Opis:
The Penal Code of 1969 introduced in Chapter VIII a complex of regulations defining the criminal liability tfor offences committed in the conditions of special recidivism. Two categories of special recidivism were introduced: basic recidivism (Art. 60 § 1 of the Penal Code) and multiple recidivism (Art. 60 § 2 of the Penal Code). To assume the first category, the following criteria are required: 1) commission of an intentional offence similar to the previous one, 2) execution of at least 6 months of imprisonment, 3) commission of a new offence within 5 years after discharge from prison. To impute the offender the commission of an offence coming under the second category of recidivism, the following conditions are necessary: 1) conviction for at least the fourth time, in this twice under the conditions of basic special recidivism, 2) repeated commision of an intentional offence to profit financially or of hooligan character, 3) total imprisonment of at least one year, 4) commission of a new offence within 5 years after the last imprisonment. For each of those two categories of recidivism, the principles of aggravated criminal liability are fixed by the Code, and they refer to less - serious - offences only. Towards persons coming under Art. 60 § 1 and 2, imprisonment within the raised limits is adjudicated. Towards such persons, absolute suppression of suspension of the execution of penalty was formulated. The strictness of these regulations is partly diminished by Art. 61 of the Penal Code, which created the possibility to depart from the aggravation of penalty as expressed in Art. 60, in "particularly justified cases, when even the lowest penalty inflicted on the basis of Art. 60 § 1 and 2 of the Penal Code, would be incommensurably severe". The Code fights special recidivism also by providing special measures against special recidivists coming under Art. 69 § 1 and 2: protective supervision (called "supervision" further on) and social readaptation centre (called "centre" further on). The first of them - supervision - is a non isolating measure, consisting in the control of behavior of the supervised person in the conditions of liberty. It is adjudicated for a period of 3 to 5 years (Art. 63 § 1 of the Penal Code). The second measure - centre - is of isolating character. The duration of stay in the centre is not appointed beforehand in the sentence: it is at least 2 years, at most 5 years long. After 2 years, the recidivist may be discharged by the execution of penalty court if there are good reasons to presume that he will not commit any offence after discharge (Art. 65 of the Penal Code). Special measures are executed after the sentence has been served.             The principles of application of the special measures differ as regards both categories of recidivists: those coming under Art. 60 § 1 of the Penal Code (called "common recidivists" further on) and those coming under Art. 60 § 2 (called further "multiple recidivists"). The organs authorized to adjudge these measures are the criminal and execution of penalty courts. Their decision as to adjudgement of them may be taken at various stages of legal and executive proceedings: in the sentence (criminal court), in the latter part of imprisonment (execution of penalty court), and during the supervision (execution of penalty court).             The principles of application of the special measures by the court which is to pass judgement in the case are stated in Art. 62 of the Penal Code. According to § 1, the application of supervision is optional towards the offenders coming under Art. 60 § 1. The court is here at liberty to decide as to the possible measures, as no premises to adjudge supervision are specified by the regulation. As to the recidivists coming under Art. 60 § 2, the adjudgement of one of the two special measures is obligatory, that of supervision as a rule. The adjudgement of the centre takes place only if the court recognizes supervision insufficient to prevent recidivism (Art. 62 § 2 of the Penal Code).             The second instance when decisions are taken as to the application of the special measures is the close of imprisonment of the recidivists. The rulings of the execution of penalty taken at this stage of the proceedings modify those taken previously - that is, in the sentence - as regards the application of the special measures.  In the case of common recidivists, these modifications may consist in adjudgement of supervision if it was not adjudicated in the sentence (Art. 91 of the Code of Execution of Penalties), or - if the recidivist is released on probation - in the specific conditional simulation of the supervision adjudicated in the sentence (Art. 98 § 1 of the Penal Code). If the release on probation is not cancelled by the court, the adjudgement of supervision loses effect (Art. 98 § 2 of the Penal Code). In the case of multiple recidivists, the modifications which may take place in the latter part of imprisonment as regards the adjudication of the special measures always consist in substitution of a strict measure by a milder one: the penitentiary court may replace the adjudgement of the centre with supervision (Art. 103 of the Code of Execution of Penalties) or release multiple recidivists on probation.             The third closing stage of proceedings when the decisions on application of special measures are taken is the execution of supervision. In this stage, the position of recidivists coming under Art. 60 § 1 and 2 of the Penal Code is identical: they can both be sent to the centre in consequence of failure of the supervision (Art. 64 of the Penal Code). Thus the adjudgement of the centre in consequence of failure of supervision serves here as a measure to discipline the execution of supervision. The present study was based on the data from criminal records of the Criminal Register and the Central Files of Convicted and Temporarily Arrested Persons. The material from these records enables one to notice the differences, as regards the data they include, between the groups of recidivists distinguished in respect of the special measure adjudicated towards them, and thus, to define initially the criteria for application of these measures. As a conclusion, an attempt was made to define the general range of adjudgement of the special measures towards recidivists regardless of the stage of proceedings in which it took place.             The research was of cross-sectional character. The examined population consisted of recidivists (coming under Art. 60) from the entire country and selected to 3 random samples: the first sample included all recidivists whose sentences had become valid within the period from March 1 till April 30, 1979 (1181 persons), the second sample included all recidivists discharged from prison within the period from February 1 till March 31, 1979 (874 persons), and the third one - all recidivists whose supervision had been completed within the period from April 1 till May 31, 1979 (544 persons). There were the total of 2599 cases, from which 72 cases had been excluded because of the lack of complete data in the Criminal Register. The final populations of the separate samples were thus as follows: I - 1146 persons, II - 869 persons, III - 512 persons (the total of 2 527 persons).             The collected material was then analysed, that is, the groups of persons were compared, distinguished on the grounds of the type of the special measure adjudicated towards them, for instance the group of multiple recidivists towards whom supervision had been adjudicated was compared with the group sent to the centre. The above comparisons were made for each sample separately, and within the sample - separately as regards the common and multiple recidivists. The method of representing the results reflects , the analysis scheme: each sample has been represented in a separate part of the present paper. The study is summed un by an attempt to estimate the general range of adjudgement of the special measures towards recidivists. The results of the estimation indicate that the application of the special measures towards recidivists is of a very broad range. As many an approximately a half of the common recidivists had been subjected to supervision; failure occurred as regards 40 per cent of the supervised persons, which makes about 1/5 of all common recidivists, and these persons came under the regulation providing the adjudgement of the centre in consequence of the failure of supervision. In 40 per cent of the cases the cause of the unsuccessful termination of supervision was the non-compliance with orders and duties by the supervised person, and in 60 per cent - commission of a new offence.             As regards multiple recidivists, there were as few as 14 per cent of them towards whom no special measure whatever had been adjudicated, owing to adjudgements of the execution of penalty courts. Approximately 27 per cent of the multiple recidivists had been sent to the centre immediately from prison, while approximately 59 per cent had been subjected to supervision. In over a half of these cases supervision was unsuccessful, which makes about 1/3 of the multiple recidivists. The cause of the unsuccessful termination of supervision was in 2/3 of the cases commission of a new offence, and in 1/3 of the cases non-compliance with orders and duties.

Opis:
A novel fuzzy neural network, called FuNN, is applied here for time-series modeling. FuNN models have several features that make them well suited to a wide range of knowledge engineering applications. These strengths include fast and accurate learning, good generalisation capabilities, excellent explanation facilities in the form of semantically meaningful fuzzy rules, and the ability to accomodate both numerical data and existing expert knowledge about the problem under consideration. We investigate the effectiveness of the proposed neuro-fuzzy hybrid architectures for manipulating the future behaviour of nonlinear dynamical systems and interpreting fuzzy if-then rules. A well-known example of Box and Jenkins is used as a benchmark time series in the proposed modelling approach and the other modelling approach. Finally, experimental results and comparisons with the other popular neuro-fuzzy inference system, namely Adaptive Network-based Fuzzy Inference System (ANFIS) are also presented.

Our skeletal system requires a certain amount of maintenance in order to withstand the external loading appropriately for a long period. This maintenance is performed by specializae cells; i.e., osteoclasts and osteoblasts, which continuously resorb and rebuild the bony matrix in small packages. It is presently not known how these cells are being signalled such that they undertake appropriate actions and resorb damaged (weak) bone and replace it with a new. It is well recognized that mechanical loading has an important effect on the cellular events. Mechanical load distribution in bony structures can be calculated using the finite element method. In addition, the effects on growth, adaptation and degeneration due to this loading can be incorporated into these models as well. That gives the opportunity to study the interaction between biological and mechanical aspects in bone tissue. In this study a few examples of such an interaction are simulated numerically and their biological or clinical consequences are discussed.
Nasz układ kostny, aby dobrze znosić przez pewien czas obciążenia zewnętrzne, wymaga pewnej dozy podtrzymywania. Podtrzymywanie to przeprowadzane jest przez pewne wyspecjalizowane komórki, tzn. komórki kościogubne (osteoklasty) i komórki kościotwórcze (osteoblasty). Komórki te w małych porcjach ciągle wchłaniają i przebudowują substancję międzykomórkową. Aktualnie nie wiadomo jak te komórki otrzymują sygnały nakazujące podjęcie odpowiednich działań, wchłania uszkodzonej (słabej) kości i zastępowania jej nową tkanką kostną. Uważa się, że obciążenie mechaniczne odgrywa ważną rolę w zdarzeniach komórkowych. Rozkład obciążeń mechanicznych w strukturach kostnych można wyznaczyć przy zastosowaniu metody elementów skończonych. W tych modelach może być ponadto uwzględniony wpływ na wzrost, przystosowanie i degenerację wywołaną obciążeniem. Daje to możliwość badania interakcji pomiędzy aspektami biologicznymi i mechanicznymi w tkance kostnej. W niniejszej pracy podano kilka przykładów symulacji numerycznej takiej interakcji oraz przedyskutowano konsekwencje biologiczne czyli kliniczne.

Continuous bone remodeling consists in simultaneous resorption of tissues and synthesis of a new matrix. If, due to variable external or internal conditions, the equilibrium is disrupted, significant rearrangments of the micro-structure and bone shape are possible. Many mathematical and computational models of this adaptation phenomenon can be assigned one of two categories; namely, theoretical models originating from the theory of adaptive elasticity and computational models making use of the optimization theory. In the present paper the approach based on the hypothesis of optimal response of a bone is proposed. It enables derivation of various adaptation laws associated with extremum of the objective functional under a set of appropriate constraints and makes a bridge between the aforementioned categories. In order to illustrate possible application of the proposed general approach the specific formulation is presented and mathematical relations governing the adaptation process are derived. Four numerical examples illustrating some of possible applications of the presented relations are included.
Na przebudowę kości mają zasadniczy wpływ dwa procesy: resorpcja tkanek oraz synteza nowej matrycy. W stanie ustalonym są one w równowadze, lecz gdy na skutek zmiennych warunków zewnętrznych któryś z nich zaczyna przeważać może nastąpić nawet znaczna zmiana struktury wewnętrznej i zewnętrznego kształu kości. W literaturze poświęconej problemowi modelowania zjawiska adaptacji kości można wyróżnić dwa charakterystyczne podejścia, jedno oparte na teorii adaptacyjnej sprężystości i drugie wykorzystujące matematyczne metody optymalizacji. W niniejszej pracy zaproponowano nowe sformułowanie wykorzystujące hipotezę optymalnej reakcji układu. Łączy ono w sobie wiele zalet obu wspomnianych metod. W celu zilustrowania ogólnej idei wyprowadzono konkretne, proste prawo adaptacji. Przedstawiono też kilka przykładów numerycznych ilustrujących niektóre z możliwych zastosowań omawianych związków teoretycznych.

The general problem of an off-line parameter tuning in the Binary Genetic Algorithm (BGA) is introduced. An example of such a tuning: a class of Correlational Tuning Methods (CTMs) is proposed. The main idea of a CTM is that it uses a mapping called measurement function as an assessment of the BGA's effciency. An example of a measurement function is described and two examples of CTMs: a modified "trials and errors" method and a modified genetic meta-algoritlm (metaBGA) are shown. Finally, experimental results with the metaBGA for four kinds of test fitness functions, where the code permutation is the tuned parameter, are presented.

The photochemical activity of photosystem II (PSII) was measured by chlorophyll a fluorescence intensity of Scots pine needles, from trees growing in various forest experimental areas exposed to air and soil pollution. Fluorescence techniques was used as a no-invasive method of detection injuries of the photosynthetic apparatus. Chlorophyll fluorescence parameters such as PSII photochemical efficiency (Fv/Fm), chlorophyll fluorescence decrease ratio (Rfd) and size of the acceptor pools available to PSII (Sm) indicated seasonal changes in the activity of the photosynthetic apparatus of pine needles. Significant differences in the variable fluorescence parameter rations Fv/Fm and Rfd between the studied sites were found in middle-winter dormancy period in January and also in samples collected in August. Winter inactivation of photosynthesis results in areduction of the photochemical efficiency Fv/Fm and Rfd. Presented results demonstrate that the effect of industrial pollution on Scots pine needles is detectable by of measurements of fluorescence parameters. They showed that Scots pine trees indicated physiological adaptation to environmental pollution and this can be monitored by the fluorescence signals earlier than by other methods.
Badano fotochemiczną aktywność fotosystemu II (PS II) igieł sosny zwyczajnej mierząc fluorescencję chlorofilu a igieł trzech populacji rosnących pod wpływem skażenia gleby i powietrza. Analizowano następujące parametry fluorescencji chlorofilu a: Fv/Fm, Rfd i Sm/Fm. Stwierdzono ich sezonowazmie - nność. Istotne różnice statystyczne pomiedzy stanowiskami wzrostu badanych populacji wystąpiły dla parametru Fv/Fm i Rfd w okresie spoczynku zimowego w styczniu. Zaburzenia fotosyntezy zimą prowadzą do redukcji wydajności fotochemicznej wyrażonej stosunkiem Fv/Fm i Rfd. Uzyskane wyniki wskazują iż kondycję drzew iglastych rosnących w skażonym środowisku można ocenić przez pomiar fluorecencji chlorofilu a w igłach. Przedstawione badania wspierają hipotezę zakładającą, że sosna zwyczajna należy do drzew o wyraźnej fizjologicznej zdolności adaptacji do skażonego środowiska.

Opis:
Mitochondria of amoeba Acanthamoeba castellanii in addition to the conventional cytochrome pathway possess, like plant mitochondria, a cyanide-resistant alternative quinol oxidase. In mitochondria isolated from amoeba batch culture grown temporarily at low temperature (6°C), higher respiration was accompanied by lower coupling parameters as compared to control culture (grown at 28°C). In the presence of benzohydroxamate, respiratory rates and coupling parameters were similar in both types of mitochondria indicating that growth in cold conditions did not disturb the cytochrome pathway. Increased contribution of alternative oxidase in total mitochondrial respiration in low-temperature-grown amoeba cells was confirmed by calculation of its contribution using ADP/O measurements. Furthermore, in mitochondria from low-temperature- grown cells the content of the alternative oxidase was increased and correlated with the increase in the unstimulated and GMP-stimulated cyanide-resistant respiratory activity. A possible physiological role of higher activity of alternative oxidase as response to growth at a low temperature in unicellular organisms, such as amoeba, is discussed.

This paper is concerned with the issue of optimum detection of known signal in nonwhite noise and/or narrow-band interferences. The detection is carried out in three steps. First, some function related to the power spectrum of interfering process I(z) is estimated via adaptation. Second, the signal + interference is withened due to I(z). Third, the replica of signal is filtered via I(z) to match it to the deformed signal in the previous step. The simulation of SS reception in presence of NB interference shows a high gain in comparison to classical single-matched detection.

We propose a new approach for the numerical solution of the Navier-Stokes equations, where the inviscid part is discretized by the finite volume method and the viscous part by the finite element method. To capture precisely the position of shock waves, the suitable mesh refinement method has to be applied. Therefore the anisotropic mesh adaptation technique equipped with some suitable modification for viscous compressible flow is used. The suitable application of the mentioned numerical adaptive method allows us to obtain sufficiently precise results without much requirement on CPU-time and computer memory.

In this paper two methods for evolutionary algorithm control are proposed. The first one is a new method of tuning tlie probabilities of genetic operators. It is assumed in the presented approach that every member of the optimized population conducts his own ranking of genetic operators' qualities. This ranking enables computing the probabilities of execution of genetic operators. This set of probabilities is a basis of experience of every individual and according to this basis the individual chooses the operator in every iteration of the algorithm. Due to this experience one can maximize the chances of his offspring to survive. The second part of the paper deals with a self-adapting method of selection of individuals to a subsequent generation. Methods of selection applied in the evolutionary algorithms are usually inspired by nature and prefer solutions where the main role is played by randomness, competition and struggle among individuals. In the case of evolutionary algorithms, where populations of individuals are usually small, this causes a premature convergence to local minima. In order to avoid this drawback I propose to apply an approach based rather on an agricultural technique. Two new methods of object selection are proposed: a histogram selection and a mixed selection. The methods described were tested using examples based on scheduling and TSP.

In this paper, a novel indirect adaptive neural controller using only two auto-tuning neurons is developed for a class of nonlinear systems. Unlike traditional multi-layered neural controllers, the structure of the proposed controller is very simple and practicable. There are three adjustable parameters in each auto-tuning neuron. Two such auto-tuning neurons used in our proposed indirect adaptive controller are used to track on-line the desired signal. The adaptation law for adjusting these parameters is developed based on the Lyapunov approach. Moreover, the stability of the overall closed-loop system can be analyzed and guaranteed by introducing the additional supervisory controller and the technique of modified adaptation law with projection. Finally, the tracking control of the inverted pendulum system is presented to illustrate the proposed method.

The process of system transformation starting in the 90s and continuing its consequences since more than a decade directs to the functioning in the mentioned context of social actors with the specific scope of demands, related to their adaptation to the liberal and democratic reality. The demands are directed to the individuals as well as to the different institutions, among others to the educational ones. The process of adaptation to new social conditions and reaching more actual qualities, in the criteria of the highly advanced in specific aspects societies or communities, can take on the form of modernisation. In the paper there are analysed the characteristics of the actual social realities of pluralistic, liberal, democratic every-day conditions, their consequences for the spheres of the individuals' functioning and directions of the possibilities of utilizing the resolves implicated by the theory of modernisation in creating the educational and extra-educational reality.
