The decree of the State Council (Rada Państwa) of 12 December 1981 on martial law imposed martial law in Poland and ended Solidarity period in Polish history. Many Solidarity activists were imprisoned and sentenced on the basis of this decree. The penal provisions from this decree were often applied by judges on retroactive basis. The text analyzes the responsibility of judges for these commitments. The Supreme Court passed a sentence on this issue in 2007. The Supreme Court expressed an opinion that judges were obliged to apply retroactive rules. The author does not share this opinion. He analyzes Polish legal acts and the Convention on Human Rights (art. 15). A part of the text is dedicated to Gustaw Radbruch’s views about human justice, which in critical situation should have been applied despite the fact that written law is different.

The opinion relates to presidential project amending Act on martial law and Act of competence of Commander-in-Chief of the Armed Forces and its subordination to constitutional authorities of Republic of Poland and other acts, which was introduced to Marshal of the Sejm on 10th of July 2011. This project amends Acts contained in its title and Act on State of Emergency and Act of state of natural disaster. Author stresses that legislator should pass laws, which brings new legal norms, which are not included in current law. In opinion of the Author, interpretation of current law shall provide to conclusion that presidential project contains norms, already binding at the moment of introducing the amendment. Author criticizes definition of “cyberspace”, proposed by the project. In Author’s opinion this definition is not precisely specified. At the end of the opinion, Author repeats the thesis that, he doubts in necessity of this amendment, presented at the begging.

The study examined Ukrainian students’ learning motivation amid the fullscale Russian invasion. A survey gauged the impact of current conditions on their emotional state and learning motivation. The results revealed a statistically significant decrease in motivation among students since February 24, 2022. The list of factors that influence the current situation in Ukraine, which, according to the interviewed youth, have the greatest influence on their learning, has been determined.

My paper is related to the thirtieth anniversary of the imposition of martial law in Poland on 13 December 1981. It focuses on Nowa Huta, a large borough in Cracow which mounted strong resistance to Jaruzelski’s decision. I first discuss the way Nowa Huta’s opposition activists were interned on the night of 12/13 December 1981 to later describe the details of the strike and its ultimate pacification.

Opis:
A sociological look at artists’ biographies makes one reflect on their increased mobility. Purposes and reasons of the artists’ migratory journeys are various, they have a different character and their effects also vary. The article based on the narratives of the Polish artists shows three variants of making decisions to emigrate from Poland following the imposition of the martial law in December of 1981. The purpose of the article is also an attempt to modify the dominant definitions of forced emigration by extending it to the aspect of internal coercion generating a strong push impulse. This internal factor seems to be very important in the cases analysed in the article. The biographical interview method allows to indicate that, apart from external coercion, various entanglements of circumstances and trajectories are revealed, which in some cases lead to the decision to leave the home country.

Objectives: The aim of the article was to solve the research problem included in the question: Can we adopt specifically defined procedures that define imposing of "martial law", "state of war" and "time of war"? Methods: The methods adopted in the research process are primarily critical analysis of a wide spectrum of source materials, including compact items, scientific articles, legal acts, theoretical methods characteristic for security science, i.e. analysis, synthesis, comparison, inference and abstraction, were supplemented by participatory observation. Results: Although the procedures for imposing "martial law", "state of war" and "time of war" have been defined at the level of the Constitution of the Republic of Poland and ordinary legislation, the applicable legal order does not formulate norms that would systematically develop these concepts in a defined form. This problem, which at times takes on the consequences of the lack of a common position of theoreticians and practitioners, raises concerns from the point of view of the legal system. Conclusions: The conclusions of the article show that it is difficult to clearly set the procedures defining the direct use of the definitions of "martial law", "state of war" and "time of war". A lot of scientists are having a discussions about this. There is also a whole range of documents and legal acts that do not generally regulate the security and defense of the state, but some of their provisions refer to "time of war", "state of war" and "martial law".

The relevance of the investigated problem lies in the need to provide primary psychological assistance to military personnel and other victims of the Russo-Ukrainian war at its current stage, because psychological problems are occurring in an increasing number of people, in particular in the territory of Kharkiv and Zaporizhzhia. The purpose of the article is to determine the specifics and stages of providing psychological assistance, as well as consultations to victims of the war, primarily to the populations of Kharkiv and Zaporizhzhia, which are located within the war zone. In the course of the research, a set of methods was used, namely analytical, graphic and synthesis methods. The main results of the conducted research should be considered the established features of providing assistance to the affected part of the population, which was at the epicentre of combat events in the Kharkiv and Zaporizhzhia Oblasts, as well as specific actions that prevent the deterioration of a person’s psychological state during the war. Identified were the factors needed to provide psychological assistance for thevarious population specifics, taking into account aspecvts such as gender, age, as well as the person’s degree of psychological deterioration. The practical significance of the results of this academic paper lies in the development of an algorithm of actions for providing psychological assistance to Ukrainians during the state of war in the country, as well as conducting the necessary actions and consultations to improve the psychological state of the population affected by the war from specific cities. The results of the study can be used as an example to provide consultations and conduct to the population of other regions of Ukraine and beyond in real time. In addition, the results can be a helpful tool for establishing recommendations for improving mental health in conditions of war.

The introduction of martial law on December 13, 1981 resulted in the formation of an opposition underground almost immediately throughout the country. Support from abroad was of great importance for its functioning. This article raises the issue of the activities of the underground Toruń structures of “Solidarity” in the context of aid coming from the West. Over the course of the 1980s, the Toruń underground received printing equipment, computers, parts for radio transmitters, printing ink, money, émigré publications, etc. An important aspect of foreign contacts was the creation of a specific corridor for the secret distribution of copies of the Toruń underground press to “Radio Free Europe”. Articles from this press were later read in radio broadcasts broadcast to Poland.

The article is devoted to the study of the operation of the banking system of Ukraine during the war period. The key indicators of the banking sector have been analyzed, in particular, the number of banking institutions and the dynamics of assets and liabilities. The key financial results of the banking sector, namely net profit and loss, return on assets and capital have been analyzed. It is revealed that maintenance of operational efficiency and effective measures taken by the National Bank of Ukraine allowed the banking sector to adapt to the crisis conditions and make a profit under martial law.

The opinion explains that “time of war” begins at the moment of taking the decision to declare a state of war under the procedure provided by Article 116 of the Constitution. “The time of war” implies the ability to exercise the powers by the Commander-in-Chief of the Armed Forces. The author puts a thesis that the Supreme Commander of the Armed Forces may be appointed in peacetime, but will assume his/her only after the declaration of the state of war.

I have presented what the arrest of the opposition activist in Nowa Huta looked like on the night of 12/13 December 1981 and I have presented the course of strike and its repression in the largest workplace in Cracow – in the Vladimir Lenin Steelworks in Nowa Huta.

Author analyze the processes of development of the collective memory of “Solidarity” and the martial law and try to determine their place in collective memory of Polish history. The analyze is based on data from five sociological surveys made in two periods divided by sixteenth years in which communist regime has collapsed and a new political regime emerged. The analyzes shows the ambivalent evaluation of this two events which diminish with time and “Solidarity” is more univocally seen as the positive event of Polish history and martial law as the negative one. In spite of this, the author suggest that there is no reason to think that ambivalence towards “Solidarity” and martial law will disappear completely.
