Opis:
Problems associated with searching for missing people are of complex nature. Police statistics clearly show that the number of people reported missing is increasing (in 2014 it exceeded 20,000 people). The etiological factors of the missing person are very diverse in nature and are not always associated with criminal activities. Human trafficking, kidnapping for a ransom and fights between criminal groups undoubtedly generate difficulty in specifying a group of people who are missing. We can also add victims of planned or accidental homicide, suicide, victims of accidents to the group of missing people. The aim of this article is the analysis of methods of searching for hidden corpses, both in urban areas and an open terrain, applied in criminalistics and forensic archaeology.
Problemy związane z poszukiwaniem zaginionych osób mają charakter złożony. Statystyki policji wyraźnie wskazują, że liczba osób uznanych za zaginione wzrasta (w roku 2014 przekroczyła 20 000 osób). Uwarunkowania etiologiczne związane z zaginięciami mają bardzo zróżnicowany charakter i nie zawsze bezpośrednio dotyczą działalności przestępczej. Zjawisko porwań dla okupu, handlu ludźmi, porachunków grup przestępczych generuje trudną do bliższego określenia grupę osób uznanych za zaginione. Możemy również dołączyć do tej grupy ofiary planowanego lub przypadkowego zabójstwa, samobójstw, ofiary nieszczęśliwych wypadków oraz kataklizmów. Celem artykułu jest wskazanie na interdyscyplinarny charakter metod poszukiwania ukrytych zwłok zarówno na terenach miejskich, jak i otwartych, które stosowane są obecnie w kryminalistyce i archeologii sądowej.

The binding statute of 23 July 2003 on the protection and care of historical monuments was the first Polish legal regulation relating to the protection of the national heritage to introduce the concept of the archaeological monument. Its pre-war predecessors and the statute on the protection of cultural property from 1962 consistently used the terms “excavations” or “findings”. The introduced division of monuments into mobile, immobile and archaeological (the latter are also classified as mobile and immobile) constitutes irrefutable proof that the object under protection has become more extensive and concrete. New systemic, economic and legal conditions have become the reason why the scale of threats to archaeological heritage grew rapidly already at the onset of the 1990s. The solutions introduced into the statute, concerning the protection of archaeological monuments, imposedcivic duties whose neglect is now threatened with penalaccountability. From the viewpoint of the almost five years-long existence of the statute on monuments it has become apparent that the application of its regulations can be problematical. Reservations are formulated not only by bodies using this law in their decision-making process but also those involved in combating and preventing crimes committed against monuments (the police force, border guards, customs services). Fundamental doubts are produced by an interpretation of the definition of the historical monument and its classified form, i.e. the archaeological monument. Attention is also drawn to the fact that the range of the definition of the archaeological object has been delineated much too generally, which makes it possible to classify, for instance, an item originating from the early twentieth century as an archaeological monument. Indubitably, the clarity and acuteness of the definition are closely associated with legal consequences pertaining to, e.g. , awarding a person who had discovered an archaeological monument or punishment for damaging or appropriating it. It is high time, therefore, to answer whether the binding definition should be modified, and if so, then to what extent. It seems that this question should be addressed to archaeologists, since in the course of the past decade the range of the interests of contemporary archaeology has changed due to the development of large municipal agglomerations and the construction of roads and highways, always accompanied by archaeological investigations. A discussion on the definition of the archaeological monument is also directly connected with the increasingly universal search for monuments, conducted across the country.

Modern criminalistic has at its disposal a wide range of methods for identification of unidentified corpses and human remains. These methods can be applied both in cases of victims of crimes committed currently as well as decades-or even thousands of years ago. Advanced research enables not only to determine the identity, but also to establish a specific cause of death. It happens that in the course of performed examination earlier findings are verified, e.g. based on written sources, which – in the end – turn out to be untrue. Sometimes the results of examination concerning kinship are also surprising. It is more and more often that forensic archaeology takes part in this research. It secures a professional manner of search for this type of corpses or remains and guarantees their professional exhumation.

In the middle of 2009, the Regional Court in Warsaw (Court of Competition and Consumer Protection) received a petition to recognise provisions of the model agreement as prohibited. The plaintiff claimed that the provisions of [tar. 8 of the Regulations lor use of exhibited museum items used by the Września Children Regional Museum in Września, reading as follows: “Photographing and filming of exhibits and exhibition rooms is prohibited without the permission of the director of the museum. Photographing is possible after such permission is obtained and a fee is paid”, should be deemed prohibited. The Court recognised the provisions of the model agreement as prohibited and ruled that the provisions of the model agreement with the content quoted above must not be used by the Września Children Regional Museum in Września in transactions with consumers. The essential aim of the article is to determine legal consequences of the decision being discussed and the entering of the provisions concerned into the Register of Prohibited Clauses by the Office of Competition and Consumer Protection. The authors of the article give answers to frequently asked questions concerning the impact of the entry in the Register of Prohibited Clauses on the validity of similar provisions used in regulations of other museums. It is important here that, although the said decision was issued according to the procedure for abstractive control of provisions of the regulations of the museum and refers only to the regulation which is the object of proceedings before the regional court, its impact affects the interpretation of the provisions about abusive clauses carried out in other potential similar cases. In this context, it is important that if other museums make use of any provisions identical to the provisions of par. 8 of the Regulations of the Września Children Regional Museum in Września that were recognised as prohibited in the decision referred to above, such identical provisions cannot be automatically regarded as prohibited (abusive).

The article is devoted to selected issues in combating and preventing crime against archaeological heritage. The authors [»resent basic legal [»revisions determining archaeological relics and define the term “crime that is related to them. Whilst describing basic activities of state institutions within the scope of combating this tvpe of crime, the authors commence a discussion on insufficient staffing among police monument coordinators. Most controversial examples of prosecuting attorneys errors are mentioned in the discussion on certain procedural problems which appeared in the course of conduct of penal procedures known to the authors. The issue of participation of archaeologists and museum employees in illegal trade in archaeological relics “in good faith is also discussed; moreover, the authors describe the problem related to the absence of efficient solutions with respect to trade in archaeological relics from illegal excavation sites outside of Poland. The article is completed with a summary of combating crime against archaeological relics and a conclusion that Poland still misses proper determination and, more importantly, proper evaluation of this type of crime and awareness of the importance of the problem. Negative effects of criminal activities are overlooked or marginalized; it should be remembered that such activities generate nonrenewable losses.

The aim of the study was to answer the question whether there are differences in the progression of the disease and its morphology, dependent of the patient’s age, as well as show colorectal cancer differences between young and elderly patients. Material and methods. During the period between 2009 and 2011, 747 patients with rectal carcinoma, and 478 with colon cancer underwent surgery at the Department of General and Colorectal Surgery. The study group comprised patients under the age of 40 years (56 patients) and >80 years (90 patients). The following were subject to analysis: gender, tumor location, percentage of radical and palliative procedures, clinical and histopathological staging, as well the differences in the morphology of the tumor. The χ2 test and Yates’ correction were used for statistical analysis. p<0.05 was considered as statistically significant. Results. A higher incidence of rectal carcinoma was observed in younger patients (p=0.004). Amongst the younger patients 30.3% were diagnosed with stage III cancer, while 35.7% with stage IV. In case of elderly patients 30.6% were diagnosed with stage III cancer, while 30.7% with stage IV. In 53.3% of young patients, local lymph node metastases were observed, while in the elderly 41.8%. No statistically significant difference was observed, considering the total number of lymph nodes metastases. However, in case of stage N2, results were unfavorable for young patients 31.8% vs 17% in case of the elderly. Mucogenic adenocarcinoma incidence was similar in both groups. In case of patients< 40 years we observed a higher incidence of poorly differentiated tumors, as compared to the elderly patients (>80 years). Conclusions. 1. It is necessary to create appropriate prevention programs for young community, and improvement of public awareness in this age group. 2. Colorectal cancer (CRC) in young patients is often recognized in advanced stage. 3. A high percentage of unresectable tumors in group of elderly patients shows that CRC is still diagnosed too late in Poland.

Circulating tumor cells (CTC) are cells in circulating blood that have the antigen and gene features of tumor cells of a specific type. Since they can be potentially used in diagnostics and monitoring of treatment of many tumors, they have been attracting attention of researchers worldwide. Plastin-3 (PL S3) is one of such markers of CTC. The aim of the study was to assess expression of PL S3 in CTC in patients with colorectal cancer, to conduct a statistical analysis and to demonstrate a link between expression of PL S3 and progress of the disease, level of CEA and Ca19-9 markers, gender and age of the patients. Material and methods. A group of 85 patients of the Department of General and Colorectal Surgery of the Medical University in Łódź were enrolled in this study. Circulating tumor cells were isolated from whole blood of patients with colorectal cancer and an analysis of PL S3 gene expression in CTC was conducted. The next step was to conduct a statistical analysis and to demonstrate a link between expression of PL S3 in patients’ CTC and progress of the disease, level of CEA and Ca19-9 markers, gender and age of the patients. Results. PL S3 is a marker which can be potentially used in prediction and monitoring of colorectal cancer. A link between expression of PL S3 in CTC of patients with colorectal cancer and metastasis to lymph nodes has been demonstrated. It may be of key importance how PL S3 could impact the qualification to supplementary cancer treatment in patients with stage II colorectal cancer. A link between expression of PL S3 gene in CTC and gender requires further in-depth studies. It is beyond doubt that PL S3 must be further investigated to determine its role in diagnostics, prediction, treatment and monitoring of treatment of colorectal cancer
