The aim of this study has been to determine the response of cyanobacteria to the lake protection and restoration measures implemented in the littoral zone of an urban lake called Jeziorak Mały. The first investigations were conducted in 1996 and were resumed in 1997-2003, 2005 and 2013, following the installation of a separator and the creation of stone accumulation sites. Long-term changes in phytoplankton cyanobacterial proportions, abundance and biomass were analyzed in relation to environmental conditions at the sites in the littoral zone (S – separator pipes, K – sites with stones and R – sites with macrophytes). Relationships between cyanobacteria and water chemistry variables were analyzed by calculating the Spearman’s rank correlation coefficient, and then with canonical correspondence analysis (RDA). The results provided evidence that water temperature, total nitrogen and iron concentration (S, R), but also PO43- in spring (S,K) were the principal factors affecting cyanobacterial development. There was a significant decrease in the share, abundance and biomass of cyanobacteria coinciding with a decrease in conductivity and PO43- following the onset of lake restoration efforts. Changes in dominant species from the ones typical in hypertrophic lakes to those typically found in eutrophic lakes took place during the research. The modifications indicated a strong initial response of cynaobacteria to the restoration measures, but the situation stabilized in 2013, when cyanobacteria returned to their previous average levels. This suggests that the introduction of lake restortation measures contributed to the lake’s improved water quality and they should be retained for efficient lake management in the future.

Celem artykułu jest określenie statusu praw obywatela do „czystego środowiska” oraz jego obowiązków wobec środowiska w warunkach zrównoważonego rozwoju świetle regulacji międzynarodowych i krajowych. W artykule przeanalizowano trzy powiązane ze sobą aspekty, tj. prawa człowieka do czystego środowiska, obowiązki obywateli i władz publicznych wobec środowiska oraz ochronę środowiska zgodnie z zasadą zrównoważonego rozwoju. Prawa człowieka do „czystego środowiska” są zagwarantowane konstytucyjnie i wywodzą się z Powszechnej Deklaracji Praw Człowieka oraz Deklaracji z Rio de Janeiro „Środowisko i Rozwój”. Prawa te realizowane przez władze publiczne poprzez zapewnienie bezpieczeństwa ekologicznego, użytkowanie i ochronę zasobów środowiska zgodnie z zasadą zrównoważonego rozwoju. Ponadto każdy obywatel ma nałożone obowiązki wobec środowiska, powinien dbać o zasoby środowiska, użytkować je zgodnie z zasadami prawa ochrony środowiska. Na podstawie analizy doktryny i przepisów prawnych w tym zakresie zaobserwowano wyraźną relację pomiędzy koniecznością zagwarantowania podstawowych konstytucyjnych praw człowieka do „czystego środowiska” przez władze publiczne a obowiązkiem tych podmiotów wobec środowiska poprzez ochronę zasobów środowiska zgodnie z zasadą zrównoważonego rozwoju. Należy to zrealizować w taki sposób, aby zrównoważyć prawa człowieka do „czystego środowiska” z prawami środowiska do ciągłości i trwałości zasobów (równowagi przyrodniczej), przy jednoczesnej gwarancji rozwoju gospodarczego. Przykładem realizacji tych założeń jest Agenda 2030, obecnie realizowana w Polsce i innych krajach UE.
The aim of this article is to determine the status of citizens’ rights to a “clean environment” and their obligations towards the environment in the conditions of sustainable development in the light of international and national regulations. Therefore, the article analyzes three related aspects, i.e. human rights to a “clean environment”, obligations of citizens and public authorities towards the environment, and environmental protection in accordance with the principle of sustainable development. Human rights to a “clean environment” are constitutionally guaranteed and are derived from the Universal Declaration of Human Rights and the Rio de Janeiro Declaration “Environment and Development”. These rights are implemented by public authorities by ensuring ecological safety, use and protection of environmental resources in accordance with the principle of sustainable development. In addition, every citizen has obligations towards the environment, because he should take care of environmental resources and use them in accordance with the principles of environmental protection law. Based on the analysis of the doctrine and legal regulations in this area, a clear relationship was observed between the need to guarantee basic constitutional human rights to a “clean environment” by public authorities and the obligation of these entities towards the environment by protecting environmental resources in accordance with the principle of sustainable development. This should be done in such a way as to balance human rights to a “clean environment” with environmental rights to the continuity and sustainability of resources (natural balance) while guaranteeing economic development. An example of the implementation of these assumptions is the 2030 Agenda currently implemented in Poland and other EU countries.

The aim of this article is to determine the status of citizen’s rights to ‘a clean environment’ and their obligations towards the environment under sustainable development conditions, considering international and domestic regulations. It analyses three interlinked aspects: human rights to a clean environment, obligations of citizens and public authorities towards the environment, and environmental protection in accordance with the principle of sustainable development. Human rights to ‘a clean environment’ are enshrined in the Constitution, drawing on the Universal Declaration of Human Rights and the Rio de Janeiro ‘Environment and Development’ Declaration. These rights are implemented by public authorities through ensuring ecological safety and the useand protection of environmental resources, adhering to the sustainable development principle. In addition every citizen has obligations towards the environment, because he should take care of environmental resources and use them in accordance with the principles of environmental protection law. The analysis of legal doctrine and legislation highlights a clear relationship betweenthe necessity for public authorities to ensure constitutional rights to a ‘clean environment’ and their obligations towards the environment through the protection of environmental resources in line with the sustainable development principle. This entails balancing the human right to a ‘clean environment’ against the environmental right to the continuity and sustainability of resources(natural balance), while also ensuring economic growth. An example of these principles in action is Agenda 2030, currently being implemented in Poland and other EU Member States.

The aim of this study was to determine the response of planktonic cyanobacteria and periphyton assemblages (periphytic algae in the separator pipes, epilithon and epiphyton) to lamella separator-treated stormwaters in urban Lake Jeziorak Mały in 1997-2003 and 2005. Relationships between periphyton and phytoplankton assemblage and water chemistry variables were analyzed by calculating the Spearman’s rank correlation coefficient, and then with canonical correspondence analysis (CCA). The basic factors favouring the cyanobacterial growth were water temperature and iron, while high chloride concentration limited their development. Cyanobacterial abundance recorded at the separators was half that of the pelagic zone because of a lower water temperature and higher Cl concentration, indicating high algal sensitivity to the considerable velocity and disturbances caused by stormwater effluents. Higher silicon and calcium concentrations at the separators and orthophosphates at sites with stones and gravel showed connection with the growth of diatoms, especially Fragilaria leptostauron var. martyi, Diatoma vulgaris and Navicula gregaria. The richness of the dominant cyanobacteria, Aphanizomenon gracile and Limnothrix redekei, was related with the water temperature, conductivity, pH, and TN. Similarities in the periphyton dynamics in separator pipes and epilithon between the years covered by the study suggest significant influence of separator-treated stormwater on these assemblages, in contrast to epiphyton and phytoplankton in the pelagial zone, where these waters had limited influence.

This article shows the general prinicples of water protection in the international, European Union and Polish levels in the contex of human rights. Because deficit of drinking waters is very important issue not only in Africa and Asia countries but also in some state in UE e.g. in Poland with scarce water resources. The legal aspect of water protection against pollutants stemming from anthropogenic activity is complex and hence, is regulated in many conventions, directives and national laws. The very important for water protection is to limit iflows of sewage into water bodies or limit pollution at source, and effective remediation and restoration of the water damage. All contribute to improved quality of waters and ensuring their proper quality which is the basic human right to life.

Animal rights at the international level have been defined in the Universal Declaration on Animal Welfare, which has become a guiding principle for many EU countries in shaping animal protection legislation. The subject of this article is the humane protection of homeless animals, which is the responsibility of the municipality in terms of maintaining cleanliness and order. The study assumes that by carrying out tasks regarding the protection of animals from homelessness, municipalities contribute to the effective protection of animals by providing them with appropriate care. The analysis found that the provisions of the Universal Declaration on Animal Welfare have been fully incorporated into Polish legislation. However, the effectiveness of the provisions on the protection of homeless animals executed by municipalities is not entirely satisfactory as evidenced by the post-inspection data and selected jurisprudence. In order to improve this state of affairs, the following de lege ferenda postulates were formulated, which in part are also guidelines of the Supreme Audit Office extending the catalog of activities in municipal homeless animal protection programs, introducing the requirement to inspect animal shelters by municipalities, changing the location requirements of animal shelters and also clarifying sanitary requirements concerning the conditions in which animals live in to improve their welfare. The above changes in legislation may contribute to more efficient humane protection of homeless animals in Poland and may serve as an example for other EU countries.
Prawa zwierząt na forum międzynarodowym zostały określone w Światowej Deklaracji Praw Zwierząt, która stała się wytyczną dla wielu państw Unii Europejskiej (UE) w kształtowaniu przepisów w zakresie ochrony zwierząt. Przedmiotem analizy niniejszego artykułu jest humanitarna ochrona zwierząt bezdomnych, która jest obowiązkiem gminy w ramach utrzymania czystości i porządku. W pracy założono, że realizując zadania w zakresie ochrony zwierząt przed bezdomnością, gminy przyczyniają się do ich efektywnej ochrony poprzez zapewnienie im odpowiedniej opieki. W wyniku przeprowadzonej analizy stwierdzono, że w pełni wprowadzono postanowienia Światowej Deklaracji Praw Zwierząt do prawodawstwa polskiego, jednakże skuteczność przepisów w zakresie ochrony zwierząt bezdomnych przez gminy nie jest do końca skuteczna, czego potwierdzeniem są dane pokontrolne i wybrane orzecznictwo. W celu poprawy tego stanu sformułowano postulaty de lege ferenda, będące częściowo również wytycznymi Najwyższej Izby Kontroli, a mianowicie rozszerzenie katalogu działań w gminnych programach ochrony zwierząt bezdomnych, wprowadzenie wymogu kontroli schronisk dla zwierząt przez gminy, zmianę wymogów lokalizacyjnych schronisk dla zwierząt, a także doprecyzowanie wymogów sanitarnych dotyczących warunków bytowania zwierząt w schroniskach dla poprawy ich dobrostanu. Powyższe zmiany w prawodawstwie mogą przyczynić się do bardziej efektywnej humanitarnej ochrony zwierząt bezdomnych w Polsce oraz mogą być wskazówką dla innych państw UE.

The Water Framework Directive 2000/60/EC is considered a very modern strategy of water management in the EU. The purpose is to establish a framework for the protection of inland surface waters by preventing further deterioration and protecting the condition of aquatic ecosystems, as well as increasing the protection and improvement of the condition of the aquatic environment by limiting emissions and losses of priority substances. It was considered that changes in the water law in Poland during the process of implementing the guidelines of the Water Framework Directive may have contributed to widening and strengthening the monitoring system of lakes and changes in their quality, especially their ecological state. This article aims to determine the changes in legal regulations in the field of water quality/ecologically state of lakes in Poland as a result of the implementation of the WFD. The EC reports indicate that some requirements are too rigorous and complicated for Member States to implement. Water monitoring was significantly expanded and modernised which lead to improvement of lake water quality in Poland. The five-grade ecological status of lake waters and standardised biological indicators were introduced. It was highlighted that the improvement of the WFD implementation process allowed for more effective water management and the development of effective strategies for the protection of lakes in Poland and other EU countries.

The European Union International Organization for Standardization management system for the environment (ISO 14001) is established by European Commission Regulation 1221/2009. This legislates a voluntary system where organizations can register in a community eco-management and audit scheme. In the literature, this standard is recognized as an instrument of international environmental protection law, introduced by soft law regulations. ISO 14001 has been implemented by many global and European organizations, and it strives to improve the quality of their environmental resources. It was considered that the ISO 14001 eco-management and audit scheme enforced protection of environment in EU countries by imposing the obligation to implement appropriate legal regulations in this area. This article aims is determine what legal solutions in chosen UE countries enable the effective implementation of ISO 14001 and what positive effects it has on the state of the environment in these countries. The results demonstrated that the number of certified organizations is increasing despite the many difficulties and costs of implementing and organizing required environmental protection areas. The implementation of ISO 14001 was described using the example of Poland and Italy compared to other EU countries. The uptake identifies improved environmental quality, and this is confirmed by indicators of decreasing gas emissions and increasing waste recycling which improve global air, soil and water quality. The higher implementation index of the ISO 14001 standard in Italy translates into higher environmental quality indicators in this country than in Poland.
