine, preceded by the COVID-19 pandemic, the issue of border surveillance with regard to the eastern border of the Republic of Poland, also performing the function of one of the longest sections of the European Union’s external land border, has become extremely important. Therefore, the article aims to point to the importance of border surveillance and border traffic control at the eastern border of the Republic of Poland to the cross-border security of the EU. To achieve this objective, it presents the main characteristics of border control and cross-border security at the external borders of the EU, describes the ‘Polish’ section of the EU’s external land border, indicates the efficiency of control measures taken and identifies the threats and challenges to the protection and surveillance of border traffic. The article is theoretical and partly comparatively analytical in nature. It relies on traditional research methods: deductive reasoning and comparative analysis.

The Second Republic of Poland, after regaining independence as a new state and creating state structures, faced many serious challenges. Barely formed boundaries required effective protection as soon as possible. An important problem was the process of gradually gaining power over the borders. While its protection system was developing on the western border, regular military operations continued in the east. This task was not facilitated by the incompletely resolved border conflicts and the ethnically patchy population living in the border areas. One of the most serious problems was the lack of experience in protecting the state borders caused by the loss of independence. For the above reasons, the process of developing the border protection system of the Second Polish Republic lasted several years. How difficult that task was is shown by the number of border formations that were brought into existence at that time, subjecting them to various modifications. As a consequence, due to difficult relations between the Republic and neighboring states, the developed system of border protection was not uniform. It also had to face still not fully stabilised situation in Europe.

The aim of this study is to present the current legal and institutional determinants of prosecuting the crime of immigrant smuggling [Article 264(3) of the Penal Code] across the north-eastern border of the Republic of Poland, on the Russian, Belarusian and Ukrainian sections, as an external border of the EU, in accordance with the provisions of the Schengen Information System. The thesis of the study is that the state authorities and institutions, while combating border crime, including the crime specified in Article 264(3) of the Penal Code, fulfill the obligations imposed on them by national and EU regulations on cross-border security. In Poland, the leading service in this regard is the Border Guard (THE BORDER GUARD). The study first discusses terminology and then characterises the crime of illegal immigration as a determinant of cross-border security. A separate attention is paid to the crime specified in the above-mentioned Article, which became the main area of interest of the author of the study. In its final part, based on the legal grounds, the objectives and tasks of the Border Guard as a specialised force responsible for preventing and combating illegal immigration are discussed. Final conclusions are formulated in the summary. The bibliography lists the legal acts, case law and literature used in the study.

The article touches upon a set of issues related to the cross-border crime definition and features. Cross-border crime can be defined as a criminal-legal, criminological and criminalist concept. The author’s approach is that it is exactly criminal-legal dimension of this problem that is primary one. A criminal-legal understanding of cross-border crimes is suggested. It is analyzed by comparing the provisions of a number of international and national acts in the context of cross-boundary as a legal concept and characteristics of offences. There is emphasized that cross-border crimes constitute a relatively stable set of crimes that threaten the interests of states in the sphere of border and national security. The cross-border crimes objective features are considered. They include public interests, offender’s modus operandi, the victim, items transferred across the border. It is concluded that the cross-boundary nature in the criminal law of Ukraine stems from the peculiarities of the offender’s actions. The classification of crimes into unconditionally and conditionally cross-border is suggested. Such a division is associated with the obligatory/optional nature of such an objective feature as border crossing.

Celem pracy jest zdefiniowanie bezpieczeństwa transgranicznego, próba wytyczenia nowego kierunku jego rozwoju, oraz ukazanie istotnych problemów dotyczących funkcjonowania systemu ochrony granicy państwowej i sformułowanie wskazówek służących ich rozwiązaniu. Materiał badawczy stanowi literatura fachowa związana z szeroko pojętym bezpieczeństwem. Metoda badawcza to analiza tekstu i danych statystycznych. Wyniki badań koncentrują się na przedstawieniu nieprawidłowości i różnic pomiędzy założeniami teoretycznymi, a stanem rzeczywistym bezpieczeństwa transgranicznego RP. Wnioski płynące z analizowanych badań pozwalają stwierdzić, iż poprawa ,,Założeń wieloletniej koncepcji funkcjonowania Straży Granicznej na lata 2009-2015» znacząco wpłynie na proces umacniania bezpieczeństwa transgranicznego Polski.
The aim of this paper is to define the cross-border security and to attempt the delineation of a new direction for its development, as well as to show the important issues relating to the functioning of the state border protection and make suggestions for their solution. The research material is literature related to the wider security, as well as the Border Guard statistics. The test method is the analysis of text and statistics. The results of the research focused on the presentation of the discrepancies and differences between the theoretical assumptions and the actual state of the Polish cross-border security. The conclusions of the included studies allow us to conclude that the long-term improvement ,,Assumptions Border Guard operation concept for 2009-2015” significantly affect the process of strengthening Polish cross-border security.

In the article, the authors summarised the concept of state border security. They have suggested a wider interpretation of the border security model. They discussed modern models of border security in a theoretical context. They presented progressive models of security and functioning of Ukraine’s borders and described their features. They emphasised that the modern Ukrainian-Polish boundary represents a partially liberal model of security and functioning and it can be characterised by the operational security model. Different models of the functioning of the Ukrainian-Polish boundary (asymmetrical, selectively simplified, and symmetrical) were identified and connected with the transformational processes of the Ukrainian-Polish relations.

W przedstawianym artykule autorzy odnieśli się do wprowadzenia metodologicznego problematyki zapewnienia obrony, ochrony i bezpieczeństwa granicy państwowej w warunkach zewnętrznego zagrożenia państwa i w czasie wojny. Wyjaśniono pojęcie systemu bezpieczeństwa narodowego, podsystemu ochrony granicy państwowej, granicy państwowej oraz zagrożeń tradycyjnych i współczesnych (hybrydowych) godzących w bezpieczeństwo terytorium państwa. Celem głównym badań i dalszych rozważań badawczych autorów w zakresie określenia we wskazanym zakresie ochrony i obrony granicy będzie udzielenie odpowiedzi i otrzymanie nowej wiedzy w aspekcie koordynacji służb państwa wydzielonych do obrony jego terytorium oraz wskazanie nowego modelu zintegrowanych działań o charakterze obronno-ochronnym. Ważnym w opinii autorów jest nie tylko centralizacja zarządzania bezpieczeństwa granicy państwowej, obszaru terytorium państwa w strefie, czy w obszarze przygranicznym. Najistotniejsze w opinii autorów jest przygotowanie służb mundurowych, administracji publicznej do przygotowania obrony granicy państwowej we wszystkich jej 4 domenach: lądowej, morskiej, powietrznej i cyberprzestrzeni. Dlatego też przygotowywany podsystem ochrony granicy państwowej musi być stale już w czasie pokoju dostosowywany do zmieniających się zagrożeń oraz wyzwań występujących w czasie pokoju, kryzysu oraz w czasie wojny.
The authors of this article referred to the methodological introduction to issues of border protection and defence while in condition of external threat to state’s security and during wartime. The concepts of the National Security System, the Border Protection Subsystem, state’s border, as well as both traditional and modern (hybrid) threats to state’s territory has been explained. The main goal of author’s current and future research in the area of state’s border security and protection is to answer questions and gain new knowledge in the aspect of coordination of state’s services tasked with protection of national territory and to indicate a new model of integrated border security and protection operations. In the authors' opinion the most important task ahead is the readiness of the uniformed services and public administration to prepare the protection and defence of the state’s border in all its four domains: land, sea, air and cyberspace, the State’s Border Protection subsystem must be constantly updated to meet the evolving threats and challenges during peacetime as well as during crisis, external threats to state’s security and wartime.

Cross-border security is part of both external and internal security of a state; hence the responsibility for it is usually divided. Similarly, the responsibility for Polish border administration is split in both subjective and objective sense. The Constitution of the Republic of Poland in art. 146 indicates that the Council of Ministers, and in particular the Minister of National Defence, the Minister competent for Internal Affairs and the Minister competent for Public Finance shall ensure external and internal security as well as public order in the state. To a lesser extent, the responsibility for state security is also shared by other ministers supervising central administration bodies that have state border protection within their scope. In addition, very important functions directly or indirectly related to border security are carried out also by voivodes. In the current paper, the author presents individual institutions and state bodies involved in cross-border security of the Republic of Poland, demonstrating their impact on the overall level of this security.
Bezpieczeństwo transgraniczne jest częścią bezpieczeństwa zewnętrznego i bezpieczeństwa wewnętrznego państwa – odpowiedzialność za nie jest zazwyczaj podzielona. Polska administracja graniczna zarówno w sensie podmiotowym, jak i przedmiotowym jest niejednolita. Konstytucja Rzeczypospolitej Polskiej w art. 146 wskazuje, że Rada Ministrów, a w szczególności Minister Obrony Narodowej, minister właściwy do spraw wewnętrznych i minister właściwy do spraw finansów publicznych zapewniają bezpieczeństwo zewnętrzne i bezpieczeństwo wewnętrzne oraz porządek publiczny w państwie. W mniejszym stopniu odpowiedzialność za bezpieczeństwo granicy ponoszą też inni ministrowie nadzorujący centralne organy administracji rządowej mające w swoim zakresie działania zadania ochronne granicy państwowej. Bardzo ważne funkcje bezpośrednio lub pośrednio związane z bezpieczeństwem granicy wykonują wojewodowie. Autor charakteryzuje poszczególne instytucje i organy państwowe, wykazując ich wpływ na poziom bezpieczeństwa transgranicznego Rzeczypospolitej Polskiej.

The aim of this paper is to try to summarize, how, the scholars researching border studies and cross-border cooperation practitioners reacted to the COVID-19 pandemic during the period from 16 of March to 21 of June 2020. As it was not possible to follow all the texts (often published without peer-review in thematic blogs) and events, the overview is not exhausting. Another goal of this text is to synthesize the main messages of those texts and events and to identify possible future trends in border studies. We will most likely experience the discourse change which will lead us towards studying impacts of re-bordering rather than de-bordering. We can also expect the lower engagement of the local and regional actors in cross-border cooperation, which will be in some border contexts considered as an unnecessary luxury.

Author analyses in the article the problem of functioning of the external borders of the Republic of Poland in the Schengen area. The text frames the analysis in the context of the political science. The author discusses the changes in state system of protection of the state border of the Republic of Poland resulting from the integration of the Republic of Poland with the European Union, in particular with the Schengen area. The basic objective of the article is the analysis of the scope and type of organisational and administrative-logistic undertakings in the field of border protection after Poland’s participation in the Schengen Area. The analysis is started with characterisation of changes in the system of management of the state border and the ways of functioning of border services in connection with the accession to the EU were characterised. EU requirements for strengthening border infrastructure and the system of cooperation between institutions responsible for border security were also analysed. As a result, the accession of the Republic of Poland to the Schengen area entailed a complete change in the strategy of managing the state borders. Autor analizuje w artykule problem funkcjonowania granic zewnętrznych Rzeczypospolitej Polskiej w strefie Schengen. Tekst sytuuje się w obszarze nauk o polityce. Autor omawia zmiany systemu ochrony granicy państwowej Rzeczypospolitej Polskiej, wynikające z integracji Rzeczypospolitej Polskiej z Unią Europejską, w szczególności ze strefą Schengen. Celem podstawowym artykułu jest analiza zakresu i rodzaju przedsięwzięć organizacyjnych i administracyjno-logistycznych w zakresie ochrony granicy po przystąpieniu Polski do strefy Schengen. W pierwszej kolejności scharakteryzowano zmiany systemu zarządzania granicą państwową oraz sposobów funkcjonowania służb granicznych w związku z akcesją do UE. Analizie zostały również poddane unijne wymogi zarówno w zakresie wzmocnienia infrastruktury granicznej, jak i systemu współpracy instytucji odpowiedzialnych za bezpieczeństwo granic. W efekcie przystąpienie Rzeczypospolitej Polskiej do strefy Schengen wiązało się z całkowitą zmianą strategii zarządzania granicami państwa.

In recent years, the European security environment has been subjected to many tests. For the first time since the end of the Second World War, Europe is struggling with new, hitherto unknown threats and challenges in the area of security. Today’s security environment is increasingly volatile, complex and uncertain. At the same time, there is a deficit of its understanding, which results, among others, from its interdisciplinarity and multifaceted nature, as well as the penetration of many military factors and civilian, the development of new technologies, as well as globalization processes and their consequences. An additional factor intensifying the perception of changes in the security environment is the reduction of time spent on analyzing and understanding the changes taking place, as well as planning and implementing adequate solutions. In this context, the situation on NATO’s eastern flank is becoming one of the key issues to ensure the security of this part of Europe. Due to its international obligations resulting from its accession to the EU and the Schengen Agreement, Poland has assumed the obligation to ensure the security and inviolability of the Polish eastern border, which is integral with the external border of the European Union and NATO. Actions and efforts in the field of security, however, depend not only on the defense system of a given country, but on many factors, including geopolitical, historical and military conditions. The events of the last two years in its immediate vicinity are also significant for Poland’s security, including the crisis on the Polish-Belarusian border and the war in Ukraine. The main purpose of these considerations is to try to find an answer to the question of how to ensure the security of the Polish eastern border in the current security environment.

The current period of development of Ukraine is characterized by the intensification of European integration processes, among which ensuring the adaptation of the national border security system to the European standards takes an important place. The mechanism of implementation of the border policy implementation to ensure the border security of the European Union is the European integrated border management, the complex basis of which is the European Border Surveillance System (EUROSUR). For the successful European integration of Ukraine, it is important to take into account the European experience of formation, functioning, and prospects for the development of European integrated border management. Planning of preventive strategic steps, which in the future will ensure a successful integration of Ukraine’s border security system and its state border into similar components of the European Union, should be included in the content of all thematic strategic documents (legislation, concepts, strategies, programs, plans, etc.).
