The article describes the natural background, the origin, the course and the outcome of the dispute between Poland and the European Commission which was going on in the years 2016–2018 regarding the forest management performed in the Białowieża Forest. The dispute took place on two interrelated levels: natural and legal. The main axis of the dispute between the Polish government and the European Commission was the difference of views as to what actions would prove effective in the fight against the latest gradation of the bark beetle, which occurred with exceptional intensity in the Białowieża Forest in 2015, and what actions would be most beneficial in the context of preserving rare species of birds and insects that make up the fauna of the Białowieża Forest. The article presents extensively the arguments raised by both parties to the conflict in the proceedings before the Court of Justice of the European Union, which were initiated by a complaint filed by the European Commission. As a commentary on these arguments, the views expressed in the scientific literature as to the proper reaction in response to a recurrent infestation of the bark beetle, usefulness and efficacy of the active forest management operations questioned by the European Commission, as well as an impact of these operations on the conservation of natural habitats, insects and birds are presented. The legal dimension of the dispute boiled down to the question of what actions in the situation were allowed, required or prohibited under Polish and EU law.
W artykule opisano podłoże, genezę, przebieg i wynik sporu między Polską a Komisją Europejską, który toczył się w latach 2016–2018 o gospodarkę leśną prowadzoną w Puszczy Białowieskiej. Spór toczył się na dwóch powiązanych ze sobą płaszczyznach: przyrodniczej i prawnej. Główną osią sporu była różnica poglądów na to, jakie działania mogą przynieść skutek w walce z gradacją kornika drukarza, która w 2015 r. nastąpiła z wyjątkową intensywnością w Puszczy Białowieskiej, a także jakie działania byłyby najkorzystniejsze w kontekście zachowania rzadkich gatunków ptaków i owadów współtworzących faunę Puszczy. W artykule obszernie zaprezentowano argumenty podnoszone przez obie strony w postępowaniu przed Trybunałem Sprawiedliwości Unii Europejskiej, które uruchomione zostało skargą wniesioną przez Komisję Europejską. Jako komentarz do tych argumentów przedstawiono poglądy wyrażane w nauce odnośnie do pożądanych sposobów reagowania na okresowe gradacje kornika drukarza, celowości i skuteczności kwestionowanych przez Komisję Europejską działań gospodarczych oraz wpływu owych działań na stan podlegających ochronie siedlisk przyrodniczych, owadów i ptaków. Prawny wymiar sporu sprowadzał się do kwestii, jakie działania w zaistniałej sytuacji są dozwolone, nakazane bądź zakazane w świetle prawa polskiego i unijnego.

The author of the article describes an urban and regional “field of memory”. He analyzes female hodonyms, official forms of commemorating women in Białystok and female dendronyms in the Białowieża Primeval Forest, as well as acts of civic commemorations. On this basis, he discusses trends in local symbolic politics in the twentieth and twenty-first centuries and compares them to the ideological assumptions of the Polish policy of memory. Using a regional perspective, the author highlights the disproportion between the past ethnic and religious diversity of Podlasie and the practices of marking public space and natural and cultural heritage by the dominant community and the institutions of the unitary state.

Fundusz Leśny został utworzony w celu umożliwienia prowadzenia gospodarki leśnej przez nadleśnictwa, w których koszty są wyższe od osiąganych przychodów. Jego zadaniem jest wyrównywanie niedoborów finansowych w nadleśnictwach deficytowych. Lasy Państwowe prowadzą działalność na zasadzie samodzielności finansowej i pokrywają koszty z własnych przychodów. Celem artykułu jest analiza wykorzystania środków pozyskanych z Funduszu Leśnego w nadleśnictwach Białowieża, Browsk i Hajnówka na rozwój sylwanoturystyki w Puszczy Białowieskiej (PB). W badaniach użyto metody sondażu diagnostycznego z wykorzystaniem ankiety badawczej i wywiadu bezpośredniego, literatury specjalistycznej oraz sprawozdań finansowo-gospodarczych za lata 2020-2021. Badane nadleśnictwa przeznaczyły najwięcej środków na budowę ścieżek pieszych i rowerowych, wykonanie tablic promujących PB, remont dróg dojazdowych do ,,miejsc mocy”, edukację przyrodniczo-leśną oraz inne usługi związane z ruchem turystycznym na obszarze badanych nadleśnictw.
The Forest Fund was established in order to enable forest management to be carried out by forest districts, where the costs are higher than the revenues generated. Its task is to compensate for financial shortages in deficit forest districts. The State Forests operate on the basis of financial independence and cover the costs from their own revenues. The aim of the study is to analyze the use of funds obtained from the Forest Fund in the Białowieża, Browsk and Hajnówka Forest Districts for the development of sylvan tourism in the Białowieża Forest (PB). The research used the method of a diagnostic survey with the use of a research questionnaire and direct interview, specialist literature and financial and economic reports for the years 2020-2021, „places of power”, forest nature education and other services related to tourist traffic in the area of the studied forest districts.

The judgment of the Court of Justice of the European Union of 17 April 2018 in Case C-441/17 (failure of a Member State to fulfil obligations), brought by the European Commission against Poland, concerning “logging” in the Białowieża Forest, was widely reported in the media and on the scientific forum (naturally, also in the doctrine of international and European law). Analysing this decision and referring to the jurisprudence and achievements of the doctrine, commentators cautiously (but, in essence, not always correctly) indicated what decisions and actions constituted the basis of this dispute, which ultimately led to Poland’s defeat before the Court, considering the judgment an end to the case and, at the same time, the canon for the subject knowledge. It should be emphasised, however, that the judgment itself did not resolve the dispute as to which model of protection of the Białowieża Forest is appropriate. In particular, it has not contributed to determining whether the previous activities of the State Forests (although it proved them formally inconsistent with EU law) were beneficial (or harmful) to the protection of the Białowieża Forest stand. By emphasising the imperfection of the situation, the authors try to constructively draw from it conclusions de lege lata and de lege ferenda.

Opis:
Sentinel-2 mission, as a part of European Space Agency Earth Observation Program Copernicus, designed specifically for Earth surface observations provides images in 13 bands. That imaging is used to analyse many subject areas as Land monitoring, Emergency management, Security and Climate change. In the presented paper the application of Sentinel-2 data for automatic forest cover changes detection has been analysed. As input data, B02, B03, B04 and B08 bands have been used to compute Normalized Difference Vegetation Index (NDVI) and Enhanced Normalized Difference Vegetation Index (ENDVI). To track changes in the forest cover over the years, for each pixel the difference in the value of vegetation indices between consecutive years have been calculated. Then the threshold was set at the level of 0.15. The values of differences above the threshold mean a significant decrease in the quality of vegetation and may be considered areas of deforestation.

Białowieski Park Narodowy należy do światowego dziedzictwa UNESCO od 1979 r. W 1992 r. jego obszar powiększono o białoruską część Puszczy Białowieskiej, a w 2014 r. ponownie go poszerzono. Obecnie obejmuje cały jej teren po obu stronach granicy o powierzchni 141 885 ha. Obowiązkiem Polski jako strony Konwencji UNESCO z 1972 r. dotyczącej Światowego Dziedzictwa Kulturalnego i Naturalnego jest ochrona Puszczy przed zniszczeniem i zachowanie jej w niezmienionej postaci dla przyszłych pokoleń. Z ustaleń kontroli NIK wynika jednak, że w latach 2008–2018 nie opracowano opartej na merytorycznych podstawach strategii prowadzenia gospodarki leśnej w Puszczy, która służyłaby jej ochronie. Prowadzenie cięć w drzewostanach zagrożonych obecnością kornika drukarza nie zawsze było zaś poprzedzone wnikliwą oceną ich wpływu na siedliska i gatunki chronione.
The Białowieska Forest is one of Poland’s ten UNESCO Biosphere Reserves, which protect unique nature and cultural values of the area. In 2008, the Polish part of the Białowieska Forest was covered with the Natura 2000 PLC200004 protection. Therefore, it is a unique area, where forest management calls for special care and respecting of regulations on nature protection. However, as a result of the decisions on increased felling of trees, justified with the intention to reduce massive attacks of the European spruce bark beetle, on 20th July 2017 the European Commission filed a complaint to the EU Court of Justice claiming Poland had failed to meet the requ irements stemming from the Bird Directive and the Habitats Directive. On 17th April 2018, the Court of Justice confirmed the stance of the Commission. As a result, from July 2018 to January 2019, the Supreme Audit Office of Poland conducted the audit to check whether forest management in the Białowieska Forest was compliant with the law, including nature protection requirements.

The aim of this work was to expand current knowledge on the species composition and distribution of the jewel beetles (Coleoptera: Buprestidae) in the Białowieża Primeval Forest (BPF) based on research conducted in the years 2000–2018 and a literature review. The BPF is considered the best-preserved forest of the European lowland and is a reference point for all forest research. Thus, knowledge of its fauna is vital. This research was conducted and incorporated the whole Polish part of the BPF, including Białowieża National Park (BNP), using standard methods for faunistic studies of terrestrial beetles. We also investigated potential microhabitats of saproxylic buprestid beetles and reared larvae from inhabited host material. Collected larvae and/or pupae were identified in the laboratory or grown to the adult stage. However, most specimens were collected using various traps (Lindgren, Moericke, barrier type Netocia and IBL-2), especially traps placed in the upper tree canopy. Two species previously unrecorded in the BPF (Agrilus graminis, A. mendax) and new information on several of the rarest Central European Buprestidae species (Buprestis splendens, Eurythyrea quercus, Anthaxia chevrieri, Chrysobothris chrysostigma, Agrilus antiquus croaticus, A. ater, A auricollis, A. convexicollis, A. pseudocyaneus) are presented here. Currently, 54 species of Buprestidae are known to occur the BPF area, of which 49 were collected from the Polish part and 26 were collected from the Belarusian part, whilst two species (Dicerca berolinensis and Eurythyrea austriaca ) have no specific location data. In the BNP, which covers about 17% of the Polish part of the BPF, up to 39 species of buprestid beetles have been found. We also provide an original key for differentiating Agrilus nicolanus – a species recently discovered in Poland (BPF and Biebrza Valley), that was previously known to occur only in Asia and the Lipetsk region in the European part of Russia – from Agrilus betuleti species group. In conclusion, the BPF is an important refugium of buprestid beetle richness including known forest relics.

Opis:
The paper describes current (in years 2007−2017) changes of basic parameters of forest stands that constitute the managed part of Białowieża Forest (ca. 53,000 ha), divided into three forest districts: Białowieża (12,600 ha), Hajnówka (19,700 ha) and Browsk (20,400 ha). The investigated tree stands represent different phases of ecological succession, modified by silvicultural treatments and other human activities. The course of the succession processes is varied, depending, first of all, on local site conditions, consisting mainly of fresh sites (ca. 60%) – particularly fresh broadleaved forest, and encompassing exceptionally high fraction of wet and swamp sites (40%) – especially wet broadleaved forest site type. Most stands represent the intermediate, highly productive phase of succession, with spruce and oak as the dominant tree species. In particular, such stands are common in Białowieża and Hajnówka forest districts. Recently, the share of the mentioned stands is declining, most intensely in the Browsk Forest District. In 2017 alone, 430 ha of highly productive forest stands disappeared from the Białowieża Forest. The process of decay involved mixed stands; besides of spruces which were killed by a current bark beetle infestation, also many oaks, pines, birches, alders as well as rare and valuable minor tree species (such as ashes and maples) died. Dying spruce and, more often, oak stands are often replaced by low−productive hornbeam trees, occupying earlier lower stand strata in such stands. The resulting hornbeam stands are often distinguished by low crown closure and low productivity. Tree stands occurring in the Białowieża Forest are among the most endangered by wind damage stands in Poland. It means that in case of strong winds, several trees will be broken and/or uprooted. The intensity of such phenomena will be further increased by the high tree volume of stands as well as by the presence of many gaps in forest canopy, caused by a massive mortality of spruce trees. In general, one may expect that in the nearest future many stands occurring in the Białowieża Forest, built by different tree species, will be subject to a massive decay. The list of factors contributing to this process is long and involves, among other things, recurring droughts during the growing season, unfavorable changes in ground water table and increased frequency of strong winds. All these factors negatively influence the health status of trees, which further favours the development of parasitic fungi and insects. In consequence, there is a high probability that many areas in the Białowieża Forest will, for a long time, retain a treeless character and/or will be occupied by low−productive and single species hornbeam stands.

Opis:
Since several years already, a massive infestation of bark beetle has taken place in the Białowieża Forest, decimating a local Norway spruce population. In consequence, many open areas appeared, practically deprived of trees and other forest vegetation. The existence of such areas has a very negative impact on multiple values of the Białowieża Forest: natural, social, economical and landscape−aesthetic values. The local forest administration prepared a strategy aimed at active restoration of diverse woodland communities typical for the Białowieża Forest in all places, where bark beetle infestation wiped up the spruce stands. Those plans were criticized by representatives of the environmental organizations who blamed the foresters for transforming the Białowieża Forest into ‘plantation’ and claiming that such measures are inconsistent with the existing forest management and protection plan. The postulate of environmentalists is that the recovery of woodland communities should proceed completely naturally. Taking into account the above mentioned controversies, in this paper we examine the issue of natural regeneration in the Białowieża Forest in detail. In particular, we try to determine to which extent this method of forest reproduction enables re−establishment of compositionally diverse woodland communities, distinguished by a high level of biological diversity and able to provide a wide range of commodities and benefits important for today’s society. Based on an extensive literature review we show that a combination of different (abiotic and biotic) factors, influencing establishment and subsequent growth of seedlings and saplings in the Białowieża Forest has long been strongly unfavorable for many tree species. In this regard, one should particularly emphasize the negative role of large herbivores, especially red deer, which is present in the Białowieża Forest since the end of 19th century, when it became a private hunting ground for Russian tzars. The devastating effect of deer browsing on natural regeneration is a well−documented phenomenon and widely recognized problem in the forestry practice. The fencing of young forest generation against game pressure is an indispensable measure, needed to secure the continuous existence of several tree species (first of all those palatable and vulnerable to browsing). Very strong arguments for an active approach to the described problem delivers also a long−term study on natural forest dynamics conducted since 1936. It shows that under conditions of strict protection the regeneration capacity of the Białowieża tree species is very variable. These differences lead to the compositional simplification and impoverishment of many tree stands, with numerous negative consequences for local biodiversity. We underline that an active management strategy is a basic prerequisite for maintaining a diverse character of the Białowieża stands and their ability to provide all important ecosystem services on a sustainable basis. Such a strategy should include, beside of the phase of establishment, also the subsequent developmental stages of new forest generations. The general goal of such a strategy should be to secure a possibly high diversity of tree composition and to enable the development of tree species representing a full range of life−history strategies and playing different successional roles: from typical pioneer species, through intermediate, to climax species.

The paper presents a multifaceted structure of timber harvest in 2008−2015 in the Białowieża, Browsk and Hajnówka forest districts located in the Białowieża Forest. The object of the research, including the Białowieża National Park being a remnant of the primeval forests, is considered one of the most valuable forest areas of natural origin in Europe. The studies were made on the basis of the data from the reports created by the State Forests Information System and forest management plans, as well as the nature conservation programs of the surveyed forest districts. In the analysed period, a total of 665,032.5 m3 of merchantable timber was harvested in the analysed area. The highest volume of merchantable timber was harvested in the Browsk Forest District – 305,934 m3 (46%), then in the Hajnówka Forest District – 219,300 m3 (33%), with the lowest volume harvested in the Białowieża Forest District 139,788 m3 (21%). Among the individual assortment groups, the medium−sized timber was the most common and its harvested volume amounted to 413,579 m3, while the harvested volume of large−sized timber amounted to 251,454 m3. The lowest harvested volume concerned the small−sized timber and amounted to 21,652 m3. In the analysed period, softwood had the largest share in timber harvest and amounted to 443,469 m3. Hardwood was obtained in the volume of 243,215 m3. According to the cutting category, the timber harvest structure was as follows: the highest volume was harvested in pre− commercial thinning 382,495 m3 (54%), that from incidental felling amounted to 251,003 m3 (38%), while the lowest volume of harvested timber was from final cutting – 53,186 m3 (8%). Forest districts located in the Białowieża Forest encounter many difficulties affecting timber harvest. The main reason for this lies in the numerous restrictions imposed on the management of areas covered by various forms of nature protection, including the exclusion of some habitats, or stands of 100 years of age and older from management, which significantly affects the yield. The lack of a determined rotation age for stands in the Białowieża Forest also has a significant impact on timber harvest.

Opis:
The Białowieża Forest (BF) is in many respects an exceptional object, of a great importance for nature protection and forest management, at the international scale. The BF plays also a key role from the point of view of regional development and welfare of local community. In the last period, a big threat for multiple values of the BF has arisen, as a result of enormous bark beetle infestation, which started in 2012 and has killed 1.4 million m3 of spruce trees. In the paper, first, a brief overview of the general history of the BF and an account of long−term human impacts on its functioning and structure is provided. Next, the history of bark beetle infestations in the BF is analysed. It is shown that, in the period 1992−2007, the average volume of spruces killed by bark beetle amounted on average to 20,000 m3 of wood annually. During that period practically all dead trees were removed from the forest by means of salvation cuttings. Starting from 2008, more and more trees infested by European spruce bark beetle were left in the forest, in a result of a pressure exerted by environmental groups. In 2012, Minister of Environment decided to reduce the allowable cut, determined in forest management plans elaborated for the managed part of the BF, from 107,000 to 48,500 m3/year. This decision, along with several other regulations and restrictions, made in practice impossible to stop the development of a current bark beetle infestation, which started in 2011 and intensified during the next 6 years (solely in 2016 bark beetles killed 480,000 m3 of spruce trees). In the paper, the most important implications and consequences of the current situation are briefly summarized and discussed. A special attention is given to the problems concerning: 1) protection of Natura 2000 species and sites (endangered by bark beetle outbreak), 2) a negative influence of large amounts of spruce deadwood on forest soils, 3) threats caused by pathogenic fungi, 4) question of public safety, 5) fire hazard, and 6) economical dimension. The legal and socio−economical foundations of the functioning of Hajnówka, Browsk and Białowieża forest districts comprising the managed part of the BF, as well as their most important environmental and social consequences are discussed too. Among others, it is indicated that, under current conditions of the BF, human intervention plays a key role in maintaining stable and compositionally diverse woodland communities. Finally, several suggestions and recommendations are provided, aimed at, in the short term, breaking off the current bark beetle outbreak, and, in the long term, at maintaining a multifunctional character of the BF and its ability to provide all important ecosystem services on a sustainable basis.

The article, based on a detailed query in the archival issues of “Łowiec Polski” from 1899 to 1939, shows the perception of the bison and the Białowieża Primeval Forest among the authors and readers of this periodical. The founder and first editor-in-chief of the magazine was Jan Sztolcman, a naturalist best known for his crucial role in saving the European bison. Among the collaborators of the magazine were the best naturalists of that period, so the subject matter undertaken in its papers was much broader than just strictly hunting. This article discusses issues related to the Białowieża Primeval Forest and its most valuable inhabitant (European bison) presented in the journal from the perspective of nature conservation, old hunting traditions, the search for the last free-living European bison in the Białowieża Primeval Forest, European bison breeding in Pszczyna, international efforts to rescue the European bison, monographs about the species published in the inter-war period, issues of European and American bison hybridisation, and finally, the return of the European bison to the Białowieża Primeval Forest. The journal was examined for the first time from the point of view of the history of natural sciences. Analysis of the content of the journal, often unpublished elsewhere, makes “Łowiec Polski” one of the most important sources of information about the European bison and the Białowieża Primeval Forest during this period.

The structure of timber sales in forest districts of the Białowieża Forest in the years 2008−2015 is presented. The Białowieża Forest is one of the most valuable natural areas in Europe. The data from the reports generated by the State Forests Information System of the Hajnówka, Browsk and Białowieża forest districts were used for the research. The information contained in the forest management plans and nature conservation programs of the surveyed forest districts was also used. The volume of the sold merchantable timber in the Białowieża Forest amounted to 669,072 m3, of which 63.43% was softwood and 36.57% hardwood. Among the softwood assortment, sales of the large−sized timber amounted to 44.42%, while of the medium−sized timber to 55.58%. For the large−sized hardwood, the share of sales amounted to 30.66%, while for the medium−sized hardwood to 69.34%. The small−sized timber was sold at 22,389 m3, with the share of hardwood assortments being 82%, and of softwood 18%. A small share in the sales of small−sized timber is caused by the lack of FSC certification by forest districts, which excludes large industrial companies that buy predominantly the medium−sized coniferous timber assortments. The average price obtained from the sale of timber in the the Białowieża Forest in the analysed period was 134.7 PLN/m3. At a price higher than the average, wood was sold in the Białowieża and Hajnówka forest districts, while in the Browsk Forest District the timber was sold at a price lower than the average. The total volume of merchantable timber harvested in the forest districts of the Białowieża Forest in the analysed years, including the small−sized timber, amounted to 686,684 m3, with 691,461 m3 of timber being sold. The volume of the merchantable timber sold at that time was 669,072 m3, which constituted only 0.24% of the total timber sold at the State Forests in Poland.

In Poland, the stormy discussion on the future of the Białowieża Forest has been ongoing already for a long time. The disputes are mostly focused on seeking answers to two questions: how to protect these unique forest ecosystems and whether forest management threatens their naturalness. The discussion has grown stronger after the recent, enormous outbreak of Ips typographus in the Forest. The Białowieża Forest has been managed for years with no negative effect. However, antagonists of foresters blame forest management for degradation of the Forest’s ecosystems, which is caused by favoring the economic value of timber expected to be harvested in keeping with the management plans of 3 forest districts located in the Białowieża Forest. At any rate, such assumption, has nothing to do with reality. During this discussion the idea to extend the national park for all the Białowieża Forest revived. In this paper, we reviewed the economic, social and ecological dimensions which should be taken into consideration before making a decision on extending the Białowieża National Park. It should be underlined that the Park’s area is already under the strict protection; furthermore, 2/3 of the area of neighboring managed forests are under legal protection (the nature reserves, NATURA 2000, the so-called reference forests, etc.). All things considered, we cannot find any reasonable purpose (ecological, financial or social) for expanding the Park’s area from 10 500 ha (present status) to 62 500 ha (after extension). Also, we are convinced that sustainable forest management conducted in managed parts of the Białowieża Forest, which comprises the fulfillment of all forest functions and services, should not be perceived as a threat to naturalness of the Forest’s ecosystems.
