The purpose of this article is to identify the legal problems concerning agricultural land transactions and management as well as to try to solve these problems, namely to formulate de lege ferenda conclusions. First of all, the discussion focuses on the issues relating to a sub–lease of agricultural land in the context of the pre–emption right and getting the EU financial aid. Next, the paper indicates the problems concerning the pre–emption right that the lessees of municipal land have and the possibility these entities have to use tax preferences to enlarge their farms. Subsequently, the article presents the issue of building works on agricultural land which is part of the farm, especially the works done by individual farmers. The author, presenting the above problems, has tried to put forward de lege ferenda proposals, for instance granting the pre–emption right to a sub–lessee, granting tax preferences to lessees of municipal and private land in the case of enlarging the farms and the freedom to build family farms on agricultural land. In addition, the summary calls for adopting a new act on agricultural lease and for changing the scope of activity of the Agriculture Property Agency.

The lease, along with ownership, is the legal title of running and organizing farms. The purpose of the article is, first of all, to present the formation of legal regulations concerning the agricultural land lease and factors affecting this process and, secondly, to determine how the conclusion and execution of leases as a civil law institution is affected by the fact that the National Agricultural Support Center is a state legal person. The article begins with the presentation of the evolution and development of the lease regulations, referring to the Napoleon Code, the Code of Obligations of 1934 and the system of protection of small lessees in the interwar period. Then, the Author points out that since the State Land Fund was established, it has been possible to categorize the lease of agricultural land in Poland into, so-called, private and state one. Subsequently, the paper focuses on the Act of 19 October 1991 on the management of agricultural property of the Treasury, implementing regulations to this Act and the regulations of the General Director of National Agricultural Support Center. In the summary, the Author states that the lease has become an integral element of the development and evolution of agricultural law. In particular periods, political, economic and social factors influenced, to a large extent, the formation of legal regulations concerning the agricultural land lease. In comparison with the lease of private agricultural lands, the parties’ freedom to conclude an agreement for lease of real estate from the Agricultural Property Stock of the State Treasury, to determine its conditions and performance has been largely limited. Nevertheless, lease remains a civil law contract.

Opis:
Research on the effect of birch regeneration on changes occurring in the environment on former farmlands included a quantitative and qualitative analysis of the biomass growing on the research plots. Five experimental plots were selected in the Mazovia region: two in Dobieszyn and the Kampinos National Park and one in Kozienice. The analysis performed on each plot was concerned with the amount and chemical composition of biomass in four patches of vegetation, characterised by the different ages of the birch trees growing there. The vegetation patches were classified according to age group, i.e. I: 1–4 years old, II: 5–8 years old, III: 9–12 years old and IV: over 12 years old. Biomass samples were collected in the field and determined in kg DM/ha using the following components: roots, stem, bark,branches, assimilation apparatus, litterfall and the total biomass of the other (except birch) plants. For all the above-mentioned groups, the content of the elements N, C, S, Ca, K, Mg, Na, P, Mn, Cu, Fe, Zn, Pb, and Cd was determined. This allowed us to obtain both the values of the concentrations of particular substancesand their allocation in both the organic matter and litterfall. The aim of theresearch was to discover whether the allocation of elements changes with the age of birch growing on former farmland.

Niniejszy artykuł przedstawia badania związane ze zmianami, jakie zachodziły w ochronie gruntów rolnych począwszy od 2003 roku oraz wpływem jaki wywarła Ustawa z dnia 27 marca 2003 r. o planowaniu i zagospodarowaniu przestrzennym na te zmiany. Szczególną uwagę zwraca fakt, iż grunty rolne prawie za każdą nowelizacją prawa podlegają mniejszej ochronie prawnej, przez co są wykorzystywane na różne cele niezwiązane z rolnictwem, w tym budowlane. Przedstawione zostały wzajemne powiązania planowania przestrzennego oraz ochrony gruntów rolnych.
The paper showcases research regarding the changes that have occurred in the field of the protection of agricultural land since the year 2003, as well as the influence of the Spatial Planning Act of the 27th of March 2003 on these changes. Its chief focus is the fact that with each consecutive change of legislation, agricultural land becomes less and less protected, which results in its use for purposes other than agriculture, including construction. It also illustrates the mutual relationships between spatial planning and the protection of farmland.

Agricultural land abandonment is an elusive phenomenon, as yet not fully defined. Even though it is common in Polish landscape, there are no measures to date that could quantify the phenomenon. Neither the data from the Central Statistical Office, nor the data from land registers include information on land abandonment. Therefore, there is a need for a systematic approach that could quantify and determine the extent of land abandonment. A fieldwork approach was designed for the purpose, and research was conducted on a test area of Okocim village in Małopolska region. Vegetation cover that could indicate the existence of land abandonment on the agricultural areas – such as trees, brushwood, and grass cover – was examined using a representative sample of 145 test fields. The fieldwork approach revealed that the extent of land abandonment in the test area is 37% of all areas officially classified as agricultural, which shows that the scale of the phenomenon is significant, and that there is a need to develop an approach to provide a more detailed picture of the distribution of land abandonment.

Management of state-owned agricultural land in Poland lies with the Agricultural Property Agency (ANR) that is responsible for reasonable management of this property. Sales of agricultural land should aim simultaneously at both, interests of family farms and sustainable consolidation of agricultural land. The audit conducted by NIK at the Agricultural Property Agency in Pozna and at its branch in Pia has shown that there are numerous irregularities in the area, despite detailed legal regulations.

This article raises the issue of changes in the structure of agricultural land use in Poland and the Czech Republic since the accession of both countries into the structures of the European Union. An important question raised in this article is the analysis of changes in the area structure of agricultural holdings according to the adopted agricultural land groups. The analyses were based on the graphic method of analysing the concentration strength, i.e. the Lorenz curve, to determine the distribution of the number and surface area of agricultural farms in the given area groups and the percentage share of such farms in these area groups. Additionally, the Gini coefficient was calculated for the same phenomena, to measure the concentration (inequality) of the random variable distribution. The research showed the structural change trends in the agricultural area of the analysed countries as well as varied structural situation of agricultural holdings during the accession period. The condition translates into a slower pace of structural change of agricultural holdings in Poland and a faster process of enlarging the area of agricultural holdings in the Czech Republic.

Tracking and analysing economic and social changes in the agricultural sector is vital for decision makers, sectoral parties, professional and advocacy organisations and research institutions. Collected statistical data serve as a basis for domestic decision making and provide the foundation of strategy formulation in rural development, agro-environmental protection and sustainable agriculture. In the course of our research, analyses based on statistical databases were used to assess land use changes and land market prices. The structural survey of the Hungarian Central Statistical Office in 2013 shows that the proportion of business organisations utilising arable land grew 7 percentage points while individual farms increased their share by 2 percentage points. Our research shows that the concentration of land use increased demand for land and thus contributed to the increase in land prices.
Śledzenie i analiza zmian ekonomicznych i socjalnych w sektorze rolnym jest niezbędne dla osób podejmujących decyzje, organizacji zawodowych oraz instytucji badawczych. Zebrane dane statystyczne służą za podstawę do podejmowania lokalnych decyzji oraz formułowania fundamentalnej strategii dotyczącej rozwoju rolnego, rolnośrodowiskowej ochrony oraz rolnictwa zrównoważonego. W badaniach wykorzystano dane z bazy statystycznych, aby ocenić zmiany w użytkowaniu ziemi oraz jej cen rynkowych. Ze sprawozdania Węgierskiego Głównego Urzędu Statystycznego z 2013 roku wynika, że udział organizacji biznesowych użytkujących grunty uprawne wzrosła o 7 p.p., podczas gdy prywatne gospodarstwa rolne zwiększyły swój udział o 2 p.p. Badanie pokazały, że koncentracja gruntów zwiększa popyt na nie, ale przyczynia się także do wzrostu cen.

Under the act on personal income tax, any income gained due to the sale of a whole or part of immovable property being a part of an agricultural farm is free from income tax. However, this rule does not concern the income from the sale of the land, which, having been sold, lost its agricultural character. The article is devoted to the analysis of prerequisites deciding about tax exemption, which is based mainly on administrative courts decisions and explanations of fiscal bodies. Both the loss of the agricultural character of the property as well as the fact that this loss occurs in connection with a sale, arouse serious doubts. Income tax exemptions on the agricultural land turnover is to be evaluated positively, yet the prerequisites of these exemptions should be more precise.

The increasing risk of wind erosion in the context of climate change represents a highly pressing issue. This increase is a result of the growing occurrence of droughts and elevated temperatures in the intensively farmed areas. Effective protection against the wind erosion can be provided by windbreaks, especially during the period when the soil is not protected by the vegetation cover of crops. In this report, the authors wanted to compare the methods defining the windbreak protection zones. The optical porosity and the windbreak height were the basic parameters for defining the protection area. The various methods differ among themselves by using the windbreak height parameter or not. The optical porosity of the windbreaks was determined based on photographic documentation. For the comparison, the cadastral area of Micmanice was selected due to the wide network of windbreaks in this locality. A database of windbreak height and optical porosity for each windbreak was set up. Our report thus presents the application of the new knowledge aimed at updating the methods and procedures for assessing the vulnerability of the area by wind erosion. The application of the method involving the optical porosity and windbreak height parameters resulted in a significant reduction of the windbreak protection zone compared to the method omitting the windbreak height.

The purpose of the paper was to answer the question whether the legal regulations ensure an agricultural producer (lessee) sufficient stability in terms of farming, namely in terms of running a stable agricultural activity. According to the author of this article, this stability consists of two elements: ensuring the agricultural producer continuity of possession and enjoyment of the profits as well as guaranteeing manufacturing capacity of the subject of the agricultural lease. The article presents, among other things, the assessment of the influence of legal solutions included in Act of 16 September 2011 on changing Act on the management of agricultural property of the State Treasury on stability of the agricultural lease. It also analyzes questions relating to lease of private land and lease of land from the units of local governments. Moreover, the article focuses on the instruments protecting the manufacturing capacity of the subject of the lease, including EU regulations that make the obtaining of financial support subject to meeting numerous requirements concerning the treatments and maintaining good agricultural condition. The article also concentrates on the issues of amendments and improvements. In the final part of the article the author has stated that research has confirmed that the legal regulations do not protect farming on leased agricultural land in a sufficient way. The current legal regulations on agricultural land lease do not correspond to the requirements of present situation in Poland. Therefore, de lege ferenda proposal has been put forward to change the provisions relating to the agricultural land lease

The article highlights the problem of natural agricultural-land afforestation with insufficient forest cover of the area. The article purports to substantiate land consolidation aimed at the rationalisation of agricultural and forest land management in such conditions. The authors identify the main approaches to the issue of natural agricultural land afforestation. The afforested areas of agricultural land are suggested for redesignation as a forest resource as a result of a swap and reallotment of land plots. As an example, consolidation of available land, in the conditions of natural afforestation, has been accomplished based on a number of land masses in Chernihiv Oblast’, Ukraine. Resulting from the project implementation, better configuration and improved layout of agricultural land plots have been achieved, while the length and placement of country lanes have been optimized. The reforested agricultural areas within the specific land mass have been redesignated as a forest resource. The advantages and disadvantages of natural afforestation in land consolidation are identified in contrast to alternative approaches. The research findings can be used by territorial communities in the upgrade of land management practices, laying out and redesign of landscape parks and other nature conservation areas that include areas of business activity.

W artykule zawarto część wyników badań z drugiego rozdziału raportu modułowego „Kapitał fizyczny”. Raport modułowy został zrealizowany w ramach projektu „Zagospodarowanie infrastrukturalne i kapitał fizyczny oraz policentryczność rozwoju Mazowsza” (Trendy rozwojowe Mazowsza). W jednym z rozdziałów modułu, pt. „Kapitał fizyczny – majątek nieprodukcyjny”, znalazł się opis nieruchomości gruntowych, także gruntów zabudowanych i niezabudowanych (w tym działek budowlanych). W niniejszym artykule szczególny nacisk położono na wycenę użytków rolnych i leśnych, a także działek budowlanych w województwie mazowieckim. Wskazano, że województwo charakteryzuje się relatywnie wyższymi cenami użytków rolnych niż średnia dla Polski. Na Obszarze Metropolitalnym Warszawy w najbliższej dekadzie będą następowały procesy odrolniania gruntów, co prawdopodobnie znacznie zwiększy wartość majątku tej części Mazowsza. Najdroższe działki zlokalizowane są w Warszawie, a im dalej od stolicy – tym ceny nieruchomości są niższe. Wraz z oddalaniem się od stolicy maleje również ilość ofert i transakcji na rynku nieruchomości. Działki położone w niedalekiej odległości od głównych korytarzy transportowych, a także te zlokalizowane na terenach atrakcyjnych przyrodniczo, są znacznie droższe. W najbliższej przyszłości na rynku nieruchomości kluczowe będą trendy globalne.
In the article, some results from the second chapter of the report module “Physical capital” have been presented. The report module was implemented within the project “Development of infrastructure and physical capital and the development of Mazovia polycentrism” (Trends in Development of Mazovia). In one chapter of the module, entitled “Physical capital – non-productive assets”, there was a description of land properties, both built and inbuilt land (including building plots). In this paper, particular emphasis was placed on the valuation of agricultural land and forestry, as well as building plots in the region of Mazovia. It was indicated that the region is characterised by relatively higher prices of agricultural land than the Polish average. The Warsaw Metropolitan Area in the next decade will be followed the deagrarisation processes of land, which is likely to significantly increase the value of the assets of that part of Mazovia. The most expensive parcels are located in Warsaw, and the farther from the capital, the property prices are lower. With distance from the capital, also decreases the number of tenders and real estate transactions. Plots located in the vicinity of major transport corridors, as well as those located in areas with an attractive natural environment are much more expensive. In the near future, the real estate market will follow the key global trends.

Among the planners and representatives of the doctrine of agricultural law is still valid discussion about the proper zoning in rural areas. One of the legal instruments affecting the development of the space is to record land and buildings. Information from the register of land and buildings are used by the public authorities in all of these procedures, for which the legislator pointed to records as the basis for decisions. A special role of registry is in the context of local taxes and the tax on goods and services. Basis for assessment of local taxes are the data contained in the register of land and buildings. This means that the tax authorities are bound by the provisions of the records. If the allotment is classified in the records as arable land, then the authority shall issue a decision on the agricultural tax. It is important to relevance and accuracy of information placed in the records. This is particularly important for taxpayers who run a farm for which the legislator has provided for lower land tax and the exemption of farm buildings situaded on the property. Before 1 April 2013, if the land and buildings of a defined area was classified as agricultural land, in the case of delivery of this area (establishment of rights, sale, exchange) is not subject to tax on goods and services. However, in connection with the amendment of article 43 paragraph 1 item 9 Act on tax on goods and services registry ceased to be a priority for the benefit of the exemption from VAT. Introduced a new solution, according to which VAT exemption is subject to the supply of undeveloped land other than land for construction is not entirely accurate, so there are always new interpretation doubts. Undoubtedly Registry of land and buildings is not a source of domestic law or a source of universally binding law. It is the official registry confirms the established facts. So it performs the function of information and technical, reflecting the data that result from certain documents. Besides, the legislature and judiciary Administrative treat the information in the register of land and buildings as an undisputed source of law.

Agricultural land covers more than half the area of metropolitan areas in Poland, and is therefore particularly prone to the influences of the processes associated with their development. The aim of the study was to analyse changes in agricultural land cover within the metropolitan areas of Poland for the years 1990–2012; and to capture their dynamics, types and directions. The percentage share of the total study area, for each of the forms of agricultural land cover and their changes were traced, with the spatial distribution of the changes also being determined. The results of the study show that in metropolitan areas, agricultural land cover is undergoing transformations that do not result in the loss of agricultural lands, or that involve a decrease in surface area due to their change into anthropogenic forms of land cover. The greatest transitions occurred between 2000 and 2006 and were observed in the outer zones of metropolitan areas.

Space development has, in view of limited nature of the space and persistence of its effects, axiological dimension. The regulations governing development also intervene within the range of exercising property right, what is a source of conflict of interests and what touches the issue of justice. Development of a particular space can take place under one of two competitive legal regimes. One of the regimes is established by local development plans constituting acts of local law which is commonly in force within territories covered by such the acts. In a position of the absence of a local development plan the other of the regimes, determined by rules of the law of general public order, is applied. The referred rules make the basis for giving, under the administration procedure, individual decisions on determining conditions for site development. Agricultural lands located outside administrative borders of towns, constituting arable lands of I–III class, whose contiguous area purposed for change of development classification exceeds 0.5 ha are excluded from the opportunity to obtain such a decision (a permission for development). However, the exclusion does not refer to development which fails to lose agricultural nature of a land. The courts’ decisions represent the opinion that the surface limit refers to the area which effectively is to change the way of development, not taking into consideration the land from which it was earlier parcelled out, what without doubt decreases protection level of agricultural lands. Other dissimilarity connected with determining conditions for site development of agricultural lands is departure from the statutory rule of “good neighbourhood” in case of farmstead development in farms whose surface exceeds an average farm surface area in a commune.

The research paper covers the features of the socio-economic and environmental diagnostics of agricultural land use. Zoning is a kind of basis for the territorial record keeping of the natural conditions and resources, quantity, quality, as well as the production capacity of lands in the system of taxonomic units. It is a natural and historical basis for the placement of agricultural production, land valuation, the development of land use patterns, land management patterns and projects, farming and agriculture systems, etc. Natural zoning reflects the need for priority land use in the interests of the economy. It has an agrobioecological basis due to the peculiarities of agricultural production, the essence of which is the utilization of the solar energy by the plant organisms necessary to maintain the ecological stability of the territory. The authors used the methods of particle-size and chemical analysis, the methods of comparing indicators for zones with various types of agriculture and soils of the military sites under the influence of the man-made factors. The main socio-economic indicators characterizing the development of land use were analyzed. The concept of state policy forms in the valuation of unused lands of Krasnodar Krai was substantiated.

The study is dedicated to land reallotment in the course of land use alteration in Ukraine. The case of the development of an individual residential block in an agricultural area is considered. The issue of the alteration of the spatial characteristics of land plots and changes in their designated use have been highlighted. The objective of the article is the substantiation of land reallotment at the level of an individual residential block on agricultural land which is privately owned by a number of landowners. The preconditions for the development of land reallotment in a rural type settlement in the suburban area of a big city have been substantiated. Alternative approaches to land reallotment have been suggested. A comparative analysis of the suggested approaches and their practical approbation have been carried out. The change of land plot spatial characteristics in the course of reallotment by means of various reallotment scenarios has been analysed. Land plot value after reallotment in each scenario has been specified. The practicability of each approach depending on the initial conditions has been substantiated. The research can be used in the course of rural settlement development planning, the coordination of measures on land use type alteration with landowners and land users, with private landowners or the implementation of local community initiatives.

Realizując scalenie gruntów rolnych przebudowuje się bez wątpienia gruntownie strukturę wsi i wzbogaca ją o dodatkowe elementy projektowe np. nowe drogi czy ścieżki rowerowe. Jednocześnie poprawiana jest struktura obszarowa gospodarstw rolnych, zmniejszana liczba działek o nieregularnych kształtach, czy też zmniejszane są odległości pomiędzy siedliskiem a poszczególnymi działkami gospodarstw. Ponadto zapewniany jest każdej działce dostęp do drogi publicznej, urządzeń melioracyjnych, likwidowane są zaniedbane i nieuprawiane tereny wsi (tzw. nieużytki rolnicze). Jest więc scalenie dla obszaru wiejskiego przedsięwzięciem o charakterze innowacji rolniczej. Biorąc pod uwagę powyższe przesłanki można zauważyć, że ważne jest ustalenie zakresu realizacji tych przedsięwzięć na terenie Polski i województwa lubelskiego. Przeanalizowano także wykorzystanie środków na to przedsięwzięcie z Europejskiego Funduszu Rolnego na rzecz Rozwoju Obszarów Wiejskich (skrót: EFRROW). W Badaniach zakresu prac scaleniowych uwzględniono okres 2004-2013. Dodatkowo uwzględniono prognozę realizacji scaleń na lata 2014-2020 dla województwa lubelskiego. Wybór jednostki badawczej wynikał z możliwości pozyskania danych do analizy oraz faktu, iż w województwie lubelskim realizowanych jest najwięcej tych prac urządzeniowo-rolnych. W badaniach wykorzystano metody analizy ilościowej oraz z grupy podejść przestrzenno-statystycznych.
Land consolidation projects are perfect tools for rural development. Land consolidation can be described as planned readjustment of land ownership patterns with the aim of creating larger and more rational land holdings. Other goals of land consolidation include infrastructural improvements and the implementation of developmental and environmental policies. Such activities have been implemented all over the world for many years. Owing to those experiences, we contribute to development of rural areas in an increasingly efficient way. Definition of innovation as well as features of the consolidation procedure and their individual character permit calling consolidation an agricultural innovation. Consolidation of agricultural land should be realized in the areas which have flaws in surface structure but which are willing to carry out the activity in their areas. The fact that the procedure of consolidation of agricultural land in Poland (financed from the European Union funds and the Budget) is free of charge should be encouraging. Is it possible to explain the spatial distribution of implemented consolidations? The study area covered Poland in general analyses, particularly the Lubelskie voivodship. The research employed the following methods: analysis and synthesis of the literature, field inventory, and research from the group of spatial-statistical approaches.

The change in the use of agricultural and forestry land for other purposes is the natural process of rural areas urbanisation. In the municipalities located nearby large cities, this transformation is inevitable and indeed desirable, while in the municipalities located close to the protected areas, it is a symptom of negative processes, especially from an environmental perspective. Moreover, such transformations have many other economic and social consequences which are worth paying special attention to. This paper is an attempt to determine the level of negative changes introduced in the planning documents in municipalities located within the borders of National Parks. The indicator analysis based on the statistical data of local date bank [BDL] in the fields of local government and spatial planning was conducted. The analysis enabled to present the differences between municipalities with very high natural values in terms of decreasing the area of agricultural and forestry landscape. Furthermore, to elaborate the typology of the studied administrative units the obtained results were verified by comparing them with recommended percentage share of forest and agricultural lands which potentially guarantee good conditions for the development of tourism in rural municipalities.

Ziemi rolnej przypisuje się wiele funkcji – jest zasobem zarówno gospodarczym, jak i przyrodniczym, kulturowym oraz symbolicznym. Wielofunkcyjność ziemi rolnej może jednak rodzić konflikty dotyczące jej wykorzystania, a te z kolei znaczne skutki ekonomiczne. Ekonomiści w swoich pracach nie podejmują jednak zazwyczaj tematu konfliktów. Celem pracy jest wypełnienie tej luki. W artykule przedstawiono koncepcje ekonomiczne, które mogą być wykorzystywane do badania konfliktów interesów związanych z użytkowaniem ziemi rolnej. Niniejsza praca koncentruje się na zagadnieniach metodologicznych i ma charakter przeglądowy. Wśród różnych szkół i teorii, które są przydatne w ekonomicznej analizie konfliktów, zwrócono szczególną uwagę na nową ekonomię instytucjonalną i teorię wyboru publicznego, które często są wykorzystywane także przez ekonomistów rolnictwa oraz środowiska i zasobów naturalnych. W artykule wskazano na duże znaczenie instytucjonalnych ram funkcjonowania rynku ziemi, w tym relacji kontraktowych i regulacji publicznej. Pokazano także, że ekonomia oferuje narzędzia do badania konfliktów na różnych płaszczyznach dzięki zwróceniu uwagi na odmienne interesy i zasoby ekonomiczne różnych aktorów oraz relacje między teraźniejszymi a przyszłymi potrzebami społeczeństw. Przedstawione zostały przykłady badań empirycznych na temat konfliktów dotyczących ziemi rolnej w Polsce.
Agricultural land plays several functions; it is both an economic resource and a natural, cultural, and symbolic asset. The multifunctionality of agricultural land may, nevertheless, give rise to conflicts over its use and, as a result, generate significant economic costs. However, economists usually do not investigate conflicts. The purpose of this paper is to fill this gap. The article focuses on methodological issues and outlines economic concepts that may be valuable to study land-use conflicts. Among the various approaches and theories that are important in the economic analysis of conflicts, special attention is paid to new institutional economics and public choice theory, which are often used by agricultural as well as environmental economists. The article highlights the importance of the institutional framework for a well-functioning land market. It concludes that economics can offer tools for studying conflicts by paying attention to the distinct interests and economic resources of different actors, as well as the relationship between present and future social needs. The paper also briefly reviews recent empirical research on landuse conflicts in Poland.

Agricultural land is facing challenges due to different human activities. Accelerated urbanisation along with explosive economic growth has further worsened the shortage of agricultural land over the last two decades. Kosovo, a country with small areas suitable for agriculture is meeting challenges due to unplanned settlement extension, coal surface mining, parcelisation of properties, etc. This paper consists in an analysis of the agricultural land fund in Kosovo, in quality, production potential and food security for the population, but also the challenges facing Kosovo with this strategic resource. The article analyses three main factors that have made the biggest changes in agricultural land in Kosovo: the effects of settlement extension, coal surface mining and parcelisation in reducing the soil fund. Some of the effects have triggered significant socio-economic processes that have changed the rural environment. Other important risks of agricultural land in Kosovo are: pollution, landfills, frequent floods, etc.

Desagrarization is an ambiguous, multifaceted notion and at the same time difficult to define. As a research subject it concerns mainly agriculture and is generally defined as the process of reducing the contribution of agriculture to the Gross Domestic Product. In terms of spatial changes caused by desagrarization, it is the reduction of agricultural land, increase in fallow land and woodiness, and uncontrolled landscape changes. The article seeks to present the spatial effects of the desagrarization process in the Polish rural areas. The results of the research were achieved by adopting the Shift-Share Analysis. The study confirmed that desagrarization manifests itself in changes both historical and global in character and the state interventionism and Common Agricultural Policy are limited to reducing in time its spatial and economic negative effects.

The study examined the relationship between agricultural land use and population growth rates from 1961 to 2018 in Nigeria. Secondary data were obtained from Food and Agricultural Organization and the World Bank. Descriptive statistics, trend equation and correlation analyses were used. Findings revealed that agricultural and arable land utilization grew at the rate of 0.62% and 0.72%, respectively per annum; while the total population growth rate stood at 2.57%. Also, urban and rural population grew at a rate of 4.75% and 1.67% respectively. In addition, the agricultural and arable land utilization rates had significant positive correlations with the total population, urban and rural population. Besides, the findings revealed that, agricultural land (to total land ratio) has continued to increase and currently averaged at 68.78% indicating massive land expansion put under agricultural used. Findings revealed that, most arable crop outputs increase majorly from land expansion rather than land productivity, a situation that cannot assure sustainable agricultural land use food security in a near future. Hence, the country needs agricultural land sparing policies and technologies to slow the current agricultural land expansion drive. Besides, the country’s agricultural land policies should focus on achieving land productivity and sustainable land-sharing strategies among major land users in the country. Again, the rural population growth rate is lower than the urban growth rate, implying that, the rural population is deteriorating with its probable negative effect on farm labour. This needs to be addressed urgently if the sustainable agricultural system is to be achieved in the near future in Nigeria.

The fertilizer management is one of the greatest challenges of agriculture in the 21st century. The growing demand for food, along with the similar amount of arable land, creates the necessity of increasing the crop yields in a given area. Due to the fact that the production and use of mineral fertilizers often influence the environment in a negative way, for many years more attention has been paid to natural and organic fertilizers. Their advantage is the transfer of not only organic matter but also nutrients to the soil. In connection with the structural changes in agriculture, the production of natural fertilizers, especially manure decreases, but at the same time, the production of other organic fertilizers, e.g. composts or biochar increases. The aim of the work was to present the possibility of using biochar in the production of organic fertilizers. Moreover, the project concept for obtaining an organic fertilizer containing biochar and its application in the processes of biological transformation of waste was presented.

In the 1990s, and at the beginning of the 21st century, the farm structure in Wielkopolska Province improved in terms of area. At the same time, however, an increase in land fragmentation was noted. The main reason for the unfavourable trend in land pattern observed within the study area was farmland purchasing. Apart from increasing the farm area, land purchases added irregularity to the land pattern, which became increasingly scattered, as purchased land was often located at a considerable distance from the main farm. The scattering of the land pattern can be reduced through land consolidation. Initiatives of this type are supported by the EU funding instruments. A study of the “historical land consolidation” in Brudzewek village, the first EU-funded project of this kind in Wielkopolska, shows that the undertaking is an example of effective use of EU funds. Post-consolidation activities helped to improve the condition of existing infrastructure (roads, land drainage), and expand it. The process of land consolidation in Brudzewek proved to be difficult to carry out, and affected by a wide array of factors. It showed that the major obstacles in the implementation of similar initiatives were the human factor and the availability of funds. Similarly to other regions of Poland, Wielkopolska requires the launch of large-scale land consolidation projects. Unfortunately, the process entails high costs, and calls for comprehensive solutions for the spatial development of consolidated areas. To be successful, it requires changes to the agricultural policy and its regional diversification. Also needed are an increase in funding from the state and local governments, and rational use of available EU funding opportunities. Without them, the consolidation process is unlikely to take place on a larger scale.
W Polsce systematycznej poprawie struktury obszarowej gospodarstw, towarzyszy coraz intensywniejsza fragmentacja gruntów. Skutecznym sposobem ograniczania szachownicy gruntów są scalenia. Tego typu prace były wspierane przez PROW 2007–2013 (Działanie 125. Poprawianie i rozwijanie infrastruktury związanej z rozwojem i dostosowaniem rolnictwa i leśnictwa). W artykule dokonano próby oceny wpływu środków unijnych na organizację przestrzenną gruntów we wsi Brudzewek, położonej w gminie Chocz (powiat pleszewski w województwie wielkopolskim). Analizie poddano również proces rozwoju szachownicy gruntów w województwie wielkopolskim.

The purpose of this study is to analyse the use of agricultural land on the territory of united communities and their individual districts of Zhytomyr region as the smallest units of the administrative territorial division of Ukraine. The relevance of this study, due to current changes in national land relations, dictates the need to have information about agricultural lands, their owners, tenants and the lands status for planning agricultural production, the land-leases development, sale of land. The analysis of land use was carried out according to the following indicators: location of land plots of all owners within the community district and the whole community; their area; monetary evaluation; status of documents for each land plot, in particular the availability of lease, land cultivation presence. The initial data of the researches is the data of the state land cadastre database, and data of the real property rights register, both in general access and in need of special access. As a result of the research there were defined areas and location of lands of some landowners, who leased their lands and areas of lands not leased, also there were defined areas of lands, used illegally, without any documents on land use, defined areas of lands, used or owned by agricultural producers (farms, physical persons, legal entities). A cartographic core was created for the purpose of convenient planning of agricultural land use and land management within selected districts on the territory of the community.

Agricultural land market in Hungary is in process of development, the prices of land is times lower compared to land prices in old member states of the EU. Because of their lower income Hungarian nationals do not have substantial possibilities to acquire ownership over land like nationals of the old member states of the EU. In order to preserve the agricultural sector from shocks that might arise from the differences in land prices and income with the rest of EU, Hungary as the others Central and Eastern European new member states countries (the Czech Republic, Estonia, Latvia, Lithuania, Poland and Slovakia) during the accession negotiations in 2003 was granted the possibility to maintain existing national provisions restricting the acquisition of agricultural land or forests. Based on the data provided by the Hungarian Farm Accountancy Data Network and by the Hungarian Central Statistic Office the authors examined the specific impacts of factors influencing on arable land prices.
Na podstawie danych z węgierskiego FADN i Centralnego Biura Statystycznego zbadano szczegółowe oddziaływanie czynników wpływających na ceny gruntów ornych w różnych regionach Węgier. W badaniach prowadzonych przy pomocy analizy regresji wielokrotnej wykazano, że na ceny gruntów ornych wpływają różne czynniki, w zależności od regionu Węgier.

The main aim of the work is to present legal procedures related to the transformation of agricultural land into non-agricultural land in Poland. Based on the analysis of selected legal regulations, activities and steps to be taken to start non-agricultural land use have been described. Both stages related to the transformation, i.e. change of land use and exclusion of land from agricultural production, have been extensively discussed. Interpretation of selected legal regulations made it possible to organize information on the procedure for transforming agricultural land into non-agricultural purposes. Moreover, on the basis of selected statistical data, the legal aspect has been supplemented with information on the current level of conversion of agricultural land in Poland.
Podstawowym celem pracy jest przedstawienie procedur prawnych związanych z przekształcaniem gruntów rolnych na cele nierolnicze w Polsce. Na podstawie analizy obowiązujących regulacji prawnych wskazano i opisano czynności, jakie należy podjąć, aby móc rozpocząć nierolnicze użytkowanie gruntu. Omówiono zarówno zmianę przeznaczenia gruntów, jak również wyłączenie gruntów z produkcji rolnej. Interpretacja wybranych przepisów prawa umożliwiła uporządkowanie procedury przekształcania gruntów rolnych na cele nierolnicze. Dodatkowo, na podstawie wybranych danych statystycznych, aspekt prawny uzupełniono informacjami na temat aktualnego poziomu „odralniania” gruntów w Polsce.

Chemical fertilizer use is highly increasing in farming activity, and the process has a significant impact on soil quality and pH which is the measurement of the acidity or alkalinity. Therefore, soil pH is the main variable because it regulates plant nutrition availability by controlling the chemical forms of various nutrients in agricultural activity. This research aims to find out the excessive use of chemical fertilizers & dynamic soil pH on agricultural land. The primary data had collected by using questionnaires, interviews, Focus Group Discussion (FGD) and soil testing. For the soil testing experiment, simple random sampling method was used to collect the sample in 11 agricultural continents using GPS technology to identify the land location and 22 soil samples were collected based on pre and post applied chemical fertilizer stage. In order to pH value were tested from the collected soil samples. Accordingly, the data were analyzed by ArcGIS 10.3 using the IDW technique. Therefore, the results find out the condition of soil quality during the pre-chemical fertilization, 9% of the land found to be slightly acidic, 27% of the land with neutral soil structure and 15% of the land with salinity soil structure. During the post-chemical fertilization, 9% of the land was found to be moderately acidic, 41% of the soil was found to be strongly acidic, 32% of the soil highly acidic and 18% of the land be moderately pH. The result of the study shown, chemical fertilizers use highly impact on soil quality and agricultural land productivity.

30 April 2016 saw the entering into force of the Act of 14 April 2016 on the Suspension of Sale of Land of the Agricultural Property Stock of the State Treasury and on Amending Numerous Acts . The amendments pertained to, inter alia, the Act of 11 April 2003 on the Formation of the Agricultural System , and introduced a variety of alterations thereto, thus restricting significantly the freedom of trading in agricultural land. This article provides an analysis of conformity of Polish legislation with European Union legislation and also explains the liability of the State Treasury in case of violations of EU law.

The legal structure of agricultural property has been the subject of discussion in the doctrine of agricultural law and the matter of numerous court decisions. This issue, however, still raises a lot of controversies. The problem occurs in the Civil Code regulation itself (art. 461 of the Civil Code), in which the concepts of agricultural real estate and agricultural land were wrongly identified. It should be clearly indicated that only agricultural property is a category of ownership, while this attribute does not refer to the notion of agricultural land. It should also be noted that there is no criterion of area in the Code definition of agricultural real estate. From such a perspective, it is difficult to reconcile the possibility of conducting manufacturing activity in agriculture with the use of any agricultural property regardless of its area. Besides, the weakness of the spatial planning system makes the determination of the nature of property, in particular when it loses its agricultural character, a very complicated process. Despite the mentioned shortcomings of the legal regulation, the Code definition of agricultural property should be universal and common. However, modifications of this definition introduced in specific provisions make use of multiple regulations dysfunctional.

Re-structuring of rural spaces is essential for continued sustainable development of these areas. The space-management tool of land consolidation can be used to obtain desirable structural changes, but only if it is systematically implemented and becomes a permanent element of long-term rural management policies of provincial self-governments. Land consolidation and exchange measures should be introduced comprehensively and should be coupled with post-consolidation development of land. Only then can they contribute to the multifunctional development of rural areas. In our previous studies, in order to identify the areas with the greatest defects in the spatial structure which needed land consolidation and exchange most urgently, we carried out the investigations which allowed us to select appropriate factors for identifying such groups of villages. The ranking was established using Hellwig’s synthetic index of development and the zero unitarisation method. This article presents the results of the research carried out in 36 villages of the Opoczno commune, occupying a total area of 16,590.51 ha, divided into 41,990 cadastral plots.

The subject of the considerations presented in the article is the shape of modern regulations on the protection of agricultural land. The analysis is conducted primarily in the field of protective provisions regarding the so-called quantitative and qualitative protection of agricultural land, as well as economic instruments correlated with these provisions for the protection of agricultural land. Other regulatory areas, including predominantly the existing and discussed solutions of European Union law regarding closer linking of agricultural producer support instruments with requirements in the field of environmental protection, within the scope of the so-called conditionality and greening. The subject of the study is not only the analysis of traditional directions of agricultural land protection as a means of production in agriculture, but also an attempt to determine the areas and directions for further development of this regulation.
Przedmiotem rozważań prezentowanych w artykule jest kształt współczesnej regulacji dotyczącej ochrony gruntów rolnych. Analiza prowadzona jest głównie w zakresie przepisów ochronnych dotyczących tzw. ochrony ilościowej i jakościowej gruntów rolnych, a także skorelowanych z tymi przepisami instrumentów ekonomicznych ochrony gruntów rolnych. Przedmiotem rozważań są również inne płaszczyzny regulacyjne, w tym przede wszystkim istniejące i dyskutowane rozwiązania prawa Unii Europejskiej dotyczące ściślejszego powiązania instrumentów wsparcia producentów rolnych z wymaganiami w zakresie ochrony środowiska naturalnego, w zakresie tzw. warunkowości i zazieleniania. Przedmiotem opracowania jest zarówno analiza tradycyjnych kierunków ochrony gruntów rolnych jako środka produkcji w rolnictwie, jak i próba określenia płaszczyzn dalszego rozwoju tej regulacji.

Agricultural land use and land cover dynamics were investigated in the Araban district of Turkey during the periods 1984–2019 by the use of Remote Sensing and Geographic Information Systems (GIS). Landsat TM and Landsat TIRS / OLI satellite imageries were used to determine land use and land cover changes. Using unsupervised classification method of ERDAS 8.3 software, three main agricultural activities were identified namely irrigated farming, dry farming, and horticultural / garden farming. The analysis has revealed that during the last three decades dry farming has decreased significantly by 14.69% (3802.14 ha) whereas horticultural/garden crops and irrigated farming lands have increased by 11.32% (667.19 ha) and 2.51% (2929.41 ha) respectively. Araban has been under intensive agricultural use due to its fertile soil and preference for horticultural crops such as pistachio, grapes and olives that provide more profit over dry farming crops such as wheat and barley has changed land use. Decrease in dry farming in a semi arid climate where Araban is located, has a potential ecological consequence, including a rapid drop of groundwater level, drying of wetlands and the disappearance of the biodiversity, thus, a necessary measures should be taken to implement an environmentally friendly, sustainable agriculture and settlement plan.

The intensive development of industry generates a number of negative consequences, which leads to an ecological crisis. As a result, the soil on which plant products are grown is polluted by radionuclides, heavy metals, pesticides, and chemicals. That is why in the early 1960s, the alternative farming, which is also called biological, biodynamic or organic, began to develop in Europe. The movement for alternative farming is widely developing in industrialized countries with a high level of chemization of agriculture. Therefore, the proposed topic is extremely relevant in terms of rational nature use, ensuring the sustainable development of territories, as well as food security in Ukraine. The article deals with agroecological assessment of suitability of agricultural land of the Steppe Zone of Ukraine for ecological farming and bases on the modern data from the Kherson branch of the state institution “Institute of Soil Protection of Ukraine”. Spatial modeling of the presence of nutrients in the steppe soil of Ukraine was made by the means of ArcGIS 10.1 product. Taking into account the obtained data and spatial modeling, the territories with soils of limited suitability for ecological farming occupy 67.2% (1194.5 thousand hectares) of the Kherson region, unsuitable soils are located on 16.7% (297.4 thousand hectares) of agricultural land of the Steppe Zone of Ukraine and suitable lands were detected on 16.1% (286.2 thousand hectares) of the territory of the studied lands. The conclusion was made that with the actual availability of lands occupied under ecological farming (4.3% or 75.9 thousand hectares), the territory of the Steppe Zone of Ukraine has a prime potential to increase the area under ecological farming by 4.2 times. Therefore, the article paid attention to ecological farming, taking into account the specifics of the content of trace elements in the steppe soils and their compliance with the methodology for determining whether soils belong to the categories of suitable, limited-suitability and unsuitable for ecological farming.

The purpose of the article is to indicate and assess the impact of the legal regulations specifying the rights and obligations of the owner of agricultural land with trees and forest land included in the farm in the context of the activity conducted on that farm and environmental protection. The issues in question are wide, therefore the article focuses primarily on the afforestation of agricultural lands. It presents the evolution of legal regulations and the rights and obligations of agricultural producers who have afforested, including the maintenance of forests. The paper refers also to the law on the protection of agricultural and forest lands. Additionally, the paper discusses the permission to remove trees from the farmland and selected regulations concerning the subject of trees in the farms in the civil code and tax laws. In the conclusions the author states that the legislator tries to support, on the one hand, the protection of the environment (e.g. enlarging the forest area, quantitative and qualitative protection of forest land) and, on the other hand, the activity of an agricultural producer in this area by means of financial instruments (financial means related to afforestation of agricultural land, tax exemptions, compensation for obligatory afforestation or shrub planting).

In the upcoming years Hungarian agriculture faces new challenges due to the forthcoming liberalization of the land market. Hungary, similarly to most newly accessed EU member states, requested and received temporary suspension from opening the Hungarian land market to foreigners and business entities because it was considered important to give domestic private farms, which were not strong enough at that time, the chance of land purchase. This moratorium is drawing to a close now. Although – as it was expected – the price of Hungarian land gradually started to increase following the accession to the European Union, it is still below EU average, which can be a source of many serious problems. Based on this situation, the aim of this study is to highlight factors which might cause differences between land prices in Hungary and Western Europe. To do this, analyses are made on farm-level data from the Research Institute of Agricultural Economics (AKI), using the methodologies of partial yield factor calculation and the classical determination of land value.
Węgierski sektor rolny w najbliższych latach będzie musiał stawić czoła nowym wyzwaniom w związku z nadchodzącą liberalizacją rynku ziemi. Węgry, podobnie jak nowo zrzeszone państwa członkowskie UE, zażądały tymczasowego zawieszenia obowiązku otwarcia węgierskiego rynku ziemi dla obcokrajowców oraz jednostek biznesowych. Uznano bowiem za bardzo ważne, aby dać szansę nabycia ziemi rodzimym prywatnym gospodarstwom rolnym. Mimo że ceny węgierskich gruntów rolnych zaczęły powoli wzrastać, to nadal kształtują się poniżej średniej europejskiej. Celem badań było przedstawienie tych czynników, które mogą powodować różnice między cenami ziemi na Węgrzech i w zachodniej Europie. Analizę przeprowadzono na podstawie danych z gospodarstw domowych zebranych przez Instytut Badawczy Ekonomii Rolnej (AKI), używając metodyki częściowego obliczenia współczynnika wydajności i klasycznego sposobu określenia wartości ziemi.

The paper reviews the concept of sustainable development, indicating its various dimensions. Natural environment in developed countries became almost entirely anthropogenic. Under such conditions, the way of using natural resources has to change as well. It is forced by the new needs and priorities described above, i.e. a demand for an assurance concerning renewability of natural resources as well as pro-social and pro-environmental criteria of the resources allocation. The fundamental objective of the paper is an attempt at elaboration of the new land rent concept and fi nd the answer to the question: Does a land need capital stimulus to be productive in a sustainable development? Authors formulated the hypothesis: the reason for the land rent to occur are intrinsic land utilities which in the commodity money economy cause the expected productivity of capital factor in agriculture to be higher than in its market environment. Therefore, the value of land rent is determined by a positive difference between the expected productivity of capital in agriculture and in its market environment.
W artykule przedstawiono koncepcję zrównoważonego rozwoju, wskazując jego różne wymiary. Środowisko naturalne w krajach rozwiniętych stało się niemal całkowicie antropogeniczne. W takich warunkach sposób wykorzystania zasobów naturalnych powinien także się zmienić. Związane jest to z nowymi potrzebami i priorytetami opisanymi w artykule, czyli zapotrzebowaniem na zapewnienie dotyczące odnawialności zasobów naturalnych, jak również prospołecznymi i proekologicznymi kryteriami alokacji zasobów. Podstawowym celem artykułu była próba opracowania nowej koncepcji renty gruntowej oraz odpowiedź na pytanie, czy ziemia potrzebuje dodatkowych nakładów kapitału w formie bodźca, aby utrzymać produktywność pieniężną w warunkach zrównoważonego rozwoju. Autorzy sformułowali hipotezy: powodem występowania renty ziemi są samoistne użyteczności czynnika ziemi, które w gospodarce towarowo-pieniężnej powodują, że oczekiwana produktywność kapitału w rolnictwie jest większa niż w jego otoczeniu rynkowym. W związku z tym, wartość renty gruntowej jest zdeterminowana pozytywną różnicą między oczekiwaną produktywnością kapitału w rolnictwie i jego otoczeniu rynkowym.

In the economic studies models based on panel data are increasingly used. The standard panel models are composed of a cross-section character of the data in the time, but do not include the interaction associated with the location of objects in the geographic space. Spatial panel models are based on the information contained cross-section data in the time with regard to space. The paper proposes a different approach to the changes in time on the basis of spatial matrix weight. The aim of this study was to show the possibility to apply spatial weights matrix with particular consideration of time. Data for the analysis came from the database of the CSO and the ARMA in period 2004-2012. In addition to working methods of spatial statistics classical taxonomic methods were also used to obtain a distance matrix.

The recent deterioration of the ecological condition of agricultural lands, the tendency of reducing soil fertility, and the production of plant products, mostly of low quality, necessitate an understanding of the role of trace elements in the process of plant formation. The content of trace elements in soils affects the efficiency of absorption of basic nutrients by plants. Deficiency of iron, manganese and zinc reduces the supply of nitrogen to plants. Copper and calcium promote the absorption of phosphorus by plants, but excess of iron inhibits it. Excess of copper and molybdenum reduces the transfer of potassium to plants. Due to high yields of agricultural crops, a significant amount of trace elements is removed from the soil, so the introduction of the optimal amount of trace elements against the background of high agricultural technology is an additional measure to increase the yields and quality of agricultural products. Heavy metals are an important environmental factor, which, on the one hand, is necessary for living organisms, and on the other (with increasing concentration of these elements in the environment) constitutes a negative factor in their lives. The activities of industrial enterprises, car exhausts and other attributes of civilization, increase the content of heavy metals in soils and as a consequence negatively affect their quality. The term “heavy metals” is used for the metals with a specific gravity exceeding 5 g/cm3 or an atomic number of more than 20. Among them, lead and cadmium are considered the most dangerous. Therefore, modeling the content of trace elements and heavy metals in the Steppe soils of Ukraine is an additional mechanism for quality control of agricultural land and, as a consequence, of obtaining quality products to ensure food security of the state.

The purpose of this article was to evaluate the procedure for excluding land from agricultural production in the context of disclosing land use changes in the land and building records. In order to examine the problem presented, a descriptive analysis of existing legal acts and publications was performed, and a case study was analized. The research was based on data from 2010-2019 obtained from the District Eldership and District Center of Geodetic and Cartography Documentation in Kazimierza Wielka (Świętokrzyskie Voivodeship). The work presents subsequent stages related to the disclosure of changes in land development created on the land as a result of the start of the investment process. Attention was drawn to the extension of the investment process by the applicants for excluding land from agricultural production. Studies have shown that only 15% of decisions authorizing the exclusion of land from agricultural production in the Kazimierz District in the years 2010-2018 were actually implemented and completed with updating the land and building records. However, this is not a value corresponding to the real number of excluded areas, because based on the field interview, it can be indicated that only on 12% of the analyzed plots, the investment process was not started on the land. This is primarily due to the obligation to pay a fee for the sole exclusion of land from agricultural production, but also to a change in the method of calculating the tax from agricultural tax, to a several times higher property tax.

The purpose of this paper is an attempt to present the impact of the economic size of farms on the range of support measures of the European Union Common Agricultural Policy. Detailed analyzes were conducted on the example of direct payments and payments for areas with unfavourable farming conditions (LFA). Their amount was considered in relation to farm income. The analysis covered the year 2011. In relation to the total amount of the analyzed farms, CAP support the EU in 2011 was 43.7% of farm income. The basic elements of support from the EU CAP payments were direct payments and payments for less favoured areas. They created respectively 74.3% and 9.9% of the total support. The increasing impact of these measures on income is observed year by year.
Celem niniejszego opracowania jest próba ukazania wpływu wielkości ekonomicznej gospodarstwa na zakres wsparcia środkami Wspólnej Polityki Rolnej UE. Szczegółowej analizie poddano płatności bezpośrednie i płatności dla obszarów o niekorzystnych warunkach gospodarowania (ONW). Ich wielkość rozpatrywano w relacji do dochodu z gospodarstwa rolniczego. Analizą objęto 2011 rok. W odniesieniu do analizowanych gospodarstw ogólna kwota wsparcia w ramach WPR UE w 2011 roku stanowiła 43,7% dochodu z gospodarstwa rolniczego. Podstawowymi elementami wsparcia ze środków WPR UE były płatności realizowane w ramach dopłat bezpośrednich i płatności dla obszarów o niekorzystnych warunkach gospodarowania. Stanowiły one odpowiednio 74,3% i 9,9% ogólnego wsparcia. Z roku na rok obserwuje się zwiększanie oddziaływania tych środków na dochody.

The paper analyzes legal regulations and statistical data on a lease and assesses their infl uence on structural changes in agriculture. Next, it presents the issue of lease in the context of the theory of institutional economics (in the framework of old and new institutional economics). The research has proved that a lease is an effective instrument of structural changes in the Polish village helping not only to create and enlarge the new farms but also to modernizing the existing ones. Currently, a lessee of agricultural land is an entity which, in order to run an effective business activity, has to conclude various agreements, file applications, invest. The development of a lease is part of a theory which promotes the image of an entrepreneurial person, entangled in social and institutional relationships, who enters into various agreements.
W ramach artykułu przeprowadzono analizę regulacji prawnych dotyczących dzierżawy i danych statystycznych oraz dokonano oceny ich wpływu na zmiany strukturalne w rolnictwie. W dalszej kolejności rozważania koncentrowały się na przedstawieniu zagadnienia dzierżawy w aspekcie teorii ekonomii instytucjonalnej (definicja instytucji w ramach starej i nowej ekonomii instytucjonalnej). Badania wykazały, że dzierżawa jest efektywnym instrumentem zmian strukturalnych na polskiej wsi, przyczyniając się nie tylko do powiększania i tworzenia nowych gospodarstw, ale także modernizacji istniejących. W obecnych czasach dzierżawca gruntów rolnych to podmiot, który aby prowadzić efektywną działalność rolniczą musi zawierać różnego rodzaju umowy, składać wnioski, inwestować. Poza tym w coraz większym zakresie musi dbać o dobra publiczne, czyli zachowanie wymogów w zakresie ochrony środowiska. Rozwój dzierżawy wpisuje się w nowe teorie ekonomii oraz w zrównoważony rozwój rolnictwa i obszarów wiejskich.

W pracy przedstawiono analizę struktury użytkowania gruntów i użytków rolnych zlewni rzeki Szreniawa w latach 1995-2005. Badany obszar podzielono na pięć zlewni cząstkowych. Obliczono wskaźniki: darniowo-leśny - określający stopień trwałego pokrycia obszaru zlewni roślinnością oraz użytków zielonych - określający relacje między użytkami zielonymi a rolnymi. Wykazano, że struktura użytkowania terenu na obszarze zlewni Szreniawy jest niekorzystna ze względu na ochronę gleby i środowiska wodnego. Cała powierzchnia omawianego obszaru była tylko w około 10% pokryta trwale roślinnością leśną i darniową, a grunty orne stanowiły aż 91,3% użytków rolnych. Przeobrażenia strukturalne w ciągu okresu badań były niekorzystne i polegały na zwiększeniu powierzchni gruntów ornych. W tym rejonie, o wysokim stopniu zagrożenia erozją wodną, konieczne jest podjęcie działań mających na celu wprowadzanie programów rolnośrodowiskowych w zakresie ochrony gleby i wody.
In the paper an analysis of land use pattern and agricultural land structure in the catchment area of the Szreniawa River was presented for the years 1995–2005. Studied area was divided into five partial catchment areas. The indices such as: the grass turf - forest index which determines the degree of permanent vegetation cover in the catchment and the grassland index, which describes the relations between grasslands and agricultural lands (AL) were estimated. It was shown that the catchment area of the Szreniawa River was characterised by unfavourable land use pattern in view of soil and water protection. The whole study area was permanently covered by woody and grass-turf vegetation in only 10% and arable lands constituted as much as 91.3% of agricultural lands. Structural changes during the study period were disadvantageous and consisted in an increase of the area of arable lands. In this region seriously threatened by soil erosion it is necessary to undertake the activities aimed at implementing agro-environmental programmes in soil and water protection.

The article presents data for the prices of good, medium and low land from 1999 to 2012. In addition to the price of land, direct subsidies are also considered. Direct subsidies have been taken into account in accordance with the award period 2004-2012. The data used in this analysis come from the Central Statistical Office (CSO) and from the Agency for Restructuring and Modernization of Agriculture (ARMA). The aim of this study was to compare the diversity of spatial concentration of agricultural land prices in the years 1999-2012, taking the quality of land and direct subsidies into account. In order to obtain spatial concentration of agricultural land prices, the spatial Gini coefficient was calculated. For sake of comparison, the study was also based on the classical Gini coefficient.
Celem pracy było porównanie różnorodności przestrzennej koncentracji cen gruntów rolnych w latach 1999- 2012 z uwzględnieniem jakości ziemi i dopłat bezpośrednich. Do określenia koncentracji przestrzennej wykorzystano współczynnik Giniego uwzględniając odpowiednie wagi przestrzenne. Przedstawiono dane dotyczące cen gruntów rolnych (dobrych, średnich i słabych zgodnie z podziałem GUS) w latach 1999-2012. Uwzględniono także jednolite dopłaty bezpośrednie, które przyznawano latach 2004-2012. Dane wykorzystane do analizy pochodziły z GUS i z ARiMR. Dla porównania różnorodności wykorzystano klasyczne współczynniki Giniego.
