Opis:
Market transition in Central and Eastern Europe triggered many new socioeconomic developments. One of them was the appearance of open unemployment vastly different from that noted in most developed economies around the world. As a result, the term “transformation unemployment” began to be used in literature on the subject. The authors of the article analyze the trend from a theoretical point of view and then follow up with an empirical study of unemployment. They present changes in the labor force and GDP in several groups of countries: Central Europe (Czech Republic, Poland, Slovakia and Hungary) plus Slovenia; Lithuania, Latvia and Estonia; Russia, Ukraine, Belarus and Moldova; Georgia, Armenia and Azerbaijan; and Balkan countries (former Yugoslav states except Slovenia as well as Albania, Bulgaria and Romania). The authors offer a statistical analysis of GDP growth and unemployment in individual groups of countries. In the final part of the article, the most important conclusions are summed up. These include the fact that the analyzed groups of countries display major differences in unemployment rates, along with changes in employment figures and labor productivity. Moreover, in most these countries, GDP growth has had a limited effect on unemployment. The only exception is Central Europe, though the European members of the Commonwealth of Independent States and transition economies in the Balkans also stand out positively.

There is no certainty in market economy that business activity conducted by a company will bring a market success. Therefore, bankruptcies of enterprises phenomenon performs a role of a sort of natural regulator in the economic system, which makes resources to be changed for more useful by disappearance of companies that are not effective and cannot withstand competition. The article presents the characteristics of basic types of bankruptcies but clearly indicates that actually there is no one type of such bankruptcies It means that a typology of bankruptcies takes into account the following division criteria referring to: legal and economic sphere, an entity that can be declared bankrupt, insolvency proceedings and its binding extent, the impact and extent of bankruptcies and how they affect the society, interests of participants in bankruptcy proceedings, the financial aspect, reasons of a crisis in enterprises, a rate of revenue changes in a given industry and others

The economy in the world today is becoming increasingly similar to “economic instability”. The progressive processes of globalization, the development of capital markets and transnational companies and the complex and concentrated as a result of this network of connections (global spider web) in the economy mean that not only the economy, business, but also risk are subjected to globalization. This also includes a risk of bankruptcy. Practice shows that the faster virus spreads to the bankruptcy the stronger is the connection between business attacked with the diseases of insolvency and other, domestic and foreign partners. Globalization intensifies the power of spreading of bankruptcies. The article presents the impact of the risk of globalization on the bankruptcy risk of firms in the economy.

Opis:
Upadłość to jedna z najważniejszych instytucji gospodarki rynkowej. Poprawnie skonstruowana, normatywnie i prawidłowo wdrożona instytucjonalnie gwarantuje skuteczną ochronę wierzycieli oraz efektywną alokację środków produkcji. Polski ustawodawca zdecydował się na rozstrzyganie konfliktu interesów między dłużnikiem a jego wierzycielami na tle niewypłacalności w jednym po-stępowaniu sądowym. Zgodnie z art. 2 Ustawy z dnia 28 lutego 2003 roku. Prawo upadłościowe i  naprawcze postępowanie należy prowadzić tak, aby roszczenia wierzycieli mogły zostać zaspo-kojone w jak największym stopniu, a jeśli racjonalne względy na to pozwolą, by dotychczasowe przedsiębiorstwo dłużnika zostało zachowane. Przedmiotem artykułu jest ukazanie możliwego kierunku ewolucji polskiego systemu upadłości na podstawie analizy obowiązujących przepisów prawa oraz opublikowanych wyników badań na temat upadłości, przeprowadzonych przez pracowników naukowych Szkoły Głównej Handlowej pod kierunkiem E. Mączyńskiej oraz przez Polską Agencję Przedsiębiorczości. Podstawowe metody badawcze wykorzystane w pracy to: analiza danych zastanych oraz obowiązujących przepisów prawa dotyczących upadłości przedsiębiorstw w Polsce, analiza wyników badań na temat funkcjonowania systemu upadłościowego w Polsce oraz przegląd literatury przedmiotu. W artykule omówiono również historię rozwoju prawa upadłościowego w naszym kraju oraz wyszczególniono etapy przebiegu postępowania upadłościowego. W zakończeniu zaprezentowano wnioski dotyczące funkcjonowania polskiego modelu postępowania upadłościowego, w    którym dominuje restrykcyjny model instytucji upadłości, ukierunkowany przede wszystkim na ochronę wierzycieli wraz z propozycją stworzenia modelu pośredniego upadłości opracowanego przez S. Morawską.
Bankruptcy is one of the most important institutions of the market economy. When properly con-structed and normatively and institutionally implemented, it ensures the effective protection of cred-itors and the efficient allocation of production. A Polish legislator decided to resolve the conflict of interests between the debtor and its creditors against insolvency proceedings in one court hearing. In accordance with Art. 2 of the Act of 28 February 2003, Bankruptcy and Reorganisation proceedings should be conducted so that creditors can be met as far as possible and - if rational considerations permit - the existing debtor company has been preserved. The article aims to present the evaluation of the Polish bankruptcy system based on the analysis of existing laws and publish the results of research on bankruptcy. This article presents an analysis of literature, the applicable laws and the results of research published by the Warsaw School of Economics under the direction of E. Mączyńska and the Polish Agency for Enterprise Development on the current evaluation of the shape and direction of the bankruptcy system in Poland. The basic method employed is the analysis of existing data - existing legislation relating to the bankruptcy of enterprises in Poland, analysis of research results on the functioning of the Polish bankruptcy system and literature, which has allowed to present possible directions of evolution of the bankruptcy system in the Polish economy. The paper also presents the history of the development of insolvency law in Poland and specified the stages of bankruptcy proceedings in Poland. At the end conclusions are drawn regarding the operation of the Polish model of insolvency proceedings in which the dominant model is the restrictive model of the bankrupt-cy institution focused primarily on the protection of creditors together with the proposal to create an indirect bankruptcy model developed by S. Morawska.
