The text deals with the influence that women’s movements on the one hand and organizations operating in Poland after 1945 on the other hand had on the poetry of Anna Świrszczyńska. Contrary to the established narrative developed by interpreters of this poetry after 1989, the feminist sensitivity of Świrszczyńska was not an isolated and individual phenomenon, as it grew directly from activities undertaken by women and from women’s organizations in the People’s Republic of Poland as well as during the moral and cultural transformations. Reading Świrszczyńska’s poetry in the light of socialist emancipation projects allows us also to redefine the genealogy of Polish feminism.

This article presents preliminary findings of the oral history project on the subject of the soldiers of the People’s Troops of Poland. Testimonies of ca. 40 “People’s Poland” veterans were recorded (giving more than 2000 hours of audio recordings). These soldiers fought on the Eastern Front, participating in, among others, the battles of Lenino, Budziszyn, and Berlin. The article describes the interviewed group and defines the method applied when conducting the interviews. It also gives a short account of how the interviewed were conscripted into the People’s army. The main part of the article is devoted to pointing to the similarities in the veterans’ accounts. These common elements include interspersing a personal narrative with a broad historical context, underlining that in their individual actions during the war and after it they encountered situations from which there was no escape, using the propaganda expressions dating back to the times of the Polish People’s Republic, and the feeling of being omitted (as a whole group of veterans of the People’s Troops) from the sphere of historical memory after 1989. In the last part of the article, plans for a monograph based on the project are presented.

This article seeks to reconstruct the resistance attitudes and strategies of survival among political prisoners in Poland in the years 1944–56, referred to as the Stalinist period. The introductory section reviews the literature on social resistance in authoritarian political systems, including Poland and covering political prisoners. Subsequently, a definition of ‘political prisoner’ is proposed and the socio-political context of the Stalinist period presented, in which prisons were assigned a strictly repressive function. The present analysis primarily seeks to answer the question whether the conditions in Stalinist prisons offered any room for opportunity to resist the authoritarian power – and, if yes, what sort of experiences and models the convicted resorted to. I also sought to see what forms rebellion against the authority assumed and what was the purpose of the adopted survival strategies. The article is based on documents generated by the Ministry of Public Security’s Prison Management Department and the penitentiary units reporting to it, as well as on memoirs and accounts of former political prisoners.

The article present the institution of the President against the background of the government regime’s evolution between 18th and 20th century. During this period a new model had been shaped based on separation of powers and balance between the head of the state, government (executive) and the Judiciary Branch. Author divided the history of the Presidential Office in Poland into four periods: the Second Republic of Poland (1918-1939), first years of the People’s Republic of Poland (1947-1952), late years of the People’s Republic of Poland (1989-1990) and the Third Republic of Poland (1990 ). Each of the period is different mainly because of the position and power of the President which directly depends on the Constitution, however political circumstances are not irrelevant in this matter. The dissertation attempts to describe all periods and comment them from the modern (current) point of view. Author spots that there’s been always conflict and dilemma between the idea of the strong presidency and weaker presidency. This tendency had been very visible during the Presidency of Lech Walesa, who had been trying to create the stable and firm institution of the President. New Constitution of the Polish Republic 1997 situated the President in accordance with the idea of the balance of power and division of powers. Role of the President depends currently on the political situation and the personal skills (even charisma) of the person who had been elected.

Together with the change in the political situation in Poland after World War II, the communists set new tasks for the justice system — fighting against political opponents and protecting the system. Their implementation was to be ensured by discretionary judges and prosecutors. To this end, persons trained according to models that rejected European legal culture were introduced to the judicial authorities. Military lawyers were educated at the Officer Law School, established on 19 May 1948 by the Minister of National Defence. It was a secondary law school, which provided only a minimum of knowledge to graduates.

Poland is a country of the so-called “young democracy” type. As provided for in art. 2 of The Constitution of the Republic of Poland dated 2 April 1997, “The Republic of Poland is a democratic state of law, fulfilling the principles of social justice”. Art. 4 of The Constitution of the Republic of Poland gives superior authority to the Nation. This authority can be exercised “through representatives or directly”. But Poland does not have much experience with the institution of a people’s initiative, nor with other forms of direct democracy. The Polish national law provides for two types of people’s initiative. One type is a people’s initiative of putting a bill before the parliament as provided for in art. 118 subpar. 2 of the Constitution of the Republic of Poland and the Act dated 24 June 1999 on the use of a legislative initiative by citizens. The second type is a people’s initiative of putting forward a motion to hold a legislative referendum regulated by the Act dated 14 March 2003 on holding a national referendum. The legislature did not provide for, however, a people’s initiative for the purpose of amending the constitution or its abrogation. The subject of this paper is the institution of a people’s initiative of putting forward a motion to hold a legislative referendum.
Polska jest państwem tak zwanej młodej demokracji. Art. 2 Konstytucji Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. stanowi, iż „Rzeczpospolita Polska jest demokratycznym państwem prawnym, urzeczywistniającym zasady sprawiedliwości społecznej”. Art. 4 Konstytucji RP daje władzę zwierzchnią narodowi, który może ją sprawować „przez swoich przedstawicieli lub bezpośrednio”. Jednakże polskie doświadczenia z instytucją inicjatywy ludowej, jak również z innymi formami demokracji bezpośredniej są niewielkie. Polskie prawo ogólnokrajowe przewiduje dwa rodzaje inicjatywy ludowej. Jest to inicjatywa ludowa w sprawie złożenia ludowego projektu ustawy w parlamencie przewidziana art. 118 ust. 2 Konstytucji RP i ustawą z dnia 24 czerwca 1999 r. o wykonywaniu inicjatywy ustawodawczej przez obywateli. Drugim rodzajem jest inicjatywa ludowa w sprawie złożenia wniosku o przeprowadzenie referendum ustawodawczego uregulowana ustawą z dnia 14 marca 2003 r. o referendum ogólnokrajowym. Ustawodawca nie uwzględnił jednak inicjatywy ludowej w sprawie zmiany konstytucji lub jej abrogacji. Tematem niniejszego opracowania będzie instytucja inicjatywy ludowej w sprawie złożenia wniosku o przeprowadzenie referendum.

The submitted article is based on a fragment of a thesis entitled “The Image of the Roma and Artistic Bohemia in the Literature of the Young Poland”. The subject matter of the research is the description of two communities living in the period of the Young Poland: the Roma people, and Bohemians. The adopted research method embraces the range of broadly defined anthropological research, including analysis and interpretation of texts in a cultural context, and, above all, various aspects of life referring to Bohemians and the Roma community in Poland at the turn of the 19th and 20th centuries. The research objective of this article is to show the similarities and differences between Bohemians of the Young Poland and the Roma living in this period, concerning originality of their lifestyle, customs, outfit and other phenomena. The in-depth analysis of the life aspects of the Roma and Bohemians from the Young Poland has demonstrated the similarities and differences between the two groups. They both functioned as “others” who had no relationship with the society. They were accompanied by a sense of loneliness, outsiderness, consciousness of rejection, tragedy of their situation and a sense of incomprehension and injustice.

The boards judging petty offences were established in December 1951. They were – from the beginning – entitled to judge traffic petty offences cases (petty offences against the security in traffic). In the first half of the 50’s the Boards were acting in a very simple way, by deciding cases about low-level fines (tickets) or about warnings. These minor punishments were not adequate to the decreasing safety on the roads and to the increasing number of cars. In 1956, Władysław Gomułka became the leader of the Communist Party and it was decided to change the policy in traffic petty offences cases by making the punishments more severe. The police started to give tickets more often and the boards were concentrating on punishing drunk drivers. However, the act against drunk drivers was antiquated and thus not adequate to the new situation. In 1959, the so called Anti-alcohol Act was passed and drunk driver cases were transferred to the courts. The Boards lost their importance in traffic petty offences cases, because the Police were giving tickets from one side and the courts were sentencing drunk drivers from the other side. In the 60’s the phenomenon of „road hooligans” emerged and a new act, called „the Road Code”, was passed. It gave new measures consistent with a stronger policy against traffic petty offences. The Boards played the most important role in this policy. The fines were increased three times, and the Boards could retain the drivers’ licenses for some time. The biggest part of the Boards’ jurisdiction was then concentrated on traffic petty offences, especially these connected with alcohol.

After the January Uprising in the Kingdom of Poland, across half of the following century, industrial development was mostly connected with social reforms. One tragic consequence of it was the increase in the number of children without parental protection, juvenile beggars, tramps, young criminals and prostitutes. During the last thirty years of the 19th century it became a priority in the Kingdom of Poland to pay attention to the education and protection of children and teenagers from the poorest families. Numerous innovative and educational concepts were formulated at that time; some of them were used in centres for socially maladjusted young people, for instance in Studzieniec, Mariańska Wilderness or Struga, in centres for young prostitutes. The activity of educational centres and societies which organised the protection of children (for example, The National Society for the Prevention of Cruelty to Children) was given as an example.

The article refers to the economic consequences of the post-war division of Europe into the capitalist West and communist East. One of the consequences of this division was the creation of peculiar crime phenomenon on the eastern side of the “iron curtain”, which consist on exploit the prices and goods availability differences between wealthy West and backward East of Europe. This being the case of illegal movement of goods, begun from the 1940s, between those two worlds. In article you can find the outline of characteristic for the whole Polish “People’s” Republic period smuggling conducts. The key subject of following text is first of all the problem of car smuggling in the 1980s, which wasn’t researched by polish historians before. In this interesting for us times in Western Europe (West Germany, Austria, France) and in Scandinavia at least few groups of organized crime were active in a areas of car stealing and smuggling a luxury goods into Poland. The essence of following article are the presentation of these groups, their bosses, criminal practices and techniques and indication of the cooperation between polish car smugglers and western countries citizens. Sources for this text are based first of all on operational and investigation records of former Security Service collected in archives of the Institute of National Remembrance.

Education on the area of post-war community Będzino (1945–1954) The article is based on the archives portraying the formation process of Polish schools and cultural institutions as a result of the transformations of the educational system. It presents the condition of the teaching staff and the financial base related to the density of population. The author pays attention to such problems as the lack of staff, funds and equipment. He discusses the forms of co-operation with parents and the society, the participation in all-Polish actions organized by state authorities, especially in the action of fighting illiteracy. The supplement includes the schedule and the curriculum from those times. The article is concluded with the description of the end of the existence of the community of Będzino in its primitive, post-war shape.
