While some issues (e.g. the principles of service, the expedited procedure for resolving cases and the admissibility of securing a claim before initiating proceedings) are regulated in a manner that satisfies the requirements of 2023, other issues (e.g. the rules of holding remote hearings or the consequences of failing to meet deadlines in arbitration, in particular the deadlines for issuing an award) would require a numer of modifications and improvements. This suggests that a postulate should be presented for a broader discussion within the community – both in Poland and abroad – on the shape of the regulations in this area that would be the most comfortable for the parties to the proceedings, the arbitral tribunals and the arbitral institutions, while respecting the basic (universal) arbitration rules.

The thrust of this article is to examine a contemporary international arbitration process in commercial and investment cases, specifically the interplay of common law and civil law elements in the taking of evidence. It begins with a survey of the provisions of the most popular international arbitration instruments, including international arbitration rules and IBA Rules on the Taking of Evidence in International Arbitration. Following the discussion of some relevant examples of international arbitration instruments, the author tries to answer the question whether these instruments, in their current form, support the popular thesis that the international arbitration process has become largely harmonized. In trying to verify this thesis, the article also goes beyond the text of international arbitration instruments and considers the influence of the cultural biases of international arbitration actors.

The purpose of this paper is to analyse the existing model of employment arbitration in Poland in force since 2005. According to Article 1164 of the Code of Civil Procedure, arbitra¬tion clauses in employment disputes can only be established once a dispute has already arisen. In reality, this post-dispute voluntary regulation has no practical value and employment ar- bitration is an instrument used extremely rarely in Poland. On the basis of examination of applicable laws, the author shows that in given factual and legal circumstances a reasonable employee and a reasonable employer shall seldom have a cause to simultaneously agree to arbitrate an already existing dispute. By applying the com- parative method at the same time, the paper examines possible criteria of distinguishing categories of disputes, agreements, persons and other conditions that would permit a valid arbitration clause in employment agreements. In conclusion, the author demonstrates that, firstly, the existing voluntary post-dispute employment arbitration model in Poland is a fictitious one and requires reform and, sec- ondly, that both a full elimination of arbitration clauses in employment agreements and a full arbitration clause for all future disputes are too blunt a tool not taking into account the real needs and requirements of today’s employees and employers. The author calls for a more nu- anced regulation of employment arbitration in Poland.

Lawyers involved in arbitration have doubts about the accuracy of the direction in which the current practice of arbitration is proceeding. One of the main practical issues of arbitration was the issue of conflicts of interest, arbitration costs, the ethos of arbitration. In Poland, arbitration proceedings took too long. The author partly criticizes the provisions of the Act of 10 September 2015 on the amendment of certain acts in connection with the support of amicable dispute resolution methods, which among others concerns the shortening of the post-arbitration proceedings. The legislator adopted defective criteria for determining the venue of court of appeal in cases related to the complaint to set aside the arbitration award.

When foreign investors consider investment, the possibility of international commercial arbitration and the recognition and enforcement of foreign arbitral awards in the home country where the investment will take place can be a major factor to effect investment decision. This article aims to discuss the Turkish legal framework, domestic and international, of international commercial arbitration for foreign investors willing to invest in Turkey. In this study, subsequent to the definition of investment and investors in the Turkish law, recognition and enforcement of foreign awards, appeal and setting aside of awards and the possibility of interim measures will be discussed. Special emphasis will be given to the possibility of international commercial arbitration for Build Operate and Transfer Agreements where most of the investments occur.

This paper discusses the use of consensual dispute resolution for the purpose of antitrust damage claims as introduced by the Directive. It presents these type of claims in a broader context of arbitration (or ADR), in comparison with traditional claim settling before a state court. Particular focus is on selected CEE countries and their implementation of the Directive, serving as an example of the transposition of the Directive’s rules (Article 18 and 19) into national systems in the area of consensual dispute resolution. Specific institutions intended to encourage consensual resolution included in the Directive (and transposed into national systems) are being commented on as well. Lastly, the paper briefs on the advantages of ADR in general, and concludes that even post-Directive, ADR remains attractive as a complimentary instrument to public enforcement and state judiciary enforcement.

Social arbitration as the third method of resolution of collective disputes can be used to resolve a dispute in an amicable manner. Thanks to this method, parties to the collective dispute can end their conflict thanks to the arbitration award with no need to go on strike. The author analyses the legal nature of arbitration awards and presents consequences of the related labour law legislation. The conclusion is as follows: current legal regulations are in need of change, especially when it comes to the execution, amendment and supplementation of an award issues as a part of social arbitration with the involvement of trade unions, employers or their organisations.

The paper is a translation of parts of the amended Code of Civil Procedure. It is incorporated in articles 1442-1527 of the French Code of Civil Procedure ( Le Code de procedure civile ). Décret n° 2011-48 portant réforme de l’arbitrage, was published in France’s Official Journal, alongside a report commenting on the reform. The New French Arbitration Law ( Décret n° 2011-48 du 13 janvier 2011 portant réforme de l'arbitrage ) aimed at increasing the efficiency of arbitration in France entered into force on 1 May 2011. France has had amongst the most arbitration-friendly legal regimes since 1981, when French arbitration law was modernized. Since that time, the French courts have demonstrated unfailing support for arbitration. It is worth noting that reform concerns both domestic and international arbitration. The new law becomes effective and applicable as of 1 May 2011, except for a number of specifically enumerated provisions which apply only if the arbitration agreement was entered into, the arbitral tribunal constituted, or the award rendered, after that date. The new decree codifies many jurisprudential developments, thus making existing French law more user-friendly and accessible. But the decree also takes into account international best practices in arbitration, introducing changes to French arbitration law that will make France an even more effective jurisdiction as a seat for arbitrations and with respect to the enforcement of arbitral awards. Article 1447 codifies the fundamental principle of the autonomy of the arbitration agreement, according to which the arbitration clause remains unaffected even if the underlying contract is found void. The provision states that the arbitration agreement is independent from the contract it relates to. Another example of codifying existing case law can be found in Article 1466. According to this provision, which is clearly inspired by previous French case law as well as the common law concept of estoppel, a party who – in knowledge of the facts and without any legitimate excuse – fails to invoke an irregularity of the arbitral process in due course, is prevented from doing so at a later stage. Another notable innovation is contained in Article 1526, which provides that a challenge of the award does not automatically result in suspension of enforcement proceedings. Rather, according to Article 1526 para. 2, a suspension has to be specifically requested and is granted only if the enforcement would be highly detrimental to the rights of the party requesting the suspension. The report accompanying the new law notes that the aim of this provision is to discourage bad faith annulment proceedings which seek to delay the enforcement of fully valid and legitimate awards. Article 1526 will apply to awards rendered after 1 May 2011. Finally, it remains to mention a few words about the translation. The author in this respect is based on the so-called. method dynamic equivalence or functional equivalence conveys the essential thought expressed in a source text — if necessary, at the expense of literality, original sememe and word order.

On May 21st 2015, the Court of Justice of the European Union in CDC Hydrogen Peroxide decided whether the application of jurisdiction clauses in actions for damages impedes the effective enforcement of EU competition law. The CJ stayed silent, however, on how to treat arbitration clauses, which similarly to jurisdiction clauses, exclude a default court jurisdiction. The question of how to interpret arbitration agreements in the event of an antitrust violation and subsequent actions for damages remains thus unanswered. In light of the foreseen increase in private enforcement of EU competition law, this problem gains significance. This is because arbitration agreements may be frequently used to govern commercial relationships between antitrust infringers and their injured direct contractors. Against this background, the paper aims to analyse the consequences brought about by the existence of arbitration clauses in the event of actions for antitrust damages. It seeks to answer two questions: whether the claims for antitrust damages can be per se arbitrated, and whether the general arbitration clauses used by the parties to regulate their commercial relations cover the actions for antitrust damages. In order to address these problems, the papers draws attention to the CJ’s interpretation of jurisdiction clauses and the Polish experience of interpreting the scope of arbitration agreements in the field of unfair competition law. The paper reaches the conclusion that neither the arbitration nor EU law prevent arbitrating actions for antitrust damages. Whether a specific arbitration agreement covers actions for antitrust damages or not can be analyzed only with reference to the will of the parties interpreted under applicable national law. It is believed, however, that there are many reasons to adopt an arbitration-friendly interpretation of vague arbitration agreements.

Aim: The article is concerned with the issues relating to arbitration in terms of the development of economy and entrepreneurship. The history of arbitration dates back to ancient times and many of its characteristic features continue to be reflected in the contemporary legal instruments.. The New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards should be distinguished here, along with the European Convention on International Commercial Arbitration. In the context of national arbitration, legal regulations laid down in  statute provide the main source. Attention should be drawn, in particular,  to speed as one of its key assets.., In terms of the cost of proceedings, arbitration is less expensive than a court process. The costs of arbitral proceedings appear to be clearly lower than those incurred in the state court proceedings. Another advantage stems from the possibility to design an arbitral procedure. The process of designing the arbitral procedure may proceed according to the arrangement made by the parties themselves. They can decide on the choice of law, arbitrators, their competences and method of conducting a proceeding. This division depends on a number of factors. In the light of the Polish Code of Civil Procedure this division exists only with regard to arbitral awards. The arbitral award is considered to be foreign when it is issued outside Poland. Arbitration resolves disputes which arise between entities participating in business transactions. This function is of relevance from the perspective of the contemporary economic development. Based on the analysis conducted in the paper, the author takes the view that arbitration is of crucial importance to the economic development. A quick dispute resolution has the effect that entrepreneurs show interest in this form of resolving their conflicts. For business transactions, it is paramount to have a prompt dispute resolution between entrepreneurs.. Design / Research methods: The interpretation of the impact of arbitration on business transactions was conducted employing historical and dogmatic method. The phenomenon of arbitration has been explained as an alternative form which exists next to mediation proceedings. Conclusions / findings: The studies allow the author to advance a thesis that, apart from the usual economic mechanisms, the mechanisms contributing to the resolution of disputes arising between entrepreneurs ensure the proper functioning of the economy as well. One of such mechanisms is precisely the arbitral tribunal. Unlike common courts, it is a more effective instrument in the hands of entrepreneurs.Originality / value of the article: This article is an example where the links between law and economy are discussed. The economic phenomena have so far been explored solely from the perspective of economics. In this paper, I attempted to show that legal institutions like arbitration in fact serve economic aims. In this sense it is a new approach to the question of business transactions. It can also be evaluated through the prism of economic analysis of law and institutions embedded in law. The topic discussed in the paper is merely a piece of a much broader issue which would require a more in-depth examination. I limit myself only to a certain aspect, yet those issues could be developed into a monograph.

The article deals with legal issues and controversies related to the form of the arbitration clause according to the Code of Civil Procedure. The Author endorses the procedural character of an arbitration clause and analyses the reasons for the need to comply with the form of an arbitration clause, focusing by reference on the institution of arbitration clauses contained in statutes of commercial partnerships, cooperatives and associations, including sports organisations, as well as in regulations and contract templates of banks. Arbitration has over the years gained prominence as a preferred method for dispute resolution especially for cross-border commercial disputes. One of the reasons is that the parties want to resolve their dispute in privacy and obtain an enforceable award as soon as possible. The choice of the arbitral seat during the negotiation of any international commercial arbitration agreement is perhaps one of the most overlooked influential aspects over the course of the arbitral procedures. The importance of a wise choice of an arbitral seat generally has two aspects, one of logistical convenience and the other is of a legal effect. For reason of the crucial legal effects of the place of arbitration, the parties have to be sure that they have chosen the best suitable jurisdiction as the seat of arbitration. The article will further analyse the concept of the seat of arbitration, its role, and importance in international commercial arbitration. It will also examine by reviewing the drawbacks of Nigeria as a preferred seat of international arbitration, particularly on the arbitration legislation and the respective judicial supervision and support in effectively conducting arbitration within the jurisdiction.

The introduction of planned economy in Russia after the 1917 October Revolution had a result that the whole economy was treated as one state owned organization. From 1922 the courts’ jurisdiction in cases between state owned enterprises was abolished and these cases were transferred to arbitration committees. On May 3, 1931 the state’s economic arbitration was established. It was separated completely from the courts’ system and was included into administration structures. It had nothing in common with the private arbitration and with the conciliatory proceedings. The state’s arbitration was an instrument of central planning and its activity were to strengthen the realization of economic plans. By doing it, the state’s arbitration performed two functions in the management of economy. It could pass legal acts on one side and on the other it considered the economic disputes between state institutions. From 1931 to October 1, 1991 (when arbitration was abolished) its functions have not been changed. The analysis of legal character of this institution causes problems and controversies among lawyers. The state’s arbitration was a hybrid. It was bounded with the administration and the arbitrators, very often not being lawyers, were not independent. From the other hand, the arbitration proceedings was somehow connected with the proceedings applied in the courts. Despite that, it should be treated as a separated proceedings. The state’s arbitration was an administrative, not judicial body.

The objective of this research paper is to explore and analyse mediation in the People’s Republic of China and in the Republic of China (Taiwan). The author also investigates the historical, philosophical and social origin of mediation and its development since the Han Dynasty. Mediation has a long tradition in China, and its importance can be traced back to the philosophy of Confucianism. Nowadays mediation is known as the key to resolving all disputes and linking it to the “harmonious society” political doctrine. There are currently a few types of mediation practices in China: mediation by People’s Mediation Committees outside the court, judicial mediation in civil disputes and minor criminal cases inside the court, mediation and arbitration of rural land contract disputes or mediation and arbitration in labour disputes. The importance of mediation is demonstrated by Article 111 of the Constitution of the People’s Republic of China, which provides that “People’s Mediation Committees are a working committee under grassroots autonomous organisations – the Residents Committee and the Villagers Committee – whose mission is to mediate civil disputes.” The Committees and the courts should also popularise, through mediation and arbitration, the laws and the policy and educate citizens to abide by the laws and respect universally accepted morals. As can be seen, owing to the government’s guidance on mediation procedures the number of cases settled through mediation has markedly increased. The statistics show that the parties not only resolve their dispute but are also willing to resort to mediation again. The high success rate of mediation is, among other things, due to the fact that it is a safe and neutral process, and the mediators’ role in facilitating resolution does not impose a solution. Another advantage of mediation is speed and effectiveness as well as a reduction of costs. This article also discusses the Taiwanese experience with mediation, as well as its development. To sum up it may be said that mediation in the People’s Republic of China and in the Republic of China (Taiwan) functions well and is increasingly winning trust of citizens.
