- The paper focuses on offices for the protection of the constitution – Germany's counterespionage and internal security agencies. Legal and political regulations of German secret services are analyzed with putting special attention to civil liberties, privacy protection, proper control of intelligence in a constitutional state. The idea of militant democracy (wehrhafte Demokratie) is described as a foundation for protecting the core values of liberal democracy by intelligence and security services. Articles of German Constitution and law acts regarding protection of freedom and democracy are described. Federal, decentralized setup of the offices for the protection of the constitution together with lack of executive and investigative powers is described. Reasons for such a model lie in historical conditions: the Nazi-regime past and Cold War period. Tasks and powers of the German counterespionage component are discussed with underlining differences between German and Polish models. Organizational and legal regulations of intelligence are analyzed. The article also tries to portray Germany’s system of political and judicial intelligence control. Legal precision and respect to civil rights and liberties in the German system are presented in comparison to regulations in Poland.
