    According to the author, there are no legal obstacles for a Deputy to hold shares in certain types of companies which, in their business, benefit from EU funds. If funds for the implementation of the program in which the company intends to participate, come – partly or in whole – from the state budget, they will be classified as state property. There are reasons to consider that the funds available to entrepreneurs under EU programs, paid in 100% from EU funds, do not constitute property of the state nor municipal property.

    The purpose of this opinion is to assess the proposed amendments to the Family and Guardianship Code and other statutes (the Civil Registry Records Acts and the Stamp Duty Act). The author provides an analysis of the proposed amendments, including the possibility of dissolution of the marriage by declaration of intent by the spouses, the removal from the legal system of an instrument that allows the court to adjudicate on the guilt for the breakdown of marriage, or change in rules for adjudicating on alimony for a divorced spouse. She points to the doubts as to the compatibility of the proposed solutions to the Constitution, including in particular the principle of protection of the family

    The author provided an assessment of the duties of the Chancellery of the Sejm in relation to provision of information to the public on request. Following an analysis of the provisions of the Act on Access to Public Information, she states that the Chancellery of the Sejm has an obligation to provide, under the procedure for disclosure of publicly accessible information, the information about the names of locations and hotels, in which accommodation of the Deputies were funded by the Chancellery of the Sejm. It is also required – upon request of the person concerned – to provide insights into invoices or receipts documenting Deputy’s stay in a hotel or to prepare and hand out photocopies of these documents.

    Opis:
    According to the author, the bill deserves further legislative consideration. Most of the provisions contained therein implement the provisions of the tobacco directive. Some of them impose on manufacturers, importers and distributors of e-cigarettes more far-reaching restrictions than those provided for in the Directive. She points out that the regulations that go beyond the scope of the Directive should be evaluated for compliance with the constitutional principles of freedom of economic activity. Moreover, it should also be considered whether the ban on the use of e-cigarettes in public places violates the constitutionally established right of individuals to make decisions about their own life. Doubts are also raised by the wording of Article 6 para. 1 of the proposed bill imposing a prohibition of making tobacco products, electronic cigarettes and refill containers available to people under the age of 18, whereas the existing prohibitions referred to “sale” of tobacco products.

    Opis:
    The author claims that anybody, including a Deputy to the Sejm, has – on the basis of the Act on Access to Public Information – the right of access to a document having the form of an contract concluded by the local government unit (gmina). In such a case, the disclosure of the first names and surnames of persons concluding a civil‑law contract with a self‑government unit does not violate the right to privacy of those persons. However, some information concerning persons concluding such contract may remain anonymous. According to the author, information (documents) pertaining to the domain of plan or aims of the given authority ( and not to the facts) – provided that they have been drawn up to be used in proceedings in a particular case related to the legal interest of that authority – should not be disclosed under the Act on Access to Public Information.

    Article includes an analysis of regulations of the ACTA Agreement in the light of current Polish legislation. The article indicates, that in many areas, binding polish provisions concerning demand and execution of intellectual property rights ensure the same or even higher level of protection that is in the ACTA Agreement. The publication contains indications concerning conflict of laws with Polish regulations and areas of potential amendment, which might be necessary after entry into force the Acta Agreement.

    Opis:
    The conflict between the protection of authors’ work and their right to financial benefits on the one hand and a demand for broad access to cultural goods on the other requires the existence of regulations concerning fair use rules (both personal and public).The bill, however, raises doubts about the compatibility with Article 64 paragraph 1, in conjunction with Article 31 paragraph 3, of the Constitution. The authors consider the bill to be the wrong way to implement Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain aspects of copyright and related rights in the information society. There is doubt as to whether the bill is consistent with international conventions.
